Through His Own Words: An Exploration of the Pedagogy of Robert Marcellus

This dissertation presents the clarinet pedagogy of Robert Marcellus through reorganizing, documenting, and consolidating the archival recordings of summer master classes held at Northwestern University from 1977-1990. Pedagogical discussions and exercises are examined on topics such as wind, articulation, hand and finger position, and phrasing. Marcellus' interpretation and comments are discussed, along with musical examples from Cyrille Rose's 40 Studies for Clarinet, numbers 13, 21 and 32. This dissertation contains Marcellus' repertoire list and a sequence of study. Through this examination and consolidation of Marcellus' own words, this dissertation serves as a unique resource for those clarinetists interested in learning about this distinguished pedagogue.

Succession is often studied by using a chronosequence. When using a chronosequence we study a set of sites with different ages at the same time and by comparing them we conclude what kind of changes occurred during time (space for time substitution). Only a few studies however compare how results obtained by using a chronosequence differ from those obtained by long-term studies. In my theses I repeated a study that investigated succession of ant communities on brown coal mining spoil dumps in Sokolov district after 19 years. There are chronosequences of two types of sites (spontaneous succession and recultivation) in Sokolov coal mining district. By repeating the original study I could compare changes that occurred du- ring time with changes along a chronosequnce. Relationship between occurrence of ant groups with different ecological requirements and age of site was also investigated. RDA model and variation partitioning were used to find out statistical significance between sites and their age. An increase in number of species was recorded on the spoil dumps. 22 ant species were found in the year 2020, from which 5 species were new on the dumps. The theme of this thesis is history of the knights (later lords) of Vřesovice in the late Middle Ages. The work deals mainly with political and economic role of the family members in the late medieval Bohemia, with special attention to the hussite captain Jakoubek of Vřesovice, who was mainly responisible for family rise. Furthermore, this work tries to answer the question, what happened to the family of Vřesovice since Jakoubek's death until the late Middle Ages, because during the 16th century, knights of Vřesovice belonged to the most powerful aristocratic families in Bohemia. Family members from the times of king George and Jagellonian rulers were not yet reflected by many historians. Fates of individual family members are assessed and placed into historical context. The work deals with property relations of knights of Vřesovice and manifestations of their aristocratic representation. As a whole, the work probes into political, economic, cultural and social life in late medieval northwest Bohemia. Der geschichtliche Prozess der Bodenbesetzung und – nutzung auf der Grundlage von Entwaldung und ungeordneter Bodenbewirtschaftung verursachte Konflikte zwischen der Zielsetzung der Umweltsanierung und der sozialwirtschaftlichen Reproduktion der auf Flächen mit hohen Umwelteinschränkungen siedelnden Landwirte. Diese Dichotomie zeigt sich derzeit in der Anwendung des Umweltrechts, insbesondere im neuen brasilianischen Waldschutzgesetz, das 1965 durch das Bundesgesetz Nr. 4.771 erlassen wurde, wenn es sich um Naturschutzgebiete (APPs) handelt, also um Landstriche entlang der Gewässer, die entsprechend geschützt und deren natürliche Vegetationsbedingungen erhalten werden müssen. Ausgehend von Elementen der Flussgeomorphologie gründet sich die von der vorliegenden Untersuchung verfolgte Diskussion auf die Hinterfragung der geometrischen Maβnahmen der Naturschutzbestimmungen durch die Vorlage einer Methodik zur Bestimmung dieser Flächen. Um zum Ergebnis zu gelangen, wird eine geschichtliche Rückbesinnung auf den Bodenbesetzungsprozess in Nordwest Rio Grande do Sul, zu der die Proben der