Statuten mittelalterlicher Ordensgemeinschaften: Strategien normativer Stabilisierung mittels statutarischer Gesetzgebung am Beispiel der Zisterzienser, Prämonstratenser, Dominikaner und Franziskaner

Die Dissertation beschäftigt sich mit dem Partikularrecht mittelalterlicher Ordensgemeinschaften, wobei im Mittelpunkt der Untersuchung ein struktureller Vergleich der Statuten und Konstitutionen ausgewählter religiöser Orden und Kommunitäten des Hoch- und Spätmittelalters steht. Vom ius commune blieb das Recht der Orden recht unberührt, wobei einer der Gründe - neben der unüberschaubaren Vielfalt - die den Orden vom Papst zugebilligte weitgehende Rechtsautonomie gewesen sein dürfte. Die Orden nutzten diesen Freiraum in extensiver Weise und schufen sich eigene partikulare Rechtstexte. Zu den basalen Normen der hochmittelalterlichen Orden und Gemeinschaften gehören die Regel, sodann consuetudines, Statuten und weitere normative Texte. Es hat jedoch den Anschein, dass für die Zeitgenossen oft keine klaren Unterscheidungsmerkmale zwischen den verschiedenen Bezeichnungen existierten. Der kleinste gemeinsame Nenner der bisherigen Forschung für eine Definition von Statutentexten ist wohl der, dass es sich um schriftliche, im Konsens gesatzte, in die Zukunft wirkende Normen handelt. Die Studie soll diese Auslegung überprüfen und genauer bestimmen. Dabei wird ein möglichst breiter Vergleich der Statutentexte verschiedener mittelalterlicher Orden und Religiosengemeinschaften angestrebt. Hierbei muss freilich auch auf die Eigenheiten und unterschiedlichen Verfassungsstrukturen der Verbände eingegangen werden, um zum einen diejenigen Institutionen zu beschreiben, welche legislative Kompetenzen besaßen und zum anderen zu erörtern, wie stark diese Befugnisse jeweils ausgeprägt waren. Ein weiterer Schritt ist schließlich die vergleichende Untersuchung der Texte selbst sein. Hierbei steht weniger der inhaltliche, sondern vielmehr der strukturelle Vergleich im Vordergrund, um Aussagen zum Typus ‚Statut‘ treffen zu können. Das heißt, dass Aufbau und Anlagemethode der Texte sowie ihr eigentümlicher Duktus beziehungsweise Formulierungsmuster beleuchtet werden. Im Ergebnis zeigen sich vergleichend unterschiedliche Entwicklungen und Strukturmuster auf.

Canonization of Saint Thomas Aquinas Abstract This thesis inquires into the canonization process of Thomas Aquinas, in relation to specific circumstances and general usage of the era on the field of canonizing saints. While at the grave of the reverend master, miracles were produced and the popular cult was rising, on western universities, a doctrinal dispute has flared up which touched Thomas' doctrine, as well. The case has not be resolved untill nearly fifty years, when the pope John XXII has shown interest in canonizing one important personality of Dominican order. The choice fell on Thomas. The minor friars, protected by the roman king Louis IV the Bavarian, oposed but the pope got his purpose through, and so Thomas' learning became the leading stream in theology and thinking. The aim of this thesis is to approach period specificities of the cult of saints and canonization processes, to outline a brief history of Thomas' way to canonization and following occurrences, and to try to figure out broader context of the process, evaluating the importance of particular aspects at the same time. The thesis is based on canonization documents and relies on relevant sources and specialized literature. The patronage of the Spiritual Franciscans : the roles of the Orsini and Colonna cardinals, key lay patrons and their patronage networks

The survival and success of religious reform groups in the late medieval period was often due to the efforts of an ecclesiastical patron, a powerful and often wealthy individual who exerted their influence on behalf of the group or their leaders and spokesmen. This thesis uses the wealth of documentation available on the Spiritual Franciscans to explore the origin, development and wider effect of the relationships between the most powerful ecclesiastical patrons of the reformers and their clients, spokesmen for the Italian Spirituals at the papal court who were taken into the patrons’ households for years or even decades. During that time, the political fortunes of the different groups of Spiritual Franciscans fluctuated dramatically: in only a handful of years they went from hopeful expectation at the Council of Vienne c. 1311 to heresy trials, imprisoned spokesmen and friars burned at the stake c.1317-1318. Using testaments from the patrons’ families and the patrons themselves, the thesis explores the possible reasons for the patrons’ initial attraction to their Spiritual Franciscan clients. Letters, chronicles and exegetical texts written by the clients during and after their time in the patrons’ households are examined along with papal registers and other narrative and epistolary sources to develop models of the nature and progression of the patronage relationship, and how it survived in the face of periods of intense disapproval and harassment from the papacy, other prelates and some members of the Franciscan hierarchy. After establishing a framework for the progression of the patronage relationship, evidence of art patronage and other religious and patronage interests that the patrons and clients shared is used to develop a deeper understanding of how the patrons’ choice to involve themselves with the Spiritual Franciscans positively or negatively affected others in their orbit, especially their other clients.

