This diploma thesis presents a comprehensive overview of the issue of land valuation for expropriation. The work includes a comparison of the frequency of the process of expropriation and the variance amount of compensation for expropriation in the Czech Republic and Austria. They were approached by employees of institutions that deal with the subject of this work. There was a consultation with ŘSD, Ministry for Regional Development, the Department of expropriation office, torts and state supervision in the České Budějovice, and others. The territory of Austria were approached eg. company employees Asfinag. In chapter Results are placed proposals improvement measures that can assist in potential future adjustment problems being solved.

This dissertation examines the role and position of Jewish women in the Near East between 200 BCE - 200 CE. This was a very important period in Jewish legal and cultural history. The redaction of the Mishnah, the oldest extant body of Jewish law, was completed at approximately the end of the time under review, and was to have a lasting influence on the Jewish people. No society exists in a vacuum. During these years the Jews lived within the GraecoRoman Empire and this reflected on their attitudes towards women. To appreciate this it has been necessary to go back in time to the Hebrew Bible and to trace any attitudinal changes which occurred over the centuries. Although the Mishnah has been regarded as the terminus ad quem of this investigation, brief mention is also made of prevailing attitudes affecting women in present day Jewish society. / Biblical and Ancient Studies / M.A. (Judaica)

The royal commission on espionage 1946-1948: a case study in the mobilization of the Canadian Civil Liberties Movement

There exists, at this time, surprisingly little historiography on how civil liberties were shaped and developed in practice throughout Canadian history. An examination of the 1946 Royal Commission on Espionage offers several insights into the nature of the immediate post-World War Two civil liberties movement. The commission was formed in response to the defection of a Russian cipher clerk, Igor Gouzenko, in late 1945. The commission investigated the existence of a Russian-led spy ring that had recruited several Canadian civil servants into disclosing secret information. The commission is unique in Canadian history; dominantly due to the fact that it was empowered under the War Measures Act which granted it enormous powers. Everything from a citizen's right to counsel, habeas corpus, protection from state coercion and the right to a fair trial were circumvented. This work attempts to offer a few answers to some important questions about Canadian civil liberties. What were to consequences of the commission's actions? Does Canadian society accept the need to allow a government to violate individual liberties to protect the integrity of the state? Furthermore, the following article will examine the nature of the civil liberties movement following WWII, including the role of the media and civil liberties' organizations in increasing awareness of the vulnerability of individual rights from state abuse. The purpose of this work is to demonstrate the enormous potential in which Parliament could act independently in re-defining Canadians' civil liberties while at the same time demonstrating the central role the Royal Commission on Espionage played in stimulating the post-WWII civil liberties movement. The Royal Commission on Espionage is only one black spot in the history of Canadian civil liberties but there remain many questions to be asked about Canadians' willingness to trust and accept that dictates of the state. / Arts, Faculty of / History, Department of / Graduate

