Psychologické profilování pachatele / Psychological profiling of an affender

This diploma thesis deals with the criminalistic method of psychological profiling of an offender. Psychological profiling consists in analyzing the offender's behavior. This analysis is used to create an offender profile that contains offender's likely characteristics. Such a profile is intended to help investigators narrow down the range of suspects, or contribute to the success of investigations by refocusing the investigative strategy. The aim of this thesis is to present a balanced view of the method of psychological profiling and to critically evaluate the possibilities of its use for improving the quality of investigative practice. The thesis is divided into three chapters. The first chapter first defines this method, including basic theoretical approaches and bases. Furthermore, the historical development of profiling abroad and in the Czech Republic is introduced. Appropriate and inappropriate offenses for profiling are also mentioned. At the end of the first chapter, the most important methods or approaches to profiling are outlined. The second chapter is devoted to the creation of the psychological profile of an offender itself. The Indirect Perpetration Abstract Institute of indirect perpetration is one of the most important institutes of criminal law. This diploma thesis aims to describe the institute of indirect perpetration, analyze its particular forms, analyze more deeply its selected problematic aspects and based on this provide authentic evaluation and propose changes de lege ferenda. The thesis is divided into 4 chapters. The first chapter explains the term of indirect perpetration and its conditions in general. The legally taxative enumerated forms of indirect perpetration are analyzed one by one together with their corresponding examples. The second chapter studies the history of the institute in our country. The subchapters contain legal regulation of the institute in particular criminal codes effective in Czech countries and opinions of selected historical authors about given problematic, all this since the times of Austrian criminal code from 1852 to currently effective criminal code from 2009. v anglickém jazyce The subject of my master's degree thesis is "The Issue of an Offender's Personality in Criminology". The aim of my thesis is disclosing reasons of delinquency from the view of the offender. In the first chapter I focused on basic terms such as what is criminology, criminality, and what defines an offender. In the second chapter I summarized the relevant criminological theories. The next chapter is about typologies of offenders. The fourth chapter, I pay attention to the term "personality", it's structure, term BASIC ID and the motivation of delinquency. The last chapter deals with juvenile criminality, which increased exponentially after the Velvet Revolution in 1989.

Cizojazyčné resumé This diploma thesis focuses on the method of psychological profiling of an offender. Psychological profiling, or simply profiling, is method aiming at an analysis of behavioural patterns of an offender which can be observed during crime investigation. The result of such analysis is a descriptive model of physical, psychological, and demographical features of the probable offender. Its purpose is to help the investigation of a crime mainly in the cases when the common criminological methods fail and there is little to no success shedding light on the crime - especially the criminal's identity. Profiling brings a new perspective and important information which could otherwise be overlooked by criminalists; a contribution that could lead to the crime being successfully solved. The thesis is divided into three chapters. The first chapter briefly explains the nature of psychological profiling and its place in the scientific field. The main topic of the theoretical part is radicalization and its process. Furthermore it is investigated why some individuals are threatened by radicalization more than others. The practical part analyzes the perpetrators of selected terrorist attacks. Typical characteristics that most attackers have are identified. Psychological profiling of multiple murderers Abstract In my diploma thesis, I would like to summarize the basic knowledge of psychological profiling, to find out whether there are certain generally established standards for profiling experts that entitles them to participate in criminal investigations. The subject of this diploma thesis is "The specificity of serial murders and their investigation". This diploma thesis focuses on the delimitation of serial murders, the typical way of committing serial murders, the criminalistic characterisation of serial killers as well as the methodology of such murders. The first chapter of the diploma thesis is dedicated to the definition of the term "serial murders" itself and simultaneously to the terms "mass and murderous wave". In the second chapter the aim is, primarily, to briefly analyse the legal classification of serial murders in the meaning of the Czech Criminal Code. This part of the diploma thesis also focuses on the differences between common murder, deliberate murder, murder with prior consideration and the typicalness of serial murders. The third chapter lays out different ways of committing serial murders from the view of preparatory action. The main focus of this thesis is to approach the issue of a criminal's (more specifically murderer's) personality, by means of forensic psychology. It is unfortunately not easy to explain why is one able to take another person's life. We on the other hand can gain a closer look to motivation and personal features, which can lead one to do so. The thesis focuses on knowledge of an official referee, which has been gain through a few recent years. The outcome data have been sorted out and eventually used to a criminal personality research. We've tried to map possible likeness of traits in behaviour, motivation and personal variables. A person's behaviour is, apart from the inner variables, influenced by outside factors as well. That is why this thesis pays attention to a broader area in a theoretical field of criminal engagement and criminal history. It offers a comprehensive picture of murder and factors, which influence it. Neverthless, the criminal and his personality remain the key factor. The aim of this work was to map the legislation of our strictest penalty clearly and to come up with comparison of this legislation and reality of the czech prisons using a questionnaire research. I have summoned my discoveries at the and of each chapter about the individual problem of the penalty of imprisonment and also in the closure od this work. There are five chapters in this diploma thesis. The first one is providing basics about the punishment of unconditional imprisonment and also about the purpose of this strictest penalty. I have chosen this topic because of my interest in criminal law in general. Two years ago I visited one of the largest prisons in the Czech Republic, the Valdice prison, which is situated only 20 km far from my hometown, Semily. I realized that unconditional imprisonment is a really interesting and complicated theme. The Czech prison system has recently suffered from particular problems and the aim of my thesis is to identify these problems and suggest solutions. My thesis is composed of five chapters. Chapter One is introductory and defines the basic term - sentence and its purpose. Chapter Two deals with relevant Czech legislation and consists of four parts. Part One focuses on the most important principles of imposing punishments, such as principle of legality, principle of subsidiarity, etc. Part Two analyzes the role of unconditional imprisonment in the sentencing structure.
