The derivative imperative : how should Australian criminal trial courts treat evidence deriving from illegally or improperly obtained evidence?

How should Australian criminal trial courts treat evidence deriving from illegally or improperly obtained evidence? The fact that derivative evidence gives rise to factors distinct from primary evidence makes it deserving of an examination of its peculiarities. In doing so, the assumption may be put aside that derivative evidence falls wholly within the established general discourse of illegally or improperly obtained evidence. Just as the judicial response to primary evidence must be intellectually rigorous, disciplined and principled, so must be the response to derivative evidence. As such, a principled analysis of how Australian courts should approach derivative evidence can significantly contribute to the discourse on the law with respect to the exclusion of illegally or improperly obtained evidence. This thesis provides that principled analysis by arguing that the principles which underpin and inform the discretionary exclusionary frameworks within Australia require an approach which is consistent as between illegally obtained derivative evidence and illegally obtained primary evidence.

In such societies the police stand at the point of balance on the one hand securing human rights on the other exercising their lawful powers given to them by Governments in the name of the people, to protect people and their institutions" (J Alderson Human Rights and Police Rights. Publication of the Council of Europe.) This is no small expectation. It means that the police are expected to maintain and secure the principles of democracy and human rights, the principles upon which our Constitution is based. At the same time it is the duty of a police service to maintain law and order which sometimes require the exercise of power and the use of force which on the face of it may appear to violate human dignity and certain rights and freedoms which a police force is expected to maintain in a democratic society. The manner of exercising that power has an impact on the credibility and effectiveness of the police. Human rights law internationally accepts that a police service needs to be given the power to, at times restrict certain individual freedoms in the interests of the security of the community at large. These restrictions may take place only in a constitutional way. If it takes place in an unconstitutional way the courts must have the right to exclude evidence which is unconstitutionally obtained. At this stage the courts have to formulate such a qualified exclusionary rule, but the ultimate goal must be to include such an exclusionary rule in a future Constitution. / Department of Criminal & Procedural Law / LL.M.

The theoretical part is focused on an issue of the acquired brain injury, a description of cognitive areas and as well their pathology due to this injury. The doctoral thesis focuses on the part of criminal proceedings in which the court adjudicates the injured person's private claims which arose in connection with a criminal act (so-called collateral proceedings). The importance of collateral proceedings lies in the fact that by using it the injured party may avoid time-consuming, financially as well as procedurally demanding civil proceedings. However, the institute of collateral proceedings comprises a number of specific issues since a criminal court adjudicates the private claims of the injured party in compliance with substantive law rules being outside of the scope of criminal law (mainly civil law and labour law regulations) but, still, within the framework of criminal proceedings. The basic source of the submitted thesis is the Czech legal order. However, it is not the only one taken into consideration. The doctoral thesis also contains comparative analysis of legal regulation of collateral proceedings from the point of view of the German and Swiss legal orders. Following the analysis of collateral proceedings de lege lata, as well as the comparison with foreign models I am submitting proposals for the improvement of legislation that could be used in connection with the planned recodification of the Czech Criminal Procedure.

