The invisibles : an examination of refugee resettlement

Resettlement is one of three durable solutions, which the United Nations High Commissioner for Refugees (UNHCR) uses to achieve refugee rotection. Refugees are assumed to locally integrate, voluntarily repatriate or resettle. Too many of the world's refugees, however, are left to linger in non-durable conditions in countries of first asylum that are often only minimally safer than the countries they have fled. Where neither local integration nor repatriation is possible, resettlement is the only option. Resettlement requires a third country to be willing to accept refugees into its territory. While signatory states to the 1951 Convention relating to the Status of Refugees (1951 Convention) are obliged not to refoule asylum seekers at their borders, they have not committed to accept refugees for resettlement. By geographic distance, presumptions of safety, and a lack of legal obligations, those refugees who fail to make it to the frontiers of safe states are simply not seen. These refugees remain so far removed in a vague, far-off realm that they are rendered invisible. Their invisibility is reflected in the 1951 Convention's silence on obligations to them, the dearth of academic examination of resettlement, and media and government attention only in the celebratory act of making a small number of such refugees visible and legal, through the act of bringing them within a protective state's borders. Despite their invisibility, the protection needs of those refugees left outside the borders of safe states remains. The goals of this thesis are therefore to create visibility and increase resettlement. Resettlement is examined from its theoretical motivations, historical origins, current manipulations, and future possibilities - both generally and through an examination of the Canadian scheme. The thesis closes with recommendations for resettlement reform. They are targeted at UNHCR, the international community, national governments, and Canada in particular. For resettlement to offer a fair mode of protection a comprehensive and global model of resettlement must be designed and, ultimately, implemented. / Law, Peter A. Allard School of / Graduate

Este projeto de mestrado apresenta uma visão de como áreas da Ciência da Computação relacionadas a desempenho (Avaliação de Desempenho, Engenharia de Desempenho de Software e Teste de Desempenho de Software) podem ser relacionas e também propõe uma metodologia de análise de desempenho que contém conceitos das áreas anteriormente apontadas, para que esta seja mais completa e possa ser compreendida por profissionais das três áreas. Para formalizar esse relacionamento, foi construída uma ontologia que mostra como ocorre a correlação entre as áreas, e a partir dessa metodologia proposta, foi possível analisar o desempenho da ferramenta ValiPar, em sua versão paralela e concluir que o principal gargalo com relação a escalabilidade dela é sua porção executada sequencialmente. Por fim, foi observado que a metodologia apresenta vantagens se comparada as demais, como uma formalização nas suas etapas de análise. / This master project presents a view of how Computers Science areas related to performance (Performance Evaluation, Software Performance Engineering and Software Performance Testing) can be related and also proposes a performance analysis methodology that contains concepts from all areas previously identified, so that it is more complete and can be understood by professionals of these three areas. To formalize this relationship, an ontology that shows how the correlation occurs between areas was built. And from the proposed methodology, it was possible to analyze the performance of ValiPar tool, in its parallel version, and it was concluded that the main bottleneck with respect to its scalability is its portion executed sequentially. Finally, it was observed that the proposed methodology has advantages compared to others, as a formalization in its analysis steps.

The No-fault dissolution of marriage act in Oregon: a study of its effect on selected factors

In October of 1972, the Dissolution of Marriage Act (hereinafter referred to as the Act) became a part of the law and judicial practice of the state of Oregon. The Act represents a significant change in Oregon's law. It also represents a significant evolutionary development in the 'attitude of the legal community toward the process of divorce or as it is now termed, dissolution of marriage. The Act was a response to extensive criticism from professionals and from the public. The problem is the legislators were not sure of the effects of the Act and now that it is in effect there is still little or no objective data regarding its effectiveness. This study is an exploratory attempt to evaluate the consequences of the Act, the accomplishment of its stated purposes and its impact upon the process of dissolution and the people involved.

A Cost-Benefit Analysis of the Implementation of Texas House Bill 72 in Selected Texas Public School Districts

This study was conducted to analyze the effect of implementation of Texas House Bill 72 on budgets of selected Texas public school districts and to ascertain educational benefits to students derived from implementation of the bill as perceived by superintendents. Questionnaires were sent to superintendents of the Region 10 Education Service Center to determine perceived educational benefits to students. A demographic data sheet provided information for classifying respondents by educational experience, superintendent experience, and district enrollment classifications. Sixty-two districts responded. Official public school budget data for each district were analyzed for fiscal years 1983 through 1986 as were data from the questionnaire. Overall statistical information was gleaned through CONDESCRIPTIVE. Mean total expenditures, mean total tax rate, and state fiscal aid data were compiled, tabulated, and reported for each enrollment classification and entire sample. In addition, a t-test between the difference of two independent means at a probability level of .05 was applied. The two independent means were the averages of data for the two years prior to and after implementation of the law for expenditures, tax rates, and state fiscal contributions. Data comparing local and state expenditures were compiled, tabulated, and reported for each group to compare local and state fiscal effort prior to and after implementation. One-way analysis of variance was used to compare demographic variables with perceived educational benefits. Item and factor analyses were applied to establish reliability.

