Guidelines for testifying in court

This study was conducted with the aim to research guidelines for uniformed members, detectives, and public witnesses, for use in testifying in court. The researcher reviewed relevant literature, both national and international, in order to gain an in-depth understanding of the research problem. The researcher conducted the research on the basis of an empirical design, be-cause it involved going out into the field and ascertaining the personal experiences and knowledge of the participants. The explicit design was considered the most suitable for this research, because the researcher put everything in the open by checking the weak points and the strong points regarding testifying in court. A presente tese discute a comunicação como fator dependente da interação e da cortesia linguísticas inseridas nos manuais de etiqueta, visando a identificar explícita e implicitamente as estratégias interacionais apresentadas por três autores, escolhi-dos como corpus, os quais compõem três guias de comportamento: 1)Marcelino por Claudia: o guia de boas maneiras de Marcelino de Carvalho interpretado por Claudia, de Claudia Matarazzo; 2)Etiqueta Século XXI: um guia prático de boas ma-neiras para os novos tempos, de Celia Ribeiro; 3)Sempre, às vezes, nunca: etiqueta e comportamento, de Fabio Arruda. Destes três manuais, foram escolhidas algu-mas partes que cabiam à análise proposta. A pesquisa busca embasamento nas perspectivas da Análise da Conversação (AC) e na Sociolinguística Interacional (SI). Essas bases possuem duas linhas dorsais, com estudos sobre interações e cor-tesia linguística. Dá-se ainda uma visão panorâmica dos três livros pertencentes ao corpus, com uma breve análise da variação linguística. Investiga-se também a utili-dade desses manuais na melhoria dos níveis de interação social. A análise dos mar-cadores de cortesia percorre os critérios de correção, atenuadores, modalizadores, formas de tratamento e situações de ameaça às faces, visando a encontrar respos-tas para os questionamentos da pesquisa. Quanto aos aspectos comportamentais da cortesia são pouco mencionados, exceto os que estão inseridos no contexto fala ou na intenção de fala. O estudo parte de um ponto de vista sobre a cortesia linguís-tica; teoria de ameaça às faces positiva e negativa, concentrando-se na linguagem de interesse social e na interação entre indivíduos ou grupos. / This thesis discusses communication as an interaction-dependent factor and linguis-tic politeness inserted in etiquette manuals, in order to explicit and implicitly identify the interactional strategies presented by three authors chosen as corpus, which is comprised of some parts chosen from three manuals of behavior: 1) Marcelino by Claudia: the guide to good manners by Marcelino de Carvalho interpreted by Clau-dia, by Claudia Matarazzo; 2) 21st Century Etiquette: a practical guide to good manners for modern times, by Celia Ribeiro; 3) Always, sometimes, never: etiquette and behavior, by Fabio Arruda. This research seeks to establish the bases for per-spectives in Conversation Analysis (CA) and in Interactional Sociolinguistics (IS). These theorical bases have two dorsal structures or chief ideas, with studies on lin-guistic interactions and politeness. It gives still a birds-eye view of the three books belonging to the corpus, with a brief analysis of linguistic variation. It also investigates the usefulness of these manuals in the improvement of social interaction levels. The analysis of politeness markers traverses the criteria for correction, attenuators, modalizations (a speakers attitude towards their own utterance), forms of treatment, and faces threatening acts (FTA), in order to find answers to the researchs posing questions. Behavioral aspects of courtesy are mentioned only when inserted into speech context or its intention. The study originates from a point of view about lin-guistic politeness; threatening theory on positive and negative faces, focusing on the language of social interest, with the purpose of continuity of interaction between indi-viduals or groups.

The aim of my master thesis was to specify the business and diplomatic protocol in France and answer several questions that I defined. Are there any differences between the facts that we read in books and guides about French business and diplomatic protocol, and the reality? Can we generalize French business protocol and say that it is valid for all sectors and generations of managers? Can we claim that French diplomatic protocol is valid all the time and every single president sticks to it? The first chapter explains all the key terms - protocol, business protocol, diplomatic protocol, business negotiation, etiquette. The second chapter focuses on French business protocol, especially organization and course of business negotiation, dress code and gift-giving etiquette, and finally characterizes a typical French company. The third chapter focuses on French diplomatic protocol, especially on all aspects conserning ambassadors in France. The fourth chapter represents the practical part and gives several practical examples of French business and diplomatic protocol. This part is based on four qualitative conversations with four experts on this domain.

