Analýza vývojových tendencí kriminality v Jihočeském kraji od doby zřízení vyšších územních samosprávných celků / Analysis of crime trends in South Bohemia since the establishment of higher territorial self-governing units

The thesis focuses on the analysis of trends in crime in the South Bohemian Region since the establishment of higher territorial units in terms of both theoretical and practical. The aim of this thesis was to map the evolution of crime in the South Bohemian Region in the last 14 years, and identify aspects that affect it. The theoretical part characterizes the basic concepts such as criminality, its concept, latent and registered crime or status, structure and dynamics within the crime. Further factors are defined, such as aspects influencing the development of crime, but also various types of crime, and not least the system of crime prevention. The second part of the theoretical section is aimed at defining the territorial division of the Czech Republic, and the specific characteristics of the South Bohemian Region. The practical part includes quantitative research, in which the technique of secondary data analysis was used, based on document analysis. Statistical data of the Police of the Czech Republic were selected for the research group, which were then further processed and used for the analysis of crime in the South Bohemian Region only, with an emphasis on the individually surveyed areas. Aspects influencing the development of crime have been identified and characterized in the theoretical part of their theoretical framework. The results have shown that crime did not increase by 10%, on contrary, it decreased by a total of 21.2% within the period under review. Furthermore, it was found that in each year of the investigated period, proportional representation of the various types of crime varies. The results showed biggest differences are represented in economic and violent crimes within the investigated period. The objective of my thesis has been met. I believe that the work can serve professionals to gain comprehensive information as well as study material concerning the development of crime in the South Bohemian Region .

Hospodářská kriminalita a její prevence / Economic crime and its prevention

The main purpose of this thesis is to define the term "economic criminality" and the terms related; the role of economic crime within the legal doctrine itself as well as in the Czech legal system over the course of time; determining the specifics of economic crime while stressing the role of the offender, efficiency of punishment, control and prevention of this type of crime. This thesis consists of four chapters. The first part is dedicated to the definition of crucial terms on the national and international level. I also described the legislative evolution of economic crime and the protection of possession in the Czech legal system. I listed economic crimes de lege lata, while at the same time remembering the crimes that do not fall under the economic crimes section per se. Later on, I comment on some particular attributes of economic criminality with special focus on the profile of the perpetrator which is rather atypical. This fact unfortunately makes the efforts of the law enforcement authorities so much more difficult and it complicates their work especially towards construction of the adequate preventive measures etc. I also dedicate one section to the topic of corporate criminal liability which has a strong connection to the economic crime. ABSTRACT In today´s world chicane becomes more pronounced term and is considered to be the most significant negative aspect of current school system. In addition unlike chicane in the past today is displays more alarming features. That includes in particular increasing number of chicane occurrence in schools, lower age of offenders and increased aggressivity and brutality of such behaviour. Chicane is a complex and cross-society problem. And it is defined as any behaviour with the intention to harm somebody repeatedly, threaten or intimidate other student or group of students. This intentional violence is focused on individuals or groups of students who don{\crq}t know how or cant defend themselves for whatever reason. It includes physical attacks in form of beating, extortion, robberies, damaging of property of others as well as verbal attacks in form of invectives, aspersions, assault or humiliation. It may also have the form of sexual harassment or even sexual abuse. Chicane occurs also indirectly as notable neglecting or ignoring of a student or students by the teacher or other group of students. Danger of chicane is based mainly on its severity, long term effect and related consequences for mental and physical health. These are the reasons why chicane must not be neglected and underestimated. The purpose of this diploma work is to map occurrence and severity of chicane in secondary vocational schools in Kroměříž district. In my opinion this objective has been achieved. The research objective was to prove or disprove the following hypothesis: H1: Chicane occurs in secondary vocational schools in Kroměříž district. H2: Most of chicane cases are not of severe character in secondary vocational schools in Kroměříž district. H3: Most of chicane offenders also display discipline problems. H4: Boys are more often chicane offenders than girls. The H1 hypothesis has been proved. 66 % of students in secondary vocational schools in Kroměříž ever experienced chicane and 21 % of students experience chicane in their current school. The H2 hypothesis has been proved. Chicane is not of severe character. The most common form of chicane is verbal attacks, humiliation and aspersions. The H3 hypothesis has been disproved. The research did not prove that chicane offenders also display discipline problems. The H4 hypothesis has been proved. The result of the research conclude that boys are more often chicane offenders, in 60% of cases. In addition the research pointed out the problem of chicane reporting and solving. Chicane often remains unreported or is reported but not addressed. As concerns the chicane abatement issue in secondary schools, also 8 % of students is of the opinion that their school effectively addresses chicane and less than 61 % of student does not even know if their schools are addressing this problem at all. Therefore I would recommend to schools to pay more attention to communication with students about this socially pathological problem and take preventive measures.