Untersuchung gehören, sowie eine theoretische Interpretation des weltweiten Naturschutzes vorgenommen und werden die Naturschutzgebiete für Brasilien auf drei Untersuchungsebenen diskutiert: der gegebene gesetzliche Rahmen, die Verwendung dieser Flächen und der Zustand, in dem diese sich im Nordwesten von Rio Grande do Sul befinden. Die soziale Funktion des landwirtschaftlichen Betriebs wird als wichtiger Punkt dieser Diskussion betrachtet, denn von ihr ausgehend geschieht der ganze Prozess der Verantwortungsüberweisung für den Schutz oder Nichtschutz von Naturschutzgebieten. In diesem Sinne untersuchen wir auch, wie IBAMA, FEPAM und Staatsanwaltschaft sich positionieren und angesichts der gesetzten Thematik handeln. Für die vorgeschlagene Methodik bestimmten wir drei Bereiche des Flusses Santo Cristo zu Pilotflächen, für die wir die Längsdeiche und Auen als Parameter für die Bestimmungen der Naturschutzgebiete definierten. Ebenso beurteilten wir die Bodenstruktur der Region, um eine der Art der lokalen Betriebshöfe unmittelbar verbundene Deutung zu ermöglichen. Von diesen Vorzeichen ausgehend wurde eine kritische Lesart des Verhaltens dieser Flächen möglich, indem ihre derzeitige Verwendung derjenigen der gesetzlichen Anforderungen entgegengestellt wurde. Aus der vorliegenden Untersuchung ergeben sich als wesentliche Schlüsse: Eine vertiefte Untersuchung über die Naturschutzgebiete ist dringend und erforderlich, um einen neuen Gesetzesvorschlag zu erarbeiten, der effektive Fachparameter zur Bestimmung der Naturschutzgebiete festlegt und der gleichzeitig die Entwicklung von Untersuchungen anstrebt, die darauf zielen, alternative nachhaltige Nutzungsalternativen für diese Flächen vorzulegen; Beurteilung der Schutz- und Erhaltungskonzeptionen in der Absicht, dass letztere eine breite Palette von Vorteilen für die kleinen landwirtschaftlichen Betriebshöfe in dem Maβe mit sich bringen, wie die Bodenschutzmaβnahmen zum Ausgleich der Natur beitragen und in der Erzeugung dieser Betriebshöfe einen reellen Gewinn erbringen. Schlieβlich legen wir eine Reihe von Studien vor, die in der Absicht einer Vertiefung der von uns erforschten thematischen Diskussion verfolgt werden können. / O processo histórico de uso e ocupação da terra, baseado no desflorestamento e no manejo desordenado do solo, tem gerado conflitos entre os objetivos de recuperação ambiental e de reprodução socioeconômica dos agricultores assentados sobre áreas de elevadas restrições ambientais. Esta dicotomia reflete-se na atualidade através da aplicação mais efetiva da legislação ambiental, principalmente, do Código Florestal brasileiro, instituído pela Lei Federal n. 4.771 de 1965, que trata das Áreas de Preservação Permanente, APPs, que são as faixas marginais aos corpos hídricos que devem ser devidamente preservadas e mantidas com vegetação nativa. A discussão apresentada pelo presente estudo está pautada no questionamento das medidas geométricas contidas na definição das APPs nesse instrumento legal, buscando apresentar uma metodologia para a definição destas áreas a partir de elementos da geomorfologia fluvial, além daqueles relacionados com a cobertura vegetal de entorno. Para chegar aos resultados desse estudo se apresenta uma retomada histórica do processo de ocupação da Região Noroeste do Rio Grande do Sul, na qual se inserem as áreas amostrais, faz-se uma leitura teórica sobre conservação da natureza em nível mundial e discute-se as APPs em três níveis de análise para o Brasil: a) o arcabouço jurídico que está posto; b) o uso destas áreas e c) o estado da arte em que elas se apresentam no noroeste do Rio Grande do Sul. A discussão da função social da propriedade rural é vista como ponto importante desta discussão, por ser a partir dela que se dá todo o processo de responsabilização pela preservação ou não das APPs. Neste sentido, buscamos também compreender como o Ibama, a Fepam e o Ministério Público Estadual se posicionam e desenvolvem as suas atividades frente à temática colocada. Definimos como áreas piloto para a aplicação da metodologia proposta, três setores do Rio Santo Cristo, para os