This study is justified due to the vulnerableness of the individual s fundamental right to privacy. The right to privacy, especially in terms of protection of financial and tax-related data, is protected by confidentiality provisions violated by amendments to the National Tax Code resulting from Supplementary Laws 104 and 105, both from January 10, 2001. Firstly, we will examine the Brazilian Revenue Service and the myriad of tools it has available to inspect the lives and activities of individuals and legal entities, from the right of scrutinizing accounting books, merchandise, files, and documents, to the right of imposing the duty to provide information on the taxpayer to financial institutions and the like. There is an undeniable tension between the forms of information gathering and the protection of confidential data. Among the kinds of confidentiality related to our topic, financial data confidentiality stands out. According to prevailing case law and scholarly opinions, financial data confidentiality can be moderated as a result of a court order. However, contrariwise, Supplementary Law 105/01 has authorized data to be directly turned over to the Revenue Service. This is a clear non-conformity with the current Brazilian constitutional system. Provided constitutional provisions are taken into account, tax-related information are undeniably subject to being transferred to the tax authorities, which, in turn, have the duty of keeping them from third parties due to the confidentiality clause. This second kind of data confidentiality protection ensures the same right to privacy by preventing said information from being disclosed to third parties. This provision was made more elastic by Supplementary Law 104/01. Likewise and for the same reasons as financial confidentiality, only a court order can break through the confidential nature of tax-related information. Tax-related data, provided they are lawfully obtained, can be employed by the tax authorities in order to produce evidence of taxes and fines levied, and issue deficiency notices. The evidence submitted by the Revenue Service shall be admitted as long as it respects the applicable constitutional and legal provisions, especially provisions related to individual rights and freedoms. We understand, differently from the current and prevailing literature, which seems to passively accept the full disclosure of tax-related information on taxpayers and third parties based on the recent Supplementary Laws , that although tax inspection fulfills the administration s revenue needs, its limits are drawn by constitutional provisions, which no other kind of legislation has the power to disregard / Este trabalho tem como escopo a análise das informações fiscais, do momento de sua apreensão à sua utilização, sobremodo como provas a lastrear a exigência de tributos e multas. Justifica-se a reflexão em razão da vulneração ao direito fundamental à privacidade dos cidadãos, tutelado por normas de sigilo de dados, em especial os sigilos financeiro e fiscal, por força das substanciais alterações ao texto do Código Tributário Nacional oriundas do advento das Leis Complementares nº 104 e 105, ambas de 10 de janeiro de 2001. Parte-se do exame da Administração Tributária e do vasto instrumental à sua disposição para fiscalizar as atividades desenvolvidas pelos particulares, desde o direito de examinar livros, mercadorias, arquivos e documentos dos sujeitos passivos, à imposição de deveres de informar a contribuintes e terceiros, como instituições financeiras e entes assemelhados. Observa-se uma inegável tensão entre essas formas de coleta de informações e o sigilo de dados. Dentre as espécies de sigilo de dados relacionadas à temática, desponta o sigilo financeiro, passível de relativização mediante decisão judicial, ao contrário do insculpido na Lei Complementar nº 105/01, que autoriza a transferência direta de dados à Fazenda Pública, em desconformidade à ordem constitucional vigente. Respeitadas as balizas constitucionais, as informações serão passíveis de comunicação às autoridades fiscais, que têm o dever de mantê-las afastadas do conhecimento alheio, por influxo do sigilo fiscal. Essa outra espécie de sigilo de dados atua na proteção do mesmo direito à privacidade, ao impedir a revelação de tais informações a terceiros, cujo regramento foi flexibilizado com a edição da Lei Complementar nº 104/01. Da mesma forma que o sigilo financeiro e pelas mesmas razões, o sigilo fiscal somente admite afastamento por meio de decisão judicial. Os dados de matiz tributário, quando licitamente produzidos, poderão ser apropriados por agentes fiscais na forma de provas a lastrear a exigência de tributos e multas, por meio da composição de atos administrativos de lançamento ou auto de infração. As provas constituídas pela Administração serão reputadas admissíveis desde que respeitadas as normas constitucionais e legais aplicáveis, mormente os direitos e garantias individuais. Entende-se contrariamente à tendência doutrinária atual, que aceita passivamente a ampla divulgação de informes fiscais relacionados a contribuintes e terceiros em decorrência da nova legislação complementar, pois a fiscalização tributária, embora indispensável à realização do interesse arrecadatório, encontra limites delineados pelo legislador constituinte, os quais não são superáveis por enunciados infraconstitucionais

Estudo da interferência nuclear coulombiana nos isótopos de germânio / Study of interference nuclear Coulomb the isotopes of germanium.

