Mais do mesmo : a mediação judicial como reforço do protagonismo do poder judiciário

O presente estudo busca investigar se a institucionalização de práticas de mediação pelo Poder Judiciário, por meio da Lei 13.140/15, pode ser considerada um benefício para superar as consequências advindas de uma sociedade brasileira supostamente hiperjudicializada. Para tanto, a pesquisa foi organizada em três capítulos. O primeiro cuida de elucidar a existência de um fenômeno denominado protagonismo judicial que se desdobraria em outras facetas, qual seja; o ativismo judicial, a judicialização da política e a juridificação das relações sociais – todas essencialmente relacionadas ao aumento da ingerência do Poder Judiciário nas esferas da vida. A partir disto, busca-se expor a construção de um senso comum sobre a judicialização da sociedade brasileira, especialmente após as condições institucionais criadas pela Constituição de 1988 e, em seguida, valendo-se dos dados divulgados pelo Conselho Nacional de Justiça, esta pesquisa visa questionar o suposto diagnóstico. Já o segundo capítulo tem por escopo apresentar os argumentos de autores que defendem a mediação judicial como uma proposta de solução à ideia de uma cultura do litígio, traçando seu percurso legislativo até alcançar o marco processual e legal com as Leis nº 13.105 e 13.140, respectivamente. Objetiva-se, ainda, expor as concepções de mediação judicial e extrajudicial com destaque às suas diferenças. O último ponto deste trabalho busca apresentar alguns fundamentos históricos e filosóficos sobre as facetas do protagonismo judicial mediante a exposição das ideias de Axel Honneth, Jürgen Habermas, Ingeborg Maus e Antoine Garapon, e, assim, relacioná-las com a institucionalização da mediação judicial. A dissertação concentra-se, ao cabo, em questionar a capacidade da Lei de Mediação para dirimir os problemas para quais ela foi pensada, sobretudo, porque o Poder Judiciário mantém-se como protagonista na resolução dos conflitos. / This paper aims to investigate whether institutionalizing mediation practices by the Judiciary, through the Law 13.140/15, could be considered beneficial to overcome the consequences from an a supposedly “hyper judicialized” Brazilian society. The dissertation focus, at last, on questioning the capacity of Mediation Law to solve the problems it was developed to solve, especially since the Brazilian Judiciary is still the main character of conflict resolutions.

Avaliação da judicialização da saúde no município de Ribeirão Preto/SP / Evaluation of judicialization of health in the municipality of Ribeirao Preto/SP

