Implementação de políticas públicas e relações intergovernamentais: uma análise da legislação sob a perspectiva dos dilemas de ação coletiva no transporte público coletivo da Região Metropolitana de Curitiba (RMC)Cavalcante, João Paulo de Souza 24 August 2015 (has links)
As regiões metropolitanas são o local onde se pode observar com mais clareza as grandes dicotomias presentes na sociedade brasileira. Riqueza e pobreza, qualidade de vida e falta de oportunidades. Nesse sentido, alguns dos maus resultados em matéria de políticas públicas podem ser associados a problemas em sua implementação. Diante deste contexto, o presente trabalho tem como objetivo analisar a forma com a qual a legislação relativa à implementação de políticas públicas de transporte coletivo na Região Metropolitana de Curitiba lida com os dilemas de ação coletiva. Essa análise perpassa as relações intergovernamentais entre os municípios componentes da Região Metropolitana de Curitiba e o Estado do Paraná, responsáveis pela implementação de políticas de transporte público coletivo. A dificuldade em lidar com os dilemas de ação coletiva, intrínseca à implementação de políticas, ao federalismo, à conformação das regiões metropolitanas e até mesmo ao fornecimento de sistemas de transporte público coletivo é o pressuposto que fundamenta a presente pesquisa. Para proceder àquela análise, a abordagem utilizada foi a qualitativa, de objetivos exploratórios e descritivos. Os meios pelos quais se busca respostas a tais objetivos foram as pesquisas de tipo bibliográfico e documental. Neste último aspecto, procedeu-se à análise de conteúdo dos documentos coletados, consubstanciados na legislação que normatiza a implementação de políticas públicas de transporte coletivo na Região Metropolitana de Curitiba. Essa análise buscou identificar a presença ou ausência de determinados conceitos relativos à coordenação e cooperação para a implementação de políticas públicas em contextos interativos. Como resultados, tem-se que: a) apesar de o legislador reconhecer a necessidade de que haja cooperação em matéria de políticas públicas, inexiste modelo para tanto; b) houve três distintas fases em matéria de cooperação: imposição de normas por parte da União, extrema descentralização e, a atual, com o aparecimento de modelos para a ação coletiva; c) os modelos atuais passam pela possibilidade de estabelecimento de consórcios públicos e pela governança interfederativa nas áreas metropolitanas. Enfim, concluiu-se que as normas que regem o cenário da implementação de políticas públicas de transporte na RMC são, ao mesmo tempo, problemas e obstáculos às esperadas condutas cooperativas, pois, por um lado, estimulam a competição entre os entes e a superioridade hierárquica de uns sobre outros, e, por outro, reconhecem a necessidade da ação coletiva. Ainda assim, por mais de 20 anos a RMC logrou manter uma rede integrada de transportes ativa, o que sugere a participação ativa dos atores sociais responsáveis por essa política pública. / Metropolitan areas present clearly the greatest dichotomies in Brazilian society. Wealth and poverty, quality of life and lack of opportunities. In this sense, some of the bad results in terms of public policies can be associated with problems in its implementation. In this study, the analysis relies in the intergovernmental relations between the municipalities that composes the Metropolitan Region of Curitiba (RMC) and the state of Paraná, all of them responsible for the implementation of public transportation policies. The difficulty in dealing with the dilemmas of collective action, intrinsic to the implementation of policies, federalism, the conformation of metropolitan region itself and even the provision of public transportation systems is the assumption underlying this research. To carry out the analysis, it was used a qualitative approach, with exploratory and descriptive objectives. This research used bibliographic and documentary approach to accomplish its objectives. Regarding to the later approach, the procedure was to analyze the collected documents that included the whole legislation that regulates the implementation of public transport policies in the metropolitan region of Curitiba. The document analysis sought to identify the presence or absence of certain concepts related to coordination and cooperation for the implementation of public policies in interactive contexts. The results led to the following conclusions: a) although the legislators recognize the necessity for cooperation in public policy there are no pattern to follow; b) there have been three distinct phases for cooperation, starting with the imposition of norms by the Union, going through a phase of extreme decentralization and the current one, where seem to appear the first patterns for collective action; c) current pattern seems to be the establishment of public consortia and interfederative governance in metropolitan areas. Conclusions lead to the understanding that the rules governing the implementation of public transport policies in the RMC are at the same time, problems and obstacles to the expected cooperative behavior, because on the one hand, they stimulate competition between the entities and the hierarchical superiority of some over others. On the other hand it recognizes the need for collective action. Even so, for more than 20 years the RMC managed to maintain an integrated network of active transport, which suggests the active participation of the individuals responsible for this policy.

