La déontologie constitue, de tout temps, un élément essentiel de la profession d'avocat. Constituée d'un ensemble de règles, dont certaines restent purement coutumières, elle est ce qui fait de l'avocat bien plus qu'un simple auxiliaire de la justice. S'il demeure incontestable que l'ensemble des barreaux français adopte, et depuis très longtemps, une attitude commune sur les principes, en partie dictée par le puissant barreau de Paris, il n'en est pas moins vrai, que les barreaux de province, et notamment ceux du sud-est, ont toujours fait preuve d'indépendance, préférant, bien souvent, l'esprit à la lettre. Leur position en ce qui concerne principalement la recherche de clientèle et la lutte contre les réseaux d'affaires est incontestablement courageuse. La réponse qu'ils donnent au délicat de problème de l'honoraire est novatrice. Les Conseils de l'Ordre, principalement dans le Sud-Est, avant d'être des organes de sanction, sont avant tout des organes de conseil. Ceux du ressort de la Cour d'appel d'Aix-en-Provence font de la conservation des traditions un devoir et de la modération une vertu. / Legal ethics have always been an essential part of legal business. Made up of a set of rules, some of which are merely customary rules, legal ethics lead the lawyer to be more than an aid of the justice. One usually notice the common, very ancient and general agreement of all french Bars on some principles, behaviour partly dictated by the powerful Bar of Paris. However, it’s also true that other Bars, in particular those of the South-East of France from Marseille to Nice, have always shown a real independence in the application of such principles, liking better the spirit of these rules than their letter. Regarding the search for customers and the wrestling against business networks, the positions of these bars is unarguably brave. The solution they give to the delicate problem of the fees of the lawyer are innovative. The Bars’ Councils, mainly in the South-East of the France, besides being organs of penalty for their profession, are especially organs of reflexion ans council. Those depending of the competence of the Court of Appeal of Aix-en-Provence, carry out the duty to defend the traditions and consider moderation as virtue.

RESUMÉ THE PERFORMANCE OF A LEGAL PROFESSION (THE BAR) IN THE CZECH REPUBLIC AND IN BELARUS The aim of this thesis is to characterize the practice of law in the Czech Republic and Belarus. This theme was chosen because of the comparison of advocacy in both countries and also because of the limited number of literature sources about law practices and advocacy organization in Belarus, to at least briefly cover the operation of this Institute from the very beginning. Czech Republic and Belarus are democratic countries. Czech Republic is a parliamentary form of government. According to the Constitution of the Republic of Belarus (1994) it is a presidential republic, with strong centralization of legislative, executive and judicial power in the hands of the president, as evidenced by presidential decrees, which significantly affects the advocacy activities and organization in Belarus. A common feature of both countries is the nature of the mission of advocacy - providing skilled and professional legal assistance in accordance with the law; serving the principles of legality and justice. Se observa en el Perú un incremento sostenido del número de arbitrajes en contrataciones con el Estado, por lo que es cada vez más trascendente el interés público que subyace en ello. Por ende, las disputas del arbitraje se tratan bajo el escrutinio de la sociedad en general y lamentablemente, casos como el de Orellana e investigaciones como las realizadas a raíz de Lava Jato han puesto en materia de discusión la transparencia del arbitraje. Por ello, el objetivo de este artículo es contribuir un poco más al entendimiento de la realidad arbitral de modo que se hagan más observables ciertas realidades del arbitraje peruano y se identifiquen preliminarmente algunos aspectos susceptibles de mejora como son las designaciones de los árbitros y el deber de revelación. También, se plantea una propuesta primigenia de marco normativo usando como base las reglas del International Bar Association (en adelante IBA) y teniendo en consideración características propias de nuestro contexto. Cabe mencionarse que esta investigación es en su mayoría de metodología dogmática, ya que usa normativa, doctrina y jurisprudencia para fundamentar el razonamiento. Sin también se presentan cifras y datos obtenidos de estudios e informes jurídicos para dar solidez a la argumentación. Una de las conclusiones principales es que dada la existencia de materias especializadas con pocos profesionales en dichos campos y de un creciente número de arbitrajes los parámetros numéricos de las IBA deben ser modificados para que puedan ser herramientas idóneas para nuestro sistema jurídico. / A sustained increase in the number of arbitrations in contracting with the State is observed in Peru, so the public interest underlying this is becoming more transcendent. Therefore, arbitration disputes are dealt with under the scrutiny of society in general and, unfortunately, cases such as the Orellana case and investigations such as those carried out as a result of Lava Jato case have put the transparency of arbitration under discussion. Therefore, the objective of this article is to contribute a little more to the understanding of the arbitration reality in such a way that certain realities of Peruvian arbitration become more observable and some aspects susceptible to improvement are preliminarily identified, such as the appointments of the arbitrators and duty of disclosure . Also, an original proposal o normative framework was made using as a basis the rules of the International Bar Association (hereinafter IBA) and taking into account characteristics of our context. It should be noted that this research is mostly dogmatic methodology, since it uses legislation, doctrine and jurisprudence to support the reasoning. Also, figures and data obtained from legal studies and reports are also presented to give strength to the argument. One of the main conclusions is that considering the existence of specialized subjects with few professionals in these fields and a growing number of arbitrations, the numerical parameters of the IBA must be modified so that they can be suitable tools for our legal system.

