Philosophical Subsidies to Law Education: The Virtues of Prudentia [Prudence] and of Iustitia [Justice] and the \"Case Method\" applied to the course of Fundamental Rights and Warranties.

The methodology of education is not indifferent to the development of the ethical values of the law student and the society, on the juridical side. If law education has no ethical concerns, is formalistic, arid and not connected with reality as a whole, the reaction of the jurist and of the society before law will also tend to be without ethical concerns, formalistic and arid, nurturing the lack of prestige of law, of the institutions that create and interpret the juridical institutes and of the administration of justice itself. Therefore, the implementation of a pedagogical method of law teaching which makes it possible to irradiate ethical values of great significance, particularly in the course of Fundamental Rights and Warranties, in its modern conception of Human Rights, would lead to meaningful positive effects on the moral and legal conscience of the society, in the creation, interpretation and application of the laws. This is because, from the ethical perspective, based on the classic philosophical tradition, there is an inseparable relationship between the virtue of prudentia, which is an act of intelligence directed to the command of action, and the virtue of iustitia, as a decisive attitude towards the recognition of the right of one\'s fellow, with all its broad dimension of alterity (iustitia est ad alterum). The adoption of a pedagogic instrument which brings the reality, in its entire contingency, concreteness and graveness, to the classroom - strongly connecting man\'s being to ethics, in direction of the full realization of the individual and of the society in the perspective of the bonum commune hominis and bonum commune communitatis - should allow the student to abandon a tendency to apathy and passivity in classroom. Such dynamism in law education is feasible through the use of \"case method\", by which the reality of law, learned from court decisions in concrete cases - by the jurisprudentia, which would represent the prudentia of the ius -, is object of reflections and discussion in class, moving the centre of gravity from the professor to the students, who become the core of the education process in classroom. The knowledge of actual court cases would allow the law student to comprehend the general principles which comprise the legal system and life in society and to inquiry about the ideal of justice, of a jusnaturalist conception, which supports the recognition of the fellow citizen, which is the basis of tolerance and would allow the human experience of encounter and coexistence with the fellow human. On the ethical and pedagogical dimension, the affinities of the \"case method\" with the virtue of prudentia are magnificent. The \"case method\" expresses the consubstantiation, the completion of the education for the prudentia in relation to the first part of the virtue, headed for \"seeing reality as it is\" with all of its contingency, graveness and concretion, and with regard to the other part of the moral precept set towards commanding the action to the morally correct attitude, in the legal perspective of the ideal of justice in a concrete situation in the hic et nunc of the reality. Legal knowledge is the outcome of education and practical experience, as the virtues of prudentia and iustitia are learned ex doctrina et experimento, in accordance with the Aristotelian and Thomistic tradition. The legal hermeneutic, as an act of knowledge, follows an intellectual exercise of a technical character, but is fundamentally linked to a subjective judgment arising from the internal dimension of its agent, as an act of will towards justice, driven by the moral conscience. This results in the indissoluble connection between law and moral, from the perspective of the virtues of prudentia and iustitia, with all of their vigorous pedagogical potential for the education of law through the \"case method\", with its vast and positive implications to the improvement of law, the pursue of the ideal of justice and the life in society.

Thus, the high quality teaching should be the fundamental task of educational institutions across the country. The process of teaching and learning should be developed to encourage these required qualities in the student as well as motivate him to learn, allowing him to build his own knowledge. The Case Method offers the stimulus to critical thinking, problem-solving skills and learning of concepts in the area. In this method, teaching has the student as the focus and through case studies provides a contact with the reality of companies, and so, motivating him for learning. This paper aims to verify the contribution of the case method for teaching accounting. A survey was developed with coordinators of the accounting course and the implementation in a discipline of the Accounting Course of a Higher Educational Institution was possible. The results of the survey with coordinators show that the method contributes to a better development of students, motivating them and encouraging them to a more active role in learning and developing critical thinking and judging skills. Regarding the implementation of the method of cases, the results show that students have acquired knowledge in the subject they were taught, developed skills and gained confidence / A Lei de Diretrizes e Bases da Educação Nacional, 9394/96, determina que a Educação Superior deva proporcionar ao estudante uma formação capaz de levar ao mercado de trabalho um profissional com espírito científico, pensamento reflexivo, criativo e capaz de solucionar problemas do cotidiano empresarial.

Analyse de Flux de Trames AFDX en Réception et Méthode d’Optimisation Mémoire / AFDX Frame Flow Analysis in Reception and Memory Optimization Method

Baga, Yohan 03 May 2018 (has links)
The rise of AFDX networks as a communication infrastructure between on-board equipment of civil aircraft motivates many research projects to reduce communication delays while guaranteeing a high level of determination and quality of service. This thesis deals with the effect of the back-ot-back frame reception on the reception End System, in particular, on the internal buffer, in order to guarantee a non-loss of frames and optimal memory dimensioning. A worst-case modeling of the frame flow is carried out according to a first pessimistic method, based on a periodic frame flow. Then a more optimistic method is presented based on the reception intervals and an iterative frame placement. A probabilistic study implements Gaussian distributions to evaluate the occurrence probabilities of the worst back-to-back frames and provides an illumination that opens a discussion on the relevance of not considering the worst-case modeling to size the reception buffer. Additional memory gain can be achieved by implementing LZW lossless compression.

