Mediation and its usage in labour law litigation and in employment issues Abstract This thesis provides an insight into the field of mediation as an alternative method of dispute resolution. This method is approached through the optics of labour law litigation perspective which in the author's point of view offers a huge potential for further development. Even though the key point stands in the field of labour law, the whole thesis has an interdisciplinary design following the design of the method described. The interdisciplinary focus aims to the fields of psychology, sociology and philosophy. The thesis is divided into four main sections. Their composition follows the focus point from concrete to abstract concepts. The first part aims to integrate the field of labour law into the law system. The main focus is given to the dualism of the law system and the relation of the public and private law considering its relation to the labour law. The second part is devoted to conflicts and mainly reflects the symptoms of conflict and their classification. The negatives and positives of both are considered and discussed. Prorogační a rozhodčí doložky v mezinárodním obchodě / Prorogation and Arbitration Clauses in International Trade

The thesis is aimed at the prorogation and arbitration clauses in international trade. Its aim is to analyse the legal regulation of the clauses and requirements for them using the help of legislation, case law and both Czech and foreign relevant literature. In addition to the introduction and the conclusion of the thesis, there are eleven chapters analysing the issue. The first chapter deals with dispute resolution in international trade, and introduces prorogation and arbitration clauses as instruments by which the parties can determine how and by whom will the dispute between them be decided. Chapters two to six deal with prorogation clauses. First of all, sources of legal regulation of prorogation clauses are analysed. Further, the thesis analyses the formal requirements for the clauses and also the possibility of incorporating the clause into a contract from another document. There are also discussed some other features of the prorogation clauses, namely the certainty of the chosen court, the separability of the clause, the exclusivity of the clause, and the effect of provisions protecting the weaker party under the Brussels I bis regulation The following chapters seven to ten deal with arbitration clauses. The objective of this thesis is to analyze the management of the selected company in forestry, determine the current state of drawing subsidies, overview possibility of drawing such aid in forest management in the Czech Republic and specifically in the county where the business is located. Then, based on the collected information to propose possible optimization solutions. In the first part of this work are expertly explains the basic concepts related to the topic. The second part contains the own work and proposal of solution. Economic evaluation was achieved through analysis of annual financial reports and cost calculation. Comparative period in this case, the years 2007 to 2012. Sources of financial support were divided on the resources of the European Union and national sources and described. The conclusion includes a proposal of measures for stability and business continuity.

The diploma thesis deals with an interpretation of a scenic movie environment in eighties of the twentieth century. In the beginning, I tried to recognize the cultural and historical context of the eighties that introduce us to the optical perception of this time. For a full picture serves listing movie frames with typical visual representation of these years. Particular attention is given to four feature films that could serve as a scenic genotype, which can be applied in the design of movie scenes of post normalization Prague environment. The greatest extent of the thesis is devoted to the performing processing of screenplay "Wenceslas Square" by Christopher Marcus and Stephen MrFreely, which was created by the story of Arthur Philipse. It is an unconventional love story, set in Prague in the eighties of the twentieth century and ending with "Velvet Revolution", over which no one of the protagonists is enthusiastic. Attached is a draft screenplay point of each scene, including indicative floor plans and reference photos. 56 Abstract The purpose of this work is to introduce the concept of Alternative Dispute Resolution as a full alternative to civil judicial proceedings. Emphasis is placed on the utilization of the alternative procedures in the Czech legal environment and on contemporary Czech legislation as well as its possible future development. The thesis was elaborated using primarily domestic professional literature, while a significant portion of the resources was represented by legal enactments including the relevant legislative history. This thesis only deals with foreign approaches to Alternative Dispute Resolution marginally, which is reflected in the choice of resources - foreign resources have been used to a very limited extent. Following the initial overview of the topic and the introduction of the author's relationship to the concept of Alternative Dispute Resolution, this thesis presents the theoretical classification of these methods and collectively enumerates the legal regulations pertaining thereto. Currently in the area of radiation protection, the principle ALARA (As Low As Reasonable Achievable) is being used. Through this principle the radiation burden of workers with ionising radiation is optimised. One of the economic tools used here is the {\clqq}cost-benefit analysis``. It is one of the first analytical methods which are recommended by the ICRP (International Commission on Radiological Protection) for optimising costs needed to secure radiation protection. The cost benefit analysis is a good and efficient economical tool. With the help of this method it is possible to do the optimisation as well as to prove it. It takes into consideration all significant economic and social factors that are prescribed and recommended. Especially, it can prove that all expositions are kept as low as they are reasonable achievable, while considering the economic angle. Basically, it is a conception which is applicable in all areas of the public as well as private sector, in all areas of human activity. In this thesis some particular examples of using the CBA at the NPP Temelín are shown and compared with the achieved level of RP. Based on that the ALARA system at our workplace is demonstrated. The CB analysis with its extended forms helps to make principal and continuous decisions, and it is an essential factor in protection from harmful effects of ionising radiation. Its main contribution lies in the areas where it is necessary to build additional technical or building barriers. It is very important in designing and building new workplaces with ionising radiation.
