Présenter Charles de Bovelles (1479-1566) au coeur de la question de l'humanisme qui préoccupe toutes les couches sociales, politiques, économiques et religieuses, c'est essayer de découvrir sa pensée sur l'homme et de l'homme qui a son socle dans l'adage socratique " Homme, connais-toi toi-même ". L'humanisme étant la célébration de la dignité de l'homme, il demeure nécessaire de connaître qui est cet homme pour en découvrir sa dignité. Et pour Bovelles, il n'y a pas meilleur lieu de connaissance de l'homme que soi-même. Se découvrir homme véritable, homme raisonnable, artisan de soi et médiateur, homme du monde ou homme-monde, homme cultivé, vertueux ou sage consentant à la divinité et résistant au néant, c'est entrer dans une lutte pour tenir bon dans cette dignité humaine. Le 'Sistere in homine' par la connaissance de soi en tant que moyen d'humanisation trouve son effectivité, au cœur de la théosophie bovillienne, dans la lutte contre le péché et l'ignorance de soi au moyen non seulement de la philautie mais aussi de la connaissance de soi en Jésus-Christ. Humanism is the celebration of the dignity of man, so it remains necessary to know who this man is to discover his dignity. So, for Bovelles, there is no better place for knowledge of human than oneself. To discover oneself as a real, reasonable man, a self-architect and mediator, a human of the world or human-world, as a cultured, virtuous or wise man consenting to divinity and resisting to nothingness, that means to enter into a struggle for holding in this dignity. In the heart of the bovilian Theosophy the 'Sistere in homine', self-knowledge as a way to humanizing, finds its effectiveness in the fight against sin and self- ignorance not only by means of philautie but also of self-knowing in Jesus Christ. It is in Him, genuine humanist of all time, that human reveals oneself as a relic and sign of God who invites him to bliss.

Hierdie onderskeid op grond van seksuele georiënteerdheid mag moontlik ongrondwetlik wees. Voorts is daar 'n menigte regte en verpligtinge wat outomaties uit huweliksluiting spruit, maar nie outomaties op lewensverhoudings van toepassing is nie. Hierdie onderskeid op grond van huwelikstaat mag eweneens moontlik teen die bepalings van die Grondwet van die Republiek van Suid-Afrika, 1996 indruis. Hierdie studie is gevolglik daarop toegespits om ondersoek in te stel na die grondwetlikheid van hierdie twee onderskeide. Die ondersoek word geloods met verwysing na relevante wetgewing en regspraak. 'n Bondige oorsig van fundamentele regte word as agtergrond verskaf. Na afhandeling van die ondersoek word daar aandag geskenk aan die huidige en voorgestelde toekomstige erkenning en regulering van lewensverhoudings in die Suid-Afrikaanse reg, waarna die bevindings saamgevat en krities beoordeel word. SUMMARY The definition of marriage differentiates between heterosexual and homosexual life partners with regard to the capacity to marry. This differentiation on account of sexual orientation may possibly be unconstitutional. Furthermore there are a multitude of rights and obligations that automatically flow from marriage, which are not automatically applicable to life partnerships. This differentiation on account of marital status may also violate the provisions of the Constitution of the Republic of South Africa, 1996. Accordingly this study is aimed at investigating the constitutionality of these two differentiations. The investigation is conducted with reference to relevant legislation and case law. A concise overview of fundamental rights is provided as background. In conclusion of the investigation, attention is paid to the present recognition and regulation of domestic partnerships in South African law, after which the findings are summarised and evaluated critically. / Jurisprudence / LL.M.

Adult friendship and the boundaries of marriage

Four core themes characterised this study: (a) adult friendship, particularly across the gender line, (b) the association between friendship and psychological well-being, (c) the role of attachment in friendship processes, and (d) the influence of the boundaries of marriage on friendship. Twenty six individuals were included in the initial research and 19 subjects participated in the main study. Theoretical principles of social cognition, constructive alternativism and attachment guided the collection and interpretation of data, which was collated, interpreted and then presented in case-study format. Self-with-other representation played a major role in data interpretation. Investigation into the structure and processes of friendship revealed it to be a complex and fragile relationship, defined both idiosyncratically and existentially, as well as by specific distinguishing features, such as trust, loyalty and intimacy . Attachment orientation and positive friendship experiences were noted as being contributory to the sense of interpersonal intimacy associated with feelings of well-being. Positive association was registered between 'secure' attachment orientation and self-ratings of well-being and happiness. Opposite-sex friendship emerged as an exclusive relational type, both similar to, and different from, samesex friendship and romantic love relationships. Its ambiguous role is evidently compounded by the latent sexuality in heterosocial relationships. Respondents reported cases of opposite-sex friendships metamorphosing into romantic love relationships and, less frequently, vice versa. Manifest in attachment and relational mental models, marital boundaries can facilitate or inhibit friendship. On both direct- and meta-perspective levels, securely-attached respondents were relatively accepting of opposite-sex friendships within a marital context. Insecurely-attached subjects tended to construe them as threatening to the marital reality. Responses to this threat varied: avoidantly-attached individuals used ego-protective mechanisms such as denial and repression, whereas · the anxious-ambivalent attachment orientation seemed more closely associated with feelings of mistrust and jealousy, expressed through anger and anxiety. Personal boundary structure plays an incisive role ln adult friendship. Thick-boundaried personalities seemed particularly conscious of preserving marital identity. Text in English and Arabic / In pre-colonial Africa, the Southwestern Sahara which includes Mauritania, Mali and Senegal belonged to what was then referred to as the Sudan and extended from the Atlantic seaboard to the Red Sea. The advent of Islam and the Arabic language to West Africa in the 11th century heralded an intellectual marathon whose literary output still fascinates us today. At a time when Europe was emerging from the dark ages and Africa was for most Europeans a terra incognita, indigenous African scholars were composing treatises as diverse as mathematics, agriculture and the Islamic sciences. A twentieth century Mauritanian, Arabic monograph, Irshād al- Muqallidīn ʿinda ikhtilāf al-Mujtahidīn1, written circa 1910/1332, by a yet unknown Mauritanian jurist of the Mālikī School, Bāba bin al-Shaykh Sīdī al- Shinqīṭī al-Ntishā-ī (d.1920/1342), a member of the muchacclaimed Shinqīṭī fraternity of scholars, is a fine example of African literary accomplishment. This manuscript hereinafter referred to as the Irshād, is written within the legal framework of Islamic jurisprudence (usūl al-fiqh). A science that relies for the most part on the intellectual and interpretive competence of the independent jurist, or mujtahid, in the application of the methodologies employed in the extraction of legal norms from the primary sources of the sharīʿah. The subject matter of the Irshād deals with the question of juristic differences. Juristic differences invariably arise when a mujtahid exercises his academic freedom to clarify or resolve conundrums in the law and to postulate legal norms. Other independent jurists (mujtahidūn) may posit different legal norms because of the exercise of their individual interpretive skills. These differences, when they are deemed juristically irreconcilable, are called ikhtilāfāt (pl. of ikhtilāf). The author of the Irshād explores a corollary of the ikhtilāf narrative and posits the hypothesis that there ought not to be ikhtilāf in the sharīʿah.
