Throughout history, sex and sexuality has been a subject for many debates. It has been regulated through both authorities and social norms. Female sexuality has been seen both as a symbol for motherhood and as a sin. Women have also been judged both for their virginity and their lack of it. This matter appears regularly in the media, whereas women still are objectified and judged for how they choose to exert their sexuality. Therefor, we have chosen to study how this appears in teenage movies in modern times, through a case study of the movies Easy A, Juno and The first time. We want to examine which kind of messages that are transmitted to youths about women and their sexuality. We have used the variables informal sexual education, slut shaming, victim blaming, the madonna/whore complex and objectification. Our results shows that women’s sexuality still is criticized and regulated by society and its values.

Les obligations de faire en droit des sociétés / Obligations to do under French corporate law

Cette thèse propose de découvrir les apports du droit des sociétés à la théorie générale de l'obligation de faire et de déterminer le rôle qu'elles occupent dans ce domaine du droit. A cette fin, des analyses sont consacrées à l'identification des obligations juridiques de faire parmi les différents types de contraintes pesant sur l'activité des personnes. L'étude présente ensuite une typologie des principales obligations des dirigeants et des associés. Après la détermination de l'objet des obligations de faire, il est entrepris un examen des façons d'accomplir les obligations de faire. A cet égard, les délégations constituent un mode d'exécution naturel, car elles permettent de « faire faire» au sein des entreprises. Par ailleurs, le contrôle de la manière d'exécuter l'obligation de faire constitue une étape décisive en vue de libérer le débiteur. Pour apprécier les façons de faire, les standards et le droit souple jouent un rôle important pour séparer les bonnes pratiques des mauvais procédés d'exécution. Par la suite, les réponses du droit à l'inexécution des obligations de faire sont examinées. Il s'agit alors d'analyser les difficultés résultant des obligations de faire à l'égard des responsabilités civile et pénale. Pour pallier ces difficultés, le législateur a cherché à renouveler les sanctions en recourant à la déchéance, aux injonctions de faire, au mandat ad hoc ou la stigmatisation publique. Les mérites de ces nouvelles façons de faire sont appréciés. Enfin, cette thèse défend l'idée que le régime de l'exécution forcée doit être adapté aux sociétés, car les personnes morales n'agissent pas comme les personnes physiques. / Obligation to do refers to the Roman classification of obligations: dare, facere, nonfacere, and praestare. The debtor of an obligation to do has to perform a task of any kind such as intellectual and legal services or labour works. This thesis intends to develop a legal analysis of directors' and shareholders' duties in corporate law with a specific interest for obligations to do. For instance, it focuses on duty of care, internai control, compliance or cooperation with legal auditors. Regarding shareholders' obligations, it highlights the duties of controlling shareholders - whether contractual or legal - collaterals, sweat equities, and other various cornmitments subscribed as they purchase or sale shares. This thesis also deals with how corporations, directors, and shareholders perform their obligations. In this regard, it shows that directors divide up tasks through delegations for their corporation to comply with its liabilities as well as performing their own duties. Moreover, this study reviews guidance provided by soft law and how can judges use it - through standards - to decide whether an obligation has been properly completed or not. Furthermore, it investigates the efficiency of remedies in case of the debtor's non-performance. Along with a critical examination of civil and criminal liability, this thesis assesses new forms of remedies and their merits such as injunction to do, forfeiture, and shaming.

The thesis concers the issue of conflict minerals in the Democratic republic of Congo. The situation in the country has been monitored by the NGO Global Witness for decades. Human rights violation, illicit trade followed by exporting of minerals out of the country, have been supervised by militaristic rebel groups. As a result these groups have been indirectly founded by international corporations.The aim of this thesis is to evaluate the performance of Global Witness at the agenda setting of conflict minerals, including a critical assessment of legislative measures.

Arbetslöshet bland ungdomar : En kvantitativ enkätstudie om konsekvenser av arbetslöshet hos ungdomar / Youth unemployment : A quantitative study about consequences of unemployment among youth