Courting gender bias: an examination of women’s experiences in the profession of law in Kansas

Master of Arts / Department of Sociology, Anthropology, and Social Work / Gerad Middendorf / This study examines the issue of gender bias and other gendering processes within the profession of law in Kansas. Although women have made great strides toward equality within the law profession, there are still glaring disparities between men’s and women’s occupational attainment. Women enter law school at similar rates as men do; however, they are not similarly represented in the legal profession upon graduation, or throughout their careers. Utilizing a theory of gendered organizations, this study seeks to investigate what impact, if any, certain sociodemographic factors, sector of law, mentorship, and perceptions of discrimination, have on women’s levels of job satisfaction. To accomplish this goal, this study makes connections between previous research conducted by the Kansas Bar Association, and more recent survey data modeled after the original KBA research. Underlying structures and ingrained interactions are examined quantitatively, to gain a better understanding of the gendered processes that women experience within the profession of law in Kansas.

Funktionswandel der Rechtsanwaltskammern - von staatlichen Zwangsverbänden zu staatlichen Dienstleistungsträgern

In dieser Arbeit beschäftigt sich der Autor mit der deutschen Anwaltsorganisation in Form des traditionsreichen Kammermodells. Die anwaltliche Selbstverwaltung durch Rechtsanwaltskammern stellt hierzulande eine besondere Untergliederungsform des Staates dar und verkörpert eine freiheitliche Traditionslinie in der über weite Strecken hierarchisch geprägten Staats- und Verwaltungsorganisation. Dennoch sieht sich das anwaltliche Kammermodell in der Vergangenheit zunehmender Kritik ausgesetzt. Sind die Rechtsanwaltskammern daher möglicherweise als tradierte Relikte deutscher Staatsorganisation zu verstehen? Besteht für die deutsche Anwaltsorganisation ein Modernisierungsbedarf, worin genau liegt dieser und wie ist dies in der Praxis umsetzbar? Hierzu geht der Autor zunächst rechtsvergleichend auf die britische Anwaltsorganisation ein, welche durch den „Legal Services Act 2007“ eine grundlegende Neuordnung erfahren hat und die für die Anwaltsorganisation in den europäischen Mitgliedstaaten insoweit eine Vorreiterstellung einnimmt. Die Anwaltstätigkeit der Solicitors und Barristers ist mittlerweile zur juristischen Dienstleistung in einer „Legal Services Industry“ geworden und die privaten Berufsverbände Law Society und Bar Council haben ihre Regulierungsbefugnisse an den neu eingeführten „Legal Services Board“ verloren, weshalb ihnen fortan originär nur noch die Aufgabe der Interessenvertretung verbleibt. Der Autor unternimmt anschließend den Versuch, praxisnahe Vorschläge für die Modernisierung der Rechtsanwaltskammern zu unterbreiten. Hierzu wird der den britischen Reformen innewohnende „britische Dienstleistungsgedanke“ fruchtbar gemacht und in das anwaltliche Kammersystem implementiert. Im Ergebnis werden die Rechtsanwaltskammern vom Autor als moderne staatliche Dienstleister qualifiziert, denen neben den klassischen Aufgabenbereichen „Regulierung“ und „Interessenvertretung“ unter dem Gesichtspunkt der „Förderung des Berufsstandes“ und im Rahmen des verfassungsrechtlich Zulässigen verstärkt die Aufgabe eines Dienstleisters zugunsten der eigenen Mitglieder zukommen sollte, um deren Zukunfts- und Wettbewerbsfähigkeit in einem sich stetig anglisierenden Rechtsberatungsmarkt gewährleisten zu können. / In this work, the author deals with the german lawyers'' organisation in the form of the traditional chamber model. The lawyers'' self-regulation by Bar Associations (“Rechtsanwaltskammern”) in Germany thereby represents a special subdivision of the state and embodies a liberal tradition dominated by authoritarian state structures and administrative organisation. Nevertheless, in the last years the german chamber model has been encountered to an increasing criticism. Have the German Bar Associations therefore to be regarded as traditional relicts of german government organisation? Is there a need to modernise the german lawyer´s organisation, what exactly is this and how is this implemented in practice? According to this, the author processes on comparative law, namely by analising the british lawyer´s organisation, which has been completely reorganised by the "Legal Services Act 2007" and therefore captures a pioneer role according to lawyer´s organisation in the European Member States. Law practice of solicitors and barristers has now become a part of numerous legal services in a "Legal Services Industry" and the lawyer´s associations Law Society and Bar Council have lost their regulatory powers to the newly established "Legal Services Board", meaning that they are from now on only originally responsible for the representation of lawyers´ interests. The author then attempts to submit practical proposals for the modernisation of the German Bar Associations. For this, the british reforms inherent the "british service idea" which is fructified for and implemented in the german chamber system. As a result, the author qualifies the German Bar Associations as modern service providers, which should get strengthened in addition to their traditional mission areas "regulation" and "representation" from the point of "promotion of the profession", meaning to strengthen their task of providing services for their own members within the constitutionally permissible in order to ensure their future and competitiveness in an ever-anglicised German legal services market.
