Nový regionalismus v praxi : strategické partnerství mezi Evropskou unií a MERCOSUR / New regionalism in practice : a strategic partnership between European Union and Mercosur.

This thesis deals with the interregional relations between the European Union and Mercosur. It is approached as a single case study where the examined case is defined as "the strategic partnership between the European Union and Mercosur in the context of new regionalism". The thesis consists of three main chapters. The first chapter explains the phenomenon of new regionalism and interregionalism and deals with two theoretical approaches to regional integration - neofunctionalist and intergovernmental. The subject of the second chapter is the development of regional integration within Mercosur and the analysis of the relations between the EU and Mercosur from the early 1990's till present. The current negotiations between the two regions are aimed at the conclusion of the Association Agreement creating free trade area and consisting of three pillars: political dialogue, cooperation and trade. The negotiations were officially launched in 1999, later suspended in 2004 and re-launched at Madrid Summit in 2010. The thesis seeks to find out how the EU and Mercosur are motivated to sign the agreement and what are the main obstacles blocking the successful conclusion of the negotiation process. The thesis seeks to examine the underlying motivations behind the conclusion of the Stability and Association Agreement between European Union and Kosovo on the 27th of October 2015. To determine the role of material interests and shared ideas in the process of concluding the SAA the thesis discusses and applies rationalism and constructivism, both grand theories of international relations. To test the theories and their respective hypotheses identifying the role of the relevant concepts, the research employs a single case study method, using a congruence analysis approach. In conclusion, through the rationalist lens within the perspective of the EU, the thesis confirms the existence of material interest in the conclusion of the SAA, representing security, power and economic gains. To complement the analysis via a constructivist lens within the perspective of Kosovo, the thesis solely implies a limited role of identity and norms while it points out that such constructivist concepts rather impeded the reaching of the SAA, veiling the actual role of material interest.

Au milieu des années 90, des changements de scénarios à la fois nationaux et internationaux ont conduit au développement d’un nouveau partenariat euro-latino-américain, fondé sur de nouveaux outils contractuels. Le Mexique et le Chili furent les premiers pays émergents de la région à bénéficier de cette rénovation contractuelle : cette rénovation est le sujet de cette thèse ; son but est de déterminer la nature juridique du point de vue du droit communautaire des accords Euro-Mexicain et Euro-Chilien, signés respectivement en 1997 et 2002, dans la mesure où ceux-ci ont cassé la tradition euro-latino-américaine de ne signer que des accords non préférentiels; ils inauguraient ainsi une nouvelle et ambitieuse étape dans ces relations. L’analyse du contenu de ces accords basés sur des valeurs et intérêts communs, démontre leur nature associative et révèle l’essence et la portée de ces relations qui sont devenues la base du nouveau modèle d’alliance stratégique au niveau international. / From the mid 90’s, changes in both internal and international scenarios led to a development of strategic Euro-Latino-American partnerships paving the way for new contractual tools. Mexico and Chile were the first emerging countries to benefit from this contractual renovation herewith the subject of this thesis which will seek to determine the juridical nature from the European Community Law point of view of the euro-Mexican and euro-Chilean agreements, signed respectively in 1997 and 2002 seeing as these broke the euro-Latino-American tradition of only signing non-preferential agreements, thus opening the way for a new and ambitious future for the relations between the parties. The content analysis of these agreements which are based on mutual values and interests demonstrates the associative nature as well as the essence and the scope of these relations which became the base of a new model of strategic alliances on the international level.