quais definimos os diques marginais e as planícies de inundação como parâmetros para a definição das APPs. Da mesma forma, avaliamos a estrutura fundiária da região para possibilitar uma leitura diretamente relacionada com o tipo de propriedade existente no local. A partir destas definições foi possível estabelecer uma leitura crítica das características dessas propriedades, comparando o seu uso atual com as exigências legais. Ficam como principais conclusões do presente estudo: a) que é urgente e necessário um estudo mais aprofundado sobre a questão das APPs para que seja possível apresentar uma proposta de alteração da legislação que busque parâmetros técnicos efetivos para a definição das APPs; b) que se busque igualmente o desenvolvimento de estudos que objetivem apresentar alternativas de uso sustentado para estas áreas; c) que se avaliem os conceitos de preservação e conservação com o intuito de compreender que o último traz uma grande gama de benefícios para as pequenas propriedades rurais, na medida em que as práticas conservacionistas auxiliam no equilíbrio da natureza e trazem um ganho real na produção destas propriedades. Por fim, apresentamos um conjunto de estudos que podem ser realizados com o intuito de aprofundar as discussões da temática por nós pesquisada. / The historic land grab and land usage process based on deforestation and disorderly land management caused conflicts between environmental cleanup and socioeconomic reproduction of the farmers settled on areas that underlie strict environment restrictions. This dichotomy at present gets evident in the application of the environmental legislation, particularly the new Brazilian Forest Code entitled by the federal Law No. 4.771 of 1965, when it involves permanent nature reserve (APPs), that is, marginal stripes along water corps that must be preserved with the associated original vegetation. The discussion herewith stated is based on the closer examination of the geometrical measures of the definition of the permanent nature reserves trying to present a method for the definition of theses areas out of the elements of the fluvial geomorphology. To reach the result, we make recourse to the historical land grab process in the northwestern region of Rio Grande do Sul, to which belong the areas herein studied. We make a theoretical interpretation of nature conservation at international level and discuss nature reserves at three study levels for Brazil: the given legal framework; the usage of these areas; and their conditions in northwest Rio Grande do Sul. The discussion of the social function of the farms is seen as an important aspect of this discussion because thereof happens the responsibleness for the conservation or not conservation of the preservation areas. We also study the positioning of Ibama, Fepam and prosecution in this question. We determinate three segments of the Santo Cristo river as pilot areas for the application of the proposed methodology, wherefore we defined natural levee and floodplains as patterns for the definition of nature preservation areas. We did also evaluate region’s estate to allow an understanding directly related to the kind of local property. These definitions allowed us establishing a critical understanding based on the behaviour of these areas comparing their current usage to the legal demands. The most important conclusions of this study are: 1) a deeper study of nature preservation areas urges and is necessary to allow the presentation of a new legal proposal that looks for effective technical patterns for the definition of nature reservation areas; 2) that one also tries to develop studies that try to show alternatives of sustainable usage of these areas; 3) that preservation and conservation concepts get evaluated with the intend to understand that this brings a wide scope of benefits to the small farms thus far as the conservation practices help to stabilize nature and to carry a real gain in the production of these farms. Finally we present a scope of studies that can be done with the aim of deepening the discussions of the question here studied.

