The Challenge of Modern Maritime Piracy for International Community

Piracy is one of the oldest known illegal activities, and its very existence endangers the international arena due to its lawless nature and ruthless methods. Todays' piracy, particularly prominent in Africa and Asia, has contemporary political and social implications, and is viewed as a new threat to international order. The aim of this thesis is to present piracy as both local and regional issues, and an international problem, and to observe how these two separate perspectives come together. It analyses how modern-day piracy operates, where it thrives, and what are its geopolitical impacts. It also provides a valuable addition to current views on the state of global affairs and geopolitics; by examining international legislative and interventions created to tackle piracy, and by showing that their effectiveness is insufficient. The text argues that the role of states, their sovereignty, and their lack of it are closely connected to piracy, and that the international arena, and contemporary efforts of nations and international organisations to confront piracy are mainly driven by power struggles. ! 69! Internet Law - Master Thesis Abstract This study explores and describes the discipline of Internet Law as well as the problems arising from applying its jurisdiction. Furthermore, it deals with liability limitation in the on-line world and presents various tendencies in the development of the Internet Copyright Law in the Czech Republic, USA and France. This study is divided into two main chapters. The first one deals with the theoretical and philosophical foundations of the Internet phenomenon and the second focuses on practical aspects of the on-line legal regulation. The tendencies in interpretation and application of the legislature are presented through important case studies. The research strategy for this thesis was data gathering followed by its analysis. Providing examples of local legislature (Czech, USA, French) together with presentation of corresponding case studies I was searching for the keys for interpretation and application strategies of this relatively young and dynamically developing field of law. The study's objective was to find answers to the following two questions: a) Is there a general need for the Internet legal regulation? Obrana třetích osob proti známkovému pirátství / Defence against trade mark piracy

The aim of the thesis is to analyse different instruments of defence against trade mark piracy. The thesis composes of seven chapters. Chapter One is introductory and defines basic terminology used in the thesis: trade mark, community trade mark, registration of the trade mark by the Industrial Property Office, etc. Chapter Two focuses on the term "trade mark piracy". It divides defence against it into two different means -- dispute proceedings by the Industrial Property Office and judicial instruments. Chapter Three concentrates on comments on the ineligibility for enrolment of the trade mark designation and reasons for taking these comments. The chapter Four analyzes different types of the proposal for the revocation of the trade mark -- nonusage and using the trade mark in conflict with the unfair competition regulation. The chapter Five looks at the declaration of already-registered trade marks as invalid. Different reasons for taking a proposal of declaration are examined there. The chapter Six describes different types of appeals against decisions of the Industrial Property Office. The last chapter summarizes results of the questionary about use of the instruments against trade mark piracy.

This paper analyzes and critically evaluates present music and video market functioning with emphasis to the sales of electronic format of this content which is preferred by current customers. It analyzes the widespread trend of content sharing via the Internet and specifies reasons why the trend is happening. It defines cases of behavior that are justifiable in the eyes of consumers and therefore legitimate (i.e. creation of backups, downloading and sharing legally unavailable content, downloading for personal use, etc.) and elements that reduce value of the legally distributed content for the customer (copy protection mechanisms or current licensing system). Furthermore, it analyzes new economic approaches that enable the utilization potential of the Internet (i.e. the Long Tail Theory) or of potential customers (Crowdsourcing, Word of Mouth, Gamification). The paper analyzes the functioning new services that use the Internet as a platform for their operation and offer users the experience they want. Proposal for this new system of audiovisual content distribution is proposed based on a synthesis of findings from the operation of these services, new theoretical approaches and author's own contribution. This new system rejects the idea of selling the content as goods (per items) and adopts an approach of access to the whole catalogue of content for a flat monthly fee. This newly born service has several tiers that differ qualitatively among themselves, also in terms of added value for users and finally in the price at which the layers are available. This system is very acceptable to customers as well as being an interesting long-term alternative to the current system for operators of the new system and copyright holders.

