CoordenaÃÃo de AperfeiÃoamento de Pessoal de NÃvel Superior / Esta pesquisa tem como objetivo fazer um estudo da polifonia do discurso jurÃdico, mais especificamente da sentenÃa de primeira instÃncia e dos acÃrdÃos jurÃdicos, ambos os textos de cunho decisÃrio na Ãrea JurÃdica, a partir da anÃlise de suas marcas caracterÃsticas e/ ou de sua organizaÃÃo textual e tem como objetivo geral analisar a correlaÃÃo entre o aspecto fomulaico dos gÃneros em estudo e a constituiÃÃo da polifonia presente neles. Como objetivos especÃficos, a pesquisa centra-se na identificaÃÃo das marcas que comprovam a natureza polifÃnica da sentenÃa de primeira instÃncia e do acÃrdÃo; na anÃlise das marcas de desdobramento da voz do Estado em leis, jurisprudÃncia e doutrina; na anÃlise da sobreposiÃÃo e/ ou hierarquizaÃÃo de vozes nas sentenÃas, principalmente a sobreposiÃÃo da voz do juiz na sentenÃa pelos desembargadores no acÃrdÃo. Para o tratamento da polifonia constitutiva foram selecionadas 24 peÃas decisÃrias â sentenÃas de primeira instÃncia e acÃrdÃos â oriundos de fÃruns e tribunais do estado do CearÃ. Os mÃtodos elencados foram o indutivo, visto que se partiu das marcas observadas para que fosse possÃvel tecer consideraÃÃes sobre o comportamento polifÃnico dos gÃneros jurÃdicos; o mÃtodo qualitativo para se proceder a anÃlise das marcas e o mÃtodo bibliogrÃfico, com o propÃsito de se ter uma leitura mais apurada do fenÃmeno polifÃnico. A abordagem dada ao tema baseou-se em pressupostos da SemÃntica Argumentativa e, como aparato teÃrico-metodolÃgico, utilizou as concepÃÃes de Bakhtin, Ducrot, EspÃndola e Authier-Revuz, no que concernem os conceitos de dialogismo, polifonia e heterogeneidade respectivamente. A partir destas concepÃÃes, demonstramos como as vozes nos textos decisÃrios sÃo passÃveis de apagamento e de hierarquizaÃÃes/ sobreposiÃÃes de forma muito especÃfica e como os gÃneros jurÃdicos mesmo apresentando um aspecto fomulaico, sÃo passÃveis de uma teia de vozes na sua composiÃÃo. Esta pesquisa apresenta, portanto, implicaÃÃes de ordem teÃrica que enriquecem os estudos da polifonia, bem como da heterogeneidade em peÃas decisÃrias e contribui para as discussÃes sobre a interdisciplinaridade LingÃÃstica/ Direito. / This research aims to make a study of the polyphony of legal discourse, especially from the ruling of first instance and legal judgments, both texts of stamp making in the Legal Department, from the analysis of their distinctive markings and / or your organization textual and aims at analyzing the correlation between the appearance fomulaico the genera under study and the establishment of polyphony present in them. As specific objectives, the research focuses on identifying marks that prove the polyphonic nature of the sentence of first instance and the ruling and in the analysis of the marks to stagger the voice of the state laws, jurisprudence and doctrine, the analysis of overlapping and / or hierarchy of voices in the sentences, especially the overlap of the voice of the judge in sentencing by judges in the Judgement. For treatment of polyphony were selected constituent parts-making 24 - judgments of first instance and judgments - from forums and courts of the state of CearÃ. The methods listed are the inductive, since parted observed the marks so they could comment on the behavior of polyphonic legal genres, the method for carrying out qualitative analysis of brands and bibliographical method, with the purpose of having a reading more accurate polyphonic phenomenon. The approach of the theme was based on assumptions of Argumentative Semantics and as a theoretical apparatus, we used the concepts of Bakhtin, Ducrot, EspÃndola and Authier-Revuz, as concern the concepts of dialogism, polyphony and heterogeneity respectively. From these concepts, we demonstrate how the voices in decision-making texts are subject to deletion and hierarchies / overlaps in a very specific genres such as legal and even presenting an aspect fomulaico, are liable to a web of voices in their composition. This research has, therefore, the theoretical implications that enrich the studies of polyphony as well as parts of the heterogeneity in decision-making and contributes to the debate about interdisciplinarity Linguistics / Law.
