An analysis of the justification of the stringent natural person insolvency law system in South Africa in light of the "advantage to creditors" requirement

The dissertation considers the justification of the stringent natural person insolvency system in light of the “advantage to creditors” requirement. Jackson’s (The Logic and Limits of Bankruptcy Law (1986) 3) criteria of “what is being addressed” by the South African natural person insolvency law system, and why that which is being addressed, is a “proper concern” of the South African system, is used as to assess the system. It is established that the South African natural person insolvency law system is a system which favours the protection of the interest of creditors. The international trend towards more debtor-orientated insolvency law systems, has become the topic of academic discussion, with the South African insolvency law system harsh criticised for not developing in line with this trend. It can be safe to state that academics, in analysing the South African insolvency law system, have discovered a “problem” with the South African system and are approaching their insolvency analyses by viewing the South African system as conflicting with or overriding some social or economic goal due to the fact that it has not necessarily developed in line with the international systems. In terms of the criteria established by Jackson for insolvency analyses, it can be argued that this approach is fundamentally flawed. The analysis in this dissertation is not undertaken for the purpose of identifying discrepancies or differences between the South African system and other natural person insolvency law systems found in foreign jurisdictions, but rather for the purpose of analysing the South African system against criteria distinctive to the purpose of its creation. Accordingly, to proceed with this analysis, one has to applying Jackson’s criteria and identify “what is being addressed” and why that which is addressed is a “proper concern” of the natural person insolvency law in South Africa. The person image of the drum majorette

Submitted to the Faculty of Education in fulfillment of the requirements for the Master of Education in the Department of Educational Psychology and Special Education at the University of Zululand, South Africa, 2000. / This study focuses on how drum majoretting may influence the person image of the adolescent girl. An attempt was made to determine or investigate the influence of relationship formation on the person image and whether drum majoretting influences relationship formation. The researcher also investigated the influence of drum majoretting on the person image. The fact that different concepts are used to describe this totality (person image) can easily lead to confusion. Consequently it was necessary to review the nature and influence of the most important areas that are related to the person image of the adolescent drum majorette: ► relationship formation ► physical development cognitive development emotional development ► social development. The literature study discloses that the drum majorette is involved in relationship formation with self, peers, trainer/educator and parents. Analysis of the data indicates that the adolescent whose relationships with significant others were favourable, positive and rewarding would have developed a positive self-identity, a positive self-concept and an enhanced feeling of self. Unfavourable experiences in the relationship formation are likely to limit the drum majorette's development and an impaired self-concept, negative self-identity would have been formed. Relationships in the life-world of the drum majorette may have a significant effect on the person image. Drum majoretting as a sport provides a range of experiences through which the adolescent may be socialised. For the purpose of the empirical investigation a self-structured questionnaire for drum majorettes were utilised. The questionnaires that were completed by drum majorettes were analyzed and thereafter the data that was obtained was processed and analyzed. The study has confirmed that the person image of the adolescent girl is enhanced through drum majoretting. The empirical investigation proved that all four categories of relationship i.e. self, peers, trainer/educator and parents are important to the adolescent drum majorette in order for her to self-actualize. Findings also show that the physical, cognitive, emotional and social development of the drum majorette is enhanced. In conclusion a summary .was presented and based on the findings of this study, the following are some of the recommendations that were made; ► The Department of Education should consider drum majoretting as a compulsory extra-curricular code of sport for girls. ► The school (principal) should develop and enforce a policy which will provide a set of guidelines to organize the code of drum majoretting through which the person image can be enhanced. ► A proactive empowerment programme should be established where parents can be addressed on the role of drum majoretting. Parent-child relationships are fundamental to the pupil's development of the person image. The parent-child contact will bring the educator into focus. A good parent-educator relationship is vital for the enhancement of the person image of the adolescent drum majorette. ► A strategic plan should be formulated for drum majoretting with the cooperation of parents, educators and the Drum Majorette Association of South Africa.