A Constituição Federal Brasileira institucionalizou o direito a saúde no Brasil, o artigo 196 que diz: A saúde é um direito de todos e um dever do Estado apresenta esse direito. Ao regulamentar a criação do Sistema Único de Saúde a lei 8.080 reafirma a obrigação do Estado com a Saúde da população. Dentro desse contexto a Assistência Farmacêutica (AF) tem importante papel de garantir medicamentos seguros, eficácias, em tempo e quantidade necessária para atender a demanda dos cidadãos, porém apesar das constantes atualizações em prol de promover maior eficiência dos processos da AF, ainda acontecem situações em que o paciente não tem o medicamento requerido, seja por falta nas unidades dispensadoras ou a não presença nas listas de medicamentos padronizados. Essa situação faz com que o cidadão recorra à via judicial na tentativa de garantir o acesso ao medicamento pleiteado, fenômeno conhecido como judicialização da saúde, que traz grandes implicações sobre a gestão da assistência farmacêutica. Diante disso o objetivo do trabalho foi descrever o panorama geral das ações judiciais pleiteando medicamentos e insumos para insulina que foram assumidos pela prefeitura de Ribeirão Preto. Para alcançar esses objetivos, foi realizado um estudo do tipo descritivo. Foram analisados ao todo 1861 processos judiciais sendo 1083 ainda ativos e 778 que já haviam sido encerrados. Na maioria dos processos o juiz dava como prazo máximo 30 dias (99%) para se cumprir a ação, o que é insuficiente para realizar uma licitação pública obrigando a gestão a utilizar via paralela de compra. O Ministério Público foi o principal representante legal (71,7%) utilizado e a maioria das prescrições foram advindas de hospitais e clínicas particulares (50,1%). Os principais diagnósticos referidos nas ações foram diabetes e o transtorno de déficit de atenção e hiperatividade (TDAH). Já os medicamentos mais prevalentes foram as insulinas e o metilfenidato. Dentre os médicos prescritores 3% somam aproximadamente 30% das prescrições. Diante dos resultados expostos, o presente estudo evidenciou o impacto da judicialização da saúde no município de Ribeirão Preto, demandando da gestão pública organização estrutural e financeira para lidar com as demandas judiciais. / Brazilian Federal Constitution institutionalized the right of health in Brazil, the article 196 that says: \"Health is a right of everyone and a duty of State\" presents this right. The law 8.080, that regulates the foundation of Unit System of Health, reasserts the obligation of State to population\'s health. In this context, Pharmaceutical Service (PS) has an important role to ensure the request of medicines from population with security, efficacy, on time and in quantity required, but despite of frequently updates in favor to promote better procedures of PS, situations still taking place in which the patient does not have the drug required because of its lack in dispensing units or its absence in standardized list of drugs. This situation makes the citizens call on judicialization way, trying to ensure the access to drug claimed, this phenomenon is known like judicialization of health, and brings great implications about management of PS. As a result of that, the objective from this study was describing the general scenery of lawsuits claiming drugs and insulin inputs that have been assumed by administration of Ribeirão Preto. Thus to attain this objective, a descriptive study was conducted, resulting in 1861 lawsuits analyzed, in which 1083 still active and 778 had been closed. The judge set a term of 30 days for 99% of lawsuits to comply with the decision, which is insufficient to make a public bidding, thus the management feels obliged to buy drugs in a parallel way. Public Ministry was the main legal representative (71,7%) utilized and the most of prescriptions were from private clinical and hospitals (50,1%). The main diagnoses referred to lawsuits were diabetes and adult attention-deficit/hyperactivity disorder (ADHD), whereas the most prevalent drugs prescribed were insulin and methylphenidate. Among physicians, 3% of them prescribe 30% of prescriptions. As a result of that, the present study revealed the impact of health judicialization in Ribeirão Preto, demanding structural and financial organization from public management to labor with lawsuits.

