Previous issue date: 2018-03-08 / A Bioética é um campo do conhecimento que, dentre variados objeto de estudo, também aborda a reflexão sobre estratégias que possibilitem a superação da atenção deficiente e desigual em saúde. A precária qualidade dos cuidados odontológicos e a falta de segurança na sua execução, são características da atenção deficiente e desigual. Levando em conta os pontos de conexão entre a Bioética e os direitos humanos, e considerando a segurança do paciente como tema integrante da Bioética, nesta tese, o tema da qualidade dos cuidados odontológicos e segurança do paciente será desenvolvido com base no marco do referencial dos direitos humanos, concretamente do direito à saúde. A base teórica-normativa da presente análise é o Comentário Geral n.14 de 2000, adotado pelo Comitê dos Direitos Econômicos, Sociais e Culturais. Assim, a presente tese objetiva examinar o entendimento sobre o direito à saúde bucal, a partir de duas dimensiones; a primeira, a sua associação com o direito à saúde, e segunda, o entendimento da qualidade e segurança do paciente como elementos do direito mencionado. Para o alcance deste objetivo foram postulados cinco objetivos específicos desenvolvidos em capítulos diferentes. Primeiramente buscou-se expor os vínculos entre bioética, direitos humanos e saúde pública. Em seguida, buscou-se explicitar as bases teóricas sobre o direito à saúde, contidas no Comentário Geral n.14 de 2000. O Capítulo subsequente objetivou estudar a interconexão entre o direito à saúde bucal e o direito à saúde, no contexto internacional, mediante a análise de dois instrumentos: o primeiro, a Declaração de Liverpool; o segundo instrumento é o Relatório Mundial de Saúde Oral. Em seguida, se abordou o estudo da qualidade e a segurança do paciente, no documento intitulado “Visión 2020 delinear el futuro de la salud bucodental”, adotado pela Federação Dental Internacional, com o propósito de verificar se estes, são entendidos como elementos do direito à saúde. Finalmente, objetivou-se analisar a “Política de Saúde Oral de Bogotá para o decênio 2011-2021” a fim de estudar o seu conteúdo sobre a qualidade e a segurança do paciente e sua consonância com a concepção do direito à saúde. Verificou-se que a interconexão entre o direito à saúde e direito à saúde bucal, não é suficientemente consolidada, em razão da abordagem incompleta dos elementos do direito à saúde nos documentos examinados. A Política analisada desconsidera ações concretas sobre a garantia da qualidade dos determinantes sociais da saúde bucal. Conforme as análises executadas, o alcance transformador do uso do referencial do direito humano à saúde, não foi incorporado no conteúdo dos documentos examinados. Esse fato tem impacto negativo na efetivação da saúde bucal como bem ético, como se nota, na perpetuação das frágeis condições de saúde bucal e na efetivação universal do direito aludido. Esta tese propõe a utilização do referencial do direito humano à saúde como instrumento bioético para a formulação de políticas públicas, para assim, diminuir o impacto negativo da exclusão social no processo saúde-doença. / Bioethics is a field of knowledge that, among various object of study, also discusses the reflection on strategies that enable the poor and unequal attention in health. The precarious quality of dental care and the lack of security in implementation, are characteristics of the poor and unequal attention. Taking into account the connection points between bioethics and human rights, and considering patient safety as an integral theme of bioethics, in this thesis the issue of quality and patient safety will be developed based on the reference of human rights, particularly the right to health. Quality is an element of this right essential for the protection of the patient, which imposes, inter alia, the obligation to adopt State-oriented mechanisms provide facilities, goods and services of qualified health and insurance. The theoretical-normative base of this analysis is the General Comment No. 14/ 2000, adopted by the Committee on Economic, Social and Cultural Rights. Thus, the present thesis aims to examine the understanding about the right to oral health, from two dimensions; the first, association with the right to health, and second, the understanding of quality and patient safety as elements of the mentioned right. To achieve this goal were postulated five specific objectives developed in different chapters. The first sought to clarify the theoretical bases on the right to health contained in General Comment No. 14/2000 and its links to bioethics. The second chapter aimed to study interconnection between the right to health and the right to health, in the international context, through the analysis of two instruments: the first, the Liverpool Declaration. The second instrument is the World Oral Health Report. In the third chapter, tackles the study of quality and patient safety, in the document entitled "Vision 2020 shaping the future of oral health", adopted by the World Dental Federation, with the purpose to verify if quality and patient safety are understood as elements of the right to health. Finally, the fourth chapter aimed to analyze the "Oral health policy from Bogota to the Decade 2011-2021" in order to study your information about the quality and safety of the patient and your line with the conception of the right to health. It was found that the interconnection between the right to health and right to oral health, is not consolidated enough, due to the incomplete approach of the elements of the right to health in the documents examined. The policy under review disregards concrete actions on quality assurance of the social determinants of oral health. According to the analyses executed, the transformer scope of the use of the reference of human rights to health, was not incorporated into the content of the documents examined. This fact has a negative impact on the effective oral health as well as ethical, as noted, in the perpetuation of the fragile oral health conditions and the universal effect of the right alluded. This thesis proposes the use of the reference of human rights to health as a bioethical instrument for the formulation of public policies, thereby lessening the negative impact of social exclusion in the health-sickness process.