Modélisation numérique du transfert du radiocésium dans les chaines trophiques pélagiques marines suite à l'accident nucléaire de Fukushima Dai-ichi (côte Pacifique du Japon) / Numerical modeling of radiocesium transfer to marine pelagic food chains following the Fukushima Dai-ichi neclear power plant accident (Japanese Pacific coast)

Une forte contamination radioactive du milieu marin, notamment par le 137Cs, s'est produite dans le Pacifique nord-ouest suite à l'accident nucléaire de Fukushima Dai-ichi survenu le 11 mars 2011. Deux sources majeures ont été à l'origine de cette contamination, les retombées atmosphériques (sèches et humides) et les rejets liquides directement en mer. Cette radioactivité a été transférée aux organismes marins conduisant à la contamination de plusieurs espèces pélagiques et benthiques. Dans le cadre de l'étude des conséquences de cet accident sur le milieu marin, une première modélisation de la dispersion du 137Cs dans les eaux de la côte Pacifique du Japon a été réalisée par le groupe SIROCCO, permettant ainsi d'estimer l'évolution spatio-temporelle de la concentration de ce radionucléide dans l'eau et de déterminer son terme source, c'est-à-dire sa quantité globale rejetée en mer sous forme liquide. Ce travail de thèse s'inscrit dans la même démarche et vise, par une approche de modélisation, à étudier le transfert du 137Cs aux chaines trophiques pélagiques de la côte Est du Japon, composées par les populations planctoniques, les poissons planctonivores, et les poissons carnivores. Le couplage d'un modèle radioécologique, spécifiquement développé pour cette étude, à un modèle de l'écosystème composé d'un modèle NPZD (Nutrients-Phytoplankto-Zooplankton-Detritus) et d'un modèle de circulation régionale, s'est imposé comme la méthode la plus adaptée à l'étude de la contamination des populations planctoniques dans des conditions post-accidentelles. Les résultats de cette étude ont montré des niveaux de contamination assez élevés de ces populations notamment aux alentours de la centrale où les concentrations estimées sont environ 4 ordres de grandeur supérieures à celles observées avant l'accident. En dépit de ces concentrations élevées, le débit maximal de la dose absorbée reste largement au-dessous du débit de référence à partir duquel les effets sur les populations sont ressentis. Cette étude a aussi mis en évidence la prédominance de la voie trophique dans les processus d'accumulation du césium par ces espèces, ainsi que la présence d'une légère bioamplification chez les classes de taille de zooplancton. Le modèle radioécologique développé pour étudier la contamination des espèces nectoniques est structuré en taille. Chaque espèce est composé d'un ensemble de cohortes dont le nombre est fonction de la durée de vie de l'espèce et de sa fréquence de reproduction. Contrairement aux modèles classiques, le taux d'ingestion de la nourriture par l'organisme ainsi que son régime alimentaire ne sont pas constants dans le temps mais généralement variables en fonction de la taille de l'organisme. Dans cette approche le processus de prédation est considéré comme étant totalement opportuniste. Les résultats sont généralement satisfaisants et le modèle a été validé dans les conditions d'équilibre pré-accidentelles ainsi que dans les conditions post-accidentelles. L'importance de la prise en compte des mouvements migratoires de certaines espèces dans ce type de modèle a été mis en évidence notamment dans les conditions accidentelles caractérisées par une forte variabilité spatiale de la concentration du radionucléide dans la colonne d'eau. Les niveaux de contamination estimés pour les différentes espèces sont largement supérieurs à ceux observés avant l'accident, avec une tendance à l'augmentation lorsque la taille de l'individu augmente. / Huge amounts of radionuclides, espicially 137Cs, were released to the coastal northwestern Pacific ocean after the Fukushima nuclear power plant accident, that occurred on 11 March 2011. The resultant radiocesium contamination was quickly transferred to marine biota resulting in elevated cesium levels in various organisms. Using a modelling approach, this work aims to study the 137Cs transfer to the marine pelagic food chains, from plankton populations to the large piscivorous fishes. Coupling the radioecological model, developed in this study, with an ecosystem model comprising an NPZD biogeochemical model and a regional ocean circulation model, is appeared to be the most adapted tool for modelling of plankton populations contamination in this accidental situation. The results of this study showed high contamination levels in the plankton populations, especially in the vincity of the power plant, where the maximal concentrations are estimated to be about 4 orders of magnitude higher than those observed before the accident. In spite of these high contamination levels, the maximum 137Cs absorbed dose rates for phyto- and zooplankton populations were estimated to be well below the 10 Gy/h benchmark value, from which a measurable effect on the marine biota can be observed. This study has also highlighted the predominance of the cesium uptake from food and the presence of biomagnification potential at this trophic level. The radioecological model developed to study the nektonic species contamination is based on the individual size. In this approach, each species is represented by a set of cohorts. The number of these cohorts is a function of the species life span and reproduction frequency. Unlike traditional approaches, the organism ingestion rate and diet composition considered in this modelling approach are not constant, but vary over the time according to the size of the organism. The model results are in general satisfactory, and the validation is carried out in both equilibrium and accidental situations. This study highlighted the importance of the organism migratory movements in the radioecological modelling espicially in the accident situations caracterized by a very high spatial variability of radionuclides concentrations in the seawater. The detailed caracteristics of 137Cs concentration dynamics in the different species are discussed. The contamination levels estimated for the different species are significantly higher than those observed before the accident, with a clear tendency to increase with individual size.