South Africa, 2015. / Invariably, a high percentage of the population of South Africa depends on public transport. In order to continue to satisfy commuters in terms of comfort, travel time, reliability of service and traffic congestion, there is a need to improve the efficiency of moving passengers to reduce travel time, delay time and number of stops. In the quest for advancement and improvement in public transport, many countries now embark on Bus Rapid Transit (BRT) systems based on the successful implementation of the system by cities like Curitiba (Brazil) and Bogota (Columbia). Government departments/transport authorities are often faced with the challenge of selecting the most suitable BRT system relative to the unique features of its transport demands and urban layout. Hence, this study proposes the determination of the most appropriate BRT system for the eThekwini Municipal Area (EMA).
An in-depth literature review was conducted in order to determine the most adoptable BRT system amongst median, kerb side and segregated BRT systems, taking into consideration cost implications, safety of the passengers, pedestrian crossing, physically challenged commuters, vehicle option and manoeuvres.
Physical assessment and critical review of the current operating BRT systems in Johannesburg, Cape Town and Port Elizabeth in South Africa was employed in this study as well as a critical comparison among these systems. The pros and cons of the three functional BRT systems in South Africa were stated and a way forward for EMA was recommended.
Lastly, an assessment of the proposed BRT system in EMA was conducted on the existing Phase 1 and the remaining three phases. The review conducted was based on route inspection, access to property, factors considered in the selection of a BRT system, demand analyses of the routes and the evaluation of Johannesburg, Cape Town and Port Elizabeth BRT systems. Guidelines were also provided for the remaining proposed BRT routes which could be adopted by the eThekwini Transport Authority (ETA) in order to enhance a better performance in EMA over the three functional BRT systems in South Africa using the aforementioned criteria.

A research report submitted to the Faculty of Engineering and the Built Environment, University of the Witwatersrand, Johannesburg, in partial fulfilment of the requirements for the degree of Master of Science in Development Planning, Johannesburg 2016 / The spatial transformation project in post-Apartheid South Africa aims to change the alienating urban form that resulted from planning policies based on racial segregation. Johannesburg’s municipal government aims to capitalise on its investment on the Rea Vaya Bus Rapid Transit (BRT), through the principles of Transit Oriented Development (TOD), to catalyse densification and diversification of land uses along the Rea Vaya’s corridors. This research sought to discover whether these objectives are being realised in Diepkloof and Orlando East, Soweto. In order to answer the research question, the results of a qualitative survey of people residing around these stations were analysed in conjunction with GIS data and records of Town Planning applications for properties located around BRT stations. The following findings emerged: the rate of densification has intensified but remains constrained mainly because of restricted access to finance; land-uses have remained the same but with increased activity levels. All spatial development strategies in the study area need to be aligned to the principles of TOD. This research hopes to achieve two things. Firstly, enrich the scarce literature on spatial transformation through transit investments, particularly the BRT in South African Townships. March 2016 / The minibus taxi industry plays an important role in helping thousands of commuters daily in reaching their desired destinations. The minibus taxi industry emerged in South Africa under the apartheid era in the wake of the country’s economic deregulation initiated in 1977. This industry has grown rapidly since then overtaking both buses and trains with an estimated 14 million passengers using taxi services each day (Minibus Taxis and Road Safety, internet, 2015: 10:00am). The latter is due to its accessibility, affordability as well