Zima, Martin January 2013 (has links)
The thesis analyzes the possibilities of application of the fictional worlds theory as a possible basis for a different literary-theoretical approach to the study of literary texts. Not being a mere literature research, the thesis inquires into issues which are necessarily connected with the fictional worlds theory and which have been so far rarely dealt with, if discussed at all. It contributes to the discussion on advantages and drawbacks of the mimetic approach and of the fiction theory, it analyzes the possible applicability of the fictional worlds theory in literary history, it attempts to determine the correlation between the Seymour Chatman's textual types and the fiction theory nomenclature, and last but not least the thesis deals with the possibilities of this theory in the fictional worlds of lyrical poetry. Hrušáková, Denisa January 2013 (has links)
This thesis discusses the alternatives to unsuspected sentence of imprisonment, as only they can in the long run solve an acute and currently very topical problem of the prison overcrowding. The aim of this thesis was firstly the theoretical definition of alternatives to unsuspected sentence of imprisonment with regard to the Czech legislation and, secondly, an analysis of alternatives that Czech law provides. The introductory part focuses on the importance of alternative punishments in the system of sanctioning institutions. The thesis is divided into two main chapters with regard to the two objectives it focuses on. The first chapter, dealing with the definition of "alternatives to unconditional sentence of imprisonment", is divided into four subchapters. The first subchapter, on the background of the current concept of alternatives available in the Czech doctrinal environment, seeks a theoretical definition through the criteria on the basis of which it is possible to consider a specific institute as such an alternative. The second subchapter explains the preference for alternatives to unsuspended sentence of imprisonment. The third subchapter is devoted to the development of Czech criminal policy towards alternative punishments. Subsequently, in the fourth subchapter, the author explains contemporary...

Prokůpková, Věra January 2017 (has links)
Legal, accounting and tax aspects of transformations of companies. The presented dissertation focuses on transformation of companies. The work provides the accounting, tax and legal perspective of company transformations with the goal of interconnecting these perspectives and providing the reader with a deeper insight into company transformations. The accounting perspective is often directly connected to the tax perspective. The individual forms of transformation are discussed in the work, including their graphic model-showcasing, followed by individual basic company transformation elements and institutions related to company transformations. The individual elements are also put into historical context. Basic principles affecting company transformations and their impact primarily on the tax area are discussed within the individual views of transformation. The individual elements, institutions and principles are further examined first separately in general and then with regard to their interrelations and ways they affect one another. To conclude, a step by step scenario of one of the forms of transformation, namely split, is provided.

Problematika převodních cen / Issues of transfer pricing

Drobová, Barbora January 2018 (has links)
ISSUES OF TRANSFER PRICING Transfer pricing is a very discussed topic of recent years, both by tax subjects, tax advisors as well as by tax administrations. This is due to activities of OECD and the European Union in this area, as well as due to increase in number of tax audits focusing on transfer pricing. The key documents are rules issued by OECD in the form of the Transfer Pricing Guidelines for Multinational Enterprises and Tax Administrations, which is being constantly revised and supplemented, the latest revision being issued in 2017. In the narrower terms, transfer pricing may be defined as prices for transactions between connected (related) parties. In broad terms, transfer pricing may be defined as any and all transactions between connected (related) parties including in particular transfer of goods, providing of services, transfer and other transactions concerning intangibles, cost contribution arrangements and business restructurings, as well as related tax administrations procedures when deciding on tax duty in connection with the transactions performed between the related parties and the transfer pricing documentation. In the first and second part of this thesis I am outlining the historical progress in activities of OECD in the area of transfer pricing since the first report issued...

Analýza funkcí lidské důstojnosti v ústavním právu se zaměřením na judikaturu Ústavního soudu České republiky / An Analysis of Functions of Human Dignity in Constitutional Law with Focus on Case Law of Czech Constitutional Court

Horák, Filip January 2018 (has links)
After the concept of human dignity has spread into a large number of constitutions from all over the world, detailed examination of this phenomenon is steadily gaining importance. This thesis finds three autonomous approaches to human dignity in constitutional law, namely a subjective human right, the source of human rights and an objective constitutional value. Each of these approaches is based on a particular historical view on human dignity. The key argument of this thesis states that the connection of the three aforementioned legitimate approaches leads to the creation of dangerous and undesirable hybrid forms of human dignity. These forms tend to be axiomatic, preventing from the rational legal argumentation as well as from the use of the proportionality principle. The implementation of the concept of human dignity in such an axiomatic way is an argumentative foul, unfortunately so frequently made by both judiciary and doctrines. The thesis further focuses on the examination of the axiomatic human dignity phenomenon with respect to the Constitutional Court of the Czech Republic decision-making specifically. Using quantitative methods, it first comes to the conclusion that the problem of axiomatic human dignity-related argumentation does not only exist in the Constitutional Court's...

Imlaufová, Markéta January 2019 (has links)
This master thesis deals with the topic of temptation in three Czech Theatrical Dramas of the 1970's and 1980's, inspired by the legend of Faust. These dramatic works represent different model approaches of dealing with such a topic. Thesis focuses on the principle of evil and its functioning. The temptation by Devil is therefore defined as Mephistophelian seduction, which occurs in drama plays selected as a subject of this thesis. The thesis analyzes and describes Mephistophelian seduction and its realization in theatrical dramas. Thesis elaborates the mechanism of evil principle and examines how the main protagonists are influenced in their acting and behaviour by this power. This thesis brings the power of evil into the wider context of "higher power" and describes relations between the power of evil and totalitarian power. On this base the historical and political context of the lives of the authors is considered as an important element. Based on comparison of all these aspects the principle of Mephistophelian seduction is reflected within its existential dimension.
