Problematika ústavnosti regulačních poplatků ve zdravotnictví / The issues of the constitutionality of regulatory fees in health care

Goal of this thesis was to assess the constitutionality of "regulatory fees" in healthcare, which were enacted in the Czech Republic in 2007. The first chapter goes through the two decisions of the Czech Constitutional Court concerning assessment of the constitutionality of regulatory fees and identifies five main areas to study: 1)General methodology of human rights interpretation and their collisions in the Czech constitutional system, 2)Genesis and interpretation of social rights. 3)Identification of a test to assess collision between social rights and public goods 4)Essence of the right to free healthcare 5)Empirical assessment of the regulatory fees impact Second chapter is an overview of the first area divided into two sections: traditional methods of interpretation in constitutional law and development of the proportionality principle based on an overview of the Czech and foreign jurisprudence and the previous decisions of the Czech Constitutional Court. Third chapter describes the genesis of the social rights as a specific area of human rights. Implication from both chapters are combined to create a universal proportionality test that includes specific intensity of review for social rights. The authors' rights nowadays concern every individual. They significantly influence the performing artists, who use authors' works to make their living. This thesis analyses the specific impact of the Czech legal regulations on the professional musicians, describes the competences of the collecting societies, refers to the difficulties due to differences in the legal regulations on the international scale and defines musical theme as a new term in the legal context. The thesis proves the advantage of potential use of this term in both Czech and international courts practise.

The aim of my thesis is a detailed analysis of the state finances and treasury in Czechoslovakia during the years 1918 - 1945. If we look at the structure of my thesis, the exordium of my thesis is focused on the general concept of the state finances and after that because the state finances consist of several parts, the chapters are devoted to legal development of these several parts of state finances during the years 1918 - 1938. I mean the area of state budgets, taxes and fees, currency and monetary reform, the formation and activities of the bank of issue, as well as the banking and treasury. The legal development of these individual areas is closed with the chapter devoted to the economic crisis (during the years 1929/30 - 1934), the ways and means of its solution and with next period in history of our state, i.e. the period of rearmament. The second part of my thesis is devoted not only to the common development of all areas of state finances during the Nazi occupation of Czechia, but also to comparison this development with the development of the state finances in Slovak State. Regulační poplatky v systému českého zdravotnictví / Regulation Fees in the Czech Health Care System

A large part of the work has been devoted to regulation fees as one of the health care systems regulating mechanisms. An essential place in the work is taken by elaboration of the topic of increase of costs for the health care systems functioning in the current world and the possibilities of their solution. The work also deals with an extensive and frequently discussed topic of justice in the physician-patient relationship. This topic has been processed in connection with historical circumstances and a philosophical dimension of perception of justice in health care. Further to this, ideas and ideological foundations of justice, which project into political ideologies, have been dealt with. Health care systems, the system of health insurance in the Czech Republic and its legal regulation have been briefly characterized. The aim of the work was to map an opinion of some ordinary citizens regarding perception of justice in the Czech health care and introduction of the regulation fees. Partial goals were to find out in what way political orientation reflects in the opinion on justice of the collected regulation fees and furthermore to map, in what way an amount of income of respondents influences an opinion that regulation fees represent an income for a health care facility. Two hypotheses were determined. Hypothesis no. 1: University graduates understand better the system of regulation fees. Hypothesis no. 2: More than 80% or respondents consider it unjust that regulation fees represent an income of a physician, health care facility, or pharmacy. A method of questioning was used for the processing, data collection was carried out by using a questionnaire technique. Statistical methods suitable for an analysis of categorical data were used for evaluation of information. 300 questionnaires were handed out, the return rate being 74%, the final research population consisted in 182 respondents from the city of Votice. Another employed processing method was the secondary data analysis. Results of the questionnaire research brought a number of intriguing facts relating to attitudes of the respondents as to the issue of justice and state of the Czech health care. Further to this, it has been confirmed that university educated respondents understand better the system of regulation fees. In more than 65%, respondents consider it unjust that the proceeds from the regulation fees collection represent income of a health care facility. One of the hypothesis was confirmed and the other was disproved. The acquired information can be used as a guideline for public discussion.

The use of banking products is an integral part of business. For this reason, the theoretical part of the work focuses on the general description. It also highlights the benefits of optimization in this sphere. It also indicates the differences between Czech and European banks, which are most obvious in the bank charges. They discussed the impact of financial crisis, affecting in particular the availability of credit. Practical part of the work focuses on the comparison of products, namely the current accounts of domestic and foreign bank -- ČSOB and Deutsche Bank. The result of this analysis is greater partiality for the establishment of current account at a bank in the Czech Republic. In addition, bank products are analyzed, leading joint-stock company CZ LOKO, which are mentioned experience with their use. Subsequently, the company CZ LOKO recommended a new current account, which is based on the comparison of bids for five lesser-known banks. From this analysis came to establish a new account at a branch of Austrian Oberbank AG, based in the Czech Republic. Finally, carry out a survey on the use of banking products, which demonstrated that all of today's entrepreneurs, to a lesser or greater extent, using bank's services.

Bankovní poplatky - jejich determinanty a vliv na ziskovost a rizikovost bank / Bank fee and commission income - its determinants and impact on bank's profitability and risk

This thesis consists of five essays dealing with the fee and commission income in European banks from the macro, sector and bank level perspectives. This topic is of high relevance since fee income represents the largest part of the non-interest income of EU banks. The first part of the thesis deals with banks in general terms, while the second part is focused solely on cooperative banks, which represent approximately 20% of the EU banking sector. We compare the magnitude of the bank fee income across EU countries and study its determinants and impacts on banks' performance. The first essay compares the magnitude of the fee income across EU countries with a special emphasis on the Czech Republic from a macroeconomic perspective. First, we conclude that Czech banks are not abnormally dependent on fee income and their outstanding performance can be attributed to sound risk management, high liquidity and sufficient capital buffers rather than to excessive fees. Second, our evidence suggests that the share of fee income had an increasing trend in EU countries in recent years, which might be connected to the effort to maintain sufficient profitability in the low interest rates environment. Dissertation Thesis: Essays on Health Economics and Health Policy Author: PhDr. Jana Votápková Advisor: doc. PhDr. Martin Gregor, Ph.D. Academic year: 2019/2020 This dissertation thesis is a collection of three applied economics essays and a comprehensive discussion essay which includes policy recommendations resulting from the empirical essays included in this dissertation thesis, and other early work of the author. The topics analyzed were motivated by recent Czech healthcare reforms that address the recommendations raised by the OECD. Firstly, efficiency of Czech general hospitals is analyzed stressing the need for a well-functioning DRG system. Secondly, inpatient user charges which were introduced in 2008 and abolished shortly after, are analyzed as a tool which increases private participation in healthcare expenses and thus may boost healthcare efficiency both through additional resources and reduction of excess demand for healthcare services. Thirdly, personal savings, pre-retirement savings in particular, are viewed as another private source which could ease the tight public healthcare and pension budgets. It is shown that health status is a positive determinant for pre-retirement liquid savings, thus preventive health programs should be given a priority within the Czech healthcare system.
