Veřejnoprávní regulace obchodních praktik / Public regulation of business practices

The aim of this thesis is to examine the highly topical subject of regulation surrounding commercial practices. This examination is divided into four chapters. The first chapter looks at the notion of commercial practices by considering both the linguistic and legal definition of the term, and the importance of the regulation is proved. The second chapter deals with the question of division of law into its public and private counterparts. The discussion of the consequences of this division are crucial for a better analysis of the actual implementation of the EU Directive 2005/29/CE on unfair commercial practices. In the third chapter, the scope of application of this Directive is analysed and the main principles of regulation are described. The final section focuses on the Czech law on unfair commercial practices. In this segment, the text of the provisions of the Czech Code of Consumer Protection is compared to the Directive, and the system of legal redress and sanctions in the Code of Consumer Protection is critically analysed. The legal regulation of "promotional events", during which the ban of unfair commercial practices is often breached, is placed under scrutiny. Didaktické přístupy k výuce některých témat v matematice na základní škole v řeči učitelů / Didactic approaches to the teaching of some mathematical topics at the primary school in teachers ́ diskurse

The aim of the thesis was through a new analysis of interviews with teachers of mathematics, to describe didactic practices used by teachers while teaching selected topics (namely, proportions, linear equations, divisibility, percent, symmetry, Pythagorean theorem ) and compare them with the practices reported in textbooks and other literature. First, teaching methods, teaching forms and the mechanism of concept development by M. Hejný are given. Based on the analysis of more than thirty interview, it was found that teachers use the usual didactic practices but also create their own methods and procedures. These methods and techniques are provided for each critical issue separately in the fourth chapter of the thesis. Furthermore, the content analysis of selected textbooks is given for each topic. Identified practices of teachers which they use in their teaching practice, form the result of my work.

Next, I will try to make recommendations to public authorities and elderly how to prevent unfair trade practices. The main aim of my thesis is to identify various forms of consumer deception. These include misleading and aggressive practices that consumers encounter in everyday life and which often exceed limits of acceptability regulated by legislation. The thesis emphasises primarily advertising which strongly affects consumer decision-making for buying. Legal means of protection against deception are included in the thesis as well. The deception of consumers in German, Austrian and Spanish legislation is the topic of the final chapter. The thesis is supplemented with practical examples and judicial practice.

The intended work examines how the relationship between the unaccompanied migrants and the hosts is formed within foster care. Foster care could be defined as "long-term and repetitive contacts," where specific forms of relationship are negotiated between individual actors. I ask what activities and practices the actors make significant concerning the arrival, what ideas and imaginations on the part of the actors enter into the relationship, and how emotional rules are negotiated in a relationship. Last but not least, the work examines how the individual actors relate to the category of unaccompanied minors, that is, how this category, which has its legal definition, is negotiated. The aim of my thesis is to focus on issues of ethics in real estate operations and search optimal criteria for ethics in the real estate business. I mention ethical codes and their application and rationale at work of real estate agencies and professional associations. Furthermore I explore the real estate market in the Czech Republic in terms of ethics and I mention characteristics of ethically solid agencies, however I will also devote most common unfair practices within the real estate business and the current problems of the real estate market, which do not contribute to an ethical environment in business. Using the survey I examine thinking about ethics in the real estate business from two perspectives, namely from the perspective of the client, whether former, current or potential, and from the perspective of real estate agencies and brokers.

The project inspects and discusses improvements of the technical assistance of Change Management support within IT service provider. The primary objective of the procet is to analyse and implement a new software tool to display possible improvements. This project involves whole software development proces including requirements collection, systém analysis, design, implementation. In the first part, the IT service management, especially Change Management area and ITIL methodology is described. In the second part, the analysis of current state of the proces implementation and software tool is discussed and proposed opportunities for improvement. In the end, the results are summarized and possibilities of the future improvements are proposed.

ANOTATION The theoretical thesis should point out the development and transformation of power, its mutual relationships and social control, all through discourse analysis of political practice of corporate social responsibility (CSR). Except of other theoretical thinkers, for example later Nikolas Rose, Michel Foucault mostly contributed to these phenomenons. Because power is socially constructed phenomenon and it depends on particular context, we are going to follow development and transformation of power on the concept of CSR. Concept of CSR will give us the frame for this analysis and helps us to recognize moments in CSR practices where the Foucault's model of governing, the concept of power and knowledge, discursive and disciplination practices are present. Also Rose's concepts of market texhniques and rise of new subject and subjectivity. These terms help us to cover economical and market practices on the background of firm's social and enviromental responsibility. Čeněk Pýcha History in public space: Changes of institutions of memory Abstract The submitted dissertation project is based on a longer research interest in memory and remembering. Interdisciplinary memory studies is one of the most dynamically developing subdisciplines in the social sciences and humanities. The aim of this work is to contribute to the ongoing academic discussion and to explore some environments of making sense of the past, which so far stood rather on the periphery of research interests. The research field of this project is defined by the questioning of transformations of memory institutions. I observe this change primarily on the trajectory of movement from grand institutions of memory to small ones. As the grand institutions of memory, I understand the traditional institutions of the interpretation of the past that were born in the modernization process. In this dissertation project, I focus mainly on institutions of heritage preservation and museums. With the partial disintegration of grand collective frameworks, these institutions are divided into small institutions. I study this movement in case studies on contemporary cultural practices of remembrance in new memory ecologies. Thesis Selected aspects of the production of embodiment in tv commercials works with an assumption that some tv commercials represent specific modality of discursive mechanisms of sexual representation. This thesis applies the works of M. Foucault and P. Bourdieu to semiotic analysis of chosen advertisements. Assuming that advertisements are using body and sexual motives as one of the instruments of power to affect the target groups. Main focus of this thesis is in introduction of discursive models that are used in advertising. Goal of the theoretical part is to introduce philosophical and sociological ideas and theories relating to perception of physicality, sexuality, power relations and question of subjectivism. The thesis also shows how the role of a body was perceived in different historicals eras and how the ways of use of body and embodiment has gradually developed in terms of power affection. Goal of the practical part is to analyze and interpret the acknowledgments from theoretical part on concrete examples.
