Smluvní právo autorské / Agreements and contracts within copyright law

Author's Contract Law The aim of the thesis is to analyze legal regulation of license agreements within the legal branch of "droit d"auteur", or "author"s right". The main object of interest is typified license agreement, which serves as a standard contractual type to exercise authors" economic rights to their works. Recently issued Czech Civil Code shall become applicable on January 1, 2014. Unlike the currently applicable Civil Code, which leaves the regulation of license agreements to special acts, the new code includes provisions which regulate license agreements for the whole area of intellectual property, i.e. author"s right, as well as industrial property. This regulation is in line with a tendency to unite provisions that deal with license agreements, since a unification process concerning contract licenses within author"s right, has already happened with the enactment of the current authors" code in the year 2000. A comparative review of the current "droit d'auteur' and future civil regulations of author"s type license agreement takes a significant part of the thesis. Chapter 1 lists general principles and respective sources of law for further analysis. Moral rights in copyright Abstract This thesis, after a brief introduction to the issue of copyright, defines the basic concepts relating to author's moral rights and its nature. It provides an insight into the issue from various different points of view, focusing on the natural nature of moral rights and the natural nature of an author's work, that is reflected in the copyright legislation. The thesis also offers a comparison of two major legal systems of copyright - the authors' right system and the copyright system, which demonstrate the key institutes and characterize both legal cultures through their typical features and differences. The thesis draws attention to the fact that the regulation of copyright and moral rights in particular is far from uniform in the national context and that there are significant differences not only between the different legal systems but also within those legal systems. The thesis also presents copyright and moral rights in valid Czech legislation in terms of the systemic and conceptual definition of the Czech copyright law and then discusses in detail the individual moral rights of authors. Les travaux présentés consistent en une collection d’études consacrées au droit del’immatériel au sens le plus large. Ils visent à mettre en perspective sur une dizained’années la réglementation et la régulation des propriétés intellectuelles dans la sociétéde l’information d’une part, des techniques de surveillance et contrôle, d’autre part.Ces travaux appellent souvent une approche interdisciplinaire qui en fait lasingularité. Il s’agit, en effet, d’associer dans une certaine mesure l’analyse du droitpositif aux sciences sociales. Cette démarche à l’interface vise à mettre en évidence lesenjeux politiques et sociaux de la réglementation-régulation pour favoriser unemeilleure compréhension de l’élaboration de la norme dans un univers dématérialiséet l’éclairer d’un nouveau reflet. This work often calls foran interdisciplinary approach, which makes it particular. This is an attempt to link theanalysis of the substantive law to social sciences to a certain extent. This thoughtprocess is at a crossroads in order to highlight social and political issues of theregulation-legislation and to promote a better comprehension of the law makingprocess in a dematerialized world with a new point of view. The first part relates toadaptation of intellectual properties to the new digital area of the information society.More precisely, it sticks to think their regulation-legislation inside-outside the lawinviting social imaginary and controversies about Author’s right. The issues relating tothe protection of intellectual property leads to study its relationships to personal datarights. These rights are in the heart of the second part that relates to control andmonitoring technologies in various contexts and from several angles, freedom ofelectronic communications, regulation of the e-business, and dubious contours of thedigital identity. La licence de droit d'auteur / The license of author's right (copyright)