The thesis tracks the possibilities of working with education problems through using a book in kindergarten. The theoretical part sums up knowledge about the socialization of a child, social development of a preschool age child, about moral development, about social rules and social education of children in kindergartens. Further, it sums up knowledge about children's literature, especially about genres which present rules and norms of behavior. Furthermore, it sums up knowledge about suitable methods which can be used to work with educational stories. These are RWCT methods, reading strategies, methods of emotional education and methods of dramatic education. The practical part of the thesis is based on the mixed research. The objective of the quantitative part was to find out from teachers the most common education problems at children in kindergartens, using which methods can be worked with children's literature in mediation of these problems to children and specific proven titles of the children's literature. The objective of qualitative part of the thesis was to create a possibility to work with education problems on the basis of work with a book using methodical material aimed at children from 5 to 6-7 years. This study examines customer service in selected restaurants in the Tshwane area. It is aimed at establishing criteria for excellent customer service in restaurants, which can serve as the basis for building good relationships with customers. An extensive literature study was undertaken and aspects that were discussed in the secondary research include the various components of customer service, as well as the marketing environment of restaurants in South Africa and the Tshwane Area. An empirical study was conducted to namely to investigate customer service in selected restaurants in the Tshwane Area, with the aim to establish criteria for excellent customer service as a benchmark for establishing relationships with customers, by means of an exploratory study. A self-administered survey was conducted whereby questionnaires were handed to restaurant patrons with the restaurant bill folder. Based on the research results, criteria were developed for excellent customer service which can be used as a benchmark for establishing relationships with customers, by providing customer satisfaction, which leads to customer retention, loyalty and ultimately profitability for an organisation. / Business Management / M. Longtemps figé dans l'immobilité, le portrait peint de la Renaissance va s'animer grâce à une gestuelle qui fit l'objet d'une construction progressive. Très précoce, l'idée du geste: est présente dès 1440 chez Filippo Lippi dans les portraits féminins, à partir de 1450 chez Andrea del Castagno pour une effigie masculine et, en 1470, chez Antonello da Messina pour les mimiques. Mais la norme est au portrait en buste et d'autres freins, imposés par les commanditaires, perdureront jusqu'à la fin du XVIe siècle. En dépit des tentatives dissidentes d'Antonello da Messina, de Léonard de Vinci, ou, plus tard, de Bartolomeo Passerotti, c’est le modèle princier qui va s'imposer.Trois types d'écrits de l'Antiquité se préoccupent de l'apparence du corps et de la civilisation des mœurs : les préceptes éducatifs, souvent intégrés à des thèmes plus vastes, les traités de physiognomonie qui tentent de lire sur le visage les intentions ou la destinée de l'autre, et la rhétorique, qui s'intéresse plus particulièrement à l'ethos, au pathos mais aussi à la gestuelle de l'orateur. Ces textes seront reçus à la Renaissance dans divers domaines qui traitent tous, à un moment ou un autre, du geste. Les traités des éducateurs du Quattrocento, qui jalonnent la mise en œuvre d’une véritable réforme, cèderont la place aux manuels de savoir-vivre du XVIe siècle. A partir de 1455, les maîtres à danser lombards posèrent par écrit les premiers éléments d'une théorie de la danse. Les traités artistiques s'intéressèrent au decorum dans lequel s'inscrit le geste. Au tout début du XVIIe siècle, un certain nombre de conventions furent enregistrées dans des recueils illustrés de chironomie. Loin de considérer le doigt, la main ou les membres comme des détails sémantiques, cette thèse montre que la gestuelle est un signal social à replacer dans son environnement. Elle s’est ouverte sur l’histoire de l’éducation, centrale dans celle du geste, ainsi que sur celle du genre, ou encore de la place de l’enfant et de la parentalité. Une place importante a été consacrée à l’histoire du costume, celui que l’on a choisi pour ces images. Au terme de ce travail, il devient évident que le Moyen Âge n’est pas la seule période à avoir vu se développer une "civilisation du geste". L'analyse des textes, de l’Antiquité comme de la Renaissance, révèle une remarquable continuité dans la conception et les théories relatives à la gestuelle, sous-tendue par l'Institution Oratoire, particulièrement la partie traitant de l'actio. Quintilien eut une réception de longue durée dans les arts de la prédication et, de manière plus subtile, ses qualités d’éducateur et d’observateur de l'enfance ont également favorisé sa transmission dans le cadre pédagogique. Cet auteur enseignait l’utilisation programmée du geste pour appuyer le discours, pointant comme un défaut la négligence dans "la toge, la chaussure et le cheveu". Déjà pour lui, ce soin devait être imperceptible, l’éducation et l’apprêt physique devenant comme une seconde nature, la sprezzatura avant l'heure. Parcourant nos images, la référence à l'actio qui s'est imposée depuis l'Antiquité dans l'éducation, l'expression, la représentation imagée ou théâtrale, rend compte de la précocité de cette civilisation et de sa pérennité dans le temps. Le geste s’impose comme un patrimoine vivant, transmis le plus souvent de manière inconsciente de siècle en siècle, par le biais d’une multitude de canaux et de disciplines, parmi lesquels on compte le portrait, à la fois récepteur et vecteur. / The portrait, long considered as a rigid pictorial genre, became increasingly lively through the progressive introduction of gestural expression. This idea appeared as early as 1440 in Filippo Lippi’s female portraits, in 1450 in Andrea del Castagno’s painting of a man and in 1470, in Antonello da Messina’s mimes. But the standard surrounding is bust-length portraiture and other restrictions on movement, imposed by the commissions, lasted until the 16th century. Despite various dissenting works, such as those of Antonello da Messina, Leonardo Da Vinci, or later, Bartolomeo Passerotti, the Princely model held sway.In Antiquity, three literary categories, each with a different approach, addressed the appearance of the body and civilization of the customs : educational precepts often contained within vaster literary works, physiognomic treatises — which attempt to read from faces an individual’s intentions and destiny — and rhetorical studies which, in particular, concern the ethos and the pathos, but equally the orator’s gestures. During the Renaissance these three disciplines all influenced various domains, which are interested, at one point or another, in the gesture. The Quattocento’s didactic treatises, which paved the way for a true reform, were replaced by manuals of etiquette in the 16th century. From 1455, the Lombard dancing masters wrote the initial elements of a theory of dance. Artistic treatises on painting and sculpture insist on the decorum which included gesture. At the very beginning of the 17th century, a certain number of modern conventions were recorded in illustrated collections of chironomy.Far from considering the finger, the hand or the members as semantic details, this thesis shows that body movement is a social signal to be placed back in its environment. It open on the history of education, central in that of gesture, as well as on that of the genre, or still the place of children and the parenthood. An important place was dedicated to the history of the garment, the one that was chose for these pictures.Through this work, it becomes obvious that the Middle Ages are not the only period to have seen developing a "civilization of the gesture". The analysis of texts, of Antiquity as of Renaissance, reveals a remarkable continuity in the conception and the theories relative to the body movements, underlain by the Oratorical Institution, particularly the part dealing with the actio. Quintilien had a long-term reception in the arts of preaching and, in a more subtle way, his qualities of educator and observer of the childhood also favoured his transmission in the educational frame. This author taught the use scheduled of the gesture to support the speech, considering a defect the carelessness in "the toga, the shoe and the hair". Already for him, this care was to be imperceptible, the education and the body care becoming as a second nature, the sprezzatura before time. Browsing our images, the reference to the actio that got established since Antiquity in education, expression, and both pictorial and theatrical imagery, acknowledges how precocious that civilization was and how perennial it has been.The gesture is asserted as a living heritage, transmitted more or less consciously through time, through a myriad of conduits and disciplines, including the portrait, both as recipient and vector.