An Examination of Supervisors' Implicit Person Theory and the Supervisor-Employee Relationship

Indiana University-Purdue University Indianapolis (IUPUI) / Previous research has established that supervisor’s play an important role in conveying performance management strategies and influencing an employee’s job experience. Notably, there has been a growing area of research of how Implicit Person Theory (IPT) can contribute to supervisors’ coaching and management styles. Research within the more recent years has shown that IPT has indirect effects on the employee experience. The current study expands upon both IPT and performance management literature, by examining how an employee perceives their Supervisor’s IPT, their supervisor’s coaching style of support for developmental opportunities, and the employee’s related job outcomes of: Turnover Intentions, Job Satisfaction, and Satisfaction with Supervisor. Results from 388 men and women in various industries and organizations suggest that Perceived Supervisor IPT is related to developmental opportunities within the workplace. Additionally, we found support for Supervisor IPT being indirectly related to employees’ Turnover Intentions, Job Satisfaction, and Satisfaction with Supervisor via Perceived Developmental Opportunities. When adding Employee IPT to our mediated model, we only found marginally significant support for employees’ Satisfaction with Supervisor. Additionally, we controlled for Leader Member Exchange (LMX) within our moderated mediation model and found non- significant interactions on the indirect path of Perceived Developmental Opportunities on all three employee outcomes and obtained non-significant mediations nested within our greater model. Within our exploratory analyses we found evidence of IPT interaction between an employee and supervisor predicting LMX, Turnover Intentions, and Job Satisfaction. Ultimately, this research contributes to performance management, IPT, and LMX research by providing evidence of how a developmental coaching style of providing opportunities to employees can influence the employees’ job experience and is related to their perceptions of their leader.

The Study on Person-Environment Fits and Their Outcomes: The Application of Q-methodology

In the field of organizational behavior, it has been a long-range debate whether personality attributes or situations impact individuals¡¦ behavior more significantly. Actually, person and work environment both can not be ignored, researcher have noticed the concept of person-environment (P-E) fit proved to influence various work outcomes significantly. Furthermore, there is an emerging issue about common method variance (CMV) in the field of fit researches. As a result, this research intends to develop four Q-sort profiles to apply Q-methodology for measuring P-O, P-J, P-S as well as P-G fit such that the bias of common method variance can be reduced. We proposed five research objectives in this research: (1) to develop four valid and manageable Q-sort profiles as indirect measures of P-O, P-J, P-G, and P-S fit; (2) to test the correlation between direct and indirect measures of P-E fit such that the criterion-related validity of the four Q-sort profiles can be verified; (3) to test the individual relationships between four main types of P-E fit and their outcome criteria so as to verify the criterion-related validity; (4) to understand the overall and relative impacts of four types of P-E fit on their outcomes; (5) to manifest the most desirable and undesirable organizational culture, job contents, supervisor leadership behaviors, and workgroup characteristics of employees in Taiwan. Thus, the four Q-sort profiles (i.e., condensed OCP, Job Characteristics Profile, Supervisor Leadership Profile, and Workgroup Characteristics Profile) have been developed, and validated by two categories of criteria (i.e. direct measures and work0related outcomes). Despite that the correlation between indirect and direct measures of P-E fit is not significant, indirect measure of P-O, P-J, P-G, and P-S fit are significantly correlated with at least three work-related outcomes. Next, we test our hypotheses with a regression analysis, and the result reveals that P-O and P-S fit have strong impacts on their work-related outcomes, but the impacts of P-J and P-G fit are not salient. Finally, we present the preferences of employees in Taiwan through their own rankings.