O objetivo deste trabalho é discutir a questão da cultura livre a partir dos aspectos relativos ao domínio público. O método utilizado se baseia na observação, na análise e na síntese de dados relacionados aos temas propostos, viabilizando uma discussão baseada no estudo bibliográfico exploratório e explicativo das várias questões abordadas na pesquisa que culminam na problemática desta cultura livre e da noção e dos espaços de domínio público.Por sua vez, recorre-se ao estudo e análise de objetos que compõema pesquisa como, por exemplo, o papel da internet, da \"pirataria\", do direito autoral, da evolução dos meios de comunicação e disseminação do conhecimento, das atividades de cooperação e produção independente pelos usuários da grande rede e das políticas culturais no ambiente digital. Desse modo, são descritas e discutidas experiências de bibliotecas (Digital Public Library of America - DPLA), arquivos históricos (Europeana 1914-1918), música (Jamendo), quadrinhos e games.A partir da análise e estudo do conceito e das práticas de cultura livre estabelecidas principalmente sob o domínio público e da pirataria social, chega-se a conclusão que tais questões são fundamentais no incremento de atividades e relações estabelecidas no ambiente cooperativo da internet, que identificam os usuários como produtores e disseminadores de um ciclo cultural vivo entrelaçado pelas vias da grande rede. Com isso, reforça-se o potencial de políticas culturais a partir do ambiente digital que fortaleçam o ideal de cultura livre a partir de questões tais como a revisão das leis de direito autoral, do incentivo ao domínio público e até mesmo sobre novos entendimentos acerca do universo social-cooperativo da pirataria social em rede. / The mains objective of this paper is to discuss the issue of free culture relating it to the public domain questions. The method used is based on observation, analysis and synthesis of data related to the proposed themes, enabling a discussion based on exploratory and explanatory bibliographical study of the various issues addressed in the research culminating in the issue of this free culture and the notion of public domain.In turn, it is through the study and analysis of objects that make up the research as, for example, the role of the internet, \"piracy\", copyright law, the evolution of media and dissemination of knowledge, cooperative and independent cultural activitiesmade by the users and the large network of cultural policies in the digital environment. Some interesting activities in many cultural fields are discussed and described such as in libraries (Digital Public Library of America - DPLA), historic archives (Europeana 1914-1918), music devices and communities (Jamendo), comics and video gamesFrom the analysis and study of the concept and practice of free culture established primarily in the public domain and social piracy, we conclude that such questions are fundamental in development of activities and relationships established in the collaborative environment of the internet, which identify users as producers and disseminators of a living cultural cycle paths intertwined by the large network.Thus, it reinforces the potential of cultural policies from the digital environment that strengthen the ideal of free culture from issues such as the revision of copyright law, encouraging the public domain and even on new understandings of cooperative and social universe of social piracy.