O estudo de características de isospin na excitação do estado 2 POT.+IND.1 foi implementado nos núcleos ANTPOT.70, 72, 74 Ge com a realização de medidas de espalhamento inelástico na região de interferência nuclear coulombiana (INC) com ANTPOT.6 Li de 28 MeV. A análise da INC, utilizando projéteis leves de interação isoescalar, na excitação de estados coletivos é uma ferramenta poderosa para evidenciar mudanças de estrutura em cadeias de núcleos, e fornecer resultados robustos para testes de modelos. A principal vantagem do método é a extração simultânea dos parâmetros de deformação de carga e massa das transições, minimizando as incertezas na razão entre as probabilidades reduzidas de transição elétrica e de massa, B(El) e B(ISl), indicadores importantes da coletividade dos estados nucleares. A análise foi realizada na aproximação de Born com ondas distorcidas e potencial óptico deformado (DWBA-DOMP), usando um conjunto de parâmetros de potencial óptico global. Os ajustes das previsões à distribuições angulares, empregando o método interativo de Gauss, exibiram excelente qualidade. Os parâmetros correlacionados extraídos na minimização do chi-quadrado, delta IND.n(comprimento de deformação nuclear) e C=delta IND.c/delta IND.n (razão entre os comprimentos de deformação de carga e nuclear), e suas incertezas, foram submetidos a testes estatísticos que os validaram. Dentre as grandezas determinadas a partir desses parâmetros, os valores de B(IS2), inéditos nos isótopos de Ge, mostraram uma mudança de estrutura não evidenciada pelos valores de B(E2). A probabilidade reduzida de transição isoescalar cresceu com o incremento do número de nêutrons, com um aumento abrupto no ANTPOT.74 Ge. Já a probabilidade reduzida de transição elétrica aumentou de maneira mais suave. Essa diferença de comportamento foi um reflexo da variação do parâmetro extraído C, que no ANTPOT.74 Ge indicou uma ) contribuição maior dos nêutrons frente aos prótons na excitação do primeiro estado quadrupolar. Os isótopos ANTPOT.70, 72 Ge, por outro lado, revelaram contribuições equivalentes e homogêneas para essas transições. Com a determinação precisa das contribuições de massa e de carga para a excitação do primeiro estado quadrupolar, novos subsídios estão disponíveis para futuros cálculos. / The analysis of the isospin character of the 2 POT.+ IND.1 excitation in the ANTPOT.70,72,74 Ge nuclei, with 28 MeV ANTPOT.6 Li, was applied to the inelastic scattering in the coulomb nuclear interference (CNI) region. The CNI measurements in the exitation of collective states with light isoscalar projectiles are powerful tools to evidence structure changes in nuclei chains, allowing tests of nuclear models. In this method the simultaneous extraction of the charge and mass deformation parameters, minimizes the uncertainties in the ratio of charge B(El) to mass B(ISl) trasition reduced probabilities, wich are important indicators of the nuclear collectivity. The present analysis was developed in the framework of the distorted wave Born approximation within a deformed optical potential approach (DWBA-DOMP), using a set of global optical model parameters. Excellent quality fits of the predictions to the experimental angular distributions, employing the Gauss iterative method, were obtained. The correlated parameters delta IND.N (nuclear deformation length) and C = delta IND.C/delta IND.N (ratio of charge to nuclear deformation lenghts), and their uncertainties extracted in the least squares method, were validated by statistical tests. The B(IS2) values for germanium isotopes, not previously reported, were determined in the analysis and revealed a structure change not evidenced by the B(E2) values. The isoscalar transition reduced probability raises when the neutron number increases, showing in the ANTPOT.74 Ge an abrupt enhancement. Nevertheless, the eletric transition reduced probability grows smoothly. This behavior was detected following the experimental extracted C parameters, indicating in the heavier isotope a predominance of neutrons in the first quadrupolar excitation. The ANTPOT.70,72 Ge isotopes, on the other hand, displayed equivalent and homogeneous contributions of protoons and neutrons. New information on mass and charge contributions for the 0 POT.+ IND.1 -> 2 POT.+ IND.1 transition, in the germanium isotopes, is now available for future theoretical interpretation.

De l'échec perçu du service à l'intention de comportement : le rôle de l’attribution et des attentes de compensation sur la satisfaction : une étude empirique dans l'hôtellerie chinoise / From service failure to behavioral intention : the role of attribution, recovery expectation and satisfaction : an empirical study in the Chinese hospitality industry