Le droit d'auteur – dont l'identité reste controversée – n'échappe pas à la discussion quant à la nature et au régime des contrats qui le mettent en œuvre. D'une terminologie légale ancrée dans une certaine tradition, mais hasardeuse, on infère l'originalité de l'ensemble des contrats de la matière. Or, la spécificité n'est sur ce point qu'apparente. De l'édition littéraire aux contrats de l'audiovisuel et aux œuvres diffusées sur les réseaux, l'analyse démontre que si l'auteur peut "céder" son œuvre – ce que dit la loi – il peut aussi la louer, c'est-à-dire en concéder la licence – ce qu'elle ne dit pas. Ce constat s'appuie sur une méthode de lecture renouvelée des contrats du droit d'auteur. L'attention portée par la loi impérative à certains contrats (édition, production audiovisuelle, etc.), a pu perturber l'étude de la licence, l'acte par lequel l'auteur se borne à autoriser l'exploitation de son œuvre pour un temps. Or, si la licence apparaît dans un premier temps en contrat spécial du droit d'auteur, elle sera également amenée à devenir la composante élémentaire d'un contrat complexe organisant une exploitation. Il importe donc de distinguer ces deux objets pour mieux en apprécier ensuite les interactions. Le droit d'auteur, droit "spécial", fait ainsi la preuve de son aptitude à accueillir - autant que de raison - les mécanismes du droit des contrats, droit "commun". Cette étude a pour ambition une meilleure compréhension de cette matière complexe des contrats du droit d'auteur, sans omettre le principal objectif de notre loi : la protection de l'auteur. / In the field of the author's right (a concept with a controversial identity), the nature and regime of many contracts is a subject for debate. A traditional but somehow uncertain terminology has often led to infer the originality of most of these contracts. However, this peculiarity is only apparent. From literary publishing to audiovisual contracts through creations published on networks, not only can the author of a work "assign" it – as stated by the law – but also rent it, or in other words license it – even though the law does not state it. This observation rests on a renewed reading method applied to the author's right contracts. Focusing on some of these contracts (e. g. books publishing, audiovisual production, etc.), mandatory copyright law hindered the study of license itself, i. e. the act by which an author authorizes the exploitation of his work for a fixed time. License is a special contract in the field of author's right ; it is also a basis element in a complex agreement designed to organize an exploitation. These two objects should therefore be distinguished and their interactions thoroughly analysed. A "special" right, the author's right nevertheless proves able to host (to a certain extent) the typical process of contract right – a "common" right. The present study aims to attain a better understanding of a complex matter, the author's right contracts, not forgetting the main purpose of the law itself : the protection of the author.

La déconstruction du droit d'auteur sous prétexte de technologie numérique / Deconstruction of author's right under the pretext of digital technology

L'avènement des technologies numériques, notamment des réseaux numériques, a servi de prétexte pour introduire dans le droit d'auteur des réformes qui mènent à une mutation profonde de ce droit. Un précédent a été créé par l'inclusion des logiciels et des bases de données électroniques dans son champ de protection ; ce sont de créations strictement fonctionnelles, qui ne devraient pas appartenir à la catégorie « oeuvre de l'esprit ». Cela ne pouvait qu'engendrer une distorsion du critère de l'originalité. En outre, la nature de ces objets imposera d'adapter le régime juridique ainsi que les règles de titularité. Naquit ainsi, au sein du droit d'auteur classique, un paradigme spécial que tout rapproche du copyright américain. Centré sur l'investisseur et sur la notion de fixation, il est désormais en train de contaminer le droit d'auteur. Au demeurant, on ne peut négliger l'influence capitale du copyright américain dans tout ce processus de construction et d'extension puisque certains de ses concepts et principes se retrouvent aujourd'hui dans le droit d'auteur. On assiste à un véritable mouvement de déconstruction du droit d'auteur personnaliste hérité de la Révolution française et dont l'apogée fut la loi du 11 mars 1957. Nous mettrons en évidence les divers facteurs qui ont agi et qui agissent conjointement aux niveaux national, communautaire et international, tout en démontrant que si l'environnement numérique pose certes des difficultés pour l'exploitation des oeuvres de l'esprit, le droit d'auteur, centré sur l'auteur et fondé sur la notion de communication au public, était bel et bien capable d'y faire face sans avoir besoin d'ébranler ses assises / The advent of digital technologies, including digital networks, served as a pretext to introduce author's right reforms that lead to a profound change in this right. A precedent was set with the inclusion of software and electronic databases in the field of protection as these are strictly functional creations that should not belong to the category of "oeuvre de l'esprit". This inclusion leads to a distortion of the criteria of originality as well as the need to change both the rules of ownership and the legal regime of author's rights. Consequently a special paradigm, similar to U.S. copyright, is born inside the classical author's right system. Focused on the investor and in the notion of fixation, this special right of sotware and database now contaminates the author's right system. We cannot ignore the important influence of American concept of copyright in the whole process of construction and expansion of this special paradigm as some of its concepts and principles are reflected in today's notion of author's rights. We are witnessing a movement of deconstruction of the author's rights personalist legacy of the French Revolution which culminated in the Act of 11 March 1957. We will highlight the various factors that have acted and act jointly at national, EU and international level to produce this result, while demonstrating that while the digital environment certainly poses difficulties for the use of works of authorship, the author's right, author-centered and based on the notion of communication to the public, would indeed be able to cope with digital environment without the need to undermine its foundations