Le Traité pour l'Harmonisation en Afrique du droit des affaires a été signé à Port Louis (ÎleMaurice), le 17 octobre 1993 et, entré en vigueur le 18 septembre 1998. Il a été modifié par le Traité deQuébec en date du 17 octobre 2008. Ce traité révisé est entré en vigueur le 21 mars 2010. Il a pour principalobjectif de remédier à l'insécurité juridique et judiciaire existant dans les États parties. Pour ce faire, il aadopté neuf Actes uniformes dont l'Acte uniforme relatif au droit commercial général, ci-après l'AUDCG quifait l'objet de notre étude.Le Traité OHADA a également institué une Cour commune de justice et d'arbitragechargée de l'interprétation et de l'application uniformes desdits actes. L'AUDCG a été adopté le 17 avril 1997et est entré en vigueur le 1er janvier 1998. Il a été modifié le 15 décembre 2010 et publié au Journal Officielde l'OHADA, le 15 février 2011. Il est entré en vigueur le 15 mai 2011.Il est applicable de la même façondans tous les États contractants. L'existence d'un tel corpus de règles permet de réduire l'importance du fordans la résolution des litiges internationaux et de limiter la nécessité de recourir aux règles de conflits quigénèrent une certaine insécurité juridique. C’est la raison pour laquelle le droit OHADA de manière généraleet l'AUDCG en particulier ne se préoccupe pas ou peu des conflits de lois. Pourtant,les conflits de loissubsistent dans l’espace OHADA. D’une part, l'AUDCG laisse subsister les dispositions du droit national dumoment qu'elles ne lui sont pas contraires.L'AUDCG peut également faire l'objet de divergencesd'interprétations par les juridictions nationales qui sont les juridictions de droit commun du droitharmonisé.Tout conflit d'interprétation est un conflit de lois. D'autre part, l'AUDCG s'insère dans un contextenormatif international caractérisé par une profusion de règles matérielles sous-régionales telles que l'UnionÉconomique et Monétaire de l'Afrique de l'Ouest (UEMOA),la Communauté Économique des États del'Afrique de l'Ouest (CEDEAO), la Communauté Économique et Monétaire de l'Afrique Centrale(CEMAC)et internationales de droit matériel tels que la CVIM, le Protocole du 11 avril 1980 et la Convention de New-York du 14 juin 1974 relatifs à la prescription en matière de vente internationale de marchandises, laConvention de Genève sur la représentation en matière de vente internationale de marchandises. De cetteimbrication de règles de droit naissent des conflits. Il persiste donc dans l'AUDCG des conflits de lois et desconflits de normes supranationales.La présente thèse a pour but d'étudier ces conflits ainsi que les principes de solutions qu'il convient d'yappliquer à travers les règles de conflit de lois, les Principes d'Unidroit, la loi d'autonomie, l'arbitrage. / The Treaty for Business Law in Africa Harmonization was signed in Port Louis (Mauritius ) ,October 17, 1993 and entered into force on 18 September 1998. It was amended by the Treaty of Quebec on17 October 2008. This revised treaty entered into force March 21, 2010. The treaty 's main objective is toaddress the legal uncertainty and judicial existing in States parties . To do this , it adopted new Uniform Actsincluding the Uniform Act relating to general commercial law, following the AUDCG which is the subject ofour study. The OHADA Treaty has also established a Joint Court of Justice and Arbitration responsible forthe interpretation and uniform application of those acts .The AUDCG was adopted April 17, 1997 and entered into force on 1 January 1998. It was amendedDecember 15, 2010 and published in the Official Gazette of OHADA , February 15 , 2011. It entered intoforce on 15 May 2011. It is applicable in the same way in all Contracting States. The existence of such a setof rules to reduce the importance of the forum in the resolution of international disputes and reduce the needto resort to conflict rules that generate legal uncertainty. That is why OHADA law so general and especiallyAUDCG does not care or whatever conflict of laws.Yet the conflict of laws remain in OHADA . First, the AUDCG leaves the provisions of national law as longas they are not contrary to it. The AUDCG may also be subject to differing interpretations by national courtswhich are the ordinary courts of harmonized law.Furthermore, the AUDCG is part of an international legislative context involving a wealth of substantiverules subregional such as West Africa 's Economic and Monetary Union (UEMOA) , the EconomicCommunity of States of West Africa (ECOWAS ) , the Economic and Monetary Community of CentralAfrica (CEMAC) and the Economic Community of Central African States and international substantive lawsuch as the CISG , Protocol of 11 April 1980 and the New York Convention of 14 June 1974 relating to thelimitation period in the international sale of goods .This interweaving of law born of conflict. So AUDCG persists in the conflict of laws and conflict ofsupranational norms .This thesis aims to investigate these conflicts as well as the principles of solutions that these should beapplied through the conflict of laws rules , the UNIDROIT Principles of the law of autonomy, arbitration.