This dissertation was undertaken in collaboration with the Nisga’a First Nation of northwestern British Columbia to document their traditional plant knowledge. This information was gathered through collaborative audio recorded open-ended discussion with 21 Nisga’a elders, supplemented with material from the published literature and archival sources. Background information with respect to the Nisga’a culture, language, geography, plant classification and resource management is documented in the past and as exercised today. Nisga’a names or uses of 110 plant species are described. Of these, 72 species were documented as having been used for food, 52 for medicinal purposes; 12 for spiritual purposes and 70 for technological purposes. The role of plants in traditional Nisga’a culture is further explored through comparisons of plant distribution, plant names and pre-contact trade between the Nisga’a and their immediate neighbours, the Gitxsan, Tsimshian, Haida, Tahltan and Tlingit First Nations. Maps are presented which highlight the distribution of seven plant species traditionally important in these cultures: Shepherdia canadensis (soapberry), Vaccinium membranaceum (black huckleberry), Oplopanax horridus (devil’s club), Corylus cornuta (beaked hazelnut), Malus fusca (Pacific crabapple), Veratrum viride (false hellebore), and Taxus brevifolia (western yew). Currently, one of the plants most important to the Nisga’a is wa’ums or devil’s club (Oplopanax horridus). Devil’s club stems were measured in clearcuts of different ages to examine how quickly this important spiritual and medicinal species recovers after logging. Results suggest that although devil’s club does persist after clearcut logging, stems of a suitable size are rarely found in cutblocks less than 10 years old and that time since logging only partially accounts for the persistence or recovery of this species. The dissertation concludes with a discussion of historical Nisga’a plant knowledge. The gender of those who have held and transmitted traditional knowledge and the gender of present knowledge holders is tabulated and discussed. Results suggest that although both men and women hold and pass on traditional knowledge, women were and still are more commonly involved in its transmission to the next generation. Current plant uses are highlighted and prospects for the sustainable use of plants for personal and commercial purposes are discussed. / Graduate

This article presents key data and discussion about the initial peopling of northwestern South America, highlighting its strategic significance in the continental context, cultural variability and landscape change over time. In Colombia there is very little relevant information regarding occupations prior to 12,000 BP; in contrast, the information is abundant relative to a number ofearly contexts during the Pleistocene-Holocene transition. The variability among unifacial and bifacial lithic assemblages reported in different physiographic regions indicates alternative models on early settlement to regional level. Considering the importanceof the inter-Andean valley of the Magdalena River, this article emphasizes the archaeological contexts and paleoenvironmental information, highlighting environmental impacts associated not only to global climate change, but in particular of the effects ofvolcanism. The article stresses the findings and chronologies of bifacial lithic assemblages of the Magdalena Valley in relation to the early archaeology of northwestern South America. / En este artículo se presentan los principales datos y reflexiones asociados al poblamiento inicial del noroccidente de Sudamérica debido a su significado estratégico en el marco continental, se destacará la variabilidad cultural y se enfatizarán los cambios depaisajes en el transcurso del tiempo. En Colombia existe muy poca información relevante relacionada con las ocupaciones anterioresa 12.000 AP; en contraste, la información es abundante en cuanto al número de contextos tempranos durante la transición Pleistoceno-Holoceno. La variabilidad entre los conjuntos líticos unifaciales y bifaciales reportados en distintas regiones fisiográficas plantea propuestas de modelos alternativos sobre el poblamiento temprano a escala regional. Considerando la importancia del valle interandino del río Magdalena, se recalcan los contextos arqueológicos e información paleoambiental. Asimismo, se destacan los impactos ambientales que demuestran por qué no perduraron las evidencias del Pleniglacial, lo que podría deberse a efectos asociados no solo al cambio climático global, sino, en particular, a causa del vulcanismo. Este trabajo resalta los hallazgos y cronologías de los conjuntos líticos bifaciales del valle del Magdalena en relación con la arqueología temprana del noroccidente de Sudamérica.