Il primo secolo di storia della Franciscan Printing Press, tipografia francescana nata a Gerusalemme nel Convento di San Salvatore nel 1847, è stato suddiviso in quattro fasi, corrispondenti alle quattro parti della tesi di dottorato "Comunicare la fede: il fondamentale contributo della tipografia francescana di Gerusalemme (1847-1947). Un secolo di storia". La parte iniziale (che copre il triennio 1847-1850) è dedicata alle intricate vicende che hanno portato alla fondazione della stamperia, dal ristabilimento del Commissariato Generale di Vienna fino alla pubblicazione del primo vero volume, un Catechismo in arabo ed in italiano ad uso dei fedeli di Terra Santa del 1847. La seconda sezione si concentra su un periodo enormemente innovativo (1850-1879) e, al tempo stesso, gravemente critico. Dopo una ricognizione circa i nuovi strumenti in uso nell’officina (dal torchio d’accidente a quello litografico, passando per la creazione di un laboratorio per la fusione di caratteri tipografici), sono stati analizzati i nove anni (1865- 1874) più incerti della stamperia, in cui i francescani rischiarono a più riprese di perdere il possesso dell’officina. La terza sezione racconta una fase, quella tra 1879 e 1898, più tranquilla e stabile della precedente, ma non meno ricca di avvenimenti: tanti sono stati gli sforzi, in questo tempo, per disciplinare la FPP, uniformandola alle officine europee. I dati raccolti su questo periodo consentono anche una indagine della struttura sociale-culturale della Palestina di fine Ottocento. La quarta e ultima parte documenta, in fine, un periodo decisamente più lungo dei precedenti, che ha avuto inizio nel 1899 e si è concluso dopo la Seconda Guerra Mondiale, con la nascita dello Stato d’Israele. Cinquanta anni (o quasi), segnati da grandi e gravi sconvolgimenti politici, in cui la tipografia francescana è riuscita sempre a configurarsi come istituzione pacifica e costruttiva, mai polemica. Nel ricostruire i primi cento anni di attività di una tipografia che è casa editrice e insieme opera missionaria, e che ha anche il merito di essere stata la prima a stampare in arabo in tutta la Palestina, si può facilmente scadere nel racconto agiografico, nell’estremizzazione del lato sociologico. Contro il rischio di una lettura ideologica delle fonti si è quindi operata una scelta storiografica particolare, dettata dalla volontà di far parlare in prima persona gli attori che hanno vissuto concretamente tutte le fasi della stamperia francescano-gerosolimitana nel suo primo secolo di attività. Per questo motivo, all’interno della tesi, viene dato ampio spazio a due tipi di documenti, librari e archivistici (che occupano pure un’appendice dedicata in fine di ogni sezione). Per rendere più agevole la fruizione degli argomenti trattati, che coniugano la ricerca storica secondo il proprium della storia del libro, si poi è scelto di accompagnare il testo con fotografie inedite di libri, documenti d’archivio e attrezzi di stampa originali della Franciscan Press, ritrovati (tanto fortunatamente quanto fortuitamente) in un deposito sotterraneo del Convento di San Salvatore. / The first century of history of the Franciscan Printing Press, a Franciscan printing house established in Jerusalem at St. Saviour's Convent in 1847, has been divided into four phases, corresponding to the four parts of the doctoral dissertation “Communicating the Faith: the fundamental contribution of the Franciscan Printing Press in Jerusalem (1847-1947). A Century of History”. The initial part (that covers the three-year period 1847-1850) is dedicated to the intricate events that led to the founding of the printing house, from the re-establishment of the General Commissariat in Vienna to the publication of the first volume, a Catechism in Arabic and Italian for the use of the worshippers of the Holy Land in 1847. The second section focuses on an enormously innovative and critical period (1850-1879). After a survey of new and old tools used in the typography, the section focuses on nine years (1865-1874), in which the Franciscans risked several times to lose the possession of their Franciscan Printing Press. The third section covers a less complicated period, between 1879 and 1898: many efforts were made during this time to discipline the FPP, bringing it into line with European workshops. The data collected also allow an investigation of the social-cultural structure of Palestine at the end of the Nineteenth Century. The fourth and last part is focused on a longer period, started in 1899 and ended after the Second World War, with the birth of the State of Israel. Fifty years marked by great political upheavals, in which the Franciscan printing house always managed to configure itself as a peaceful and constructive institution.

Globalization has turned the world into one ”huge village”. Various nations and cultures have integrated during this process and multiculturalism has resulted. Yet, many people are struggling to accept one another as members of one ”global village”. The difference in culture, race and ethnicity are creating barriers amongst the various nations. These hurdles prevent many communities from living in peace and harmony. Religious community are also facing similar struggles. The Franciscan Sisters of the Immaculate Conception (FIC) and other international congregations are called by the Bible and the church to give hope of unity in a diverse cultural context. Towards a Franciscan model of Clinical pastoral supervision is a study of interaction between two movements: Clinical Pastoral Education (CPE) and Franciscan Spirituality. Francis and Clare were the primary founders of the Franciscan movement and Franciscan spirituality arose from their reflections on their unique response of following Christ. From the early Franciscan sources, essential elements are retrieved. Compassion is illustrated as a key quality of this model through textual analysis of four stories of Francis and his early followers. Clinical Pastoral Education is a result of the contributions of three founders: Keller, Cabot and Boisen. Clinical pastoral supervision (CPS) is a distinguishing concept of CPE. Various models of CPS are categorised according to three paradigms of western society: classical, modern and postmodern. The study concludes by framing a Franciscan model of clinical pastoral supervision. Contemplation and compassion are the two Franciscan characteristics which give this model a unique Franciscan dimension. / New Testament / M.Th.
