Att göra sig trovärdig som HBTQI-person i svensk asylrätt : En queerteoretisk granskning av Migrationsverkets och migrationsdomstolens trovärdighetsbedömningar / To make oneself credible as a LGBTQI person in Swedish asylum law : A queer theoretical analysis of the credibility assessments of the Swedish Migration Agency and the Swedish Migration Court

The aim of this study is to analyze and derive a more profound understanding on how the Swedish Migration Agency and the Swedish Migration Court of Stockholm determine the credibility of LGBTQI-persons applying for asylum in Sweden. Through a qualitative content analysis of nine cases where decisions from both the Swedish Migration Agency and the Swedish Migration Court of Stockholm are used, this study aims to determine what is required from LGBTQI asylum seekers to prove their reliability and credibility. Furthermore a theoretical perspective on queer theory written by Fanny Ambjörnsson is applied to the assessment methodologies of both government departments, this as a way of assessing the credibility. The study shows that the Migration Agency and the Migration Court of Stockholm have a number of recurring reasons for rejecting LGBTQI persons residence; the applicant cannot account for an inner emotional process, the applicant lacks deep thoughts regarding his/hers sexual orientation, the applicant mainly describes sexual experiences rather than feelings, the applicant gives contradictory information and lastly the applicant has not considered the risks of their actions. In accordance with Ambjörnssons theory these reasons presented by both the Agency and Court are shown in the study to be based on stereotypical assumptions and heteronormative social structures.

Denna studie behandlar Migrationsverkets motiveringar vid avslag i asylärenden där konversion åberopas som skäl. Med tematisk innehållsanalys har sju beslutsunderlag, skrivna av Migrationsverket, undersökts och analyserats. Resultatet visar att det är mycket svårt, om inte omöjligt, att bli trodd som konvertit, med genuin religiös övertygelse, av Migrationsverkets handläggare. Tidigare forskning visar på liknande erfarenheter från migrationsmyndigheternas arbete runtom i världen. Kristna konvertiter är en grupp som är särskilt utsatta då de riskerar att bli dödade för deras nya tro i hemlandet och blir inte betrodd av myndigheterna i det land som de söker asyl i. Mer forskning behövs inom området för att kunna dra slutsatser om varför det ser ut på detta vis.

Denna studie ämnar undersöka vilka faktorer som de svenska migrationsmyndigheterna bedömer vara trovärdiga i asylberättelser hos dem som åberopat sexuell läggning som asylskäl. Utifrån en kvalitativ innehållsanalys, ett tematiskt tillvägagångssätt och med ett queerteoretiskt perspektiv ämnar studien även att hitta potentiella underliggande mönster som kan indikera på heteronormativa eller stereotypa föreställningar hos migrationsmyndigheterna. Detta analyseras utifrån sex stycken rättsfall där asylsökande åberopat sexuell läggning som asylskäl. Studiens resultat visar att de svenska migrationsmyndigheterna bedömer trovärdigheten och tillförlitligheten i den asylsökandes berättelse baserat på berättelsens detaljrikedom och personens djupa reflektioner. Vidare konstateras det att migrationsmyndigheterna gärna ser att dessa reflektioner baseras på negativa känslor såsom rädsla, skam och stigma kring sin sexuella läggning. Med en queerteoretisk applicering på resultatet konstaterar studien att det finns tendenser på heteronormativa och stereotypa föreställningar vid migrationsmyndigheternas trovärdighetsbedömningar. / The aim of this study is to investigate which factors the Swedish migration authorities consider to be credible in the asylum narratives of those who have invoked sexual orientation as ground for asylum. Based on a qualitative content analysis, a thematic approach and with a queer theoretical perspective, the study also aims to find potential underlying patterns that may indicate heteronormative or stereotypical beliefs in the migration authorities. This is analyzed based on six court cases where asylum seekers invoked sexual orientation as ground for asylum. The results of the study show that the Swedish migration authorities assess the credibility and reliability of the asylum seeker's story based on the detail of the story and the person's deep reflections. Furthermore, it is noted that the migration authorities would like to see that these reflections are based on negative emotions such as fear, shame and stigma about one's sexual orientation. With a queer theoretical application to the results, the study concludes that there are tendencies of heteronormative and stereotypical notions in the migration authority's credibility assessments.

HBTQ i asylprocessen : En kvalitativ dokumentstudie om trovärdighet och tillförlitlighet i HBTQ-asylsökandes domstolsbeslut / LGBTQ in the asylum process : A qualitative document study about credibility and reliability in court orders for LGBTQ asylum seekers

The aim of this study was to, through an analyze of court orders, gain a more profound understanding of how the Swedish Migration Courts argue and relate to credibility and reliability in the decision assessment for asylum-seeking LGBTQ people. The court orders used in the study was all rejected by the Swedish Migration Court and appealed to the Swedish Migration Supreme Court. The study is of an hermeneutic and qualitative perspective and an argumentation analysis of the court orders was conducted. The results show that the Swedish Migration Courts use both international-and Swedish law and guidelines as support and basis when they argue in the asylum assessments. They also use value-added words to reinforce their arguments. The critical perception of the asylum process presented by previous research can be understood to some extent. It is also possible to see that some criticism is unfounded, as more perspectives should be taken into consideration. Some gaps in knowledge about LGBTQ issues can be seen and therefore better guidelines may be necessary.

Verkställighetshinder i utlänningslagen : En studie om reglering och Migrationsöverdomstolens tillämpning av verkställighetshinder som stadgas i 12 kap. utlänningslagen

Some expulsion decisions cannot be executed due to the existence of deportation impediments, which in this case means that foreigners are in a legal limbo in such a way that they have neither the right to stay nor the opportunity to leave Sweden. The regulation of deportation impediments is found in Aliens Act (2005:716), but it is the application of these regulations that determine how specific cases are assessed, why it is highly relevant to study said cases.  The essay deals with political, practical and medical impediments, found in Chapter 12 of the Aliens Act, in order to establish the applicable law, and by analyzing ten court cases from the Migration Court of Appeal, study how the court assesses the Swedish Migration Agency's application of these legal barriers. The provisions being studied are chapter 12 1-3 §§ Aliens Act, concerning political impediments, chapter 12 18 § Aliens Act, concerning practical and medical impediments, and also chapter 12 19 § Aliens act which establishes the possibility of a new trial in a case. The applicable law is established through a legal dogmatic method, and the legal cases from the Migration Court of Appeal are analyzed using a legal sociological method.  The study concludes that political impediments are weighed heaviest in comparison to medical and practical impediments, due to the latter two not being derived from international conventions or instruments as opposed to political impediments. Furthermore, it is easier to present evidence when invoking political impediments, as evidentiary requirements are set lower than those for practical and medical impediments. At the same time the individual has an opportunity to be granted a new trial if he or she invokes a new condition that concerns political impediments, while a new trial cannot be granted if the individual invokes medical or practical impediments. The provisions concerning practical and medical impediments should therefore be developed or amended in such a way that they are adapted to the circumstances that may arise in these cases. It is also concluded that the Swedish Migration Agency's investigation and interpretation of these impediments must be more comprehensive. It must be adapted to the conditions referred to in the case, due to the application of these provisions being complex and requiring the Swedish Migration Agency's staff to be well trained and accurate in each individual case.