Refugee definition in international law The definition of the term "refugee" in international law is a very wide issue which can be conceived from many different points of view. One of the best ways how to deal with it is to focus on only one part of the generally most widely accepted definition of a refugee. This is the definition according to the 1951 Geneva Convention relating to the Status of Refugees. According to this document a refugee is a person who "owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group, or political opinion, is outside the country of his nationality, and is unable to or, owing to such fear, is unwilling to avail himself of the protection of that country..." This definition is more than fifty years old and still actual. It has been adopted in response to the Second World War and the mass refugee flood. The missing interpretation of the term "persecution", which is the fundamental element of the Geneva Convention refugee definition, is still one of the biggest problems of refugee law. Resumé Práce zkoumá definici uprchlíka a její výklad a aplikaci v současném mezinárodním právu. Vymezení zpracovávané látky je dáno smluvním instrumentem z roku 1951, kterým státy přijaly definici uprchlíka, Úmluvou o právním postavení uprchlíků. Zkoumána je zahrnující část definice, která říká, kdo je uprchlíkem. Za něj považujeme osobu, která (...) "se nachází mimo svou vlast a má oprávněné obavy před pronásledováním z důvodů rasových, náboženských nebo národnostních nebo z důvodů příslušnosti k určitým společenským vrstvám nebo i zastávání určitých politických názorů, je neschopna přijmout, nebo vzhledem ke shora uvedeným obavám, odmítá ochranu své vlasti (...)". Disertační práce pracuje s následujícími hypotézami: 1) došlo k posunu ve výkladu a aplikaci definice uprchlíka. Zde je zároveň sledováno, zda došlo k vytvoření nové obyčejové definice a jaký je případně její obsah; 2) došlo ke vzniku regionální obyčejové definice - a zde je opět brán zřetel na to, jaký je případně její obsah; a 3) restriktivní praxe států před a při vstupu cizince na území ovlivňují výklad a aplikaci definice uprchlíka. Os resultados em avaliações externas apontam para um cenário preocupante no que se refere ao ensino de matemática, especialmente no que tange os números relativos. Dessa forma, o objetivo desse trabalho é analisar o processo de ensinoaprendizagem e avaliar a eficiência de um jogo matemático como recurso de intervenção pedagógica, em relação ao conteúdo dos números relativos e em três cenários distintos no Ensino Fundamental, ambos em turmas regulares de ensino: a preconização de conteúdos (5º ano), parte da grade curricular (7º ano) e revisão de conteúdos não assimilados (8º ano). A proposta de usar o jogo matemático parte da necessidade de romper com o ensino tradicional que ainda é praticado nas escolas brasileiras, pois esse tipo de prática não consegue alavancar resultados satisfatórios. Pretendemos apresentar uma forma diferente da tradicional, onde o aluno seja construtor do conhecimento e participante ativo do seu aprendizado de uma forma a favorecer também as interações sociais e o trabalho em equipe. O trabalho visa além de apresentar resultados de aplicações de um jogo com alunos regulares de uma escola pública, referenciar as diversas facetas dos jogos sob a luz da bibliografia analisada e apresentar uma possibilidade real e aplicável de um recurso pedagógico eficiente para ensino de matemática. / The results of external evaluations point to a worrying scenario with regard to teaching Mathematics, especially regarding the figures. Thus, the aim of this study is to analyze the applicability and efficiency of a mathematical game as a pedagogical intervention resource in the content of the figures and in three different scenarios in elementary school, both in regular classes teaching: the preconization content (5th year), part of the curriculum (7th grade) and review of unassimilated content (8th year). The proposal to use the mathematical game arises from the need to step aside from the traditional teaching that is still practiced in Brazilian schools, as this practice does not produce satisfactory results. We intend to present a practice that differs from the traditional, in which the student is builder of knowledge and active participant in their learning aiming to promote social interaction and teamwork. The work aims, in addition to presenting results of applications with regular students of a public school, to show the many facets of the game in the light of theoretical analysis and present a real and applicable possibility of an effective pedagogical tool for teaching mathematics.