Dans l’hôtellerie, les défaillances de service sont presque inévitables. Pour limiter les conséquences indésirables, les chercheurs et les praticiens se sont concentrés sur l'efficacité de la compensation en cas d'échec. Malgré l'existence de divers modèles de recherche, les comportements des clients comme la rupture de la relation ou la propagation d’un bouche-à-oreille négatif, même après les efforts de récupération, restent à comprendre.Pour répondre à la question de recherche : « Dans le secteur de l'hôtellerie en Chine, dans quelle mesure la satisfaction après compensation de service peut-elle s'expliquer par les attributions et la (dis)confirmation des attentes ? », cette thèse propose un modèle conceptuel basé sur la théorie de l'attribution, le paradigme des attentes-confirmation et la théorie de la justice. Il s'appuie sur deux concepts-clés (attribution et attentes de compensation). Elle présente cinq hypothèses regroupés dans trois ensembles de relations : (1) l’influence de la défaillance du service sur l'attribution des clients, l’influence de l'attribution des clients sur les attentes de compensation et l’influence de la défaillance du service sur les attentes de compensation ; (2) l’influence de la différence entre les attentes de compensation des clients et la compensation effectivement obtenue sur la satisfaction des clients après compensation ; (3) l’influence de la satisfaction des clients après compensation sur les intentions comportementales. Ensuite, selon l'hypothèse d'appariement, nous explorons la relation entre le type de défaillance de service et le type d'attente de compensation du client ; et nous trouvons un certain décalage entre les attentes de compensation et ce qui est effectivement obtenu.Pour atteindre nos objectifs de recherche, nous avons ciblé des clients déclarant avoir eu une ou plusieurs expériences désagréables avec un hôtel au cours des six derniers mois. Au moyen d'un questionnaire en ligne, nous avons recueilli 318 réponses valides et analysé les données avec SPSS25.0. Les résultats montrent que (1) l'attribution de l'échec du service par le client a une influence significative sur les effets de l'échec du service sur les attentes de compensation ; (2) la différence entre les attentes de compensation et la compensation réelle a une incidence sur la satisfaction après la compensation ; (3) la satisfaction du client après la compensation a une influence sur les intentions du comportement ; (4) les types d'attentes de compensation sont influencées par le type de défaillance ; (5) la compensation effectivement obtenue est différente de celle attendue, principalement à cause des hôtels ne fournissant pas les compensations adéquates ou de clients recevant les indemnités non désirées ; ce décalage affecte l'efficacité de la compensation et la satisfaction du client après la compensation.Les résultats permettront aux chercheurs en marketing et aux praticiens de l'industrie hôtelière de mieux comprendre le rôle de l'attribution des clients et de leurs attentes en matière de compensation suite à une défaillance du service ainsi que le processus de compensation des services. Ils pourraient en conséquence élaborer et mettre en œuvre des stratégies de marketing plus localisées et plus satisfaisantes sur le marché chinois. / In the hospitality industry, service failures are almost inevitable. To avoid the undesirable consequences, researchers and practitioners have concentrated on the effectiveness of failure recovery. Despite that various of research models exist in empirical studies, customer behaviors like exiting or spreading negative WOM even after recovery efforts remain unsolved.As an attempt to answer the research question:In the hospitality industry of China, to which extent satisfaction recovery can be explained by client attributions and expectations (dis)confirmation? Why do customers who accept service recovery still leave the service provider or do something that is not good for the service provider? This dissertation proposes a conceptual model based on attribution theory, expectation-disconfirmation paradigm, justice theory. It relies on two key concepts (customer attribution and recovery expectation), and displays five hypotheses in three set of relationships: (1) the influences of service failure on customer attribution, the influences of customer attribution on recovery expectation and, the influences of service failure on recovery expectation; (2) the influences of the difference between customer recovery expectation and obtained recovery on customer satisfaction after recovery; (3) the influences of customer satisfaction after recovery on behavioral intention. And then, according to “matching hypothesis”, we explore the relationship between the type of service failure and the type of customer recovery expectation; and find some mismatch between recovery expectations and obtained.To achieve research objectives, we targeted customers who claimed to have had unpleasant experiences with hotels in the past six months. By means of an online questionnaire, we have collected 318 valid responses and analyzed the data with SPSS25.0. The results show that (1) customer attribution statistically significantly mediates the effects of service failure on recovery expectation; (2) the difference between recovery expectation and obtained recovery affects satisfaction after recovery; (3) customer satisfaction after recovery affects behavioral intentions; (4) types of recovery expectation are influenced by types of service failure; (5) obtained recovery differs from recovery expectation to some extent, mainly because of “hotels not giving appropriate compensations” or “customers receiving undesired compensations” – such “mismatch” or “difference” affects the effectiveness of failure recovery and customer satisfaction after recovery.The findings provide insights for marketing academics and industry practitioners to better understand the role of customer attribution and recovery expectation in service failure and service recovery process. Therefore, more localized and more satisfying marketing strategies are to be expected in the Chinese market.

The CNI measurements in the exitation of collective states with light isoscalar projectiles are powerful tools to evidence structure changes in nuclei chains, allowing tests of nuclear models. In this method the simultaneous extraction of the charge and mass deformation parameters, minimizes the uncertainties in the ratio of charge B(El) to mass B(ISl) trasition reduced probabilities, wich are important indicators of the nuclear collectivity. The present analysis was developed in the framework of the distorted wave Born approximation within a deformed optical potential approach (DWBA-DOMP), using a set of global optical model parameters. Excellent quality fits of the predictions to the experimental angular distributions, employing the Gauss iterative method, were obtained. The correlated parameters delta IND.N (nuclear deformation length) and C = delta IND.C/delta IND.N (ratio of charge to nuclear deformation lenghts), and their uncertainties extracted in the least squares method, were validated by statistical tests. The B(IS2) values for germanium isotopes, not previously reported, were determined in the analysis and revealed a structure change not evidenced by the B(E2) values. The isoscalar transition reduced probability raises when the neutron number increases, showing in the ANTPOT.74 Ge an abrupt enhancement. Nevertheless, the eletric transition reduced probability grows smoothly. This behavior was detected following the experimental extracted C parameters, indicating in the heavier isotope a predominance of neutrons in the first quadrupolar excitation. The ANTPOT.70,72 Ge isotopes, on the other hand, displayed equivalent and homogeneous contributions of protoons and neutrons. New information on mass and charge contributions for the 0 POT.+ IND.1 -> 2 POT.+ IND.1 transition, in the germanium isotopes, is now available for future theoretical interpretation.