Este trabalho trata da captura da bacia do Alto Guaratuba, devido ao recuo da Escarpa da Serra do Mar na região de Boracéia-SP. A bacia do Alto Guaratuba localiza-se no reverso imediato da Escarpa da Serra do Mar, a aproximadamente 45056’ e 45052’ de longitude oeste e 23038’ e 23042’ de latitude sul, onde situa-se a Estação Biológica de Boracéia (USP), A Serra do Mar corresponde a um conjunto de escarpas festonadas com cerca de 1.000km de extensão, que vai de Santa Catarina ao Rio de Janeiro. Sua origem está relacionada a processos tectônicos de movimentação vertical realizadas no Cenozóico. A observação de imagem LANDSAT TM 7 permitiu uma primeira aproximação do delineamento estrutural (linhas de falhas, fraturas, etc) da área de estudo. O emprego do programa ILWIS, no tratamento das cartas topográficas 1:10.000 permitiu, por seu lado, confirmar aquelas direções estruturais, de sentido geral NE-SW, bem como mostrar a presença de compartimentos escalonados do relevo, a partir da borda da Escarpa para o interior. A fotointerpretação na escala 1:25.000 revelou a presença de uma drenagem direcionada a NE-SW, seguindo os alinhamentos estruturais que já haviam sido assinalados. Revelou também a mudança de direção do Rio Guaratuba, formando um cotovelo, próximo à borda da Escarpa, descendo-a na direção N-S. Algumas evidências de campo mostram o Rio Guaratuba, em seu cotovelo de captura, descendo oblíquo às estruturas do gnaisse até posicionar-se perpendicularmente a elas ao descer a Escarpa. O conjunto desses dados indica a importância da tectônica na formação do relevo da área, originando os patamares escalonados, entre os quais instalou-se a drenagem. Por outro lado, a erosão regressiva na Escarpa foi responsável pela captura do Alto Guaratuba, gerando um grande anfiteatro. Assim, foi possível propor uma história prognóstica de evolução da Escarpa, sob a ação erosiva, aproveitando as linhas estruturais, podendo ocasionar novas capturas. Dessa maneira, seria necessário estudar os altos cursos dos rios que deságuam no litoral a partir de suas cabeceiras no Planalto, além de verificar de que maneira eles correm atualmente na direção que correm. / This assignment is about the capture of the Alto Guaratuba basin, due to the retrocession of Serra do Mar’s scarp in Boracéia’s area. The Alto Guaratuba basin is located near to Serra do Mar scarp, approximately at 45º56’and 45º52 of longitude west and 23º38’and 23º42’of latitude south, where Estação Biológica de Boracéia is located. The Serra do Mar corresponds to a whole of festooned scarps with about 1000km of area that is situated from Santa Catarina to Rio de Janeiro. Its origin is related to tectonic process of vertical movements that happened in Cenozoic. The observation of image LANDSAT TM 7, permitted the first approach to the structural delineation (fault lines, fractures, etc) of study area. The use of the program ILWIS, in topographic maps treatment, allowed the confirmation of structural directions, in a general meaning NE-SW, and also shows the presence of compartments that have the form of a stair in the relief, from the Scarp’s edge towards interior. The photo interpretation in 1:25.000 scale revealed the presence of drainage directed towards NE-SW, following the structural lineaments that had already been shown. It revealed, the changes of Guaratuba’s direction, forming an elbow, near the Scarp’s edge, going in the direction of N to S. Some evidence shows the Guaratuba River, in its elbow of capture, going down oblique to the gneiss structures until being positioned perpendicularly to them while going down the Scarp. All of these details indicate the importance of the tectonics in the area’s relief formation, leading to landing steps. However, the regressive erosion in the Scarp was responsible for the capture of Alto Guaratuba, creating a big amphitheater. Though, it was responsible to make a prognostic history of the Scarp’s evolution, with the erosive action, taking advantage of the structural lines that can make new captures. So, it would be necessary to study the high water courses that flow to the coast, from their headwaters in plateau, and also to check in what manner they flow nowadays in the direction they flow.

