Rewarding inventive ingenuity through patent ownership as part of the Australian innovation strategyEliades, Dimitrios George January 2007 (has links)
The government has indicated that innovation fosters economic growth and is essential to maintaining a competitive position in international markets. Patents are the preferred mechanism by which the Australian Government and other governments encourage their nationals to protect their innovations. The question of the entitlement was raised in several cases in the Federal Court of Australia where there has been a failure to name all of the inventors on a patent grant (non-joinder) or where persons were mis-named as inventors, who were not and consequently have no interest in a grant (rnis-joinder). In both cases, parties who were not themselves daiming an entitlement to the invention, brought objections based on a number of grounds, including entitlement. The results have been the revocation of the patent in the case on the non-joinder of an inventor and in the case of mis-joinder, the preliminary view of a judge of the Federal Court has been, that the patent would be invalid through lack of entitlement. The result is that competitors are permitted to 'exploit' the invention, as the subject matter is not protected by a patent. The implications are far reaching, For example, where a research team in collaboration with another develops an invention but omits the inventive contribution of even one member of one team or includes a person who has not made an inventive contribution in the patent grant, the patent will be invalid. In these circumstances, the author considers that the result produces a disincentive to innovate. Consideration of this area in other jurisdictions reveals that the U.S. and the U.K. have recognised this as an unsatisfactory state of affairs. As a result, Congress in the U.S. made provision in their Patent Code in the early 1950's, that in the case of error or mistake giving rise to a non-joinder or mis-joinder of inventors, the patent would not be invalid but could be rectified by the Director of Patents and Trade Marks (the 'Director'). In the U.K., the Comptroller has powers to deal with a wide variety of cases involving entitlement to ownership of a patent. The situations include but are not limited to cases where some but not all of the persons entitled to the grant have been granted the patent, i.e. non-joinder, or where a person entitled to be granted a patent, has been granted a patent together with a person who is not entitled, i.e. mis-joinder. The thesis will focus on the non-joinder and mis-joinder of inventors, but the U.K. provision addresses a wider field of parties entitled, whether entitled as inventors or on some other basis. In addition, the U.K. and Germany have made provision restricting the persons who are able to challenge a patent on entitlement grounds. This is restricted to those persons having an interest in the patent, rather than open to any person, as is the case in Australia. The Australian decisions have been determined on historic cases dating back to the 17th century. It is timely to consider amendments which will overcome revocation of patents under Australian law, for what is essentially a matter between the persons interested. These amendments will accordingly encourage innovation, particularly in an environment where intellectual property has taken on greater importance and where the identification of the inventor has become more complex as collaborations in research become more common.

We conducted the study to explore and define the role of the social worker in Primary
Health Care. The medical care model on its own is viewed as inappropriate for
developing countries. We see Primary Health Care as holding the key to improving the
health status of the many disadvantaged communities in South Africa. The Primary
Health Care approach demands those health care providers, including social workers
work collaboratively to provide the best possible services to the communities. Social
Work is a profession concerned with the disadvantaged. However, social workers are
assigned a very limited role in Primary Health Care. Since participants are concerned
about subjective and experiential realities, participatory research was the appropriate
research method. The major findings and conclusions were that, social workers have
a role in Primary Health Care. They have to be assertive and tell others what is it that they do to find a place in Primary Health Care / Social Work / M.A. (Social Science (Mental Health))

Tagung des Sonderforschungsbereichs Transregio 96 „Thermo-energetische Gestaltung von Werkzeugmaschinen standen erste Ergebnisse zur Modellierung und Simulation von Komponenten und Baugruppen von Werkzeugmaschinen im Mittelpunkt. An den drei Standorten Aachen, Chemnitz und Dresden werden unterschiedliche Lösungsansätze für die steuerungsintegrierte Korrektur thermischer bedingter Strukturverformungen in spanenden Werkzeugmaschinen verfolgt. Von diesen wird eine unterschiedliche Wirksamkeit bzw. Eignung für verschiedene Einsatzfälle erwartet.
Bevor diese in der Praxis umgesetzt werden können, müssen Fragen zur Beschreibung der Wärmequellen und zur Wärmeübertragung beantwortet werden. Außerdem bedarf die Umsetzung der Konzepte in den CNC-Steuerungen effizienter Verfahren zur Modellierung und Simulation der thermisch bedingten Strukturverformung. Für die Entwicklung und Bewertung der Korrekturverfahren sowie zur Berechnung der notwendigen Achs-Korrekturen ist die Systemsimulation u. a. an einem prozessaktuelle Werkzeugmaschinenabbild erforderlich. Für die Bewertung ihrer Praxisrelevanz werden die Einzellösungen nach und nach in ein betriebswirtschaftlich orientiertes Gesamtmodell integriert.