Det övergripande syftet med föreliggande studie var att undersöka levnadsförhållanden bland arbetslösa ungdomar. Syftet var även att undersöka vilka konsekvenser som arbetslösheten kan föra med sig för ungdomarna. Konsekvenser som har undersökts är inom livsområdena 1)hälsa 2) sociala relationer och fritid 3) konsumtion 4) rökning, alkohol och droger 5)kriminalitet och 6) livet i sin helhet. Metoden som använts är en kvantitativ metod med enkäter, som har delats ut till arbetslösa ungdomar i två kommuner i Sverige. För att ta reda på varför vissa ungdomar påverkas negativt av arbetslösheten, medan andra förblir nästintill opåverkade har ekonomi- skammodellen använts. Utgångspunkten för ekonomi-skammodellen är att desto högre den ekonomiska påfrestningen är i relation till skamgörandeeffekter, vilka uttrycks genom en negativ attityd från omgivningen, ju mer negativ inverkanhar arbetslöshet i människors liv. Studiens resultat och analys bekräftar denna teori. En större andel av ungdomarna som upplever högre grad av ekonomisk påfrestning och skamgörande effekter har även en sämre hälsa, röker mer, dricker oftare och har provat droger i högre utsträckning samt uppskattar livet i sin helhet att vara sämre, jämfört med ungdomar som upplever lägre grad av ekonomisk påfrestning och skamgörande effekter. Oavsett påfrestning bedömer ungdomarna generellt sett sina sociala relationer och fritid på likartade sätt, varpå modellen ej kan användas för att förklara variationer inom detta livsområde. I föreliggande studie undersöktes även hur ungdomarna påverkas av att vara arbetslösa i ett konsumtionssamhälle där normen är att konsumera. Resultat och analys visar att det är de ungdomar med mest påfrestning som konsumerar i högre grad, vilket förklaras utifrån att de kompenserar för den statusförlust som arbetslösheten medfört. / The aim of the study was to investigate living conditions amongst unemployed youths. The aim was also to examine the effects unemployment can have on young people. Consequences that have been explored are within the following areas of life: 1) Health 2) Social relationships and leisure activity 3) Consumption 4) Smoking, alcohol and drug abuse 5)Crime and 6) Life in its entirety. The method used is a quantitative method with questionnaires, which were distributed to unemployed youths in two towns in Sweden. To find out why some young people are adversely affected by unemployment, while others remain virtually unaffected the economy-shame model was used. The starting point for this model is that the higher the economic stress is in relation to the humiliating effects, which are expressed through a negative attitude from people in the environment, the more negative impact unemployment has in people's lives. The results and analysis in this study confirms the theory. A greater proportion of young people who experience higher levels of economic stress and shame also have poorer health, smoke more, drink more often and are more likely to have tried drugs and have a negative outlook on life, as opposed to adolescents who experience lower levels of economic stress and shame. Overall the model can not be used to explain variations in areas of life concerning social relations and leisure activities. The study also looked into how young people are affected by being unemployed in a consumer society where the norm is to consume. Results and analysis shows that it is young people who experience a greater level of economical distress and shame who consume the most. The explanation for this might be that they are compensating for the loss of status resulting from unemployment.

The Na-kd Truth : En Foucauldiansk diskursanalys av makt, straff och disciplin inom fenomenet bojkottskultur / The Na-kd Truth : A Foucauldian discourse analysis of power, punishment, and discipline within the phenomenon of cancel culture

What are the power relations between the fashion company Na-kd, influencers, and the general public? This study problematizes and concretizes the events surrounding the fashion company Na-kd that took place at the end of 2020 and is further discussed as an example of so-called cancel culture. The study explores the cancel culture phenomenon through the theoretical framework of Michel Foucault; including power, punishment, and discipline. By way of a Foucauldian discourse analysis, we have identified three main discourses: the boycott discourse, the violation discourse, and the discourse regarding subject positions. The analysis also identified the following subject positions as active partakers in the discourse: followers, company, influencer, woman, and boycotter which are discussed and analyzed in terms of how they relate to one another. The study’s key findings include the problematic use of boycott culture as a concept and whether it can be applied to companies or not, the shift of responsibility from company to influencers (i.e. individuals), and how great the power of the followers actually is. / Hur ser maktförhållandena ut mellan Na-kd, influerare och allmänheten? Studien problematiserar och konkretiserar händelserna kring modeföretaget Na-kd som ägde rum i slutet på 2020, och diskuteras vidare som ett exempel på bojkottskultur. Vidare i studien så utforskas bojkottskultur som fenomen utifrån det teoretiska ramverket Michel Foucault innefattande makt, straff och disciplin. För skapandet av en enhetlig undersökning så används Michel Foucaults diskursanalys, där tre huvuddiskurser identifieras: bojkottsdiskursen, diskursen om överträdelser inom fallet och subjektspositioner. Avslutningsvis diskuteras de identifierade subjektspositionerna; följare, företag, influerare, kvinna och bojkottare och hur dessa i förlängningen relaterar till varandra. Studiens huvudsakliga resultat  utmynnar i huruvida bojkott som begrepp går att applicera på ett företag eller inte, hur förflyttningen av ansvar från företaget till influerare sker och hur stor följarnas makt faktiskt är.
