La coopération juridique franco-brésilienne / French-Brazilian legal cooperationMarques, Silvio Antonio 08 September 2017 (has links)
Depuis la fin du XXème siècle, le nombre d'enquêtes et de procédures judiciaires civiles et criminelles internationales a considérablement augmenté à cause de la mondialisation de l'économie et de la facilité de transport de personnes et de biens. Toutefois, les normes de coopération juridique internationale, y compris celles existantes entre la France et le Brésil, n'ont pas accompagné cette évolution. En réalité, l'assistance juridique internationale a toujours faiblement fonctionné à cause, notamment, de la défense rigoureuse de la souveraineté étatique, de l'absence de confiance mutuelle et de coordination entre les pays. La distribution de pouvoirs dans la communauté internationale est faite horizontalement, de sorte que les normes d'assistance entre les États sont marquées par la décentralisation et le particularisme. Dans la plupart des régions du monde, l'accomplissement des demandes d'entraide judiciaire est lent et bureaucratisé, en dépit de la signature de nombreux traités bilatéraux et de conventions régionales et mondiales. L'extradition est encore réalisée presque selon la même formule inventée par les égyptiens et les hittites en 1280 av. J.-C .. La commission rogatoire, dont les racines se retrouvent dans les systèmes de la litterœ publicœ romaine et de la lettre de pareatis française, est encore le principal outil d'entraide civile et pénale. Quelques normes qui peuvent être classées comme de première génération prévoient encore l'utilisation de la voie diplomatique indirecte. Les règles de deuxième génération, créées, notamment, à partir de la fin du XXème siècle, ont amélioré la transmission de demandes, à travers les autorités centrales, mais ne résolvent pas tous les problèmes. En fait, seules les normes de l'Union européenne sont véritablement de troisième génération, parce qu'elles privilégient l'envoi direct de demandes d'entraide civile et pénale, la rapide exécution du mandat d'arrêt européen et l'accomplissement d'une grande quantité de jugements civils sans exequatur ou autre procédure intermédiaire. Les normes de coopération juridique franco-brésiliennes, qui découlent des conventions signées en 1996, sont aujourd'hui dépassées et anachroniques. Les règles de droit interne des deux pays qui visent l'assistance internationale sont franchement plus généreuses et plus efficaces que les règles d'origine conventionnelle. L'élaboration de nouvelles conventions surgit ainsi comme une solution envisageable, malgré les énormes défis politiques et juridiques. Évidemment, les conventions éventuellement parrainées par les Nations Unies ou par la Conférence de La Haye qui traitent de la coopération juridique directe semblent plus appropriées à une résolution plus ample des principales questions. Mais rien n'empêche la conclusion de textes régionaux, inter-régionaux ou même bilatéraux, mais leur étendue serait plus restreinte. / Since the end of the twentieth century, the number of international investigations and legal proceedings in civil and criminal matters has grown considerably due to the globalization of the economy and the ease of transportation of people and goods. Nevertheless, the international legal cooperation rules and regulations, including those between France and Brazil, have not kept up with this evolution. In fact, the international legal cooperation has always been flawed, mostly as a result of the rigorous defense of state sovereignty and the lack of mutual trust and coordination among countries. The authority distribution in the international community is made horizontally, thus the norms of assistance among States are marked by decentralization and particularism. In most regions of the world, the enforcement of legal cooperation claims is slow and bureaucratized, despite numerous treaties and bilateral, regional or international conventions. Extradition is still carried out in accordance with practically the same formula invented by the Egyptians and Hittites in 1280 B.C .. The letter of request, which springs from the Roman litterœ publicœ and the French lettre de pareatis, is still the major tool of civil and criminal legal cooperation. Some standards, regarded as first-generation, stipulate the use of indirect diplomatic ways. The second-generation norms established mostly at the end of the twentieth century have improved the transmission of demands through central authorit1es but have not solved all the problems. In fact, only the European Union norms are truly third-generation, since they favor the straight submission of civil and criminal legal cooperation claims, the swift execution of the European arrest warrant and the execution of a large number of civil judgments, with no exequatur or any other intermediate procedure. The French-Brazilian legal cooperation rules, which stem from conventions signed in 1996, are outdated and anachronistic. The rules of internal law of the countries that pursue international cooperation are utterly more generous and effective than those of conventional origin. The elaboration of new conventions thus arises as a significant solution, despite the enormous political and juridical challenges. Naturally, prospective conventions sponsored by the United Nations or by The Hague Convention concerning: direct legal cooperation seem more suitable to a comprehensive solution of the main issues. However, nothing precludes the conclusion of regional, interregional and bilateral texts, even though these will have a smaller reach.