as convenience. The minibus taxi industry has also been stereotypically identified as an industry dominated by violence amongst various taxi associations over access to various routes while being heavily dominated by patriarchal male figures. Nevertheless, the minibus taxi industry and particularly queue marshals have however, not received the much needed attention as key players in the public transportation sector. Limited literature has been written on the taxi industry in general and on queue marshals specifically and yet, 14 million commuters use taxis daily to get around (Minibus Taxi and Road Safety, internet, 2015: 10:00am). It is as a result of this limitation that this 2
research study aims to contribute to the existing body of literature on the minibus taxi industry by analyzing the socio-economic lives of queue marshals focusing specifically on the form and function of queue marshals in Bree Street taxi rank, Johannesburg as well as the observable presence of patriarchy that is found in these ranks and whether the same influence is found within their households. In doing so, this research study hopes to examine whether or not the spirit of ubuntu exists within the industry that has been stereotypically perceived by society as violent and dominated by taxi drivers with ‘bad attitude’ and reckless driving skills. The hope is that, through understanding the socio dynamics of the lived experiences of queue marshals within the minibus taxi industry, queue marshals will no longer be ‘invisible’ while helping to reveal a different perception (two different worldviews to one coin) of an industry solely believed to be dominated by violence, ‘unruly’ and ‘rude’ individuals (Sauti 2006). / GR2017

A research report submitted to the Faculty of Engineering and the Built Environment, University of the Witwatersrand, Johannesburg, in partial fulfilment of the requirements for the degree of Master of Science in Development Planning, 2016 / Over the last decade national, provincial and local governments within South Africa have paid considerable attention to the benefits and need for an effective and reliable public transport system to meet the social challenges facing South African cities. The development of public transport systems is viewed as a tool to alleviate poverty and unemployment, as they provide access to opportunities and services previously out of reach. In Johannesburg the Spatial disparities created during the apartheid era continue to divide the city along the lines of class and race, and serve to marginalise low income groups located on the periphery, far from economic centres. Over the last 10 years urban and economic growth in the west of Johannesburg has occurred at a rapid rate giving rise to numerous informal settlements and government subsidised homes. These developments occurred without the development of public transport systems isolating low income residents. This study seeks to examine the extent to which public transportation systems are responding to the growth of new urban and economic nodes in Johannesburg in a manner that supports the interests and needs of the city’s low income residents.
The study investigates the cases of the Gautrain and Rea Vaya. The study evaluates the systems through an analysis of the state’s public transportation plans and policies and the challenges and successes of each system, taking into account what are the state’s current and future public transport plans and how are they responding to urban and economic growth in the west of Johannesburg.
Through the use of spatial data, the study examines the spatial and economic trends in Johannesburg, the location of the urban poor and the effects of changes in commuter patterns. The study takes into account current and future urban and economic trends and examines the way in which public transport systems can make a positive impact upon the urban poor. This evaluation is done through an analysis of international literature and best practices that can be used in the development of public transport systems that are responsive, effective and reliable. Key respondents were interviewed to examine the impediments facing the development of responsive
public transport systems and how this affects low income commuters in Johannesburg.
