L'amélioration de l'application et de l'interprétation uniformes des conventions internationales relatives au contrat de transport : le cas de la faute qualifiée / Improving the uniform application and interpretation of international conventions on the contract of carriage : the case of qualified misconduct

Les conventions internationales de droit uniforme du commerce international ont pour but d'adopter un ensemble de règles qui soient communes et directement applicables aux rapports juridiques existant entre les différentes parties à un contrat commercial international. L'uniformité de ces conventions peut cependant être rompue en raison d'interprétations divergentes dont certaines de leurs dispositions font l'objet de la part des différents juges nationaux. C'est en particulier le cas des dispositions relatives à la faute qualifiée dans les conventions internationales de droit uniforme relatives au contrat de transport. Pour réduire les divergences d'interprétation en ce domaine, il a été proposé de changer la formulation de cette faute qualifiée qui après avoir été formulée au moyen d'un standard, l'a donc été au moyen d'une définition. Cette thèse s'est dans un premier temps intéressée à l'étude des résultats obtenus en matière d'uniformité d'interprétation de cette faute qualifiée sous l'empire du standard, puis sous celui de la définition. Cela a permis de mettre en évidence le fait qu'au-delà de la rédaction de la faute qualifiée au moyen d'un standard ou d'une définition, les divergences d'interprétation apparaissaient ou pouvaient apparaître à cause notamment de divers éléments perturbateurs qui ont été identifiés et au sujet desquels un premier niveau de propositions de solutions a été fait. Cependant, ces propositions de solutions, qui consistent globalement à adopter une interprétation en tenant compte des divers éléments perturbateurs de l'uniformité de l'interprétation qui ont été identifiés, doivent être mise en œuvre au moyen de mécanismes dont la création est nécessaire. C'est ce que cette thèse a proposé dans un deuxième temps.En effet, ces mécanismes ont pour objet la délivrance de recommandations interprétatives aux sujet des dispositions conventionnelles faisant l'objet, au moins potentiellement, de divergences d'interprétation. Ces recommandations sont à destination des juridictions des Etats parties aux conventions concernées et bénéficient d'un statut sui generis qui justifie qu'elles soient prises en compte par le juge. Si c'est la faute qualifiée dans les conventions internationales de droit uniforme relatives au contrat de transport qui a servi de support et de fil conducteur pour cette étude, les éléments de solution proposés ont toutefois vocation à s'appliquer, selon le même schéma, dans d'autres domaines que celui du droit des transports, régis par des conventions internationales de droit uniforme du commerce international. / The purpose of international conventions of uniform international trade law is to adopt a set of rules that are common and directly applicable to the legal relationship between the parties to an international commercial contract. The uniformity of these conventions can, however, be broken by divergent interpretations of which some of their provisions are the subject of the various national judges. This is particularly the case of the provisions relating to misconduct described in the international conventions of uniform law relating to the contract of carriage. In order to reduce differences of interpretation in this area, it has been proposed to change the wording of this qualified fault which, after having been formulated by means of a standard, has thus been made by means of a definition. This thesis was at first interested in the study of the results obtained in terms of uniformity of interpretation of this qualified fault under the influence of the standard, then under that of the definition. This made it possible to highlight the fact that beyond the drafting of the qualified fault by means of a standard or a definition, the divergences of interpretation appeared or could appear because of various disruptive elements which have been identified and for which a first level of proposals for solutions has been made. However, these proposals for solutions, which generally consist in adopting an interpretation taking into account the various disruptive elements of uniformity of interpretation that have been identified, must be implemented through mechanisms that are necessary to create. This is what this thesis proposed in a second step. The purpose of these mechanisms is to issue interpretative recommendations on conventional provisions that are the subject of at least potentially divergent interpretations. These recommendations are addressed to the courts of the States Parties to the conventions concerned and enjoy a sui generis status which justifies them being taken into account by the judge.If it is the misconduct described in the international agreements of uniform law relating to the contract of carriage which served as support and guideline for this study, the proposed elements of solution are however intended to apply, according to the same scheme, in other fields than transport law, governed by international conventions of uniform international trade law.

Verkställighetshinder i utlänningslagen : En studie om reglering och Migrationsöverdomstolens tillämpning av verkställighetshinder som stadgas i 12 kap. utlänningslagen

Some expulsion decisions cannot be executed due to the existence of deportation impediments, which in this case means that foreigners are in a legal limbo in such a way that they have neither the right to stay nor the opportunity to leave Sweden. The regulation of deportation impediments is found in Aliens Act (2005:716), but it is the application of these regulations that determine how specific cases are assessed, why it is highly relevant to study said cases.  The essay deals with political, practical and medical impediments, found in Chapter 12 of the Aliens Act, in order to establish the applicable law, and by analyzing ten court cases from the Migration Court of Appeal, study how the court assesses the Swedish Migration Agency's application of these legal barriers. The provisions being studied are chapter 12 1-3 §§ Aliens Act, concerning political impediments, chapter 12 18 § Aliens Act, concerning practical and medical impediments, and also chapter 12 19 § Aliens act which establishes the possibility of a new trial in a case. The applicable law is established through a legal dogmatic method, and the legal cases from the Migration Court of Appeal are analyzed using a legal sociological method.  The study concludes that political impediments are weighed heaviest in comparison to medical and practical impediments, due to the latter two not being derived from international conventions or instruments as opposed to political impediments. Furthermore, it is easier to present evidence when invoking political impediments, as evidentiary requirements are set lower than those for practical and medical impediments. At the same time the individual has an opportunity to be granted a new trial if he or she invokes a new condition that concerns political impediments, while a new trial cannot be granted if the individual invokes medical or practical impediments. The provisions concerning practical and medical impediments should therefore be developed or amended in such a way that they are adapted to the circumstances that may arise in these cases. It is also concluded that the Swedish Migration Agency's investigation and interpretation of these impediments must be more comprehensive. It must be adapted to the conditions referred to in the case, due to the application of these provisions being complex and requiring the Swedish Migration Agency's staff to be well trained and accurate in each individual case.