The thesis deals with self-censorship on the biggest online social network Facebook. The main purpose was to determine the reasons for using self-censorship on Facebook. Qualitative research was elaborated with usage of semi structured interview focused on virtual world of active Facebook users and on deeper examination of it. Theoretical part describes concepts and ideas related to the theme of the thesis. The methodological part describes in detail the qualitative research and it's requirements. The analytical part deals with the research itself, analysis of transcribed interviews and with the rules designed by researcher for safe use of Facebook by children. The researcher has decided to set the rules from the findings determined during the creation of the thesis. The self-censorship is the key to the safe behavior on Facebook. Every user of this social network has to learn how to distinguish, what could be placed there and what shouldn't.

A study of God’s encounter with Abraham in Genesis 18:1-15 against the background of the Abraham narrative

The present work is a new attempt to interpret on the episode in Genesis 18:1-15 by the method of narrative criticism. The general tendency on the narrative had focused on the exemplary act of Abraham’s hospitality interpreting it as his righteousness by the perspective of NT (Heb 13:2) or by the test motive of Greek Myth (the birth of Orion). The retributive theology was considered too much in interpreting the Fellowship narrative (Gn 18:1-15).These interpretations conflict with the narrator’s own theological views: (1) righteousness by faith (Gn 15:6), (2) God’s mercifulness to save Lot (Gn 19:29), and (3) God’s being gracious to make Sarah conceive (Gn 21:1). This study attempts to find out the author’s own interpretative view indicated in the whole Abraham narrative (Gn 11:27-25:11) as well as in the Fellowship Narrative itself (Gn 18:1-15).The present work is an attempt to interpret on the narrative by the method of narrative criticism. This study pays attention to the narrator’s various literary skills: “linking structure with preceding episode” (Gn 18:1a); “Sandwiched structure” of the larger context (Gn 18:1-21:7); Unique Plot Sequence; and Repeated Clue word and phrase (“laugh,” “Sarah,” ”this time next year”). These literary skills are understood to indicate the faithfulness of the Lord who tries to fulfill what he promised. The conclusion of this study overturns the traditional interpretations on the Fellowship Narrative. This work attests that Abraham showed his righteousness not by doing hospitality but by obeying God’s new command of circumcision out of willing heart as he used to obey the Lord’s commands having faith in the promise of the Lord (ch.5.3.2.2). The motive of God’s visit is to have the covenantal fellowship with obedient Abraham (ch. 2.1.6; 2.1.6.1). Abraham’s first moment recognition of deity is attested by interpreting of the technical pair verb, “And he lifted up his eyes and he saw and Lo!” (Gn 18:2a), which depicts prophetic experience of Abraham (ch.3.3). Abraham’s manner for the visitors is relevant to the higher ones (ch.3.3.2.1). The futile human endeavor without having faith is considered as the reason of being delayed of fulfillment of God’s promise (Gn 16).