Through the use of numerous forms of data including maps, policy documents and key respondent interviews, study reveals that future transport developments see the Gautrain and the Rea Vaya expanding to the west of Johannesburg. These developments will only occur in the late future, leaving low income residents without a formal means of public transport for many years to come. Low income residents within these regions lack the means to access opportunities and services. Research into the phenomenon reveals that in order to address the challenges faced by the urban poor in the west a more dynamic and integrated approach is required in the development of public transport systems in Johannesburg. These findings provide a critical understanding the development of public transport systems and the impediments that restrict the responsiveness of public transportation development in Johannesburg. / MT2017

RESUMO O transporte urbano é importante para a sociedade porque promove as relações econômicas e sociais mediante o deslocamento das pessoas. Contudo, o setor está passando por uma mudança de cenário, em virtude da expansão da concorrência do transporte informal e aumento do uso de carros particulares. Tal mudança tem causado queda no número de usuários do serviço e aumentos nos custos do setor. Essa situação induz as empresas a solicitar em aumentos nas tarifas. Entretanto, tais aumentos não solucionaram o problema. Por isso, este estudo faz uma reflexão crítica sobre a tomada de decisões relativa à tarifa no transporte coletivo urbano por ônibus, utilizando-se da abordagem conceitual de gestão econômica. A reflexão tem o objetivo de contribuir com a aplicação dos conceitos de gestão econômica na elaboração de um modelo tarifário que colabore no processo de tomada de decisão da tarifa e no planejamento de resultado. Para tanto, fez-se uma pesquisa bibliográfica e documental para descrever as características do setor e as variáveis que afetam a decisão a respeito da tarifa. Dessa forma, analisaram-se e evidenciaram-se aspectos relevantes do setor a respeito das relações institucionais, do planejamento e o processo de tomada de decisão, do modelo tarifário GEIPOT, da abordagem gestão econômica e da decisão sobre a tarifa. Como considerações finais verifica-se que: existe uma tendência a mudanças nas responsabilidades institucionais referentes ao planejamento e ao processo de tomada de decisão no setor; há problemas conceituais no modelo GEIPOT; o modelo tarifário contribui com o planejamento de resultados e com o processo que envolve a decisão sobre a tarifa do setor. / ABSTRACT Urban transportation is important for society because it promotes economical and social relations through the movement of passengers. However, the sector has been facing changes in its scenery due to the growing competition in informal transportation and to the increased utilization of private cars. This change has been causing a decrease in the number of users of this service as well as higher costs in the sector, and such a situation leads companies to require price adjustments, though these adjustments do not solve the problem. For these reasons, this study makes a critical reflection on making decisions related to pricing for urban transportation by bus, using the economic management conceptual approach. The reflection aims to contribute for the application of the economic management concepts in the elaboration of a pricing model that can be helpful in the decision making regarding prices and in the planning of results. With this objective, a bibliographic and document research was made in order to describe the characteristics of the sector and the variables affecting decisions regarding prices. Therefore, some aspects related to the public power intervention in the sector were herein analyzed and evidenced, as well as the utilization of the economic management approach for the elaboration of a decision model regarding prices. Finally, it is found that the pricing model contributes for planning results and for the process which involves making decisions related to pricing in the sector.

Os objetivos deste trabalho são dois: avaliar a percepção da sociedade e dos especialistas em transporte sobre os benefícios alcançados com a implantação de sistemas de transporte público urbano sobre trilhos e verificar se a percepção dos especialistas é alinhada com a percepção da sociedade. O trabalho foi desenvolvido a partir de uma pesquisa bibliográfica para identificação dos benefícios do transporte público sobre trilhos. Após definidos os benefícios foi aplicada uma pesquisa, de caráter exploratório, utilizando a escala de Likert, à sociedade, mais especificamente a alunos de graduação de cursos universitários na região metropolitana de São Paulo num total de 433 respondentes, distribuídos em 7 locais distintos. Em seguida foi realizada uma pesquisa junto a especialistas em transporte, com utilização de uma planilha para avaliação dos benefícios com base no Método de Análise Hierárquica - MAH. Na pesquisa com especialistas obteve-se 34 planilhas distribuídas em 4 grupos distintos. Os resultados mostram que a sociedade e os especialistas possuem uma percepção bastante positiva dos benefícios gerados pela implantação de sistemas de transporte público urbano sobre trilhos, havendo, no entanto, diferenças sensíveis nas avaliações, que refletem na ordem de importância dos benefícios. / The objectives of this work are, over all, two: evaluate the society´s and transportation specialists the perception on the benefits, reached with the implantation of urban public transport on tracks systems and to verify if the perception of the specialists is aligned up with the perception of the society. The work was developed from a bibliographical research that had the goal to identify the benefits of the public transport on tracks. After defined the benefits the research was applied to the society using the Likert´s scale, in exploratory way, more specifically the graduation´s pupils of university courses in the metropolitan region of São Paulo in a total of 433 respondents, distributed in seven distinct places. After that was carried through a research next to transportation´s specialists, with the resource of a spread sheet for evaluation of the benefits on the basis of the Analytic Hierarchical Process - AHP. About the research with specialists, one got 34 spread sheets distributed in four distinct groups. The results show that the society and the specialists possess a sufficiently positive perception about the benefits generated for the implantation of urban public transport on tracks systems, having, however, sensible differences in the evaluations, that they reflect in the order of the benefits importance.

