Acquisitive prescription This Master's degree thesis deals with the topic of acquiring the right of ownership by prescription (usucaption). Its aim is to describe the form of the institute in Czech law and to put it into a broader framework. Acquisitive prescription is a means of original acquisition of ownership rights to things. It solves the problem, when possessor does not own the object of the possession. The ownership to the thing is acquired under these conditions: good faith of the possessor, just title, possession for required time. The thesis is composed to five chapters. The introduction summarizes the aims of the study and explains the concept and the structure of the thesis. Chapter One is introductory and defines basic terminology used in the thesis. It describes the concept of things and rights in rem in Czech private law. Then it explains the theory of possession, such as its fundamentals, its meaning and protection provided to the possessor. After that it focuses on definition of ownership and methods of acquiring the right of ownership. This chapter concludes with a short explanation of what is acquisitive prescription and what is its significance. Chapter two focuses on the history of this institute. Acquisitive prescription in Roman law and its reflection in modern private law codes Abstract Acquisitive prescription is a legal institute, which function is to reconcile state of fact with state of law. This institute served especially to acquire ownership for possessor of the thing by lapse of prescribed time, but it should also serve to acquire other laws, such as servitudes. This thesis focuses mainly on Roman law form of acquisitive prescription. In order to properly understand the concept it is essential to percept it in relation to a unique conception of Roman property law including all its specifics and differences from current view on ownership. First part of the thesis is dedicated to Roman ownership concept and its basic characteristics. Subsequent part describes the development through which the acquisitive prescription in Roman law proceeded during its existence. The thesis focuses on particular institutes such as usus auctoritas, usucapio, praescriptio longi temporis and praescriptio longissimi temporis. Firstly a form of acquisitive prescription in ancient and pre-classical era is investigated. The subject of interest here is the term of auctoritas. En el presente trabajo de investigación de tipo cualitativo se realizó un análisis para lograr establecer el apartado a considerar para delimitar que el auto de sobreseimiento no califica como una causal de interrupción del proceso de prescripción adquisitiva de dominio para el mismo, se ha comenzado analizando las instituciones jurídicas de la prescripción adquisitiva de dominio y la usurpación en relación al auto de sobreseimiento y si el auto de sobreseimiento en una denuncia de usurpación interrumpe la prescripción adquisitiva de dominio para posteriormente sustentar las razones de la búsqueda de dicho apartado para garantizar la posición originaria obtenida por la usucapión, sobre la propiedad y que no se afecte el derecho de usucapir ante un auto que declara nula la responsabilidad penal sobre el proceso. / In this qualitative research study, an analysis was conducted to establish the criteria for determining that a dismissal order does not qualify as a ground for interrupting the adverse possession process. The study began by examining the legal institutions of adverse possession and usurpation in relation to a dismissal order, specifically whether a dismissal order in a usurpation complaint interrupts the adverse possession process. Subsequently, the reasons for seeking this clarification were presented to ensure the preservation of the original position obtained through adverse possession, safeguarding the right to adverse possession even when there’s an order declaring criminal liability null and void in the process.

The acquisitive prescription, in the colletive urban mode, aims the landing regulation of areas ocuppied by low income population that, historically, live in possession law insurence, having their fundamental housing rights violated. In a enclosement way, we discourse about fundamental rights, in special, the social rights and their efficacy. Afterwards, we put on context the housing right in the sociological view, as in the national and international law view. Finnaly, we analyze the acquisitive prescription in their many modality and treat, specially, the acquisitive prescription in the collective mode. In fact, the collective acquisitive prescription has a fundamental function to landing regulation of areas occupied by low income population, who didn´t find in the law, regulation tool that guarantee one of the dimensions of the fundamental housing right, that include the possession law ensurance / O trabalho tem por objetivo analisar o instituto da usucapião coletiva, prevista na Lei nº 10.257 de 2001, como instrumento de eficácia do direito fundamental à moradia. A usucapião, em sua modalidade coletiva, visa a regularização fundiária de áreas ocupadas por população de baixa renda que, historicamente, vive em situação de insegurança jurídica da posse, tendo violado seu direito fundamental à moradia. De forma abrangente, discorremos sobre os direitos fundamentais e, em especial, sobre os direitos fundamentais sociais e sua eficácia. Posteriormente, contextualizamos o direito à moradia tanto no plano sociológico, como também no plano do direito pátrio e internacional. Por fim, tratamos do instituto da usucapião, em suas diversas modalidades para chegarmos, enfim, ao instrumento da usucapião coletiva. De fato, a usucapião coletiva tem função fundamental para a regularização das áreas ocupadas por população de baixa renda, que não encontrava no ordenamento jurídico instrumento que lhe garantisse uma das facetas do direito fundamental à moradia, que é a segurança jurídica da posse

Magistro darbe nagrinėjamas dar senovės Romos teisėje suformuotas vienas iš nuosavybės teisės įgijimo pagrindų – įgyjamosios senaties institutas, jo taikymo sąlygos. Darbo tikslas – išnagrinėti įgyjamosios senaties instituto taikymo sąlygų, t.y. sąžiningai atsiradusio bei sąžiningo, teisėto, atviro bei nepertraukiamo valdymo bei daikto valdymo kaip savo, turinį, apibendrinti Lietuvos Aukščiausiojo Teismo praktiką. Darbe analizuojama daikto valdymo kaip faktinės būsenos ir kaip savarankiškos daiktinės teisės samprata, jų atsiradimo ir pasibaigimo momentų ir pagrindų santykis. Didelis dėmesys yra skiriamas teismų praktikoje kilusioms įgyjamosios senaties instituto taikymo problemoms, pateikiami jų pavyzdžiai ir galimi sprendimo būdai. / This study is devoted to the analysis of the acquisitive prescription (its conditions) as the foundation of the acquisition of ownership. Acquisitive prescription derives from Roman law. The purpose of the study is to evaluate the subject-matter of conditions of the acquisitive prescription – the acquisition of the thing in good faith, the possession of it in good faith, legitimately, openly, continuously as its own, to summarize the practice of the Supreme Court of Lithuania. The fact of possession itself, also the possession as an independent right in rem, the relation of the acquisition and the termination moments and grounds are also analyzed. The extensive attention is given to problems araised from the practice of the Supreme Court of Lithuania, the examples of such problems and its possible solutions also are given.