La relation auteur-éditeur dans le contrat d'édition littéraire / the relations established between authors and publishers in the literary publishing contract

La démocratisation de l’écrit dans notre société culturelle moderne a fait que tout un chacun peut se revendiquer auteur. La reconnaissance n’est plus désormais à rechercher à travers la traditionnelle publication chez un éditeur mais à travers l’immatérialité des outils d’auto-édition offerts en ligne. D’une part, avec la phase de désintermédiation qui se joue entre les différents acteurs du secteur littéraire, l’écrivain se passe d’une maison d’édition. L’éditeur disparaît. D’autre part, l’auteur, personnage romantique et emblématique sur lequel le droit d’auteur a été forgé, s’efface progressivement du paysage juridique. Avec l’effacement du mythe est emportée la vision propriétaire des droits d’auteur, au profit de l’utilisateur. L’auteur disparaît. Les nouvelles pratiques de cette société connectée bouleversent le droit et sa capacité d’adaptation. Pourtant le contrat d’édition littéraire, socle de la relation auteur-éditeur, existe bel et bien et constitue le sujet de cette étude. Modèle dominant des contrats d’auteur, l’ambition de cette recherche est d’arriver à saisir à travers cette relation la nature du contrat d’édition et le jeu des nouveaux équilibres posés par l'ère numérique (réforme du Code de propriété intellectuelle), mais aussi de saisir les mutations à la lisière du droit d’auteur qui redéfinissent la possession dans l’ère immatérielle avec les modèles alternatifs du contrat d’édition littéraire (licences libres et creative commons). Les moyens d'y répondre emprunteront à l'analyse juridique mais aussi dans une juste mesure à l'internormativité, qui permettra d'observer le droit avec les yeux du sociologue, de l'économiste et de l'historien / The liberalization of writing in our contemporary cultural society has made it so anyone can now aim for the title of author. The recognition of one’s work is now sought, not through the traditional means of publishing, with the assistance of a professional publisher, but through immaterial processes of self- online publishing. On one hand, thanks to these new means, the author is able to cut the intermediation of the publishing field and to avoid using a professional publishing company. On the other hand, the author, romantic and emblematic character upon whom author’s rights have been forged is fading away from the legal landscape. With the decay of the myth, the ownership conception of author’s rights is taken away by those of the user. The author is fading away. The new customs of our over connected society are dramatically changing law and its ability to adapt. Although, publishing contracts are still a part of the process and are the subject at the heart of this study. The French intellectual property code was able to grant this contract access to the dematerialized world by incorporating the paradigm shift. Main model of publishing contracts, its ambivalent nature is due to the merging of both civil and intellectual property law that can be applied to it. This study aims to capture the true nature of the publishing contract figure, through the relations established between authors and publishers, including their new balance, and also to grasp a full understanding of the mutations surrounding the authors’ rights and that redefine ownership in a now immaterial era through the new alternative means of self-publishing (free licenses and creative commons)
