Previous issue date: 2015-10-07 / This thesis aims to assess the evolution of the right to religious freedom in the
Brazilian legal system, focusing on the rules and principles that underlie the
protection of freedom of belief. Analyzes the role of the State as guarantor of the
fundamental right to religious freedom, concomitantly with the full exercise of
citizenship. Shows the limits established by the Brazilian legal system the right to
religious freedom. Performs analysis of the current relevant case law to the subject,
focusing on the most controversial issues. Establishes the relationship between the
right to religious freedom with other constitutional principles, including the principle of
the secular state. Shows that religious freedom is a fundamental and universal right
to override the positive law and seeks to mention if there hierarchy between
fundamental rights. Discusses the right to religious freedom, focusing on the
relationship between the various religions and the state. Identifies which solution
offers Brazilian constitutional jurisdiction for matters relating to religious freedom and
the secular character of the state. / Esta tese tem por objetivo abordar a evolução do direito à liberdade religiosa no
ordenamento jurídico brasileiro, enfocando as normas e princípios que fundamentam
a tutela da liberdade de crença. No tocante a religião pode-se observar que cada
individuo é livre para escolher ou não uma determinada religiosidade. Analisa a
atuação do Estado enquanto garantidor do direito fundamental à liberdade religiosa,
concomitantemente ao pleno exercício da cidadania. Mostra os limites estabelecidos
pelo ordenamento jurídico brasileiro ao direito de liberdade religiosa. Realiza a
análise da atual jurisprudência pertinente ao tema, focando nos assuntos de maior
polêmica. Estabelece relação entre o direito à liberdade religiosa com os demais
princípios constitucionais, inclusive com o princípio do Estado laico. Demonstra que
a liberdade religiosa é um direito fundamental e universal que se sobrepõe ao direito
positivado, procurando aludir se existe hierarquia entre os direitos fundamentais.
Discorre sobre o direito à liberdade religiosa, enfocando o relacionamento entre as
várias religiões e o Estado. Identifica qual solução a jurisdição constitucional
brasileira oferece para as questões relacionadas com a liberdade religiosa e o
caráter laico do Estado.
