Vývoj újmy působené konfliktními zvláště chráněnými druhy volně žijících živočichů v ČR / Development in damage caused by conflict specially protected wild animal species in the Czech Republic

The submitted M.Sc. thesis describes development in populations of the bird and mammalian species, having been involved in human - wildlife conflicts, particularly of the specially protected species, in the Czech Republic as well as in compensation payments for damages caused on private properties by the selected specially protected wild animal species. At the same time, it compares various tools, applied to solve human - willdife conflicts in the different parts of the world. The study presents information provided by governmental authorities or gained from grey literature, expert databases and scientific papers. Trends both in the development in conflict species populations and in compensation payments were assessed and the relationship between both variables was found. In total, payments for damages caused by conflict wild animal species has been increasing in the Czech Republic since 2000, but trends in the conflict species populations differ from each other, influenced particularly by their bionomics. The analysis performed shows, that the act on the topic is effective only for some of the above wild animal species. For large carnivores, namely the Grey Wolf (Canis lupus), Eurasian Lynx (Lynx lynx) and Brown Bear (Ursus arctos), the above tool does not provide suitable solutions for their...

The Wrong Solution to Fair Value Accounting: Does the Relaxation of Fair Value Accounting Improve Financial Reporting for Banks?

The financial crisis of 2007-2008 sparked a debate over the usefulness of fair value accounting. Many banks and other financial institutions claim that the strict rules of fair value accounting exacerbated the financial crisis. To fix the problem of fair value accounting, FASB issued FAS 157-4, FAS 115-2 and FAS 124-2. These Staff Positions relax the rules for fair value accounting by providing entities more flexibility in fair value estimates and OTTI reporting. This study explores the merits of these changes to fair value accounting and analyzes whether they will improve banks’ financial reporting. First, I examine the role of fair value accounting in the recent financial crisis. Next, I evaluate whether these Staff Positions result in more useful information to investors and other decision makers. I find evidence that suggests that fair value accounting had a limited role in the financial crisis and did not contribute to banks’ financial burdens. These findings bring into question the purpose and necessity of FAS 157-4, FAS 115-2 and FAS 124-2. Furthermore, my analysis shows that these Staff Positions do not enhance the usefulness of information to decision makers. In fact, they appear to weaken the usefulness of financial information.

The European Union's Directive 2008/115/EC and Member States implementation thereof, subject Third Country Nationals awaiting for return/removal from the European Union, and its subgroup of non-returnable Third Country Nationals, to conditions of cooperation in order to access human rights. This creates a tension in relation to the principle of non-discrimination in that all individuals, regardless of migration status, are to access their rights. Nevertheless, the concept of cooperation is about to be expanded in the European Union's regulations on migration. This thesis assesses the prevailing legal understandings of the concept, within the European Union and across its Member States, against the principle of non-discrimination. The conclusion of how these understandings fare is that it depends. It depends on what method of legal interpretation is used when interpreting the concept and against which general interest of the European Union it is being compared against; that of the prerogative to exercise border control or that of protecting fundamental rights.