A pesquisa parte de um pensamento problematizante que questiona a judicialização da saúde como um fenômeno observável pela pesquisa científica do direito. O primeiro alvo da pesquisa é compreender o que se entende por direito à saúde, falar de suas origens, ainda que de modo limitado. O direito à saúde é então examinado no tocante ao seu conteúdo, bem como nos seus aspectos de direito fundamental, social e prestacional. Ao longo de todo o texto, são expostos precedentes dos Tribunais brasileiros, com o propósito de ilustrar e melhor entender o fenômeno pesquisado. Sobre a judicialização, tem-se como foco a legitimidade do Poder Judiciário e ainda a relação entre política e direito que, no caso em questão, significa políticas públicas de saúde versus direito fundamental à saúde. Aborda-se ainda a dimensão econômica do direito à saúde, em princípio, com o debate sobre os custos dos direitos e, mais adiante, com a visão do problema a partir de fundamentos da análise econômica do direito, exercendo-se, em seguida, um juízo crítico sobre algumas conclusões encontradas. O objetivo principal, portanto, é investigar os casos de violência de gênero levados até as esferas internacionais, mais especificamente até à Comissão Interamericana de Direitos Humanos e a efetiva participação dos movimentos de mulheres nesse contexto, englobando denúncia e possível influência nas decisões – em caso de haver decisões. Havendo participação nas decisões, objetiva-se também apurar como foi essa influência. Sinteticamente, realizou-se estudos de casos que, uma vez não resolvidos na esfera doméstica, foram apresentados, pela sociedade civil, no âmbito internacional. Os objetivos gerais foram demonstrar o panorama geral da violência de gênero no Brasil, como os movimentos de mulheres atuaram efetivamente na luta contra essa violência e se conseguiram transformações palpáveis, e, ainda, apurar o quanto a legislação pode apresentar-se inefetiva. Os métodos utilizados nessa investigação foram o dialético e o estudo de caso. A partir da análise de textos de militantes, defensores de direitos humanos e dos Relatórios sobre os casos selecionados, chegou-se a várias conclusões, dentre elas, obteve-se uma resposta parcial ao problema principal que é a participação efetiva dos movimentos de mulheres, seja organizados em ONGs, seja de forma não institucionalizada, operando tanto nos debates, como no fornecimento de subsídios para análise da condição da mulher no Brasil, através das estatísticas por elas desenvolvidas. / This research aims to explore the role of women's movements in the judicialization of Brazilian cases of violation of women's human rights. The main objective, therefore, is to investigate cases of gender violence brought to the international spheres, specifically to the Inter-American Commission on Human Rights and the effective participation of women's movements in this context, including denunciation and possible influence on decisions - in case Decisions. If there is participation in the decisions, it also aims to determine how this influence was. Synthetically, case studies were carried out which, once not resolved in the domestic sphere, were presented by civil society at the international level. The general objectives were to demonstrate the general panorama of gender violence in Brazil, how the women's movements worked effectively in the fight against this violence and have achieved tangible transformations, and also to investigate how ineffective legislation may be. The methods used in this investigation were the dialectic and the case study. Based on the analysis of texts by militants, human rights defenders and the Reports on selected cases, several conclusions were reached, among them, a partial response was obtained to the main problem: the effective participation of women's movements, Whether organized in NGOs or noninstitutionalized, operating both in the debates and in the provision of subsidies to analyze the condition of women in Brazil, through the statistics they develop.

Família homoafetiva sergipana : o tribunal de justiça de Sergipe e o novo conceito de família

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES / The purpose of this study is to analyze the jurisprudence formed by the Court of Justice of the State of Sergipe regarding civil homoeffective judgments within the family between 2005 and 2015, seeking to draw a profile of the local judiciary in refers to the grounds of decisions rendered in the second degree of jurisdiction. As a starting point will be made a preliminary study on the theory of the State and how the judiciary gained strength in post-liberalism, which came to settle with the establishment of Constitutional States, with Brazil included in this. Subsequently, on the stabilization of the judiciary power, the concepts and theories on judicialization of judicial politics and activism will be analyzed, and how the aforementioned phenomena have contributed to the formation of a new right of Brazilian families, especially those formed by same sex. In the end, the research will present whether the Sergipe judiciary, in the grounds of its decisions to recognize the rights of this new family formation, has been activist or not. / O presente trabalho tem por objetivo fazer uma análise da jurisprudência formada pelo Tribunal de Justiça do Estado de Sergipe no que concerne às decisões cíveis homoafetivas dentro do âmbito familiar, entre os anos de 2005 a 2015, buscando traçar um perfil do judiciário local no que se refere as fundamentações das decisões prolatadas em sede de segundo grau de jurisdição. Como ponto de partida será feito um estudo preliminar sobre a teoria do Estado e como o judiciário ganhou força no pós-liberalismo, o que veio a estabelecer-se com o assentamento dos Estados Constitucionais, estando o Brasil incluído neste seio. Posteriormente, acerca da estabilização da força do poder judiciário, serão analisados os conceitos e teorias sobre judicialização da política e ativismo judicial e de que forma os referidos fenômenos contribuíram para a formatação de um novo direito das famílias brasileiras, em especial aquelas formadas por pessoas do mesmo sexo. Ao final, a pesquisa apresentará se o judiciário sergipano, na fundamentação de suas decisões de reconhecimento dos direitos dessa nova formação familiar, vem sendo um tribunal voltado a uma concepção ativista ou não. / São Cristóvão, SE

