[pt] O presente trabalho enquadra-se na linha de pesquisa Teoria do Direito, Ética e Construção da Subjetividade e tem por objetivo refletir acerca de uma abordagem não patriarcal da construção da subjetividade a partir da obra do psicanalista inglês Donald W. Winnicott. Para tanto, aponta-se a perspectiva patriarcal da constituição do sujeito que estaria presente no trabalho teórico de Freud, apesar de suas descobertas não patriarcais na experiência clínica psicanalítica, e as modificações matriciais que a teoria do desenvolvimento emocional primitivo winnicottiana trouxe. Mobiliza-se o conceito de patriarcado de Maturana e de Verden-Zoller como um espaço psíquico no qual o conflito, as hierarquias, a dominação da natureza e a regulação do humano antissocial são valorizados. De modo diverso, o espaço psíquico matricial valoriza a harmonia, a empatia, a colaboração e a alteridade, encontrando-se na relação materno-infantil. Desenvolve-se o objetivo proposto a partir da diferença na relação indivíduo/sociedade na obra de Freud e na de Winnicott, o que se reflete no modo diverso como percebem a ambivalência, a agressividade, o sentimento de culpa, a formação do superego, a ética e a relação do sujeito com objetos externos. Por fim, propõe-se o conceito winnicottiano de democracia enquanto um conjunto de subjetividades maduras como uma forma de levar o viver matrístico da relação materno-infantil para a vida adulta e para vínculos mais amplos (família, escola e sociedade). / [en] The present work is part of the research line Theory of Law, Ethics and Construction of Subjectivity and aims to reflect on a non-patriarchal approach to the construction of subjectivity from the work of the english psychoanalyst Donald W. Winnicott. For this, it is pointed out the patriarchal perspective of the constitution of the subject that would be present in the theoretical work of Freud, despite his non patriarchal discoveries in psychoanalytic clinical experience, and the matricial modifications that the winnicottian theory of primitive emotional development brought. The concept of patriarchy of Maturana and of Verden- Zoller is mobilized as a psychic space in which conflict, hierarchies, domination of nature and the regulation of the antisocial human are valued. In a different way, the matricial psychic space values harmony, empathy, collaboration and otherness, being found in the mother-child relationship. The proposed goal is developed from the difference in the individual/society relationship in the work of Freud and Winnicott, which is reflected in the different way in which they perceive ambivalence, aggressiveness, guilt, the formation of the superego, ethics and the relation of the subject to external objects. Finally, the winnicottian concept of democracy is proposed as a set of mature subjectivities as a way of bringing matrístico from the mother-child relationship into adult life and into broader ties (family, school and society).

[pt] O foco deste estudo é apontar como o delírio do paciente psicótico é estruturado a partir das relações familiares transgeracionais. Utiliza- se o conceito de transmissão psíquica geracional para mostrar que o desenvolvimento psíquico de todo indivíduo é constituído pelas relações intersubjetivas que este estabelece, tendo como base as relações familiares. O sujeito é visto como formador e formado através destas relações. Tenta-se mostrar pelo enfoque psicanalítico como se dá esse processo no caso do paciente psiquiátrico adolescente É abordada a questão das expectativas familiares com a chegada de um novo membro e a dinâmica da família em relação aos filhos na fase da adolescência. A visão da terapia familiar psicanalítica embasa a análise de um caso clínico mostrando a questão da transmissão psíquica transgeracional na construção do delírio de um paciente psicótico adolescente atendido com sua família em um hospital psiquiátrico, universitário e público. / [en] This dissertation intends to demonstrate how the delusion of a psychotic patient is structured by transgenerative family relationships. The concept of generative psychical transmission is used to prove that the psychical development of every person is constituted by the intersubjectives relations, having their foundations in the families relationships. The person is the maker as well as it is made through these relationships. It is tried to demonstrate this process under psychoanalytic focus when working with psychotic adolescents. The author proves the expectations of the families when a new member becomes part of it and too the family dynamic when they have adolescents members. The theory of psychoanalytical family therapy is used to analyze a clinical situation demonstrating the transgenerative psychical transmission in the construction of delusion of a psychotic adolescent and their family history in a public mental hospital.

[pt] O foco do presente trabalho é a dinâmica das relações familiares de adolescentes em conflito com a lei. O estudo foi realizado a partir de entrevistas com mães de adolescentes pobres, moradores da Baixada Fluminense, que cumprem medidas socioeducativas determinadas pela Vara da Infância e Juventude da Comarca de S. João de Meriti. A autora aborda aspectos psicológicos e sociais da questão, apontando fatores que, de alguma forma, facilitam a entrada do jovem, cada vez mais cedo, no universo do tráfico de drogas. Através de uma breve resenha, é destacada a histórica desigualdade social existente no Brasil, que vitimiza, há quinhentos anos, a população mais desfavorecida, empurrando-a para a margem do tecido social. O jovem oriundo de tal camada, passa a ter visibilidade a partir da prática de atos ilícitos, preocupando e atemorizando a mesma sociedade que o excluiu. / [en] This essay focuses on the relationships in families of juvenile offenders under correctional custody in Rio de Janeiro. The study is based on interviews with mothers of poor adolescents under the responsibility of juditial authorities of the district of São João de Meriti. The author emphasizes psychological and social aspects of the matter, indicating points which may collaborate for teenagers to join the drug traffic universe. A brief report of the Brazilian historical social inequality points out the victimization of the working class people, relegated to an inferior position in the society. The poor adolescents gain visibility through illicit acts, preoccupying and terrorizing the same social class that had excluded them.
