Vybrané problémy trestní odpovědnosti právnických osob / Selected issues of the Criminal Liability of Legal Entities in the Czech Republic

The aim of the present thesis was to determine the problems of the current legislation of the criminal liability of legal persons and to consider whether it is possible to adopt the legislation as it is applied in England and Wales and use it into the legal order of the Czech Republic in compliance with the development of Czech legislation and England and Wales. Due to the extensiveness of the issue, only certain problematic parts of the legal order of the criminal liability of legal persons in the Czech Republic were selected. Attention was focused on the questionable parts selected only from the substantive part of the law. The approach to criminal liability of legal persons is diverse in the Anglo-American system. Variation can be seen at the level of individual states belonging to the system and at the federal and state levels. The first part of the thesis summarizes the development of the legal liability of legal persons in England and Wales, which were selected as the representatives of the Anglo-American system of legal culture. These countries were chosen because of the author's personal experience, which was gained during studies abroad, specifically in the United Kingdom. Title of the Diploma Thesis: Criminal Liability of Legal Persons Abstract: Through this diploma thesis, the author presents a comprehensive summary of the phenomenon of criminal liability of legal persons, to the individual contexts of which presents his considerations. He discusses this phenomenon from many points of view, which correspond to the structure of his diploma thesis, as it forms its individual parts. These aspects are the legal theoretical background of this issue; the historical development of the phenomenon, including common law and civil law culture; legislative developments in the Czech Republic; positivist analysis of the applicable substantive legislation contained in Act No. 418/2011 Coll., On Criminal Liability of Legal Entities and Proceedings against them; a comparative analysis of the substantive legislation of the Czech and Slovak Republic and the subsequent summarization of the application of this new form of liability in the practice of the Czech courts. This thesis is dedicated to issues of criminal liability of legal entities. Act no. 418/2011 Sb., Act on Criminal Liability of Legal Persons and Proceedings Against Them (hereinafter as "the Act") came into force on January 1th , 2012. Adopting appropriate legislation Czech Republic not only met its international commitments, but also reacted to the fact that legal entities are becoming an instrument for committing serious types and forms of crime. The aim of this thesis is the analysis of the terms of criminal responsibility of the legal entities in context, taking into account strengths and weaknesses of the effective legal regulation. Studying the general issues of the offense responsibility of legal entities is the precondition for submitting integrated analyses of this specific section of the Act. This thesis is divided into three parts, which are formed by chapters, its sections and subsections. Resume Criminal liability of legal entities is relatively new institute in continental legal culture and the Czech republic was one of the last countries in Europe that accepted this concept. In addition, this concept was introduced not by the conviction of its necessity, but for reasons of international policy. Criminal liability of legal entities, however, was introduced to Czech law by Act no. 418/2011 Sb., on Criminal Liability of Legal Entities and their Prosecution. Therefore it is necessary to deal with this issue. The aim of this thesis is to make a comprehensive analysis of the Act on Criminal Liability of Legal Entities and their Prosecution, to analyze its most important provisions, as well as to define the provisions which are considered problematic, together with proposals for amendments and further innovation of current legislation. The first chapter defines the concept of legal entity that the Act on Criminal Liability of Legal Entities and their Prosecution doesn't define itself. O uso do terceiro molar na estimativa de idade em brasileiros / The use of third molar in the age estimation in Brazilians

