Violating the body’s envelope: the effects of violence and mutilation in four poems of Prudentius’ Peristephanon.

This thesis examines the violent punishments undergone by various martyrs in Prudentius’ Peristephanon. In particular, it explores how the poet’s depiction of this violence and suffering might affect readers of the collection. Four poems (poems II, III, IX and XI) are studied from the point of view of the emotions they are likely to evoke in the reader. The question of whether different types of readers might undergo different emotional experiences while reading these poems arises as a result of the proposed study. The first chapter of this thesis thus examines the nature of emotions, focussing on their sources and composition. This examination suggests that an individual’s emotional experience can be influenced both by biological factors and by social and cultural environment. With this in mind, an examination follows of various aspects of Roman society and culture which were likely to influence the ways in which its citizens, in particular, reacted to the violent scenes in the poems. We will also consider how our own specific cultural milieu may influence modern readers to sometimes react differently to Roman readers. In particular, it is proposed that most readers of the Peristephanon will react with varying shades of disgust and horror. These two emotions are thus used as a framework for discussing reader reactions to the poems. Disgust and horror are understood in a very broad sense, allowing for different varieties of these emotions, which at times even give rise to contradiction and paradox. The remaining chapters of the thesis are devoted to examinations of the four chosen poems which explore the various ways in which they might evoke horror and disgust among both Roman and modern readers. Often, there is considerable overlap between these two groups. The book "Knihy Jakubovy" by Olga Tokarzcuk tells us the fate of the self-proclaimed Jewish messiah Jakub Frank and his followers in 18th century Poland. Essas medidas tinham como objetivo influir também sobre a comunidade estrangeira instalada no país, e a partir de 1938 foram promulgados decretos especificamente elaborados para conter os possíveis problemas que o governo acreditava que o elemento estrangeiro poderia trazer. Dentre esses problemas a atuação política era ponto central. Neste período a comunidade italiana no Brasil sofria fortes influências do governo fascista, que desde a década de 1920 investia na propaganda do regime entre os súditos emigrados, a fim de elevar o seu prestígio internacional e assim conseguir também apoio para a implementação de seus projetos de governo. Para tanto, inventivou a organização de seus súditos através de associações dos mais diversos tipos, da imprensa e de outros meios. Os esforços de implementação dos projetos de ambos governos atingiram a comunidade italiana do estado de São Paulo. Em meados da década de 1930, quando as relações diplomáticas entre os dois países eram boas, os italianos aqui instalados conseguiram manter uma expressiva rede de associações de caráter étnico. Mas, à medida que as relações Brasil/Itália foram se desgastando, devido às disputas no cenário internacional, a situação dos italianos passou a ser menos favorável para a expressão de sentimentos nacionalistas e de pertencimento étnico, situação esta agravada pela entrada do Brasil na Segunda Guerra ao lado do bloco Aliado. Diante das medidas, os italianos de São Paulo vão procurar maneiras de reagir e se adaptar. These measures also aimed to better control the foreign community here installed, and from 1938 the government started publishing decrees especially prepared for dealing with problems that the government believed the foreigners were likely to bring. Among these problems, political activity was a central one. During that period the Italian community suffered the influence of the fascist government that had been investing in political propaganda targeting the emigrant community since the 1920?s, with the intention of elevating Italy?s international prestige and also gaining support for their project. In order to do that, they invested in the organization of their subjects through associations of all sorts, the press and other institutions. The efforts to implement both State projects affected the Italian community of São Paulo. In the mid 1930?s, when the diplomatic channels between both countries were open, the Italians here installed were able to maintain an expressive ethnic association network. But, with the tensions between both nations rising because of the international agenda, the conditions for the Italians to manifest their nationalist and ethnic sentiment of belonging got tougher, a situation aggravated by Brazil?s decision to join the Allies in World War II. Against Vargas's measures of foreign control, the Italian community of São Paulo sought ways to react and adapt. The setting of Brazil?s foreign control project, the police actions to run the project and the Italian community?s reaction have much to say about the intentions and political standings of the Brazilian State at the time and about its manners of dealing with the national society. This thesis focuses on political persecution as a reason for which international protection is granted. Firstly, it discusses what role persecution on political grounds has played in the past, and how the entitled person is provided with protection as a result. The following chapter assesses the way political persecution is included in the relevant international law norms, as well as European law norms, which are an important source of the legal regulation of granting international protection in the European Union. As an example of how Member States respect both international and European commitments in their national legislation, the thesis reveals the laws and regulations made applicable in the Czech Republic. The crux of this thesis centres around the interpretation of different terms which are crucial for granting international protection on political grounds. This is the imperative, determining factor of the decision-making process in individual cases. Chapter 4 compares the legal regulation of political persecution in two regional legal subsystems, European and Inter-American, and incorporating international and regional commitments in the national legislation on the American continent is demonstrated on the relevant US laws. This work examines the prosecution of the Roman Catholic Church in the Communist-ruled Czechoslovak Republic. The first part analyzes the mutual relationship of the communist ideology and the Roman Catholic Church. The basic tenets of communism are presented via the works of Karl Marx, Vladimir Ilyich Lenin and consecutive texts labeled Marxist- Leninist. The thoughts of the church are presented through the statements of several popes that took a stand against the ideals of communism and the atrocities committed in their name. The second chapter analyzes the individual steps the Communist-controlled state took against the church. Particular attention is devoted to the period from the February 1948 Communist takeover up to the end of the 1950s. This period can be further divided into three phases, distinguished by the differing tactics employed by the Communist Party. In the first phase, the Communists were attempting to subdue the church, the second phase was characteristic by very ruthless prosecution of the church officials, while the hallmark of the third phase was mainly a systematic policy of atheization. Gender persecution as a ground for asylum in South Africa and Canada: Reconceptualising a theoretical framework for assessing refugee claims by women

