A valorização dos precedentes judiciais pelo direito processual civil brasileiro / The increased significance of judicial precedents in Brazilian civil procedure law.

Nessa dissertação, pretendemos analisar a valorização dos precedentes judiciais pelo Direito Processual Civil brasileiro. Para tanto, no primeiro capítulo faremos algumas considerações gerais sobre os sistemas de common e civil law, principalmente no tocante ao tema desta pesquisa: os precedentes judiciais. Diante da comparação entre os dois sistemas, poderemos demonstrar que há uma inegável aproximação entre eles, principalmente no que concerne aos precedentes judiciais. Com relação ao Direito brasileiro, muito embora a valorização dos precedentes seja alternativa eficaz para propiciar segurança jurídica e igualdade ao jurisdicionado, e imprimir celeridade à marcha processual, as técnicas de operação com precedentes já existentes, recentemente inseridas e aquelas que se pretende inserir, devem ser pensadas à luz dos referidos princípios constitucionais e de acordo com a nossa realidade. Nesse contexto, estudaremos, no segundo capítulo, os princípios que orientam o tema da presente pesquisa, para que possamos, no terceiro capítulo, analisar individualmente cada técnica processual relacionada ao nosso tema, de forma a verificar a contribuição que cada uma trouxe ao ordenamento jurídico, bem como ao ideal de concretização dos princípios relacionados no capítulo anterior. Por fim, no quarto capítulo abordaremos o Projeto do novo Código de Processo Civil, que, conforme será demonstrado, dá continuidade ao movimento de valorização dos precedentes judiciais pelo Direito Processual Civil brasileiro, na medida em que estabelece normas para vinculação dos Juízes e Tribunais ao entendimento dos Tribunais superiores, bem como cria novo mecanismos de operação com precedentes judiciais. / In this work, we intend to analyze the enhancement of judicial precedents by the Brazilian Civil Procedure Law. In this end, in the first chapter, we will make some general remarks on the common law and civil law systems, especially regarding the topic of this research: judicial precedents. Following the comparison of these two systems, we will be able to demonstrate that there is an undeniable closeness between them, especially with regard to judicial precedents. With respect to Brazilian Law, although the contemporary tendency towards increasing the significance of precedent is an effective alternative that provides legal certainty and equality to all citizens, and to expedite Court proceedings, the procedural techniques regarding precedents should be analyzed in light of the constitutional principles listed above and in accordance with our reality. In this context, in the second chapter, we study the principles that guide the focus of this research, so that, in the third chapter, we can individually analyze each procedural technique related to our topic, in order to verify the contribution that they make to the legal system, as well as to the ideal of embodiment of the principles listed in the previous chapter. Finally, in the fourth chapter, we will discuss the project of the new Code of Civil Procedure, which, as will be shown, continues the movement towards increasing the value of judicial precedents by Brazilian Civil Procedure Law, extending the standards for binding lower court judges to the understandings of the higher courts and creating new mechanisms for operating with judicial precedents.

The primary objective of this work is to provide a comprehensive view of the human rights protection system concerning the prohibition of torture, focusing specifically on its European regulation. On the way to fulfill this aim, the following three hypotheses were confirmed: the prohibition of torture is currently regulated at all levels of protection of human rights, namely the universal, regional and national levels; from a comparative perspective, the highest level of protection has been achieved within the European system; and the prohibition of torture has recently acquired a social dimension. This work provides a comprehensive view, of the prohibition of torture at present time, and analyzes the instruments and mechanisms created to date. The interpretation was put into historical context, which is highly important, not only because it provides an exhaustive insight into the regulation of this issue in different sources, but also because this approach helps to understand the regulation correctly and enables the interpretation and application of respective standards in an adequate manner. It also makes it possible to better predict future developments in this area. O presente trabalho examinará a temática da imunidade de jurisdição do Estado estrangeiro em relação às violações aos Direitos Humanos. Na primeira parte, será abordada a configuração do instituto da imunidade de jurisdição do Estado estrangeiro, analisando seus fundamentos (soberania, independência, igualdade e dignidade), operando a distinção entre jurisdição, competência e imunidade do Estado estrangeiro, abordando a questão da transição do paradigma absoluto ao relativo e examinando como se deu esta transição na jurisprudência do Brasil. Na segunda parte do trabalho, tratar-se-á da oposição entre os Direitos Humanos em relação à imunidade de jurisdição do Estado estrangeiro, examinando-se as novas abordagens teóricas a respeito (teoria da renúncia implícita, teoria da hierarquia normativa, teoria da jurisdição universal, teoria da opção e da calculabilidade do risco, teoria e teoria do benefício coletivo), bem como suas repercussões jurisprudenciais, além de se propor uma síntese entre as teorias, para, finalmente, analisar o panorama jurisprudencial brasileiro na questão da imunidade de jurisdição em relação a violações de Direitos Humanos por Estado estrangeiro. / This paper will examine the issue of sovereign immunity regarding Human Rights violations. The first part will look at the configuration of the State’s jurisdictional immunity, analyzing its foundations (sovereignty, independence, equality and dignity), operating the distinction between jurisdiction, competence and sovereign immunity, addressing the transition from the absolutist paradigm to a relative one and examining how this transition occurred in Brazilian case-law. In the second part, the opposition between Human Rights and State’s jurisdictional immunity will be addressed by examining new theoretical approaches about the issue ( the implied waiver theory, the normative hierarchy theory, the universal jurisdiction theory, the option-risk calculability theory and the theory of collective benefit) as well as its repercussions in case law, in addition to proposing a synthesis between the theories, to finally analyze the Brazilian case-law on the question of sovereign immunity and Human Rights violations.