A estimativa de idade em indivíduos vivos ou mortos desempenha um importante papel das ciências forenses, pois pode ser requisitada para propósitos civis ou por razões criminais: desastres em massa, adoção, asilo, direitos civis ou imputabilidade penal, dentre outros. Os dentes desempenham um protagonismo neste contexto, pois são mais resistentes que os ossos em condições ambientais extremas e seu desenvolvimento dificilmente é afetado por fatores exógenos ou endógenos. Pelo fato dos terceiros molares (3ºM) serem os únicos ainda em desenvolvimento a partir dos 14 anos de idade, tornam-se úteis para determinar se um indivíduo atingiu a maioridade legal aos 18 anos de idade. As técnicas desenvolvidas na atualidade para estimativa de idade em pessoas vivas em sua maioria dependem de imagens radiográficas dos dentes, pois é um método não-invasivo e com potencial de conseguir amostras de banco de dados de clínicas radiológicas para estudos populacionais. Este estudo almejou verificar o método de Cameriere et al. (2008c) (MC) em brasileiros, no intuito de estabelecer parâmetros para discriminar se um indivíduo é maior ou menor de 18 anos de idade a partir do índice de maturidade do 3ºM (I3m); também teve como objetivo comparar a sensibilidade (SE) e a especificidade (ES) deste método com os estágios G e H do método desenvolvido por Demirjian et al. (1973) e adaptado por Mincer et al. (1993) (MD). A análise de 444 radiografias panorâmicas de indivíduos entre as idades de 14 a 22 anos resultou em, para o valor de corte do I3m<=0,08 (MC), uma SE de 77,4%, uma ES de 86,2% e uma probabilidade estimada (PE) corretamente de 87,8%. Para o MD foram encontrados, respectivamente para os estágios G e H, SE: 80,54% / 52,94%, ES: 85,27% / 95,54% e PE: 86,8% / 94,2%. Diferenças significativas de dimorfismo sexual, com mineralização mais precoce para o sexo masculino, foram encontradas apenas paras médias de idade pertencentes às faixas de I3M>=0,08 (MC) - à exceção da faixa [0,7, 0.9) - e aos estágios E e F (MD). O método é adequado para estimar a idade adulta para propósitos forenses em brasileiros, entretanto deve ser aplicado cuidadosa e criteriosamente. Recomenda-se uma combinação de diversos métodos disponíveis para aumentar sua acurácia, bem como o estabelecimento de diferentes parâmetros de probabilidade para determinar se uma pessoa é maior ou menor de 18 anos de idade, a depender dos diferentes requisitos legais, se civil ou criminal. Para brasileiros, o método atinge sua melhor performance com I3m<=0,13 (MC) ou estágio G (MD), parâmetros recomendados para considerar a maioridade legal para fins civis, administrativos e trabalhistas. Para fins criminais, recomenda-se o I3m<=0,05 (MC) ou estágio H (MD). / The age estimation of living or dead individuals is an important part of forensic sciences because it can be used in various situations, including mass disasters, or for civil or criminal reasons, such as adoption, asylum, civil rights or criminal responsibility. Teeth play a major role in this context because they are more resistant than bones in extreme environmental conditions and their development is hardly affected by exogenous or endogenous factors. Because the third molars (3rdM) are still in development from the age of 14, they are useful for determining whether an individual has reached the legal age of 18 years. The techniques developed at present to estimate the age of living people mostly rely on radiographic images of teeth, because it is a non-invasive method and has potential to get samples database of clinical radiological for population studies. This study aims to verify the method of Cameriere et al. (2008) (CM) in Brazil to discriminate whether an individual is under or over 18 years from the maturity index of the 3rdM (I3m), as well as comparing the sensitivity (SE) and the specificity (SP) of this method with the G and H stages of the Demirjian et al. (1973) method (DM) modified by Mincer et al. (1993). The analysis of 444 panoramic radiographs resulted in a SE of 78.3%, a SP of 85.1% and a correct classification (CC) of 87%, for a cutoff value of I3m <= 0.08 as in original study. Significant differences in sexual dimorphism in the early mineralization of males were found only for the average age belonging to the bands I3m >= 0.08, except for the range [0.7, 0.9). For the MD were found, respectively, for the G and H stages - SE: 80.54% / 52.94%, SP: 85.27% / 95.54% and CC: 86.8% / 94.2%. The method is suitable for estimating adulthood for forensic purposes in Brazil, although it must be applied carefully and judiciously. We recommend a combination of several methods that are available to increase accuracy as well as the establishment of different parameters that are likely to determine whether a person is more or less than 18 years of age, depending on the different legal requirements, whether civil or criminal. For Brazilians, MC an MD achieve its best performance with I3m <= 0.13 or G stage, respectively, recommended parameters to consider the legal age for civil purposes. For criminal purposes, it is recommended I3m <= 0.05 (CM) or H stage (DM).

L'apport des théories morales de la responsabilité pour penser l'imputabilité des crimes de guerre

