O modo pelo qual o Direito tem sido utilizado em prol de avanços sociais na defesa, proteção e promoção da cidadania, acarreta a discussão sobre democratização da justiça e o acesso efetivo aos direitos contemplados constitucionalmente. O direito positivado brasileiro (legislação) é extremamente complexo: extenso e pouco claro. A grande maioria da população não possui acesso às informações necessárias para atuarem nas relações jurídicas, são sujeitos de direitos e deveres quase sempre desconhecidos. A assistência jurídica integral e gratuita, instrumento constitucionalmente garantido para superar o obstáculo ao acesso democrático à justiça e ao direito, não se restringe à mera postulação em Juízo ou dispensa do pagamento de custas processuais e honorários advocatícios, mas se caracteriza pela prestação de informação e consultoria jurídica à comunidade, esclarecendo seus direitos e obrigações, auxiliando na compreensão da temática jurídica do texto constitucional. O acesso democrático à administração da justiça (judiciário) e da justiça social (direitos fundamentais) está diretamente ligado à universalização da cidadania rumo à igualdade e emancipação social. Tal emancipação a ser construída racionalmente por indivíduos livres e iguais, tende a pensar a coletividade em igualdade de condições, superando elementos de poder nas relações sociais, reivindicando um patamar mínimo de direitos, equidade e igualdade de oportunidades, compreendendo o direito de usufruir de uma vida digna no cumprimento dos deveres. / The period after the Brazilian Constitution of 1988 is marked by difficulties in implementing the rule of law, consolidation and improvement of democracy and the affirmation of citizenship in its modern meaning, involving rights and duties in public and universal. The manner by which the law has been used in support of progress in social protection, protection and promotion of citizenship, leads the discussion on justice and the democratization of access to effective constitutional rights contemplated. The positive Brazilian law (legislation) is very complex: long and unclear. The vast majority of the population has no access to information necessary to act in legal relations, are subjects of rights and duties almost unknown. The full legal and free, constitutionally guaranteed tool to overcome the obstacle to democratic access to justice and the law, is not restricted to mere postulation in court or remission of court costs and attorneys fees, but is characterized by the provision of information and legal advice to the community, clarifying their rights and obligations and help in understanding the legal issues of the constitutional text. The democratic access to the administration of justice (legal) and social justice (rights) is directly linked to the universalization of citizenship towards equality and social emancipation. This emancipation to be built by individuals rationally free and equal, tends to think the community on equal terms, overcoming elements of power in social relations, demanding a minimum level of rights, equity and equal opportunities, including the right to enjoy a dignified life in fulfillment of obligations.

Diffusion du droit et Internet en Afrique de l'ouest

"Mémoire présenté à la Faculté des études supérieures en vue de l'obtention du grade de maîtrise en droit des technologies de l'information" / L'accès au droit en Afrique de l'Ouest est difficile et restreint, et cela pour de nombreuses raisons. Parmi celles-ci peut être citée la faible diffusion papier des ressources juridiques nationales, qui est en partie due au manque de moyens matériels et financiers. Or, depuis une dizaine d'années, des projets de diffusion des ressources juridiques via Internet se développent, donnant ainsi un accès libre aux informations juridiques publiques. Ce mode de diffusion du droit représente une alternative pour les États africains, leur permettant de bâtir de nouvelles stratégies favorisant l'accès au droit. Néanmoins, ce nouveau mode de diffusion du droit fait ressurgir une réflexion relative à la nature plurale des droits ouest africains et de la place des droits originellement africains dans ces nouvelles stratégies. La présente analyse montre que l'utilisation des nouvelles technologies, telles qu'Internet, dans des stratégies de diffusion du droit est pertinente, à la condition que les États africains redéfinissent leur culture juridique, en prenant en considération les sources originellement africaines afin qu'elles prennent place dans la diffusion du droit via Internet. / Access to legal information in West Africa is difficult and restricted because of a weak dissemination network. The insufficient publication and distribution of national legal resources can partly be attributed to a lack of financial and material resources. Over the past ten years, legal resource publication projects on the Web have been developed to offer free access to public legal information. This type of document dissemination model represents an alternative solution for African States by allowing them to elaborate new strategies to increase legal information dissemination. This new law publishing model, however, has brought about the need to reconsider the pluralistic nature of West African laws and the place these originally African laws occupy within the new strategies being put forth. The following analysis demonstrates how the use of new technologies such as the Internet has proven to be relevant for legal resource publication and distribution insofar as African states always take into consideration originally African sources when redefining their legal cultures through the dissemination of their laws via the Internet.

L'accessibilité et l'intelligibilité de la loi en droit constitutionnel : étude du discours sur la "qualité de la loi"

L'objectif de valeur constitutionnelle d'accessibilité et d'intelligibilité de la loi, largement inspiré du discours sur la « qualité de la loi », semble consister, dans la jurisprudence du Conseil constitutionnel, en deux exigences différentes : la capacité de la loi à avertir le citoyen et la soumission de l'administration et du juge au respect de la loi. Cette étude propose une dissociation de ces deux exigences, qui renvoient à deux « qualités » distinctes de la loi : celle ex ante et celle ex post. Alors que la « qualité » ex post concerne la prédétermination de l'utilisation du texte par les autorités chargées d'appliquer la loi, la « qualité » ex ante renvoie à l'information du citoyen sur la législation en vigueur et implique un renouvellement du rapport préjuridique du citoyen au droit. Cette étude propose également une comparaison entre la jurisprudence de la Cour suprême des États-Unis – « Vagueness doctrine » – et la jurisprudence du Conseil constitutionnel relative à la « qualité de la loi » / The « Quality of law » doctrine, as found in the jurisprudence of the Constitutional Council, has two functions. First it means that a citizen must have notice of a law before it is applied to him; and second that a statute's text must be sufficiently « clear » in order to avoid arbitrary enforcement. This thesis proposes a distinction between these two functions of the « Quality of Law » doctrine; the first reflecting an ex ante principle and the latter an ex post principle. Whereas the ex post « quality » deals with misuse of the statute's text by authorities charged with enforcement, the ex ante function – fair notice of laws in force – requires a more modern meaning as the nature of law changes and its delivery becomes more fractured and unpredictable. This thesis includes a comparison of the French doctrine with a parallel doctrine in American Constitutional Law – the « Vagueness doctrine »