Avec le lancement du Partenariat Euro-Méditerranéen (PEM) en 1995, les relations entre l’Union européenne et les Pays tiers méditerranéens (PTM) connaissent une évolution notable. Du fait de la mise en place d’un cadre multilatéral complété par la conclusion des accords d’association, ce Partenariat représente une rupture avec les politiques méditerranéennes antérieures. Dans le contexte du cinquième élargissement de l'Union européenne du 1er mai 2004, la Politique Européenne de Voisinage (PEV) transforme le PEM en préconisant la création d’un cercle d'amis avec les voisins méditerranéens du Sud et les nouveaux voisins de l’Est. Ce métissage est le résultat de la rencontre entre deux cadres à objectifs différents et contextes géostratégiques différents : le PEM comme cadre de coopération régionale établi dans les années quatre-vingt-dix et une PEV en tant que politique de l’UE employant les méthodologies issues du processus de préadhésion. Les transformations des relations euro-méditerranéennes après la PEV ont permis l'émergence progressive d'une nouvelle forme relationnelle avec un impact contrasté sur les dimensions bilatérale et multilatérale du PEM. Cette étude définit le résultat de cette nouvelle dynamique interactive des politiques de l’UE sous le nom de cadres de voisinage euro-méditerranéens. La délimitation des cadres de voisinage euro-méditerranéens passe par l’analyse des transformations des relations après le cinquième élargissement en distinguant la dimension multilatérale de la dimension bilatérale. Si la dimension régionale euro-méditerranéenne post-élargissement n’est que partiellement affectée par la PEV, la dimension bilatérale est, quant à elle, profondément modifiée par l’instauration progressive d’un cadre relationnel à mi-chemin entre l’association et l’adhésion. / With the launch of the Euro-Mediterranean Partnership (EMP) in 1995, the relation between the relationship between the EU and Mediterranean countries witnessed a significant evolution. With the establishment of a multilateral framework supplemented by the conclusion of association agreements, this Partnership represents a break with past Mediterranean policies. In the context of the fifth enlargement of the European Union on May 1st, 2004, the European Neighbourhood Policy (ENP) transforms the PEM; advocating for the creation of a circle of friends with Mediterranean neighbors in the South and the new neighbors in the East. This mix is the result of the encounter between two frameworks with different objectives in different geo-strategic contexts: the EMP as a regional cooperation framework established in the nineties on one hand and the ENP, i.e. an EU policy using the pre-accession process methodologies on the other hand. The transformation of Euro-Mediterranean relations after the ENP allowed for the gradual emergence of a novel relational framework with a mixed impact on the bilateral and multilateral dimensions of the EMP. This study defines the result of this new interactive dynamic of the EU policies falling under the Euro-Mediterranean neighbourhood framework. The delimitation of the Euro-Mediterranean neighbourhood frameworks involves the study of the transformations in the relations following the fifth enlargement, distinguishing between multilateral and bilateral dimensions. While the Euro-Mediterranean regional dimension post-enlargement is only partially affected by the ENP, the bilateral dimension is, in turn, profoundly changed by the progressive introduction of a relational framework halfway between the association and the membership.

The compliance with intellectual property laws and their enforcement in Jordan : a post-WTO review & analysis

This thesis examines the implementation, enforcement and evolution of IP laws and regulations in the Hashemite Kingdom of Jordan. The period of interest includes the last decade of the twentieth century and the first decade of the twenty first century, with emphasis on the role played by Free Trade Agreements struck between Jordan and the United States, the European Union, and Jordan’s accession to the World Trade Organization. This thesis also examines the enforcement of the current set of IP laws in Jordan, and looks at their social and economic compatibility with the Jordanian societal norms and economic realities. This thesis argues that Jordanian IP laws lack a meaningful social and economic texture, and have failed to be evenly enforced in Jordan, essentially because they do not fit the Jordanian culture and are not compatible with Jordan’s economic stage of development. Additionally, the thesis argues that IP laws have had insignificant economic impact on the Jordanian economy as the majority of technologies used in Jordan, and the majority of foreign direct investments attracted to Jordan, are not IP related. Finally, the thesis argues that the current Jordanian enforcement model, which is built on coercion by donor countries, is serving the interests of foreign companies to the exclusion of the local citizens, and will not, in the long run, produce an enforcement model based on self-regulation by Jordanians, themselves. The laws, therefore, are unable to produce tangible results for the Jordanian people, or help meet their economic interests. The last part of the thesis deals with recommendations and suggestions aimed at creating an integrated approach to the adoption of IP policies.

Déclenché par la Déclaration de Barcelone du 27 et 28 novembre 1995, il fournit aujourd’hui le modèle le plus complet pour une meilleure mise en œuvre réelle et effective des droits de l’homme dans le cadre des accords d’associations. Inspiré, d’une politique euro-méditerranéenne qui a pour objectif la promotion et la protection des droits de l’homme, tel qu’énoncée dans la Déclaration universelle des droits de l’homme, inspire les politiques internes et internationales des parties et constitue un élément essentiel pour la mise en œuvre de l’accord d’association Algérie-UE. Y’a-t-il une réelle mise en œuvre de l’accord d’association Algérie-Union Européenne dans les perspectives du respect des droits de l’homme ? Is there a genuine implementation of the Algerian-European association agreement in the perspective of the respect of human rights? And what are the means used for that propose?