A noção de pirataria, pertencente ao vocabulário humano desde a Antiguidade, ganha novos sentidos no atual período histórico. Neste período da globalização, o modo de produção capitalista e o meio técnico-científico-informacional se tornaram planetários. Consolida-se, portanto, uma mesma base técnica do funcionamento das sociedades nos distintos territórios, acompanhada da globalização de normas de controle cada vez mais rígidas, como se procura mostrar, neste trabalho, a partir da expansão do sistema de patentes e de proteção de direitos intelectuais. Entretanto, as novas tecnologias informacionais e comunicacionais são progressivamente mais flexíveis e possibilitam, nos lugares onde se instalam, usos não previstos e, por isso mesmo, classificados como ilegais. Nesta pesquisa, defende-se que a expansão do meio técnico-científico-informacional no Brasil engendra novas formas de piratarias, sejam aquelas praticadas pelos agentes do circuito superior da economia urbana, sejam aquelas características do circuito inferior, de acordo com a proposição de Santos (1971; 2004 [1975]). A pirataria não pode, portanto, ser analisada como uma aberração ao processo de globalização em curso, mas, ao contrário, uma de suas manifestações mais notáveis. Assim, análises econômicas e jurídicas sobre o fenômeno, mesmo predominantes, não permitem a compreensão da totalidade dos agentes e situações envolvidos. O processo de urbanização do território combina a seletividade de objetos e informações, a desigualdade de renda e a manutenção de baixos salários, associados à ampla difusão de novas mercadorias cujo consumo é incentivado pela propaganda. Nesta situação brasileira, a pirataria, contraposta ao elevado preço das mercadorias ditas originais, tem uma função central no processo recente de modernização do território. Finalmente, almejando revelar a pirataria como um uso das técnicas e informações contemporâneas a partir dos lugares, são analisadas situações geográficas reveladoras de formas de vida e de produção baseadas na desapropriação como fonte de criação de novas economias urbanas, especialmente em São Paulo, Belém do Pará e Foz do Iguaçu - Ciudad del Este. / The notion of piracy, which has been used by human vocabulary since old times, acquires a new sense during the historic period. At this globalization period, the way of capitalist production and the informational scientific technical environment have become worldwide. It consolidates, therefore, on the same technical basis of the society functioning in distinct territories, followed for the more and more rigid world rules of control, as it is presented, on this essay, on the expansion of legal right system and the protection of the intellectual rights. However, the new informational and communicational technologies are progressively more flexible and they allow, where they are set on, non-predict uses and, for that, classified as illegals. This research takes into consideration the expansion of the informational scientific technical environment in Brazil cause new ways of piracy, those that are practiced by the agent of higher circuit of the urban economy, or those whose features of the lower circuit, according Santos proposition(1971; 2004 [1975]). The piracy cannot, therefore, be analyzed as nonstandard to the globalization process in course, but, on the contrary, one of the most remarkable manifestations. So, economic and juridical analysis on the phenomenon, predominant or not, do not allow the comprehension of the totality of the involving agents and situations. The process of urbanizing of the territory combines the selectivity of objects and information, the social inequalities and the maintenance of low incomes, combined to the enormous diffusion of the new goods whose consumption is stimulated by propaganda. In this Brazilian situation, the piracy, contrasting to the higher price of goods so called originals, has a central function on the recent process of modernization of the territory. Finally, getting into the point to reveal piracy as a use of the up-to-date technics and information from the places, they are analyzed as revealed geographical situations of life style and of the production based on embezzlement as source of creation of an urban economy, especially in São Paulo, Belém do Pará and Foz do Iguaçu - Ciudad del Este.

中國數位盜版問題 – 媒體論述與美國特別301報告分析 / Digital piracy in China - an analysis of media discourse & the special 301 report

This thesis explores the level of focus that major media outlets in both the US and China place on the emerging issue of digital piracy. By using a predetermined coding framework to perform a discourse analysis on intellectual property rights discourse in China Daily and The New York Times, it was discovered that each publication has a unique focus and amount of coverage on particular issues, and a noticeable discrepancy in coverage was established. The amount of digital piracy-related coverage in these two publications fluctuated between the years of 2007 and 2011, during which China hosted two major world events: The 2008 Beijing Summer Olympics and the 2010 Shanghai World Expo. Surprisingly, discourse related to digital piracy specifically was not noticeably affected by either world event; rather discourse has picked up in the previous two years in greater amounts. China’s section of the USTR Special 301 Report was also analyzed using the same coding framework to determine what areas of focus were most significant within its pages. There was no noticeable correlation throughout the five years in topical focus between elite media discourse and the USTR Special 301 Report other than a significant correlation between the focus on economic-related issues in the Special 301 Report and China Daily. The influence of the Special 301 Report on media discourse was negligible, as were the reported digital piracy rates. In terms of journalistic valence, China Daily articles were generally a lot more positive about all groups that were included in this study, while The New York Times was mostly critical of China. One common thread of valence that both publications shared was that they both focused increasingly on positive business developments related to digital piracy, such as major business deals between US entertainment content providers and Chinese distributors. In terms of national image, China is trying hard to boost its impression amongst other countries by both publishing large amounts of positive articles in its international papers such as China Dailiy, but also through increasing amounts of consultation with public relations firms. A good record on the issue of digital piracy is not only important in maintaining China’s national image, but also in preserving its trade relationships with other nations such as the US, who have IPR-related topics at the core of their concerns.
