Previous issue date: 2012-12-08 / Agência 1 / O presente estudo busca investigar de que maneira a ética feminista pode promover os
direitos humanos fundamentais na perspectiva de gênero a partir do múltiplo dialético Os
direitos humanos que, em sua base, tem uma percepção de mundo masculino, precisam
ter sensibilidade para reconhecer o outro a partir de sua história, de seu contexto social,
de sua cultura, de suas diferenças. Se, num primeiro momento, a humanidade
experimentou as consequências dramáticas do tratamento da diferença para permitir,
dentro da legalidade, as atrocidades do holocausto, evoluiu para contemplar a todos os
seres humanos o direito à igualdade, tratando o indivíduo de forma abstrata a tal ponto
dele vir a não ser reconhecido por seu semelhante, tendo sido urgente a correção do
curso no sentido de se reconhecer as suas diferenças. Entretanto, nada disso faz sentido
sem que os direitos humanos tenham como base fundante a ética. Do mesmo modo em
que se debate a visão hegemônica masculina no direito, discute-se a possibilidade da
própria ética estar contaminada com a visão masculina ao ponto de obscurecer a visão
da própria mulher, uma vez que ela mesma estaria vendo o mundo sob a ótica
masculina. Necessário se torna, então, a reflexão através do múltiplo dialético, de uma
ética feminista que dê conta de todas as conquistas obtidas pelos movimentos de lutas
para a libertação da mulher para prover os direitos humanos na perspectiva de gênero.
Verificou-se o impacto dos estudos de gênero para a compreensão dos direitos humanos
fundamentais. O diálogo com as reflexões de Nancy Fraser sobre a redistribuição dos
recursos econômicos em sociedades desiguais, uma vez que a justiça de gênero
empenha-se em discutir questões distributivas complementadas com as questões de
representação, identidade e diferença. O foco de nossas reflexões se concentrou sobre
as políticas feministas que anteriormente estavam centradas no trabalho e na violência e
agora as lutas de gênero ajustam seu foco na identidade e na representação,
evidenciando a relevância do assunto para a construção de uma sociedade democrática
em especial em relação aos direitos humanos fundamentais. Por outro lado, a análise da
relação entre o feminismo e as práticas sociais correntes deve ser feita a partir de sua
dualidade, ou seja, do impacto do feminismo sobre as percepções, comportamentos e
instituições sociais e do impacto destes sobre o movimento feminista. A contribuição
deste trabalho é no sentido do reconhecimento das identidades e diferenças nas
questões de gênero e para enriquecer a teoria crítica dos direitos humanos fundamentais,
inovado as pesquisas na área jurídica na perspectiva de gênero uma vez que tem como
fio condutor a ética feminista para a compreensão dos direitos humanos, para alcançar o
âmago dos direitos e garantias fundamentais na sua participação para a construção de
uma nova cultura humanista, na defesa dos valores da pessoa humana, uma vez que o
estudo sobre gênero objetiva desvelar os percalços das mulheres para verem efetivados
os direitos humanos fundamentais através do múltiplo dialético. / This study investigates how feminist ethics can promote fundamental human rights with
a gender perspective from multiple dialectical. Human rights has in its base a perception
of the male world need to be sensitive to acknowledge the other from its history, from its
social context, their culture, their differences. If, at first, humanity experienced the tragic
treatment difference to allow, within the law, the atrocities of the Holocaust, has evolved
to include all human beings the right of equality treating the individual in the abstract to
the point it does not come to be recognizes by his fellow, having seen an urgent course
correction in order to recognize their differences. However, none of this makes sense
without the debate on male hegemonic vision right, discusses the possibility of ethics
itself be contaminated with the male vision of the point of obscuring the vision of the
woman herself, since she should be seeing the world from the perspective male.
Becomes necessary, then the reflection through multiple dialectical a feminist ethics that
accounts for all the gains made by the movements of struggle for the liberation of
women to provide human rights from the perspective of gender. It is the impact of
gender studies to the understanding of fundamental human rights. The dialogue with
Nancy Fraser’s reflections o the redistribution of economic resources in unequal
societies, since gender justice strives of the distributive discusses complemented with
issues of representation, identity and difference. The focus of our reflections focused of
feminist politics that were previously focused on labor and violence and now struggles to
adjust its focus on gender identity, showing how relevant it is to build a democratic
society in particular respect to fundamental human rights. Moreover, the analysis of the
relationships between feminism and social practices currents must be made from its
duality, ie, the impact of feminism on the perceptions, behaviors and social institutions
and the impact of these on the feminist movement. The contribution of this work towards
the recognition if identities and differences in gender issues and to enrich the critical
theory of fundamental human rights, innovative research in the area of law in a gender
perspective since they have as a common thread for feminist ethics understanding of
human rights, to reach the core of the fundamental rights and guaranties for their
participation in the construction of a new humanistic culture, to defend the values of the
woman person, since the genre study aims to unveil the struggles of women to see
effected fundamental human rights through multiple dialectical.
