This thesis investigates the intellectual foundations of the thinking of the father of the modern West German armed forces, Wolf Graf von Baudissin, during their establishment between 1951 and 1956. Its aim is to identify the main areas of reform as advocated by Baudissin as well as to shed light on central features of Baudissin's character and ideas, primarily his ideas on the role and impact of democracy in a modern society. The thesis demonstrates how the environment in which Baudissin operated was characterised by strong opposition to new ideas by former Wehrmacht soldiers, whose ideas belonged to a traditionalist movement of military thinking. It also reveals how Baudissin's ideas were to a large extent the product of collaboration with a great number of politicians, academics and intellectuals, some of whom dominated the intellectual scene of the early post-1945 Federal Republic. The thesis demonstrates how Baudissin's thinking was influenced by certain polarities, out of which he developed three historical types of soldiers as an intellectual response to opposition. Baudissin's proposals for reform were directed towards the German youth as those who were to build the new West German post-war society. He stressed the extensive democratic rights allocated by the Federal Republic's constitution and the positive educational value of the proposed reforms, all in the face of accusations that they were utopian. Investigating Baudissin's intellectual foundations, the thesis stresses Baudissin's positive image of occidental culture, with a strong attachment to ethical and communitarian values, and a negative image of Russia as the exponent of communism and authoritarianism. Looking specifically at democracy, the thesis highlights Baudissin's emphasis on democracy by proclaiming that his conversion to democracy was the product of amalgamation of pre-war conservative thinking with modern democratic liberalism. The thesis finally argues that the overall image of an ethical-democratic citizensoldier, the 'Staatsbürger in Uniform' negates the historical antinomy between the condition of being a soldier and a citizen.

Behandelte Themen sind: 1. Menschenrechte gelten während bewaffneter Konflikte grund sätzlich fort. Sie gelten damit gleichzeitig und nicht alternativ zum humanitären Völker recht. 2. Hoheitsgewalt und damit die Anwendbarkeit der genannten Menschen rechts verträge kann grundsätzlich auch bei Kampfeinsätzen vorliegen. 3. Das Verhältnis beider Rechtsgebiete ist eines wechselseitiger Ergänzung. 4. Mögliche Widersprüche zwischen den beiden Rechtsgebieten können überwiegend durch Auslegung oder mittels vorhandener Notstands klauseln ausge räumt werden. 5. Können Widersprüche nicht durch Auslegung oder Derogation ausgeräumt werden, gehen im Einzelfall die Normen des humanitären Völkerrechts als speziellere vor (lex specialis derogat legi ge nerali). 6. Die komplexe und umfangreiche Materie beider Rechtsgebiete läßt sich auf ein solches „Destillat“( bringen, das sich in Ausbildung und Training ver mitteln läßt und auch für die sich im Feld oder auf See befindlichen Truppen praktikabel ist.

Aus dem Vorwort:<br><br> Vor wenigen Wochen ist im Heft 13 der „Studien zu Grund- und Menschenrechten“ eine Arbeit von Herrn Schäfer mit dem Titel „Zum Verhältnis Menschenrechte und humanitäres Völkerrecht“ erschienen. Wir haben inzwischen nicht nur zahlreiche faktische Situationen, in denen dieses Verhältnis von Menschenrechten und humanitärem Völkerrecht relevant ist, sondern es gibt zunehmende Äußerungen rechtlicher Instanzen (Internationaler Gerichtshof, Jugoslawien-Tribunal, Menschenrechtsausschüsse), die sich diesem Problem gewidmet haben, von Stimmen aus der Wissenschaft ganz zu schweigen. Herr Schäfer wird versuchen, eine Zwischenbilanz zu ziehen.<br><br> In vielen Fällen, nämlich stets bei Auslandseinsätzen von Streitkräften, hängt die Frage, wie das Verhalten von Menschenrechten zu Regeln des humanitären Völkerrechts zu beurteilen ist, auch davon ab, ob die menschenrechtlichen Verpflichtungen eines Staates ihn auch dann begleiten, wenn er außerhalb seines Territoriums agiert. Herr Dr. Weingärtner wird sich dieser zentralen Frage stellen, die nicht erst, aber vor allem auch nach der Banković- Entscheidung des Europäischen Gerichtshofs für Menschenrechte aus dem Jahr 2001 vielfach erörtert wird. Die Bundesrepublik Deutschland selbst wurde etwa vom Menschenrechtsausschuß der Vereinten Nationen bei der Diskussion ihres letzten periodischen Berichts mit dieser Frage direkt konfrontiert. An die Einsätze in Afghanistan, Kongo und nun auch vor der libanesischen Küste ist zu erinnern. Gern nehme ich diesen Zusammenhang zum Anlaß, auch auf die Arbeit von Dirk Lorenz „Der territoriale Anwendungsbereich der Grund- und Menschenrechte“ hinzuweisen, die im Jahr 2005 als Band 25 in der vom MRZ herausgegebenen Schriftenreihe erschienen ist.<br><br> Frau PD Dr. Schmahl behandelt ein Thema, das im engen Zusammenhang mit den beiden vorangegangenen steht. Können Menschenrechtsverletzungen oder Verletzungen von Normen des humanitären Völkerrechts zu individuellen Schadenersatzansprüchen führen? The thesis sets out to mobilise the concept of strategic culture as a tool to understand German security policy. The main assumptions behind the concept of strategic culture are that security policies emanate from collectively held beliefs and values relating to the use of force and that these values and beliefs emerge over-time and are shaped through formative periods and critical junctures, especially at times of war. Building upon these key assumptions the thesis moves to identify the antecedents of (West) German strategic and then to construct a framework for analysis to apply to aspects of post-Cold War security policy. Three central research questions guide the conduct of the study: What is German strategic culture? Has it changed through the ending of the Cold War? And How does it impact upon behaviour? The thesis holds that Germany has a distinct strategic culture, which emerged in the wake of the Second W orId War and acquired substance and form through the rearming of West Germany in the 1950's. This strategic culture, it is argued, incorporates three types of elements. At its core are beliefs and values relating to the use of force that form its basal fabric, stemming out of this are a range of dispositions or 'security policy standpoints' that actively relate core values to the third element of strategic culture the observable policy manifestations. The thesis identifies (West) German strategic culture through an examination of aspects of the rearming of West Germany which is then presented in the form of a full anatomy of the strategic culture and its constituent parts. Subsequent to this the thesis tackles the issue of change after the Cold War and the relationship between strategic culture and security policy behaviour. These two questions are dealt with through an examination of the transformation of the Bundeswehr since 1990, together with a case study of the· practice of compulsory military service, a policy that has endured since the end of the Cold War. Through its investigation the thesis argues that German strategic culture has persisted after the ending of the Cold War and has come to playa decisive role in shaping security policy behaviour

Das Pro und Contra hinsichtlich bewaffneter Drohnen für die Bundeswehr schwelte hierzulande bereits seit Längerem, als Bundesverteidigungsminister de Maizière 2012 mit einem befürwortenden Plädoyer aus der Deckung trat und solche Kampfmaschinen als „ethisch neutral“ einstufte. Inzwischen könnte – ohne Einbeziehung des Parlaments – eine Entscheidung der Bundesregierung gefallen sein. In der Antwort auf eine parlamentarische Anfrage der Linkspartei hieß es, „dass eine durchhaltefähige bewaffnete Aufklärung […] als Schutz bei plötzlich auftretenden gravierenden Lageänderungen unbedingt erforderlich ist“.