Potentials and Impediments to Universal, School-based Screening for Behavioral and Emotional Risk: A Critical Discourse Analysis of Current Case Law

Disproportionality in special education is a long-standing issue. Some scholars have proposed group or universal screening for emotional and behavioral risk in schools as a method of addressing disproportionality. Considering previous case law, questions exist as to the legality of such screening programs in public schools. The purpose of this inquiry was to apply critical discourse analysis (CDA) to the federal case of Rhoades v. Penn-Harris (2008) to explore how court discourse reflects issues of social power and multidisciplinarity in the context of a school mental health screening program. CDA is usually interdisciplinary and focuses on explaining discourse structures related to social problems and may be applied from various theoretical frameworks and methodologies. This study used a discourse-historical approach to address the questions regarding the court’s discussion of relative power relationships, its use of argumentation strategies, and the knowledge base(s) accessed in formulating its arguments. Case study findings indicated that the court's use of various argumentation strategies in its discourse on student mental health screening presented varying potential duties and liabilities for entities and individuals involved in such programs. Additionally, although mental health screening in public schools requires an interdisciplinary approach, the court's discussion of the program litigated in Rhoades used a centrist, law-based perspective, suggesting that attempts to facilitate a pluralist or an integrationist approach to such cases may require efforts particular to legal, as opposed to clinical, practice. Recommendations for developing school mental health screening programs sensitive to issues addressed by Rhoades are provided.

Abstract The purpose of this study was to investigate which legal sources the Swedish courts base their rulings on, regarding reconsidering of animal prohibition and if this provides guidance in future assessments. Further on was the purpose to investigate to which extent animal prohibition is decided, reconsidered and reversed by the county administrative boards between the years 2013–2017. To find out which legal sources the courts base their rulings on, 75 court rulings was audited from administrative courts and administrative court of appeals. To investigate which extent animal prohibition is decided, reconsidered and reversed, statistics from the Swedish Agriculture Agency was audited. The result indicate that some guidance on how decisions can be motivated, can be assisted by court rulings. Legal sources, that the courts support their motivations on, that may be indicative in future assessments regarding reconsinderings of animal prohibition, are for example the administrative court of appeals practice from Jönköping (case nr 1777–11). The statistics from the Swedish Agriculture Agency shows that the county administrative boards decided on animal prohibition on average 81,5% of the initiated animal prohibition trials and reversed on average 29% of the submitted applications for reverse of animal prohibition. The applications for reverse of animal prohibition that are subsequently appealed to court are rarely reversed, only 2 of the 75 court decisions reversed the animal prohibition. The guidance available at present from the courts is limited.