Approche fonctionnelle de l’outillage lithique à l'aube de l'Holocène dans le nord-ouest de la France / Functional approach of stone tools in northwestern France at the down of the Holocene

Après une simplification significative des méthodes de débitage durant l'Azilien, rompant progressivement avec les normes magdaléniennes, le retour au cours du Dryas récent à des productions lamino-lamellaires élaborées marque un tournant abrupt dans la tradition lithique. Bien qu'un certain flou pèse sur la chronologie des événements, les recherches menées depuis quelques années autour des industries de la transition Pléistocène-Holocène permettent de bien cerner les transformations survenues dans les modalités et les objectifs des productions lithiques. En revanche, malgré le fait que les interrogations des chercheurs soient largement orientées vers des reconstitutions d'ordre palethnographiques, les finalités fonctionnelles des outils, leur modalité d'emploi et les chaînes opératoires dans lesquelles ils sont impliqués restent des thèmes de recherche très peu abordés. C'est afin de pallier ce manque que nous avons exploré ces questions à travers l'analyse tracéologique des industries lithiques de deux sites du nord-ouest de la France issus d'opérations récentes (Le Buhot à Calleville, Eure ; La Fosse à Villiers-Charlemagne, Mayenne). L'apport de ce travail est appréciable à différentes échelles spatio-temporelles. Sur le temps court, les résultats obtenus révèlent des contrastes saisissants entre les occupations, tant au regard des activités menées par l'intermédiaire des outils que de l'économie des produits des débitages, et enrichissent le modèle de complémentarité des sites déjà proposé. Sur le temps long, le croisement des données fonctionnelles acquises ces trente dernières années entre l'Azilien et le premier Mésolithique et les autres données du registre archéologique permet de discuter des inflexions dans les systèmes techniques et les économies préhistoriques. / After a significant simplification of the flint reduction methods during the Azilian period, which broke gradually with Magdalenian standards, the return to sophisticated laminar productions during younger Dryas marks a strong split in the lithic tradition. Beyond a state of uncertainty towards chronological boundaries, the research which have been conducted for thirty years gives a good understanding about changes in flint production methods and aims. Even though most research focuses on palethnographic reconstitutions, the functional purposes of the flint industry and the chaînes opératoires in which flint tools are implicated remain insufficiently studied. And yet, these questions are of prime importance to meet the expectation of the palethnographic reconstitutions that archaeologists covet. To overcome this deficiency, the functional analysis of two north-western France sites (le Buhot site at Calleville, Eure ; la Fosse site at Villiers-Charlemagne, Mayenne) attributed to the Pleistocene-Holocene transition were undertaken. The contribution of this doctoral research can be appreciated at different spatio-temporal scales. Áreas de preservação permanente (APPs) e o planejamento do seu uso no contexto das bacias hidrográficas : metodologia para adequação dos parâmetros legais

Der geschichtliche Prozess der Bodenbesetzung und – nutzung auf der Grundlage von Entwaldung und ungeordneter Bodenbewirtschaftung verursachte Konflikte zwischen der Zielsetzung der Umweltsanierung und der sozialwirtschaftlichen Reproduktion der auf Flächen mit hohen Umwelteinschränkungen siedelnden Landwirte. Diese Dichotomie zeigt sich derzeit in der Anwendung des Umweltrechts, insbesondere im neuen brasilianischen Waldschutzgesetz, das 1965 durch das Bundesgesetz Nr. 4.771 erlassen wurde, wenn es sich um Naturschutzgebiete (APPs) handelt, also um Landstriche entlang der Gewässer, die entsprechend geschützt und deren natürliche Vegetationsbedingungen erhalten werden müssen. Ausgehend von Elementen der Flussgeomorphologie gründet sich die von der vorliegenden Untersuchung verfolgte Diskussion auf die Hinterfragung der geometrischen Maβnahmen der Naturschutzbestimmungen durch die Vorlage einer Methodik zur