Text in English and Arabic / In pre-colonial Africa, the Southwestern Sahara which includes Mauritania, Mali and Senegal belonged to what was then referred to as the Sudan and extended from the Atlantic seaboard to the Red Sea. The advent of Islam and the Arabic language to West Africa in the 11th century heralded an intellectual marathon whose literary output still fascinates us today. At a time when Europe was emerging from the dark ages and Africa was for most Europeans a terra incognita, indigenous African scholars were composing treatises as diverse as mathematics, agriculture and the Islamic sciences. A twentieth century Mauritanian, Arabic monograph, Irshād al- Muqallidīn ʿinda ikhtilāf al-Mujtahidīn1, written circa 1910/1332, by a yet unknown Mauritanian jurist of the Mālikī School, Bāba bin al-Shaykh Sīdī al- Shinqīṭī al-Ntishā-ī (d.1920/1342), a member of the muchacclaimed Shinqīṭī fraternity of scholars, is a fine example of African literary accomplishment. This manuscript hereinafter referred to as the Irshād, is written within the legal framework of Islamic jurisprudence (usūl al-fiqh). A science that relies for the most part on the intellectual and interpretive competence of the independent jurist, or mujtahid, in the application of the methodologies employed in the extraction of legal norms from the primary sources of the sharīʿah. The subject matter of the Irshād deals with the question of juristic differences. Juristic differences invariably arise when a mujtahid exercises his academic freedom to clarify or resolve conundrums in the law and to postulate legal norms. Other independent jurists (mujtahidūn) may posit different legal norms because of the exercise of their individual interpretive skills. These differences, when they are deemed juristically irreconcilable, are called ikhtilāfāt (pl. of ikhtilāf). The author of the Irshād explores a corollary of the ikhtilāf narrative and posits the hypothesis that there ought not to be ikhtilāf in the sharīʿah. The Syrian Refugee Crisis and the European Union: A Case Study of Germany and Hungary

This thesis explores the impact of the Syrian refugee crisis on the Common European Asylum System. It evaluates the extent to which the European Union was able to implement a common asylum system, identifies discrepancies between different European countries, primarily Germany and Hungary, and briefly examines the roots of these differences. To this end, the structure of the international refugee protection regime and the German and Hungarian asylum systems are analyzed. Furthermore, the thesis explores how the governments of the two countries perceive the rights of refugees and how their views have affected their handling of the crisis. The case studies of Germany and Hungary have revealed that the treatment of Syrian refugees varies enormously within the EU. Hence, the implementation of the Common European Asylum System has not been achieved, which can be attributed to the deficiencies within the system and the growing ideological rifts within the EU.

Sustainable investments : Transparency regulation as a tool to influence investors to choose sustainable investment funds

In March 2018 the European Commission published the Action Plan on Financing Sustainable Growth. One of the main objectives with the actions presented in the action plan is to reorient capital flows towards sustainable investments, i.e. to influence more investors to invest sustainably. The action plan was followed by three proposals for transparency regulation regarding an EU taxonomy on sustainability, sustainability benchmarks and sustainability disclosures. Furthermore, the action plan included actions regarding two other transparency measures – sustainability labels and sustainability ratings. The first purpose of the thesis is to investigate if transparency regulation in the EU can be used as a tool to influence investors to choose sustainable investment funds. One of the main aims of the actions presented in the Action Plan on Financing Sustainable Growth, as well as the accompanying regulation proposals, is to reorient capital flows towards sustainable investments, i.e. to influence more investors to invest sustainably. In light of this, the Commission’s three proposed transparency regulations, as well as the concept of sustainability labels and ratings, are used as a basis for the investigation. The second purpose of the thesis is therefore to critically review the three regulation proposals and the concept of sustainability labels and ratings in order to gain an understanding of how different transparency measures can influence investors to choose sustainable investment funds. The transparency regulations and measures are analysed and critically reviewed in light of their objective to influence more investors to invest sustainably. A behavioural economics perspective, as well as consumer behaviour theories and decision-making models, are applied in order to analyse the transparency regulations and measures from an external perspective. Based on the analysis there are many indicators that transparency regulation can be used as a tool to influence investors to choose sustainable investment funds. However, to what extent transparency regulation can influence investor behaviour varies depending on which transparency measures are used and how they are designed. Sustainability benchmarks seem to have the least potential to influence investor behaviour, while the EU taxonomy on sustainability and sustainability labels seem to have the best potential to influence investor behaviour.