Nesse sentido, oferece uma perspectiva crítica, elaborada a partir da articulação entre a teoria dos campos de Pierre Bourdieu e o conceito de justiça social de Nancy Fraser. Segue uma proposta de análise crítico-reflexiva que considera a posição da pesquisadora, recorre ao entendimento da gênese dos processos sociais e privilegia o estudo da prática política do Judiciário por meio de ações e discursos cujos sentidos remetem à reprodução do campo jurídico e à expansão de suas fronteiras em direção ao campo político. Ao fim, propõe um novo entendimento para a prática da judicialização, conceituando-a como estratégia de ação dos agentes jurídicos no campo político, de forma que o protagonismo do Judiciário se configura como expressão desta estratégia que agrega capital político e visa a conferir legitimidade às decisões políticas tomadas pelo Judiciário na esfera extrajudicial. O sentido prático dessa estratégia é a ampliação do poder político do Judiciário, o que impõe a necessidade de atualizar a discussão sobre a relação entre Estado e Sociedade no que se refere aos processos deliberativos da experiência democrática contemporânea, particularmente no que diz respeito às políticas sociais, que envolvem um complexo sistema de direitos econômicos, culturais e políticos que exigem não um novo Judiciário, mas uma esfera deliberativa plural e paritária. / This thesis analyzes the relation between the pivotal political role of the judiciary and the judicialization of health, children, and adolescent rights policies from the study of two programs developed by the National Justice Council, namely the Health Forum and the National Register of Adoptions. The political rise of the judiciary was investigated with the aim of displaying the relationships and social processes which gave rise to the political practice of legal agents and to the structuring the judicial-political field. In this sense, the thesis offers a critical perspective, drawn from the articulation between the field theory of Pierre Bourdieu and the concept of social justice of Nancy Fraser. The thesis follows a proposal of critical-reflexive analysis which considers the position of the researcher; which resorts to the understanding of the origin of social processes; and which favors the study of the political practice of the judiciary through actions and speeches whose sense refer to the reproduction of the legal field and to the expansion of its borders into the political field. At the end, the thesis proposes a new understanding to the practice of judicialization, conceptualizing it as an action strategy of legal agents in the political field, so that the pivotal role of the judiciary is configured as an expression of this strategy, which adds political capital and aims to confer legitimacy to the political decisions taken by the judiciary out of the scope of the court. The practical sense of this strategy is the expansion of the political power of the judiciary, which imposes the need to update the discussion about the relation between state and society concerning the deliberative processes of contemporary democratic experience, particularly regarding social policies, which involve a complex system of economic, cultural, and political rights, which do not demand a new judiciary, but a plural and equal deliberative sphere.

This process would include not only the inscription of the lives of children and adolescents in the legal, juridical and political Brazilian sphere throughout the corpus of laws, decrees and jurisprudence, as would consider them as social and political actors. This dissertation is concerned to follow how a discursive field and an institutional network guided and directed the process of judicialization. We followed and analyzed the documentation produced (Codes, Constitution, Laws, Statutes, Iconography) between 1920 and 1990, aiming at presenting a summary of the historicity of that process, considering the contribution of juridical, educational and assistance fields. / Este trabalho trata da judicialização da infância no Brasil. Esse processo abrangeria não apenas a inscrição da vida das crianças e dos adolescentes no âmbito legal, jurídico e político brasileiro em todo o corpus de leis, decretos e jurisprudência, como passaria a considerá-los como atores sociais e políticos. Essa dissertação preocupa-se em acompanhar como um campo discursivo e uma rede institucional orientaram e dirigiram este processo de judicialização. Acompanhamos e analisamos a documentação produzida (Códigos, Constituição, Regulamentos, Estatutos, Iconografia) entre as décadas de 1920 a 1990, com o objetivo de apresentar uma síntese acerca da historicidade do processo mencionado, considerando a contribuição dos campos jurídico, educacional e assistencial.