Individual psychodynamic development : the Imago relationship approach in organisational context

Imago relationship therapy was originally applied to couples counselling by Dr Hendrix (1992, 1993). This model was applied to a group of senior managers from the Lonmin Platinum Mine to create an understanding of intrapersonal and interpersonal dynamics to reduce the conflict levels they experienced in the workplace. Imago theory is applicable to the workplace because of the influence of intrapersonal processes on interpersonal dynamics, which is the same influence that causes conflict in romantic relationships. Love relationships consist of three stages, namely romantic love, the power struggle stage, and the real love stage. In the organisational context, these stages are the initial excitement phase, the power struggle stage, and the conscious relating stage. The study aimed to obtain quantitative and qualitative data on the effects of the Imago theory programme presented to the group of managers. The study thus aimed to determine whether the managers experienced a shift in their consciousness after the programme had been presented. Furthermore, the study aimed to determine whether such a shift in consciousness would have an effect on the individuals’ overall emotional wellbeing and if it would increase their overall life satisfaction. Furthermore, the study investigates if the programme had a positive effect on their interpersonal relationships (particularly with their subordinates). Twenty-two senior managers and 22 subordinates participated in the study. Certain pre-tests were conducted, followed by the seven-module intervention. The same post-tests were conducted after the training had taken place. Quantitative and qualitative results were obtained. The quantitative results showed that the participants’ problem solving abilities improved and that they experienced marginally higher levels of life satisfaction. The reactivity levels experienced by the participants during conflict situations decreased, and their levels of marital satisfaction improved. The results also showed that the managers responded more positively to their subordinates after the intervention. Furthermore, the subordinates experienced their managers as being more flexible after the intervention. The qualitative results indicated that a shift in consciousness did take place as envisaged. The group understood both intrapersonal and interpersonal psychodynamics. They also willingly applied Imago concepts to improve their functioning in the organisational context. / Psychology / D. This thesis is a biographical study of Erika Theron (1907-1990), an Afrikaner woman who played a significant role in many aspects of public life in South Africa in a critical time in the country‘s history. The study seeks to give recognition to her achievements, which have received scant attention in a historiography with a masculine bias. At the same time it examines her changing role from collaborator to critic of the apartheid system. Certain defining features of Theron‘s life have been highlighted. First, Theron grew up in a staunchly Afrikaner nationalist, service-oriented family which encouraged loyalty to her own people and civic responsibility. Second, she was unusual among Afrikaner women of her generation, in that she was highly educated, independent and ready to assume leadership roles. She became a pioneer in a number of fields, attaining high professional rank and holding important public offices – frequently as the first woman to do so in the country. The thesis focuses on five areas of Theron‘s public life. After returning from post-graduate studies abroad, she worked with Hendrik Verwoerd in the campaign to uplift poor whites, particularly the rehabilitation and re-integration of the Afrikaner poor. She thereafter commenced a long career as a social work academic, which included a number of milestones for her new discipline, for the profession of social work and for the advancement of women in academia. From the 1950s she served on the town council of Stellenbosch, including terms as deputy mayor and mayor. She played an important role in historic conservation but was also instrumental in the rigorous institution of apartheid structures in the town during the early days of National Party rule. In the early 1970s she served as chairman of the Commission of Enquiry into Coloured Affairs which influenced her personal views on the country‘s race policies. Dissertation / This study explores the role of the principal in the management of parent involvement in secondary schools in Northern Province. A literature study investigated existing theories and models of parent involvement; parent involvement in the South African context and the provision of education in South Africa in historical perspective. It also investigated the managerial role of the principal in parent involvement. A qualitative investigation in three secondary schools in Northern Province was done. Data were gathered by means of participant observation in-depth interviews with principals and focus-group interviews with teachers and three parents on the school governing bodies. Analysed data revealed the following findings: principals lack knowledge on parent involvement and schools lack policies and organisational structures dealing with parent involvement as well as home-school relations. As a result of these findings, there is a need to equip principals with ways in which they can involve parents in their schools. / Educational Leadership and Management / M. Ed.