Bestimmung dieser Flächen. Um zum Ergebnis zu gelangen, wird eine geschichtliche Rückbesinnung auf den Bodenbesetzungsprozess in Nordwest Rio Grande do Sul, zu der die Proben der Untersuchung gehören, sowie eine theoretische Interpretation des weltweiten Naturschutzes vorgenommen und werden die Naturschutzgebiete für Brasilien auf drei Untersuchungsebenen diskutiert: der gegebene gesetzliche Rahmen, die Verwendung dieser Flächen und der Zustand, in dem diese sich im Nordwesten von Rio Grande do Sul befinden. Die soziale Funktion des landwirtschaftlichen Betriebs wird als wichtiger Punkt dieser Diskussion betrachtet, denn von ihr ausgehend geschieht der ganze Prozess der Verantwortungsüberweisung für den Schutz oder Nichtschutz von Naturschutzgebieten. In diesem Sinne untersuchen wir auch, wie IBAMA, FEPAM und Staatsanwaltschaft sich positionieren und angesichts der gesetzten Thematik handeln. Für die vorgeschlagene Methodik bestimmten wir drei Bereiche des Flusses Santo Cristo zu Pilotflächen, für die wir die Längsdeiche und Auen als Parameter für die Bestimmungen der Naturschutzgebiete definierten. Ebenso beurteilten wir die Bodenstruktur der Region, um eine der Art der lokalen Betriebshöfe unmittelbar verbundene Deutung zu ermöglichen. Von diesen Vorzeichen ausgehend wurde eine kritische Lesart des Verhaltens dieser Flächen möglich, indem ihre derzeitige Verwendung derjenigen der gesetzlichen Anforderungen entgegengestellt wurde. Aus der vorliegenden Untersuchung ergeben sich als wesentliche Schlüsse: Eine vertiefte Untersuchung über die Naturschutzgebiete ist dringend und erforderlich, um einen neuen Gesetzesvorschlag zu erarbeiten, der effektive Fachparameter zur Bestimmung der Naturschutzgebiete festlegt und der gleichzeitig die Entwicklung von Untersuchungen anstrebt, die darauf zielen, alternative nachhaltige Nutzungsalternativen für diese Flächen vorzulegen; Beurteilung der Schutz- und Erhaltungskonzeptionen in der Absicht, dass letztere eine breite Palette von Vorteilen für die kleinen landwirtschaftlichen Betriebshöfe in dem Maβe mit sich bringen, wie die Bodenschutzmaβnahmen zum Ausgleich der Natur beitragen und in der Erzeugung dieser Betriebshöfe einen reellen Gewinn erbringen. Schlieβlich legen wir eine Reihe von Studien vor, die in der Absicht einer Vertiefung der von uns erforschten thematischen Diskussion verfolgt werden können. / O processo histórico de uso e ocupação da terra, baseado no desflorestamento e no manejo desordenado do solo, tem gerado conflitos entre os objetivos de recuperação ambiental e de reprodução socioeconômica dos agricultores assentados sobre áreas de elevadas restrições ambientais. Esta dicotomia reflete-se na atualidade através da aplicação mais efetiva da legislação ambiental, principalmente, do Código Florestal brasileiro, instituído pela Lei Federal n. 4.771 de 1965, que trata das Áreas de Preservação Permanente, APPs, que são as faixas marginais aos corpos hídricos que devem ser devidamente preservadas e mantidas com vegetação nativa. A discussão apresentada pelo presente estudo está pautada no questionamento das medidas geométricas contidas na definição das APPs nesse instrumento legal, buscando apresentar uma metodologia para a definição destas áreas a partir de elementos da geomorfologia fluvial, além daqueles relacionados com a cobertura vegetal de entorno. Para chegar aos resultados desse estudo se apresenta uma retomada histórica do processo de ocupação da Região Noroeste do Rio Grande do Sul, na qual se inserem as áreas amostrais, faz-se uma leitura teórica sobre conservação da natureza em nível mundial e discute-se as APPs em três níveis de análise para o Brasil: a) o arcabouço jurídico que está posto; b) o uso destas áreas e c) o estado da arte em que elas se apresentam no noroeste do Rio Grande do Sul. A discussão da função social da propriedade rural é vista como ponto importante desta discussão, por ser a partir dela que se dá todo o processo de responsabilização pela preservação ou não das APPs. Neste sentido, buscamos também compreender como o Ibama, a Fepam e o Ministério Público Estadual se posicionam e desenvolvem as suas atividades frente à temática colocada. Definimos como áreas