Imputer un acte à quelqu'un soulève déjà des difficultés propres. Mais ces difficultés sont encore augmentées lorsque c'est un crime de guerre que l'on cherche à imputer. En effet, à qui attribuer un crime lorsque la structure engage des actions collectives (bataillons, foules, organisations résistantes) ou que les actes commis ont été ordonnés par des supérieurs hiérarchiques ? Comment prendre en considération le fait que le contexte de guerre peut-être perturbant ou traumatisant pour les soldats, sans pour autant en venir à excuser les actes commis ? Et pourtant, il faut arriver à proposer des solutions, car ces questions revêtent une importance capitale, non seulement au sein des procès internationaux, mais aussi dans le contexte général d'après-guerre. L'exactitude des inculpations, la visibilité des méthodes juridiques et des procédures sont autant d'éléments qui acquièrent une portée particulière dans les efforts pour installer une paix aussi durable que possible. De plus, l'établissement des responsabilités, au niveau des individus comme au niveau des États, doit permettre de comprendre ce qui a rendu possible des crimes au sein d'un conflit armé et ainsi de penser les éléments possibles d'une prévention. / My research starts from the statement that imputing an act on someone raises its own difficulties. But these difficulties are increased when it is a war crime that we have to attribute. Indeed, to whom does one accredit a crime when the context engages collective actions (battalions, crowds, resistant organizations) or when acts performed were ordered by superiors in the hierarchy ? How to consider the fact that the context of war can be disturbing or traumatizing for soldiers, without going so far as to excuse them of their crimes? And nevertheless, it is necessary to propose solutions, because the question takes on major importance, not only in regard to justice within international lawsuits, but also in the post-war general context. Indeed, the exactness of accusations, the visibility of legal methods and procedures are some of the many elements which acquire a particular impact on the efforts to settle a peace that will be as durable as possible. It is more than 6 yeas as of the moment when Act No. 418/2011 Coll., on penal liability of legal entities and proceedings against them, entered into effect, however, in spite of it inland legal regulation still offers a number of key application and conceptional issues. The achieved objective of the dissertation work submitted was to provide comprehensive and detailed interpretation of the existing legal regulation of the conditions when criminal liability of legal entities is established and to point out, in that interpretation, to some of its particularities, deficiencies or ambiguities in the interpretation. In order to achieve that objective, the author dealt with not only Czech legal regulation as such, however, also with wider topics that clarify the origination of this form of penal liability but that can also help interpreting problematic legal institutes or be the basis for next amendments to the law, if any. For this purpose, the presented dissertation work is divided in four main chapters. The first part contains introductory and fundamental issues of the criminal liability of legal entities. Les éléments constitutifs : essai sur les composantes de l'infraction / The constituent elements : essay on the offence components

Les éléments constitutifs sont omniprésents en droit pénal. Pourtant, il s’observe un profond désordre en la matière, où aucun consensus n’existe. Ils varient, selon les auteurs, dans leur nombre et leur contenu. Les hésitations qui les entourent trahissent de profondes incertitudes quant à leur nature, leur objet, ou encore leur fonction. Il existe pourtant un enjeu réel à la détermination des éléments. Instrument principalement didactique, ils sont aussi un outil au service du principe de légalité. Définis par le législateur, ils doivent être vérifiés par le juge pour que la condamnation soit légale. Or, outre le fait que les éléments conditionnent la caractérisation des infractions, ils peuvent aussi en guider la qualification. Pour ce faire, il faut toutefois parvenir à identifier un schéma d’analyse qui, révélateur de l’infraction, vaille pour toutes les infractions. Un tel schéma peut être dégagé une fois l’outil précisé. En revenant sur son émergence, des indices de la nature et de la fonction exactes des éléments peuvent être trouvés. Initialement, ils ont permis de préciser la teneur du comportement infractionnel, en rendant effective une certaine conception de l’infraction. C’est de cette idée qu’il faut partir : elle éclaire sur ce que sont et quels sont les éléments. L’infraction répond à des principes qui lui donnent une certaine physionomie. Elle possède à ce tire des composantes essentielles qui résultent de ce que le législateur n’est pas totalement libre dans le choix des comportements incriminés. Identifiés puis approfondis pour en déterminer la teneur exacte, les éléments constitutifs peuvent être un outil efficace, présentant des intérêts aussi bien pratiques que théoriques. Ils permettent de circonscrire l’infraction, de mieux en appréhender les spécificités et, par suite, de l’identifier, là où les critères actuels se révèlent insuffisants. C’est une approche renouvelée de l’outil qui peut être proposé, laquelle conduit à dégager des éléments qui, une fois précisés, sont la mesure de l’infraction. / Constituent elements are omnipresent in criminal law. Nevertheless, there is no consensus about them. They vary through the authors in their number and content. The hesitations surrounding them betray deep uncertainties about their nature, object or function. There is, however, a real stake in the determination of the elements. As a primarily didactic instrument, they are also a tool for the principle of legality. Defined by the legislator, they must be verified by the judge so that the conviction is legal. Besides the fact that the elements determine the characterization of infringements, they can also guide their qualification. In order to do this, however, it is necessary to identify a pattern of analysis that, indicative of the infringement, applies to all infringements. Such a scheme can be cleared once the tool has been specified. By returning to its emergence, clues to the nature and exact function of the elements can be found. Initially, they made it possible to specify the content of the offending behaviour, by making a certain conception of the offence effective. It is from this idea that we must start: it illuminates what they are and which they are. The offence corresponds to principles which give it a certain physiognomy. In this respect, it possesses essential components which result from the fact that the legislator is not completely free in the choice of the conduct complained of. Identified and further developed to determine its exact content, the elements can be an effective tool with both practical and theoretical interests. They make it possible to circumscribe the offence, to understand the specificities and, consequently, to identify it, where the current criteria prove insufficient. It is a renewed approach to the tool that can be proposed, which leads to the identification of elements that, once specified, are the measure of the offence.
