Previous issue date: 2016-06-09 / The aim of the present study is to analyze the right to health as of its economical and political aspects, in face of the proper use of public resources allocated to health policies, and the institutional and political protagonism of the Judiciary Power in the deciding processes on health thereof. The proposed methodology is based on the historical dialectic materialism, taking into account the dynamics of reality and its context. As to technical approach, the research was carried out making use of documental and comprehensive bibliographic research, examining rulings and proceedings pertaining to public health. For data collecting, the Information System on Public Health Budget, a system used by the Health Ministry for monitoring and assessing resources applied into the health sector, as well as the THEMIS PG 3.0 information system used by the Judiciary Power of the State of Maranhão, responsible for the control, follow-up, and distribution of First Instance processes in all counties of the State of Maranhão, in order to describe public health expenditures coupled with other social policies, as well as the interpretation of their response on the increasing role of the Judiciary Power on health demands, were used. The study highlights the right to health and its relation to Social Security, in the context of the changings of the Capitalist State, pointing out the standard social protection adopted by Brazil, as well as the Sanitary Movement which reverberate on the universalization of the right to health. Furthermore, the study analyzes the health policy nstituted by the Federal Constitution of 1988, and the performance of the Health Boards in elaborating health policies in the counties, and especially in the County of Sao Luis, MA-Brazil. And finally, the alleged political and institutional protagonism of the Judiciary Power is analyzed as to the demands on Public Health in the State of Maranhão, and the County of São Luis, within the SUS (Unified Health System) system. / A pesquisa tem como objetivo analisar o direito à saúde a partir de seus aspectos econômicos e políticos, em face da aplicação dos recursos públicos destinados à política de saúde e do protagonismo institucional e político do Poder Judiciário nos processos decisórios sobre saúde. A proposta metodológica situa-se no materialismo histórico dialético, considerando-se a dinâmica da realidade e seu contexto. No que tange ao procedimento técnico, a investigação foi
realizada mediante pesquisa bibliográfica ampla e pesquisa documental, com levantamento de leis, resoluções e portarias, entre outros documentos relacionados a saúde pública. Quanto às técnicas para a coleta de dados e informações, utilizou-se o Sistema de Informações sobre Orçamentos Públicos em Saúde (SIOPS), sistema utilizado pelo Ministério da Saúde para monitoramento e avaliação dos recursos aplicados na área da saúde, bem como o sistema de
informações THEMIS PG 3.0, utilizado pelo Poder Judiciário maranhense, responsável pelo controle, acompanhamento e distribuição processual de 1º Grau em todas as comarcas do Estado do Maranhão, com o intuito de descrever os gastos públicos com saúde, fazendo uma análise com as demais políticas sociais, bem como a interpretação dos seus reflexos no aumento da atuação do Poder Judiciário nas demandas de saúde. Aborda o direito à saúde e a sua relação com a seguridade social, no contexto das transformações do Estado capitalista, destacando o padrão de proteção social adotado pelo Brasil, bem como o percurso do Movimento Sanitarista que repercutiu na universalização do direito à saúde. Busca, ainda, analisar a política de saúde, gestada pela Constituição Federal de 1988, e a atuação dos Conselhos de Saúde na elaboração da política de saúde nos municípios, em especial, no Município de São Luís. E, por fim, analisase o suposto protagonismo institucional e político do Poder Judiciário frente às demandas sobre saúde pública no Estado do Maranhão. A atenção aqui é a análise das demandas judiciais no Estado do Maranhão e do Município de São Luís entre 2011 e 2014, no âmbito do Sistema Único de Saúde.
