Analisou-se a operacionalização do Direito à Educação dos adolescentes que saíram da medida socioeducativa em meio fechado, investigando as questões relativas ao acesso, permanência, defasagem de série/idade, abandono escolar e preconceito na escola pública que teve o maior número de adolescentes que saíram da Fundação CASA. Utilizamos a pesquisa quantitativa para elaborar o perfil dos adolescentes na ESAC e a abordagem qualitativa para as entrevistas com os educadores da escola (professor, professor mediador, coordenador pedagógico e vice-diretor). Também realizamos entrevistas com o adolescente para compreensão mais aprofundada sobre o objeto da pesquisa, relacionando-o e contextualizando-o com a realidade, que se encontra em constante transformação e contradição. Concluímos que ainda existem muitos desafios para que o direito à educação seja realmente efetivado a esses jovens. Os dados apontam, que, na situação escolar destes adolescentes, há altos índices de distorção de idade/série e evasão escolar. E as entrevistas mostraram as reais dificuldades para a inserção e permanência deste adolescente na escola, como o preconceito ainda existente na comunidade escolar, a falta de capacitação dos profissionais da escola para lidar com estes adolescentes e a falta de articulação entre as políticas públicas. Por fim, essa pesquisa identificou as dificuldades deste fenômeno contribuindo, portanto, com a possibilidade de organizar estratégias de atuação profissional do Serviço Social que visem garantir o direito à educação na escola da comunidade dos adolescentes que saíram da internação. / The present Social Service Dissertation brings the results following research: The return to school of the community of adolescents who fulfilled socioeducative measures in closed environment. It was analyzed the operationalization of the Right to Education of the adolescents who left the socio-educational measure in a closed environment, investigating the issues related to access, permanence, serial / age gap, school dropout and prejudice in the public school that had the largest number of adolescents who Left the CASA Foundation. We used the quantitative research to elaborate the profile of the adolescents in the ESAC and the qualitative approach to the interviews with school's educators (teacher, mediator teacher, pedagogical coordinator and deputy director). We also conducted interviews with the adolescent for a deeper understanding of the research object, relating it and contextualizing it with the reality, which is in constant transformation and contradiction. We conclude that there are still many challenges so that the right to education is actually effectively provided to these young people. The data indicate that, in the school situation of these adolescents, there are high rates of age / grade distortion and school dropout. And the interviews showed the real difficulties for the insertion and permanence of this adolescent in school, such as the prejudice still existing in the school community, the lack of training of school professionals to deal with these adolescents and the lack of articulation between public policies. Finally, this research identified the difficulties of this phenomenon, thus contributing to the possibility of organizing strategies of professional work of the Social Service aimed at guaranteeing the right to education in the community school of the adolescents who left this closed environment.

The methodological option was the qualitative research, as a means to understand the educational proposal from this municipal corporation for the implementation of the policy of teenager in conflict with laws´s insertion. The methodological procedures have comprised the analysis of documents, interviews and observations. The theorist referential presents the teenager offender's report, with emphasis in the irregular situation doctrine for the integral protection and their right to the education, as alleged in the Child and Adolescent's Statute. Are also highlighted freirean referential categories in order to help the interpretation of the collected evidences and the proposition of overcoming experience challenges, with emphasis on the curriculum organization. The research revealed that they could identify structuring actions in Embu´s educational policy to ensure that the teenager in conflict with the law could be inserted in municipal system of education. Also in inspected school were observed procedures that consider the inclusion of these students in situation of vulnerability / O presente trabalho tem como objetivo analisar a política pública da Secretaria Municipal de Educação de EMBU, no que diz respeito ao acolhimento dos jovens em medida socioeducativa, chegando até uma escola para investigar os desafios da prática. A opção metodológica foi a pesquisa qualitativa, como meio de compreender a proposta educacional desse município para implementação da política de inserção do adolescente em conflito com a lei. Os procedimentos metodológicos incluíram a análise de documentos, a realização de entrevistas e observações. O referencial teórico apresenta o histórico do adolescente infrator, com ênfase na doutrina da situação irregular para a proteção integral e o seu direito à educação, conforme preconizado no Estatuto da Criança e do Adolescente. Também são destacadas categorias do referencial freireano no sentido de auxiliar a interpretação das evidências colhidas e a proposição de superação dos desafios da prática, com destaque para a organização curricular. A pesquisa evidenciou que, na política educacional de EMBU, puderam ser identificadas ações estruturantes para garantir a inserção do adolescente em conflito coma lei na rede municipal de ensino.