Cette thèse a voulu mettre en regard les clivages entre culture instituée transmise par l’École, et culture(s) intime(s) des personnes (candidates à la VAE) en cause dans la recherche, dont son auteure. Cette mise en regard est nourrie par un but : montrer dans quelle mesure le travail d’écriture sur la pratique, à la fois individuel et collectif, permet-il d’articuler la singularité des sujets, des trajectoires, des expériences, des situations et des activités, à la généralisation du discours institutionnel relié aux procédures normées du dispositif VAE. Mais ce travail d’écriture permet-il aussi de construire des savoirs à partir de l’expérience, objet et source de développement, et de faire progresser langage et processus de pensée ? Notre troisième question : comment ce travail d’écriture à partir de l’analyse collaborative de la pratique conduit-il à faire se rencontrer l’enquête de la vie courante et l’enquête scientifique, dans l’effort partagé pour organiser l’expérience par sa reformulation, sa théorisation et son objectivation ? Trois hypothèses majeures, en lien étroit avec la théorie développé par Lev Vygotski sur le développement des fonctions psychiques supérieures, ont conduit la recherche : les interactions langagières produites lors d’un accompagnement en ZDP, dans une dynamique heuristique, éthique et collaborative, développeraient en synergie, des échanges inter et intra-psychiques ; ces interactions langagières favoriseraient les processus de conceptualisation, de réflexivité, d’internalisation, de langage intérieur et de positionnement de soi en tant qu’auteure de sa parole ; ces interactions transformeraient alors les rapports au monde, à autrui, au savoir et à l’écrit des scripteurs, ainsi que leur reconnaissance identitaire en tant qu’individu, et en tant que professionnel. / This thesis wanted to put on the opposite between established culture, transmitted by School, and private culture, the VAE candidates’ concerned by this research, as well as the author’s. This putting on the opposite is fed by a purpose: to show to what extent the individual and collective work of writing on practical, allows to articulate first the peculiarity of the subjects, the trajectories, the experiences, the situations and the activities, with the generalization of the institutional speech linked with the standardized procedures of the device VAE ? In a second time does this work of writing allows to build knowledges from the experience, object and source of development, and to make progress language and process of thought? Our third question: how does this work of writing from the analysis collaborative of the practice, lead to make the investigation of the common life meet the scientific investigation, in a shared effort to organize the experience by its reformulation, its theorization and its objectification? Three major hypotheses, in narrow link with the theory built by Lev Vygotski on the psychic development of the superior functions, led the research: the linguistic interactions produced during a support in development area potential , in a heuristic, ethic and collaborative dynamic, would develop in synergy, exchanges inter and intra-psychic ; these linguistic interactions would help the processes of conceptualization, reflexivity of insourcing, inner language and positioning of itself as author of his word; these interactions would transform then, relations to the world, to others, to the knowledge and to their writings, as well as being recognized in their individual and professional identity.

Im Mittelpunkt der 3. Tagung des Sonderforschungsbereichs Transregio 96 am 29. und 30.Oktober 2013 am Werkzeugmaschinenlabor der RWTH Aachen standen die verschiedenen Lösungsansätze der einzelnen Teilprojekte bei der Durchführung der experimentellen Untersuchungen zur Verifizierung von Simulationsergebnissen bzw. zur Ableitung von Modellparametern.

Secret key generation from reciprocal spatially correlated MIMO channelsJorswieck, Eduard A., Wolf, Anne, Engelmann, Sabrina January 2013 (has links)
Secret key generation from reciprocal multi-antenna channels is an interesting alternative to cryptographic key management in wireless systems without infrastructure access. In this work, we study the secret key rate for the basic source model with a MIMO channel. First, we derive an expression for the secret key rate under spatial correlation modelled by the Kronecker model and with spatial precoding at both communication nodes. Next, we analyze the result for uncorrelated antennas to understand the optimal precoding for this special case, which is equal power allocation. Then, the impact of correlation is characterized using Majorization theory. Surprisingly for small SNR, spatial correlation increases the secret key rate. For high SNR, the maximum secret key rate is achieved for uncorrelated antennas. The results indicate that a solid system design for reciprocal MIMO key generation is required to establish the secret key rate gains.
