This article provides a different approach to the debated issue of the criterion of solution of what has come to be called “property not registered vs. embargo registered”. In it, it argues that all the solutions that has been raised (even the adopted as “binding precedent” in the judgment of the Seventh Civil CassationPlenary) are based on an optical error, because they look at the embargo act of a static way, as if it were an act that creates a final situation, forgetting that the embargo is a procedural act that is not an end in itself, but is inserted into the dynamic of the execution process, a process in which the final situation occurs (the awarding of the asset under seizure to the successful bidder or creditor, that is, the acquisition of a real right). Observed, however, theembargo on the dynamic of the executive procedure, as an act that prepares the forced alienation of the asset, is postulated, as a criterion of solution to the problem, that of priority registration (that is, the contained in the first paragraph of the article 2022 of the Civil Code, but with the tempering of the appreciation of good faith), once the annotation of the embargo “reserve priority” to the act of forced alienation of the asset. / El presente trabajo pretende aportar un enfoque distinto al debatido tema del criterio de solución de lo que ha venido a llamarse “propiedad no inscrita vs. embargo inscrito”. En él, se sostiene que todas las soluciones que se han planteado (incluso la adoptada como “precedente vinculante” en la Sentencia del VII Pleno Casatorio) parten de un error de óptica, pues miran el acto del embargo de manera estática, como si se tratara de un acto que crea una situación final, olvidando así que el embargo es un acto procesal que no es fin en sí mismo, sino que se inserta en la dinámica del proceso de ejecución, proceso en el cual se produce la situación final (la adjudicación del bien embargado al postor adjudicatario o al acreedoradjudicatario, esto es, la adquisición de un derecho real). Observado, en cambio, el embargo en la dinámica del procedimiento ejecutivo, como acto que prepara la enajenación forzada del bien, se postula, como criterio de solución al problema, el de la prioridad registral (esto es, la contenida en el primer párrafo del artículo 2022 del Código Civil, pero con el atemperante de la apreciación de la buena fe), en cuanto la anotación del embargo “reserva prioridad” al acto de enajenación forzada del bien.

Konst som förenar : Ett sätt att förändra världen? / The collective artwork : A way to change the world?

This master thesis aims to investigate participatory art with focus on socially engaged art. The study is based on  Hannah Arendt’s theories of plurality, the public space and the work of art as a ”thought-thing” where the sensory experiences are central. The human’s social life is based on appearances, and individuals appear in front of each other. These appearances are based on a variety of perspectives. The purpose of the essay is to understand what vulnerability means for the art form, and how we as viewers can approach the artwork. By taking a theoretical point of view, the process draws support from Arendt's claim about the work of art as a ”thought-thing”. This is also the method for the thesis where the thought and it’s exploration have a central place and contribute to an organic process. This process follows the events that occur in the outside world like a ”train of thoughts” that connects and develops as a chain.          During this process there have been two great world events that have affected peoples freedom and ability to meet: the pandemic and the war between Russia and Ukraine. This led to the study being influenced by art initiatives linked to Ukraine.           The study begins with identifying the roles and perspectives in the artwork and then continues to discuss how to approach the analysis. This led to see the artwork as several parts that form a whole with the conclusion that the hermeneutic circle would form an appropriate method. The spectator’s pre-understanding is the starting point of the interpretation and helps to reach a deeper understanding of the subject. Finally the analysis results in an interpretation of the French artist JR’s work The Resilience of Ukraine that takes place in Liviv in March 2022. This participatory artwork illustrates the Ukrainian people’s situation in the war between Russia and their country.           The conclusion of the study is that it is important to see whose vulnerability it is that shapes the artwork and that vulnerability is an aesthetic perspective that enables a deeper understanding of the world. The spectator is an active agent that takes part in the appearances even when not formally invited to join the event. With it’s pre-understanding and ability to interpret, the role activates and the spectator gains a deeper understanding of the situation or the artwork. It is the ability to gain deeper understanding that is central for the spectator.

Recherches sur la cour royale égyptienne à l’époque saïte (664-525 av. J.-C.) / Researches on the Egyptian royal court during the Saite Period (664-525 BC)

Cette thèse propose une analyse de la « cour royale » égyptienne sous la XXVIème dynastie saïte (664-525 av. J.-C.) à partir des sources majoritairement textuelles (privées et royales) et historiques. Le volume de synthèse se développe autour de trois axes principaux traitant la « cour » dans son acception sociale, telle qu’on l’entend dans la sociologie historique. La première partie est ainsi consacrée à l’étude de la cour comme la Maison du souverain afin d’éclairer l’ensemble des activités qui caractérisent la « vie de cour » et son organisation domestique et qui rendent l’espace curial « privé » ou « officiel ». La deuxième partie examine la cour dans son agencement social et en tant qu’outil de représentation et de communication : ce sont alors le protocole du palais royal et son rôle-clef dans le maintien de l’équilibre social entre les souverains saïtes et leurs sujets (système des faveurs–ḥswt) qui sont analysés. La troisième partie se concentre sur les acteurs sociaux de la Résidence du roi (les courtisans et l’entourage royal) et tente de démontrer les différentes catégories auxquelles appartiennent ces élites et de déceler les modalités de leurs accès au palais et au rang de « courtisan modèle » dans la hiérarchie de la cour. Enfin, l’enquête diachronique suivie tout au long de la synthèse permet de mieux connaître l’impact des emprunts archaïsants dans le système palatin saïte, et par conséquent, d’évaluer la continuité et/ou le changement de ce système par rapport aux modèles traditionnels de la cour pharaonique. Le volume du corpus regroupe un ensemble de données prosopographiques appartenant à plus de 130 officiers royaux. Un troisième volume est consacré à la bibliographie générale, aux annexes et index. / This thesis offers an analysis of the Egyptian "royal court" under the XXVIth Saite Dynasty (664-525 BC) based on textual (private and official records) and historical sources. The synthesis develops around three main axes and deals with the "Court" in its social meaning as defined by the historical sociology. The first part, then, concentrates on the study of the court as the House of the sovereign and attempts to identify the activities which characterize the "court life", its domestic organization and which make the curial space "private" or "official". The second part examines the court as a symbol of social order and the outil of representation and communication of the monarchic authority: the protocol of the Royal palace and its key role to maintain the social balance between the Saite kings and their subjects (system of the favours ḥswt) are analyzed here. The third part focuses on the social actors of the Residence (courtiers and royal entourage) and tends to demonstrate the various categories of these elites and to reveal the modalities of their accesses to the palace and to the position of "model courtier" within the hierarchical order of the court. Finally, the diachronic study followed throughout the synthesis allows to better comprehend the impact of the Archaism on the Saite palace institution and consequently to estimate the continuity and/or the changes of this system compared to the traditional models of the Pharaonic court. The corpus includes a group of prosopographical data belonging to more than 130 royal high officials. The third volume is composed of three sections general bibliography, appendices and indexes.