piloto para a aplicação da metodologia proposta, três setores do Rio Santo Cristo, para os quais definimos os diques marginais e as planícies de inundação como parâmetros para a definição das APPs. Da mesma forma, avaliamos a estrutura fundiária da região para possibilitar uma leitura diretamente relacionada com o tipo de propriedade existente no local. A partir destas definições foi possível estabelecer uma leitura crítica das características dessas propriedades, comparando o seu uso atual com as exigências legais. Ficam como principais conclusões do presente estudo: a) que é urgente e necessário um estudo mais aprofundado sobre a questão das APPs para que seja possível apresentar uma proposta de alteração da legislação que busque parâmetros técnicos efetivos para a definição das APPs; b) que se busque igualmente o desenvolvimento de estudos que objetivem apresentar alternativas de uso sustentado para estas áreas; c) que se avaliem os conceitos de preservação e conservação com o intuito de compreender que o último traz uma grande gama de benefícios para as pequenas propriedades rurais, na medida em que as práticas conservacionistas auxiliam no equilíbrio da natureza e trazem um ganho real na produção destas propriedades. Por fim, apresentamos um conjunto de estudos que podem ser realizados com o intuito de aprofundar as discussões da temática por nós pesquisada. / The historic land grab and land usage process based on deforestation and disorderly land management caused conflicts between environmental cleanup and socioeconomic reproduction of the farmers settled on areas that underlie strict environment restrictions. This dichotomy at present gets evident in the application of the environmental legislation, particularly the new Brazilian Forest Code entitled by the federal Law No. 4.771 of 1965, when it involves permanent nature reserve (APPs), that is, marginal stripes along water corps that must be preserved with the associated original vegetation. The discussion herewith stated is based on the closer examination of the geometrical measures of the definition of the permanent nature reserves trying to present a method for the definition of theses areas out of the elements of the fluvial geomorphology. To reach the result, we make recourse to the historical land grab process in the northwestern region of Rio Grande do Sul, to which belong the areas herein studied. We make a theoretical interpretation of nature conservation at international level and discuss nature reserves at three study levels for Brazil: the given legal framework; the usage of these areas; and their conditions in northwest Rio Grande do Sul. The discussion of the social function of the farms is seen as an important aspect of this discussion because thereof happens the responsibleness for the conservation or not conservation of the preservation areas. We also study the positioning of Ibama, Fepam and prosecution in this question. We determinate three segments of the Santo Cristo river as pilot areas for the application of the proposed methodology, wherefore we defined natural levee and floodplains as patterns for the definition of nature preservation areas. We did also evaluate region’s estate to allow an understanding directly related to the kind of local property. These definitions allowed us establishing a critical understanding based on the behaviour of these areas comparing their current usage to the legal demands. The most important conclusions of this study are: 1) a deeper study of nature preservation areas urges and is necessary to allow the presentation of a new legal proposal that looks for effective technical patterns for the definition of nature reservation areas; 2) that one also tries to develop studies that try to show alternatives of sustainable usage of these areas; 3) that preservation and conservation concepts get evaluated with the intend to understand that this brings a wide scope of benefits to the small farms thus far as the conservation practices help to stabilize nature and to carry a real gain in the production of these farms. Finally we present a scope of studies that can be done with the aim of deepening the discussions of the question here studied.