A pesquisa se cerca de teses sobre o direito urbano, para tratar do objeto principal desta dissertação: as inovadoras políticas urbanas de transporte elaboradas pela administração Luiza Erundina (1989-1992), como a Tarifa Zero e a Municipalização dos transportes coletivos por ônibus, na cidade de São Paulo. O caminho das políticas públicas de transporte foi tortuoso no entremeio à democracia (1978-1988), em parte foi inicialmente abordado por uma construção coletiva de movimentos sociais (como o Movimento Nacional pela Reforma Urbana-MNRU) e de grupos de trabalho com a temática dos transportes criados por partidos do campo democrático-popular. Em outra parte, configura-se um marco que tem as figuras do secretário de transportes Lúcio Gregori, e da prefeita Luiza Erundina como centrais para o desenvolvimento e articulação dos projetos políticos, esses que hoje (na contemporaneidade) alcançaram o devido debate público no país. As conclusões da pesquisa apontam para uma realidade de esforços administrativos, conjunta à falta de engajamento populacional na participação das políticas de transporte. Expõem também os limites metodológicos das diferentes propostas participativas conduzidas pela administração quando comparadas às ações de diferentes secretarias, sendo essas ações: conselhos ou fóruns de negociação. Contudo apresenta que a não efetivação das políticas urbanas elaboradas pela administração Luiza Erundina não é um resultado direto da simples existência ou não de movimento social prévio à gestão. Tratase sim (no presente) do efetivo poder popular de modificar o estado do urbano, desde a sua forma prática à sua forma sensível, desde sua forma econômica, à forma de partilhar o poder entre todo o conjunto social. / The research focuses on theses about urban law, to deal with the main object of this dissertation: the innovative urban transport policies elaborated by the Luiza Erundina administration (1989-1992), such as the Zero tariff and the Municipalization of collective bus transportation, in Sao Paulo City. The path of public transport policies was tortuous in the midst of democracy (1978-1988), in part was initially approached by a collective construction of social movements (such as the National Movement for Urban Reform-MNRU) and working groups on the theme of transports created by parties of the democratic-popular field. In another part, there is a milestone that has the figures of transport secretary Lúcio Gregori and the mayor Luiza Erundina as central for the development and articulation of political projects, which today (in the contemporary world) have reached the due public debate in the country. The conclusions of the research point to a reality of administrative efforts, together with the lack of populations engagement in the transportation policies. They also expose the methodological limits of the different participatory proposals conducted by the administration when compared to the actions of different secretariats, being these actions: councils or forums of negotiation. However, it argues that the failure to implement the urban policies developed by the Luiza Erundina administration is not a direct result of the mere existence or absence of a social movement prior to management. It is a question of the actual power of the people to change the "state of the urban", from its practical form to its sensible form, from its economic form, to the way of sharing power among the whole social set.