The goal of this paper is to identify four types of voluntary failure by L. M. Salamone in Czech public-serving non-governmental organizations (NGO's) and to determine extend of their display by studying of the development of one particular organization and presence and dynamics of these failures. The paper is a case study of the NGO spolek Naděje which mostly works in the field of social services across the area of the Czech Republic. This organization is examined by predefined indicators which were chosen for all four types of voluntary failure. These are philanthropic insufficiency, philanthropic particularism, philanthropic paternalism and philanthropic amateurism. The paper consists of five parts. The theoretical part introduces the key concepts and theories for this paper, fundamental definitions of the civil sector, theory of the state and market failure, a role of the civil sector and brief characteristics of public-serving NGO's. Last but not least there are described four types of voluntary failure of Salamone. The next part presents the methodology of the study for which it was chosen strategy of the research, i.e. case study of one public-serving NGO, and research indicators. A Sceptical Aesthetics of Existence: The Case of Michel Foucault Emmanouil Simos (Hughes Hall) Michel Foucault's genealogical investigations constitute a specific historical discourse that challenges the metaphysical hypostatisation of concepts and methodological approaches as unique devices for tracking metaphysically objective truths. Foucault's notion of aesthetics of existence, his elaboration of the ancient conceptualisation of ethics as an 'art of living' (a technē tou biou), along with a series of interconnected notions (such as the care of the self) that he developed in his later work, have a triple aspect. First, these notions are constitutive parts of his later genealogies of subjectivity. Second, they show that Foucault contemplates the possibility of understanding ethics differently, opposed to, for example, the traditional Kantian conceptualisation of morality: he envisages ethics in terms of self-fashioning, of aesthetic transformation, of turning one's life into a work of art. Third, Foucault employs these notions in self-referential way: they are considered to describe his own genealogical work. This thesis attempts to show two things. First, I defend the idea that the notion of aesthetics of existence was already present in a constitutive way from the beginning of his work, and, specifically, I argue that it can be traced in earlier moments of his work. Second, I defend the idea that this notion of aesthetics of existence is best understood in terms of the sceptical stance of Sextus Empiricus. It describes an ethics of critique of metaphysics that can be understood as a nominalist, contextualist, and particularist stance. The first chapter discusses Foucault's late genealogy of the subject. It formulates the interpretative framework within which Foucault's own conceptualisation of the aesthetics of existence can be understood as a sceptical stance, itself conceived as nominalist, contextualist and particularist. As the practice of an aesthetics of existence is not abstract and ahistorical but the engagement with the specific historical circumstances within which this practice is undertaken, the second chapter reconstructs the intellectual context from which Foucault's thought has emerged (Heidegger, Blanchot, and Nietzsche). The third chapter discusses representative examples of different periods of Foucault's thought -such as the "Introduction" to Binswanger's "Traum und Existenz" (1954), Histoire de la folie (1961), and Histoire de la sexualité I. La volonté de savoir (1976)- and shows in which way they constitute concrete instantiations of his sceptical aesthetics of existence. The thesis concludes with responses to a number of objections to the sceptical stance here defended.

Incivility in social media as agonistic democracy? : a discourse theory analysis of dislocation and repair in select government texts in KenyaKatiambo, David 07 1900 (has links)
In an era when adversarial politics is condemned for either being archaic or right-wing extremism, proposing that incivility can be used to counter existing hegemonies, despite its potential to incite violence, is proposing an unorthodox project. By rejecting foundationalist approaches to the current incivility crisis, this study sees an opportunity for it to act as a populist rapture that defies simple binary categorisation and deconstructs incivility, at an ontological level, to reveal the deep meanings and concealed causes that contrast the grand narrative of hate speech. After an overview in chapter one, the study continues with a theoretical review of literature on incivility, guided by the works of radical democracy theorists who universalise what seems particular to Kenya. This review is followed by the description of Bakhtin’s concept of carnivalesque as utani, a joking relationship common in East Africa. For its theoretical perspective, the study is guided by Mouffe’s theory of agonistic democracy and a research method developed by transforming Laclau and Mouffe’s (1985) work in Hegemony and Socialist Strategy: Towards a Radical Democratic, into a method for Discourse Analysis. Various concepts from Laclau and Mouffe’s work are used to innovate an explanation of how political practices in social media, both linguistic and material texts, enhance incivility and the struggle to fix a regime’s preferred meaning. Guided by Laclau and Mouffe’s Discourse Analysis, the study describes how the government is using linguistic tools and physical technologies to repair the dislocation caused by incivility in social media in its attempts to re-create hegemonic practices. Without engaging in naïve reversal of the polarities between acceptable and unacceptable speech, and considering that at the ontological level politics is a friend—enemy relation, the study argues that incivility in social media is part of the return of politics in a post-political era, rather than simple unacceptable speech. While remaining aware of the dangers of extreme speech, but without reinforcing the anti-political rational consensus narrative, incivility is seen as having disruptive counterhegemonic potential, that is, if we consider the powerplay inherent in democracy.
