of conflicting issues such as the incorporation of international treaties, the sovereignty
of states, globalization and multuculturalism. Specifically, we will investigate the origin
of human rights, alongside his growing recognition, from the Revolutions until its
completion in the Universal Declaration of Human Rights in 1948. The question,
however, has become broader, when analyzed from the perspective of the
internationalization of these rights as conditions and limits of democracy. Given the
convergence on the reception of international treaties on human rights, we analyze a
series of positions, including recent placements of the Supreme Court, and
Constitutional Amendment n.45/2004. The study aims to review the classical concept of
sovereignty, now within a new perspective based on the appearance of certain
limitations of the state and a crisis in the face of the protection of human rights. We
analyze the phenomenon of globalization in light of its complexity and its relation to
sovereignty and human rights in pursuit of an expansion of democracy. The theme is
consistent also with the line of contemporary constitutionalism, since their approach has
a close connection with the issues of sovereignty and globalization, as well as a current
relationship with the protection of human rights. The research aims to analyze the
formation of a new society within a global vision of the constitutionalization of
international law. It seeks to glimpse the invocacion model of foreign precedents and
the possibility of dialogue betweem States as a way of protecting and enforcing the
protection of human rights / O trabalho que ora se apresenta ? resultado de pesquisa sobre a quest?o dos Direitos
Humanos, em face de quest?es conflitantes como a incorpora??o dos tratados
internacionais, a soberania dos estados, a globaliza??o e o multiculturalismo. De modo
espec?fico, investiga-se a origem dos direitos humanos, ao lado do seu progressivo
reconhecimento, desde as Revolu??es at? a sua concretiza??o na Declara??o Universal
dos Direitos Humanos de 1948. A quest?o, contudo, apresenta-se mais ampla, quando
analisada sob a perspectiva da internacionaliza??o desses direitos como condi??es e
limites da democracia. Em face da converg?ncia acerca da recep??o dos tratados
internacionais de direitos humanos, analisa-se uma s?rie de posicionamentos, inclusive
recentes posicionamentos do Supremo Tribunal Federal, al?m da Emenda
Constitucional n.45/2004. O estudo procura rever o cl?ssico conceito de soberania,
agora dentro de uma nova perspectiva fundada no aparecimento de certas limita??es ao
Estado e de uma crise em face da tutela aos direitos humanos. Analisa-se o fen?meno da
globaliza??o em face de sua complexidade e sua rela??o com a soberania e os direitos
humanos na busca de uma expans?o da democracia. O tema proposto coaduna-se, ainda,
com a linha do Constitucionalismo contempor?neo, visto que sua abordagem mant?m
uma ?ntima liga??o com as quest?es da soberania e globaliza??o, al?m de uma atual
rela??o com ? prote??o dos direitos humanos. A pesquisa busca analisar a forma??o de
uma nova sociedade mundial dentro de uma vis?o de constitucionaliza??o do direito
internacional. Procura-se vislumbrar o modelo de invoca??o de precedentes
jurisprudenciais estrangeiros e a possibilidade de di?logos entre Estados como forma de
resguardar e efetivar a prote??o dos direitos humanos
