Sweden is, according to its constitution, a state governed by law. The rule of law is upheld by the correct application of specific sources of law, consisting exclusively of legislation and its legislative history, court practise, established practise and the literature of jurisprudence. The non-regard for all other kinds of arguments, such as, for example, subjective justice in the matter at hand, ensures that formal justice is maintained. The outcome of two similar cases must result in the same ruling regardless of the person presiding. However, the courts are not the only place where the rule of law must be respected. In state and municipal administrations, legal decisions concerning individuals are made every day. Oftentimes administration officers are the first instance of adjudication. To achieve the same level of legality, administration officers must apply the same sources of law as do law graduates, but without any education in law. In this thesis, the method of legal problem solving that is practised by administration officers is studied, as well as the historical development of the profession of administration officers. Three representatives were interviewed about the scope of the method used in specific cases. The results showed that the methods clearly differed from the method of law graduates, in part due to organisational, economic and educational differences, and that the historical legacy is still very present in the administrative work.

Financování přenesené působnosti obcí v České republice / Financing of delegated powers of municipalities in the Czech RepublicČERMÁKOVÁ, Veronika January 2011 (has links)
The aim of this diploma paper was to evaluate the current state of development and financing of delegated powers of municipalities in the Czech Republic. Development financing was assessed for the period 1993 - 2003. Specifically, were monitored tax, non-tax and capital revenues, grants and current and capital expenditures. An analysis found that total revenue and expenditure in the period grew almost identically. Revenue increased primarily due to growth in tax revenues and increased subsidies. Expenditure increased depending on the growth of prices, but also due to broader range of tasks delegated by the state to municipalities. The intended goal was achieved by using analysis of entitlement subsidies and an allowance for the state administration. Analysis of entitlement grants was done in all municipalities in the Czech Republic for the period 2001 - 2010 and specifically the communities of South Region for the period 2003 - 2010. Using both analysis revealed that entitlements constitute a substantial share of subsidies in total subsidies received and this proportion increases with the increasing population. Analysis of the contribution to the state administration was performed in all 623 villages of South County. The villages were divided into five categories, depending on the extent of delegated powers. By analyzing the contribution to the state administration was established, how the allowance in each year, what was the cause of change and what was the structure contribution to the state administration of the individual categories.

The companies and organizations should take care about the control of quality. That´s why they boot quality into their systems of management. An implementation of such approaches presents the chance to directly benefit from the experiences gathered in the implementation in private sector. Main goal of this diploma work is the analysis of the systems of quality management in public administration. It treats with the assessment of an impact of quality management system on his effectivity in state administration. First chapter extends the knowledge of the systems of quality. This part talks about specific demands for quality management system used in public sector. The knowledge from first part was used in next chapter for analysis of the situation in selected organization. To review the impact of system, The municipal authority in Vsetin as a representative of transferred state administration, and Czech statistical office as a representative of central state administration were choosed. System of quality management applicated in these two examples was analysed.

The aim of this diploma thesis is to formulate a strategy for lifelong education of the state forest administration authorities' workers. The Ministry of Agriculture runs the education in the state and public administration on the basis of the Education Conception of the Ministry of Agriculture for the years of 2015-2020. This conception outlines education of state and public administration workers with departmental specialization. It determines the basic frame of lifelong education of all workers with departmental specialization. Yet there is no detailed strategy for particular domains of the department which would respond to real needs in practice. The strategy proposed in this thesis focuses on state forest administration workers at municipalities and regional offices. It is based on results of previous research which surveys the situation of state forest administration workers from the point of view of their work performance. Our research, which makes part of this thesis, is focused on their vocational lifelong education and surveys their needs concerning work performance and preferred forms and tools of further special education. The thesis explains the need for a high level of transparency in the state administration on a concrete example of administrative practice - using of hedge commands by the financial administration. For explanation, the hedge command is is the ultima ratio tool in the area of the tax administration. The mistrust that has arisen in using of this tool is considered a public-political problem in the text. In this study the researcher attempted to determine the current role expectations of a clinic manager in a primary health care setting, to identify factors determining and influencing the role of a clinic manager, to determine what effect the current role expectations had on the management of primary health care services rendered at the clinic, to establish the developmental needs of clinic managers to enable them to adhere to their role expectations, and to identify and recommend measures to support clinic managers in the execution of their managerial role by addressing the identified deficiencies.
The researcher selected a quantitative, exploratory, descriptive and contextual design. Clinic managers of fixed clinics in the Free State province were randomly selected to participate in the study and a questionnaire was utilised as data-collection instrument.
The study found that the clinic manager's role is comprehensive and varies from telephonic booking patients to assessment of the quality of primary health care programmes. A number of non-managerial functions were identified, such as consultation of patients, management of medicine, dispensing of medicine and ordering of stock. It was also found that the respondents were not involved in a number of management functions such as financial and human resource management, and adherence to the implementation of standards.
Factors that negatively influenced the clinic managers' management role included:
* Lack of time due to the large number of patients they had to consult due to the shortage of staff.
* Shortage of staff.
* The execution of non-managerial tasks.
Although it was found that the current role of the clinic manager was confusing as it entailed much more than just clinic management, it is foreseen that the role of the clinic manager could in future be clarified if the recommendations are implemented. / Health Studies / D.