Doctor Legum - LLD / According to the United Nations High Commissioner for Refugees, women account for 48% of the refugees globally. "Persecution" is the central tenet in the refugee definition, but the ensuing jurisprudence was initially developed from the male experience. Therefore, the phallocentric nature of international and domestic refugee regimes mean that women's experiences of persecution are often marginalised, first, in their country of origin, and secondly, by the States from whom they seek refuge. Thus, the patriarchal conceptualisation of persecution exists in the content, interpretation and application of refugee law. The critical analysis of international refugee law, together with a comparative study between South Africa and Canada's refugee regimes, confirms that this conceptualisation impacts negatively on the manner in which gender-related asylum claims are assessed. This thesis argues for a reconceptualisation of refugee law through feminist scholarship, to investigate, question and expose the patriarchy residing in refugee laws and processes, and to theorise how gender-related persecution should be determined. Refugee jurisprudence has generally established that gender is socially constructed and based on sex which is biological and unchangeable The arrangement of sex and gender as immutable constructs enable the subordination of women, and within the refugee discourse, underpins gender related persecution specifically. Therefore, the reconceptualisation of sex and gender into malleable and dynamic concepts facilitates a paradigm for the protection of refugee women. The dominance theory and the deconstruction theory, together with feminist methods are used to conceptually explore the construction of sex and gender, recognising how the intersection with other identities, such as race and class, influence the understanding of sex and gender in refugee discourse. This thesis argues that the current construction of sex and gender together with the strategies that are increasingly used by governments to prevent refugees from crossing the borders, mean that asylum-seekers generally, and women, specifically are not receiving adequate protection. The xenophobic rhetoric of officials together with the enactment of restrictive refugee legislation, collectively result in South Africa and Canada creating and maintaining the illegal status of asylum-seekers.

Migration in general and the assessment of the need of protection concerning people from Afghanistan in particular, has in recent years risen on the migration agenda, especially after the Taliban regime's expanded control in the country. This thesis aims to investigate what guidelines that are in place for assessing female Afghan asylum seekers who applies for asylum in Sweden based on gender related persecution. Through a legal dogmatic analysis, three determinations from the Swedish Migration Agency and three determinations from three of Sweden's migration courts have been examined. The purpose has been to examine the guidelines of the determinations, analyze the values applied by the Swedish Migration Agency and the Migration Courts in the determinations, and whether the current application of the law is legally secure based on Frändberg and Von Essen's definition of legal security. The results show that there are shortcomings in the Swedish Migration Agency's as well as the Migration Courts' assessments, which is consistent with previous research. The results as well as previous research shows knowledge gaps about what requirements that should be expected from the applicants in terms of reliability, credibility, and evidence.