O presente trabalho tem como objetivo a análise da atuação da jurisprudência como base de confiança no contexto do ordenamento jurídico, na vigência da Constituição da República Federativa do Brasil de 1988. Especial atenção será dispensada à construção dos contornos da autovinculação do Poder Judiciário, que permite que o indivíduo possa ter a legítima expectiva de que o entendimento adotado pela jurisprudência será aplicado a seu caso e, em consequência, possa legitimamente definir sua conduta com base nesse entendimento, permitindo, por consequência, que a jurisprudência atue como base de confiança. Receberão atenção especial também os elementos que permitem aferir a aptidão da jurisprudência para gerar confiança e avaliar a evolução da capacidade da jurisprudência para gear confiança no tempo. A pesquisa desenvolvida é exploratória quanto a sua técnica e justificativa quanto a seu objetivo. É exploratória, porque busca no ordenamento jurídico brasileiro, na jurisprudência do Supremo Tribunal Federal e do Superior Tribunal de Justiça assim como na doutrina elementos que permitam compreender a atuação da jurisprudência como base de confiança; é justificativa quanto a seu objetivo, pois busca compreender os fenômenos jurídicos envolvidos na atuação da jurisprudência como base de confiança, buscando explicálos adequadamente e identificar, no âmbito do ordenamento jurídico brasileiro, os elementos que permitem construir a autovinculação do Poder Judiciário e que possibilitam estabelecer critérios para a aferição da aptidão da jurisprudência para gerar confiança. Deste estudo resulta que a autovinculação do Poder Judiciário no ordenamento jurídico brasileiro e a definição de seus contornos podem ser reconstruídas não apenas a partir de princípios estruturantes — como o princípio da igualdade e o princípio da segurança jurídica — e de postulados hermenêuticos — como o postulado da unidade e o postulado da coerência —, mas também dos diversos mecanismos que visam a assegurar que, uma vez que a interpretação do texto normativo pelo Poder Judiciário atingiu determinado grau de definitividade, ela seja adotada nos outros casos sujeitos à aplicação da norma, seja pelo Poder Judiciário, seja pela Administração Pública, exigindo-se que os indivíduos se conformem com a aplicação dessa interpretação, a partir dos quais pode ser induzida uma regra geral segundo a qual: a) o Poder Judiciário deve uniformizar e estabilizar a interpretação dada aos textos normativos e o conteúdo das normas a partir deles reconstruídas; b) uma vez uniformizado e estabilizado o conteúdo da norma, ele deverá ser adotado pelo Poder Judiciário e pela Administração Pública nos demais casos em que a norma for aplicável; e c) os indivíduos devem se conformar com essa aplicação. Resulta, também, que a utilização pelo Poder Judiciário (e, em alguns casos, também pela Administração Pública) de mecanismos processuais cuja aplicação pressupõe a existência de jurisprudência que ostente as características que a tornam apta a atuar como base de confiança fornece elementos para que se afira se a jurisprudência está apta a atuar como base de confiança e para acompanhar a evolução no tempo da capacidade da jurisprudência de gerar confiança e da intensidade da confiança gerada. / This work aims at analyzing precedents as the basis for legitimate expectation within the Brazilian legal system under the 1988 Constitution, especially concerning the definition of the circunstances under what will a precedent be considered binding, allowing individuals to legitimately expect that their cases will be ruled in accordance with the suitable precedent, and of the conditions for precedents to be deemed suitable to serve as grounds for legitimate expectation and of the criteria to gauge whether precedents can generate expectation. Attention will be given also to the criteria to assess whether case law generates confidence and to follow the evolution of its capability of generating confidence. This research conducted is exploratory as to its method and justificatory as to its objective. It is exploratory because it seeks to find within the Brazilian legal system and case law, as well as within doctrine, instruments to understand the role of precedents as grounds for legitimate expectation. It is justificatory as to its objective in that it seeks to understand the legal phenomena involved in precedents as the grounds for legitimate expectation, by seeking to explain such phenomena properly and to identify within the Brazilian legal system the conditions that must be present for precedent to become the grounds for legitimate expectation and the criteria that can be applied to assess whether precedent is suitable to generate expectation. This study has demonstrated that the hypothesis in which judicial courts must follow precedents can be defined not only according to principles and postulates, but also in accordance with the mechanisms provided for in the Brazilian legal system to ensure that, once the judiciary has consolidated the interpretation of a given legislative text, said interpretation is adopted in other cases that are subject to the application of the precedent whether by the judiciary or by public authorities, while demanding that individuals comply with the application of this interpretation. From these mechanisms, a general rule can be drawn whereby: a) the judiciary should standardize and consolidate the interpretation given to legislative texts and the content of the rules drawn therefrom; b) once the content of the rules are standardized and consolidated, they must be adopted by the judiciary and by the public administration in other cases to which the same standard applies; and c) individuals must comply with such application. This general rule evidences the boundaries of the binding effects of the precedents within the Brazilian legal system and the suitability of precedents as grounds for legitimate expectation, as a means to define the behavior to be adopted by the individual. These mechanisms also allow for the definition of the criteria to assess whether case law generates confidence and to follow the evolution of its capability of generating confidence.

Contentious issues of necessary defence in judicial practise The subject of this thesis is necessary defence in Czech criminal law. Necessary defence is defined as an action which is usually considered illegal but because it is made in defence against an imminent or persistent attack on values protected by criminal law, it is not considered a crime. The law also states that the intensity of this defence cannot be clearly and obviously disproportionate to the form of the attack. This thesis focuses primarily on contentious issues that courts often deal with when they interpret and apply necessary defence in real cases. Before focusing on contentious issues this thesis first describes the basics of necessary defence. Since necessary defence is one of the circumstances excluding liability in Czech criminal law, this thesis first briefly describes these circumstances. In the next section the thesis focuses on the conditions and limits of necessary defence as they are defined in criminal law. Necessary defence is comprised of an attack and a corresponding defensive action. This section first focuses on the obligatory attributes of the attack and then on the conditions of the defence.
