Alternativy nepodmíněného trestu odnětí svobody / Alternatives to Unconditional Sentence of Imprisonment

The topic of my thesis are the alternatives to unconditional sentence of imprisonment, while the main emphasis is given to conditional sentence, conditional sentence with supervision, house arrest, a sentence of community service and financial penalty, which means alternative punishments in narrow sense. The aim of my thesis is to describe and summarize the legislation concerning alternative sanctions to unconditional sentences of imprisonment, and to assess the usage of alternative sanctions, as well as to present proposals de lege ferenda. The paper consists of introduction, six chapters, and conclusion. The first chapter analyses the concept of punishment, its purpose and elemental principles that apply for imposing sentences. The introduction to the second chapter focuses on disadvantages of imposing unconditional sentence of imprisonment. It also deals with short-term punishments. It mentions international approaches to alternative measurements, especially the activity of the UN and the Council of Europe. Furthermore, this chapter describes the system of alternative measures. It presents process alternatives, known as diversions, and substantive alternatives, including alternatives to punishment and alternative sanctions. Podpora divadel v hlavním městě Praze / Support of theatres in the capital city of Prague

Prague, the capital of the Czech Republic, is specific in many respects. Concerning cultural life, the characteristic features are to be found primarily in the way cultural activities are supported and publically financed. So called "transformation" of Prague theaters suggests that "The Grant System of the City of Prague" is closely linked with the ownership structure of theaters. The particular way the theaters, i.e. providers of the public service, are supported changes the way individual theater are run. The goal of the Master Thesis is to assess financial support of theaters in the City of Prague with respect to different ownership structures and to point out to potential links between the actual support of culture and the current priorities in this area in the City of Prague as well as in the Czech Republic as a whole. The starting point is with the description of the current governance of the Prague's cultural life, its organization and linkages. A particular attention is paid to the comparison of various ownership structures in the sphere of culture and to the Grant System of the City of Prague. A separate chapter is devoted to the overview of requirements and rules for the provision of public financial support with selected theaters. Consequently, the present-day system of governance and support of cultural activities in Prague is evaluated together with selected ownership structures of theaters.

Punishment of community service and its performance Abstract The diploma thesis deals with basic aspects of community service in terms of Czech and foreign legal regulation, it deals with its development in time, statistical data, special regulation of criminal measures of publicly beneficial works imposed on juveniles and problematic aspects of existing legal regulation. The aim of the thesis is to define the status of the punishment of community service in the system of domestic and foreign law, to provide detailed information on the substantive and procedural law contained in the Criminal Code, Criminal Procedure Code and other supporting acts, to deal with problematic aspects and to mediate opinion of public, judges and probation officers. In cooperation with the probation officer and with the providers of community service I summarized the basic problematic aspects of the community service and considered their possible solution, which I summarize in the individual chapters. In terms of used methods the thesis uses a legal-analytical, legal-comparative, legal- descriptive approach, query model and statistical models. This dissertation is focused on the impacts of new legal regulations concerning non-profit making organizations on citizen associations. The introductory part gives the old and the new legal regulations of non-profit making organizations. The next chapter describes the transformation method of citizen associations(now societies) to other legal forms. This is followed by the suggestion of criteria when the organizations decide on the change of legal form a part of which is a case study showing the differences in taxation of individual legal forms. The final part describes results of research of transparency of non-profit making sector. Discussion contains recommendations how to solve the problems connected with the new legal regulation.

Úloha a postavení neziskového sektoru podle nové právní úpravy / The role and status of non-profit sector according to the new legislation

This diploma thesis focuses on the non-profit sector in the Czech Republic, which is very often discussed topic not only in the media but also on the social comunnity, whether lay or professional community. The aim of the thesis is the legal provision regarding the status of the non-profit sector in the Czech Republic, focusing on a comprehensive overview of the status and legal anchoring of non-profit sector, its characteristics, development and involvement in running the development of Czech society. The research question is: What impact has the Act no. 89/2012 Coll., Civil Code of law, which entered into force on 1. January 2014, the non-profit sector? There is a complete theoretical overview of the characteristics of the non-profit sector and are further explained the changes that the new Civil Code brought. Based on the collected data are analyzed activities of the various forms of non-profit sector in the theoretical part. They discussed the various powers and obligations arising from NOZ to uncover the circumstances of the research question. The collected information is found that the new legislation provided for in the Act no. 89/2012 Coll., Civil Code of law, is sufficient. Nongovernmental organizations are with their obligations, including the possible transformation familiar and by no means compromising functionality. Individual institutions that are not fully familiar with the NOZ is recommended to do so, to avoid future confusion in both administrative duties and in their functionality. It is also recommended for all institutions to check all the information in public registers, which are currently registered. Comprehensive amendment to the law is not recommended.

The aim of my study was to determine the influence of the new property tax adjustment on the budgets of selected municipalities and to determine how these municipalities use and apply the possibility given to them by the legislative on property taxes. In my study, I compared 11 municipalities located in the Český Krumlov District. It includes the towns of Český Krumlov, Vyšší Brod, the township Frymburk and the municipalities of Větřní, Bohdalovice, Světlík, Lipno nad Vltavou, Kájov, Chvalšiny, Zlatá Koruna and Hořice na Šumavě. I compared the generally binding regulations in the tax periods 2008, 2009, 2010 and the revenues from the tax in the same periods in these selected municipalities.

The main aim of this thesis was to define one of the alternative punishments - community service from different points of view. Firstly from a historical and descriptive point of view, regarding procedural aspects and further specifics, namely cooperation with the Probation and Mediation Service. Further the thesis outlined the alternative end of the performance, specifically postponing the sentence, parole and waiving of sentence, which may happen to the offender in certain cases. Pros and cons of this kind of punishment were discussed in detail and also its position in the system of penalties, especially competition with the punishmnt house arrest. This thesis also contains a procedure for failure regarding the sentence of community service, thus transforming the prison sentence into inprisonment, the range of conditions, and other aspects. Part of the work includes a comparison with other countries, especially Slovak Republic, having this kind of punishment for a shorter time. The second half of the thesis deals with partially unfulfilled potential regarding sentence of community service, its and ability to empty the prisons and become a universal punishment used in case of most minor offenses. Strategie práce s obecně geografickou mapou jako zdrojem informací / Strategies of use of general geographic map as a source of information

The main topic of this thesis are map skills, and the key point of interest are strategies used for map analysis. General reference map was found as a suitable map given its frequent use in the school atlases. The main goal of this study is evaluation of the general reference map analysis strategies in terms of their dimensions, i. e. their repertoire, distribution, efficiency, and adaptability. 20 upper secondary school students participated in an eye-tracking experiment that consisted of the test and the follow-up questionnaire. The eye-tracking data were analyzed qualitatively and quantitatively to obtain information about the strategy dimensions. Results showed that students used broad repertoire of strategies when analyzing the general reference map and they pointed to the most chosen strategies as well. In some cases, students used more than one strategy to solve the task and thus the most frequent strategy combinations were detected. The efficiency of strategies was evaluated based on the students' success rate and the length of the solving cycle which was affected by the type of elements, respectively map content, used for solving the task.