This thesis deals with the crime of dangerous stalking under s. 354 of the Criminal Code and also with the phenomenon called stalking, which is directly linked with the merits. In introduction of the thesis is described a relationships between the concepts - crime of dangerous stalking and stalking. The thesis is composed of three large chapters - first chapter is focused on stalking from psychological viewpoint, another chapter deals with a legislation of the crime of dangerous stalking in the Czech republic and in the last part are outlined the problematic aspects related to this crime and reasoning de lege ferenda. First chapter starts with a short description of history of stalking and includes mentioning of the first cases for introduction the antistalking legislation. Than a significant part of thesis deals with perpetrators of stalking, especially with the types of perpetrators, which were been created over the whole period of time and characteristics for each type of perpetrator. Another key part deals with victims of stalking from the psychological view and also from legal context of Victims of Crime Act, and also from context of Criminal Procedure Code from the viewpoint of the rights of the victims. (in English): This diploma thesis focuses on domestic violence from its history to the definitions of both a person in need and a violent person. It also describes legal tools of protection against domestic violence in the Czech Republic and its possiblities of help endangered persons as well as violent persons from the point of view of social work. The main topic is trans-generational violence in families which deals with these groups: children (descendants) versus parents, grandchildren versus grand-parents and last but not least great-grand parents versus their families. Describing what consequences of the transgenerational violence might have on every single member of family, victims themselves, offenders and their closest relationships. The practical part is based on mixed-research, especifically on surveys questionnaires of professionals from helping professions, who are concerned with the issues of transgenerational violence. The semi-structured questionnaires concentrate on possibilities of help of social work to victims and offenders. Moreover, motives, factors, services, prevention of transgenerational violence and domestic violence are emphasis.

The following thesis examines domestic violence against women, and information relating to it, for potential victims. It is divided into two main parts - theoretical and practical. The theoretical part includes seven main chapters, which gives answers to basic questions about the problems. It is aimed at a general description of domestic violence and those involved in it including the offenders, victims and children affected by it, who often get caught in between the offender and victim parents. Also covered are proposals of how to help these women and the institutions which offer help. Rudimentary legislation is examined, and its current implementation in the Czech republic, using data from recent research and statistics. The practical part seeks to establish the depth of awareness about domestic violence against women among potential victims, and to distinguish the differences experienced by women living in the countryside as compared to women living in city. To this end, there has been research carried out, the results of which, include valuable and new advice on how to improve awareness about domestic violence against women.

The theoretical part is firstly devoted to the notion of violence or similar terms synonymous to this and to explain them according to Czech and foreign authors. I have then proceeded to topics such as violence against children, adults and seniors, self-harm, suicide and the consequences of violence. In the practical section, I examined the perception of violence among students in primary school compared with students of the same age at a grammar school. I focused on the students of class sixth / ninth grade and first and fourth year of an eight-year grammar school). The survey was not only carried out in schools in the capital city but also in a smaller town.

This dissertation focuses on issues of domestic violence (also known as domestic abuse) against men. It looks into the issue why male victims are not taken seriously by the Czech police forces. Domestic violence against men is less common than domestic violence against women. However those males affected by domestic abuse often struggle to find support in society and in the Czech law. They are often left to deal with the problems on their own. In many cases male victims are not treated seriously by society and police forces. It is very important to highlight this issue in society and find support by the Czech government. Abuse against men should be taken as seriously as violence on female victims. The focus should be on early intervention and prevention.

The last section of the abstract part characterizes charitable care, Diocesan charity České Budějovice and its two projects which focus on help for home violence victims in South Bohemian region. Practical part of thesis examines the charakteristic of the provided services of charitable projects: Centre for women and young Women in nedd EVA and Support centre of crisis help for home violence victims.