Bakgrund: Psykisk ohälsa ses som en definition av många begrepp. Under de senaste åren har psykisk ohälsa ökat bland Sveriges befolkning. Den sjukdom som ökat markant och bidragit till ohälsa är utmattningssyndrom. Utmattningssyndrom drabbar främst personer som jobbar eller ansvarar för andra människor och har i slutändan visat sig bidra till fysisk och psykisk ohälsa. Resultatet av den psykiska och fysiska ohälsan kan vara en bidragande faktor till de långtidssjukskrivningar som ökat i dagens samhälle. Syfte: Syftet med litteraturstudien är att beskriva personers upplevelser och hantering av att leva med utmattningssyndrom samt att beskriva undersökningsgrupperna i de inkluderade artiklarna. Metod: Den föreliggande studien är en beskrivande litteraturstudie grundad på 12 vetenskapliga artiklar med kvalitativ ansats. Underlaget till studien hämtades genom sökningar i databaserna Cinahl och PsycINFO. Huvudresultat: Resultatet uppvisade ett upprepande mönster av att personer med utmattningssyndrom upplever fysiska och psykiska besvär. Dessa besvär går att relatera till kroppsliga signaler och symtom som påverkade personernas hälsa negativt samt emotionella upplevelser där självbilden och det sociala livet blev lidande. Vid tillfrisknandet upplevde personerna dock återigen en känsla av glädje och motivation. Flera olika copingstrategier beskrivs som användbara vid hanteringen av utmattningssyndrom. Alla studier redovisade deltagarantal, könet på deltagarna samt majoriteten av studierna redovisade ålder och yrke. Slutsats: Genom att personer med utmattningssyndrom uppgav egna berättelser om deras upplevelser samt hantering av utmattningssyndrom kunde syftet besvaras. Upplevelserna innebar kroppsliga symtom och signaler samt emotionella upplevelser, men även positiva upplevelser som innebar glädje. Det fanns olika copingstrategier som kunde användas vid hanteringen av utmattningssyndrom. Genom ytterligare forskning av personers upplevelser och hantering av utmattningssyndrom kan det bidra till en bättre förståelse för hur personerna känner och deras sjukdom. Genom detta kan vård och behandling förbättras. / Background: Mental illness is seen as a definition of many terms. In recent years, mental health problems has been increasing among the Swedish population. One disease that increased significantly and contributed to illness is burnout professional. Burnout professional mainly affects people who work with, or are responsible for other people and has ultimately proven to contribute to physical and mental illness. The result of the mental and physical illness can be a contributing factor to the long-term sick leave that has increased in today's society. Aim: The aim of this study is to describe people's experiences and strategies of living with burnout professional and to describe the study sample in the included articles. Method: The present study is a descriptive literature review based on 12 scientific articles with qualitative approach. The basis for the study was retrieved through searches of databases Cinahl and PsycINFO. Main Results: The results showed a repeating pattern of people with burnout professional experiencing physical and psychological trouble. These troubles are related to bodily signals and symptoms that affect people's health and contribute to negative emotional experiences where the self-image and sociability suffer. During the recovery people felt joy and motivation again. Several coping strategies are described as useful in the treatment of burnout professional. All studies reported participants, the sex of the participants, the majority of the studies reported age and profession. Conclusion: By people with burnout professional describing their own stories about their experiences and the management of burnout professional, could the aim of this study be answered. The experiences meant physical symptoms and signals and emotional experiences, but also positive experiences like joy. There are different coping strategies that can be used in the management of burnout professional. Through further research of experiences and management of burnout professional, it can gain a better understanding of how people feel and their illness. Through this, care and treatment can be improved.

The purpose of my thesis is to analyze a position of an entitled person in the process of enforcement obligation, which was adjudged by a judicial decision and wasn't fulfilled by an obliged person voluntarily. The paper is focused on the enforcement of private, pecuniary obligations. Execution procedure and all described institutes are observed from the entitled person's point of view, particularly with regard to her fundamental effort to satisfy her claim. The thesis also deals with the entitled person's options to face the obliged person's means of defense, especially deferral and discontinuance of the execution. The aim is to evaluate the current legislation's adjustment of the position of the entitled person and to try to suggest possibilities of change which could provide more effective execution for the entitled person while preserving the obliged person's rights. The thesis is divided into four chapters. The first one presents the position of the topic in the system of law and introduces the subject and the characteristic of the main terms: the execution and the entitled person. The next chapter is focused on the relation between the entitled person and persons different from the obliged person who are concerned in the execution, and highlights the most important moments of this link.
