A investigação é desenvolvida através de dois movimentos, considerando como ponto zero o ano de 1978 e os eventos consagrados na literatura como fundantes do movimento homossexual brasileiro, isto é, a constituição do grupo Somos/SP e a edição do jornal Lampião da Esquina. Um, em direção ao passado, até o ponto mais remoto cujo registro foi possível conhecer, onde se verifique a vocalização da demanda por uma vida livre do preconceito e da discriminação. O outro, em direção ao futuro, trata da sua constituição e trajetória, privilegiando suas lutas nos espaços normativos, tendo como marco final a participação no processo constituinte. O objetivo é compreender como se deram tais vocalizações e disputas. Na medida em que essa trajetória é atravessada pela pandemia da aids, que por suas conseqüências termina por impor o privilegiamento do campo jurídico como espaço de reconhecimento, o objetivo adicional é verificar quais as representações da homossexualidade de que são portadores os diversos agentes do campo nesse período. O que termina por fazer surgir uma problemática adicional, que consiste em verificar a validade e o alcance da tríplice retórica que estrutura esse campo (universalidade, impessoalidade e neutralidade), explicitada por meio de princípios ou axiomas, como o da isonomia jurídica (“todos são iguais perante a lei”), da presunção da inocência (“todos são inocentes até prova em contrário”, “in dúbio pro reo”) etc. em relação a agentes tidos como desqualificados. Para cumprimento dessa problemática suplementar será examinado o processo criminal movido contra um dos editores do jornal Lampião da Esquina, em 1981, no Rio de Janeiro, em razão de sua representatividade. / Understanding the struggles of homosexuals as disputes of representation, within the framework of cultural history, through the contributions of Roger Chartier and social structures theory of Pierre Bourdieu, I analyze the input of transvestites, dolls, fags, gay and lesbians in the Brazilian policy scene, claiming the right to live free from discrimination. The research is developed through two movements, considering the zero point of 1978 and the events established in the literature as founding the Brazilian homosexual movement, ie the foundation of the group Somos/SP and the editing of a newspaper called Lampião da Esquina. The first one, focuses in the past, to the farthest point which record was possible to be known, where there can be found a demand for a vocalization of a life free of prejudice and discrimination. The second one, directed towards the future, deals with their formation and trajectory, focusing on their struggles among normative spaces, having as the final milestone their participation in the constitutional process. The goal is to understand how did such vocalizations and disputes take place. As this path is crossed by the HIV pandemic, which ends up imposing ots consequences privileging the legal field as a space of recognition, the additional goal is to verify which are the representations of homosexuality that are carried out by different actors of the field in this period. This procedure ends up arising and additional problematic, which consists in verifying the validity and the scope of the rhetoric that structures this field (universality, impartiality and neutrality), explained through principles or axioms, such as the legal equality (“all are equal before the law”), the presumption of innocence (“everyone is innocent until proven guilty”, in dubio pro reo) etc. regarding agents taken as disqualified. To fulfill this additional issue, there will be examined criminal prosecution brought against one of the editors of the newspaper Lampião da Esquina, in 1981, in Rio de Janeiro, because of its representativeness.