Melin Rydfalk, Maria January 2011 (has links)
NyckelordVuxenutbildning, / This essay is the report of my master's dissertation for Master of Engineering and Teacher Program atKTH and SU in Stockholm. The aims of the master’s dissertation are to increase the understandingand compose a map of how different presentation models affect the interest and ability to learnwhen the subject is resilient construction element is presented on a one day seminar.I have composed maps of three different presentation models in which the presentation models’communicative approach varied between authoritative and dialogic. The presentation models thathave been composed a map of are:• Seminar designed by problem-based learning• Seminar designed by the case method• Authoritative seminar The presentations models were tested and based on the tests, the feedback from participants and myparticipation studies, the presentation were surveyed and conclusions drawn about the learning and theinterest. This study was performed in the subject resilient construction element with the target groupadults with a basic skill in mechanics. The result of this study is that the potential for learning and interest increased if the communicativeapproach is in the dialogic direction. The communicative approach should neither be veryauthoritative or very dialogic. This is because the interest tends to decrease when the communicativeapproach is too authoritative and because the participants have problem with directing the seminarif communicative approach is too dialogic. Difficulties occur for the participants to control thedialogic communicative approach if they don’t have prior knowledge. The seminar model thatincreased learning and interests the most was the case-seminar format.

Information exchange between patients and nurses during routine nursing care in ward settings : a qualitative multiple case study

Crispin, Vivianne January 2014 (has links)
Aim: This study explores what type of information patients and nurses share with, or provide to, each other, and whether or not the information received was relevant and sufficient for their needs. Background: Information exchange, as part of shared decision-making, is advocated in policy and practice throughout the healthcare sector. Much of the literature on information exchange relates to one-to-one consultations with consultants or GPs. To date, no studies have explored information exchange between patients and nurses in ward settings. Nursing literature on patients’ information needs focuses on one-way information provision from nurses to patients, rather than on two-way information exchange between patients and nurses. Methods: Interactions between patients and nurses were observed and audio-recorded using a remotely controlled audio-recording system. Semi-structured individual face-to-face interviews were then conducted to clarify and add to the observation data. A multiple case study design was used for this study: each case comprised one patient, the nurses caring for that patient, and the interactions between them. A pilot study was undertaken to inform the methods for recruitment and data collection for the main study. Results: The pilot study comprised five cases (patients n=5, nurses n=3). Changes to the recruitment strategy for the main study included surgical patients being invited to participate in the same way as medical patients. There were no difficulties with the data collection methods. The main study comprised nineteen cases (patients n=19, nurses n=22). Information exchange seemed unfamiliar to ward-based nurses. The findings show that information exchange may not be a one-off event but a complex series of interactions. Patients did not distinguish between clinical and non-clinical information in the same way as nurses. Primary reasons for patients’ hospital admission were not discussed and nurses did not share information about nursing interventions. The relevance for patients and nurses differed; patients generally wanted information for reducing anxiety and socialization; nurses wanted information for assessment and care planning. In terms of sufficiency, observation sessions highlighted that insufficient information was provided, often due to lost opportunities and paternalistic practice. However, the majority of patients and nurses perceived that they had exchanged sufficient information. Conclusion: This multiple case study provides insights into the type, relevance and sufficiency of information for patients and nurses in ward settings. In ward settings, information exchange as conceptualised by Charles et al. (1997 and 1999) may be difficult to achieve due to the complexity of patient/nurse interactions. Therefore, there are implications for policy makers as policies are not context specific. However, information exchange may be helpful for reducing patients’ anxieties. The concepts of shared decision-making and information exchange are not part of ward-based cultures and philosophies, which suggests implications for patient and nurse education. Research on information exchange between patients and nurses in other ward contexts may contribute to further understanding of information exchange in ward settings.

The use of case studies for pervasive skills training in ODL accounting education

Reyneke, Yolande 06 1900 (has links)
Studies relating to recent curriculum changes implemented by SAICA and CIMA with an increased focus on pervasive skills are limited. The problem addressed in this study related to the challenge faced by ODL accounting education institutions to deliver practice-ready accounting graduates. This study explored accounting educators’ and students’ perception of whether pervasive skills can be developed effectively through the use of case studies in an ODL environment. The study aimed to determine whether ODL accounting departments should introduce a dedicated case study-based module as part of their curriculum. The perceived level at which case studies should be introduced, challenges and the benefits of case studies in light of their pervasive skills development potential were considered in an ODL environment. The study revealed that the case study-based approach is effective and that a staggered approach to introducing case studies in existing accounting-related modules tailored for different difficulty levels, would be appropriate. / Management Accounting / MPhil (Accounting Sciences)

An analysis of the tourism curriculum at Boland College : what the tourism industry in Stellenbosch requires from entry level college employees

Swart, Claudia 12 1900 (has links)
Thesis (MPhil)--Stellenbosch University, 2013. / ENGLISH ABSTRACT: Students graduate from Boland College after obtaining the National Certificates N4 – N6 in Tourism. I have been working at Boland College Stellenbosch Campus as a tourism lecturer for 12 years and over the past few years I have found that students have been struggling to find employment in the tourism industry on completion of their studies. The national tourism curriculum offered at FET colleges was implemented in 1995 with the last renewal in 2001 for selected subjects. The tourism industry, however, is a vibrant, ever-changing industry which stands in direct contrast with a static, needs-insensitive and unchanging curriculum. The aim of this study was to establish in which respects the current national tourism curriculum corresponds, or does not correspond, with what the tourism industry in Stellenbosch requires from entry-level employees in terms of expected skills, knowledge and attitudes. Qualitative methods were used to generate data from employers representing the tourism industry in Stellenbosch, graduates and lecturers from Boland College. Research participants were interviewed using semi-structured interviews. The data was analysed by doing verbatim transcriptions of the interviews, using coding and an Excel spread sheet analysis. The results revealed specific areas where the current national tourism curriculum does not correspond with the expectations and needs that the tourism industry in Stellenbosch has from entry-level employees in terms of expected skills, knowledge and attitudes. Ek werk die afgelope 12 jaar as toerismedosent by Boland Kollege Stellenbosch Kampus.
