The Effects of Permanent Partial Disability on Claim Disposition Agreements

Search the library catalog for the location and call number. / Increasingly, workers' compensation (WC) insurers are turning to claim disposition agreements (CDA) as a means of reducing costs. CDAs are agreements between injured workers and insurers that close claims for a lump sum payment in lieu of other payments to which workers may be entitled. Intuitively, CDA payment amounts are expected to vary in response to changes in WC benefit levels. Models for decision-making processes related to lump sum versus benefit streams suggest the opposite. This thesis examines the relationship between CDA amounts and permanent partial disability (PPD) using two models. The first model utilizes individual claim information before and after a legislated benefit increase in the state of Oregon. 1 Abstract The main aim of this thesis is to analyze available information on the claim management in the international capital construction. The thesis also describes how the claim management should work and makes a comparison and evaluation of the real situation in practice. This comparison and evaluation is based on FIDIC conditions of contract available to the experts in implementation of construction projects. The thesis is divided into five chapters. The chapters deals step by step with the basic terms, the FIDIC conditions of contract, the contract price, the time for completion, the claim and the claim management. Chapter One clarifies essential terms for understanding the solved theme, the project of construction, the unification of obligations, the foreign business and the construction project organization. Second chapter deals with the FIDIC conditions of contract, which can be classified as a part of lex mercatoria, factually lex constructionis. The FIDIC conditions of contract are used in the foreign construction, but also domestically. Czech civil code inclines to the autonomy of contractual parties and gives businessmen the possibility to determine part of the content with reference to the certain contractual terms and conditions. Svenska konsumenters syn på sötnings-relaterad Front-of-package labeling

Sammanfattning Titel: En studie om hur Front-of-packaging påverkar konsumenters attityder. Nivå: C-uppsats, examensarbete i ämnet företagsekonomi. Författare: Alexandra Ekstrand och Jasmine Wiberg. Handledare: Jonas Kågström och Benny Berggren. Datum: 2019-05-24. Syfte: Vårt syfte är att skapa en djupare förståelse för hur konsumenter värderar sötnings-relaterade hälsopåståenden på livsmedelsförpackningar. Metod: I denna studie har en kvantitativ metod använts där 186 enkätsvar samlades in via en webbaserad undersökning som publicerades på sociala medier. Enkätsvaren analyserades i data- och statistikprogrammet Jamovi där deskriptiva analyser samt faktoranalyser genomfördes. Resultat & diskussion: Ett genomgående drag för i stort sett alla faktoranalyser är att WTP inte påvisar något starkt samband gentemot övriga variabler. Det finns dock ett tydligt samband mellan köpintention och de specifika påståendena i samtliga av faktoranalyser. Det vi funnit är främst att natur- och närvarofokuserade sötningspåståenden på produktförpackningar genererar högst WTP samt att vetenskaps- och närvarofokuserade påståenden ger lägst WTP hos konsumenterna inom denna produktkategori när sötning är i fokus. Uppsatsens bidrag: Undersökningen har främst bidragit genom att utveckla och fördjupa det teoretiska ramverk som André et al. (2018) skapat. Studien har även skapat en djupare inblick i huruvida FOP:ers utformning och karaktär påverkar konsumenters preferenser och WTP samt givit granola-producenter viss vägledning kring vilken karaktär hos påståenden som preferens. Förslag till vidare forskning: Ett exempel på vidare forskning är att ge studien en ny vinkel genom att följa Bonilla (2010, s. 11) tes om att utföra experimentella studier för ett mer verklighetsförankrat resultat. T.ex. genom att utföra ett experiment som innefattar respondenternas interaktion med verkliga produkter och verkliga pengar.

ABSTRACT QUANTIFICATION OF ACCELERATION CLAIMS: A SIMPLIFIED APPROACH Operating a successful business within the construction industry has become more difficult for companies as the profitability margins decreased considerably compared to previous years. Even, global economy has created an environment in which construction firms are enforced to bid projects at or below lowest profit levels. At the same time, owners are demanding more difficult projects without increasing the quality of contract documents. This has placed an added burden on the individual contractor to construct sophisticated projects. Under these circumstances, it is not surprising that the number of disputes within the construction industry continues to increase. Thus, contractors requested additional payments from the owners and the concept of claim and claim management developed. However, implementation of a well developed claim management process is crucial as the consequences and reimbursement depends on this process. The objective of this study is to discuss potential sources of disputes and types of claims in the construction industry by focusing on acceleration claims. Quantification methods for owner directed acceleration are discussed as well as required documentation and claim management strategies for preparation of acceleration claims. Two different methods, namely theoretical approach and simplified approach, are presented here and examined in detail mentioning their advantages and shortcomings. These methods are applied to two different real cases, one in Turkey and the other one is abroad in order to have a better understanding of these approaches. Furthermore, a computer program is developed to carry out the calculations that constitute the necessary steps of simplified quantification method. This study can be considered as a complete guide for young civil engineers about quantification and management of acceleration claims.

Contract and claim prevention in major projects : a study on petrochemical projects in Iran

The construction industry is notorious all over the world for disputes and claims. In large scale projects these claims are often more frequent and more expensive. The contract is the legal frame work of the project and forms project culture, therefore is a logical starting point for any attempt in reducing project claims. This research initially intended to study the possibility of drafting a robust contract which can prevent claims in major projects, and the main characteristics of such contract. However a review of contract related theories (transaction cost economics, agent theory and relational contracting) revealed that there is no such thing as perfect contract; and that contracts are invariably incomplete and prone to formation of claims. Traditional management theory considers disputes in project as pathological and tries to prevent them. The development and use of standard forms of contract was an attempt to tackle the problem of claim in the construction project, yet today more than 50 standard forms are in use in the UK alone and the rate of claims is at its highest ever. Much of the literature introduces partnering as a panacea for the current plague of disputes and claims. However this idea is seriously challenged by some scholars. Complexity science maintains that projects are complex systems and conflict occurs naturally. Conflicts are neither good nor bad by themselves; however the system needs re-adjustment after such conflicts. Flexibility of contracts or error controlled regulation can enhance such readjustment measures in the system. To get first hand information about the nature of claims from practitioners in major projects different methods of data gathering have been used. Three case studies, a set of interviews and a questionnaire survey have been conducted. Using a grounded theory like approach some repeating patterns of forming claims in the oil, gas and petrochemical projects are identified. Considering that all data have been gathered from Iranian projects, Iranian national culture has also been studied. The research concludes that contracts cannot prevent claims no matter how well they are drafted; nevertheless a poorly drafted contract can cause dispute. Some areas for improvement have been identified in the Iranian oil, gas and petrochemical sectors. By analysing the data and studying standard contracts some suggestions are made. In practice, stake holders try to preserve flexibility and rearrange relationships to keep continuity of contract and complete their projects.

The purpose of this thesis is to try to provide comprehensive analysis of the recent legislation of contract for the assignment of a claim, compare it with former legislation, critically evaluate changes that new civil code bought to contract for the assignment of a claim and find solutions for selected legal problems that acceptance of current legislation brought to experts. The thesis is systematically divided into seven chapters. First chapter briefly define the concept of obligation and is dedicated to changes in subject of obligations based on the will of the parties. Contribuição crítica ao estudo dos limites objetivos da coisa julgada / Critical contribution to the study of the objective limits of res judicata

Esta dissertação tem como objetivo discorrer sobre os limites objetivos da coisa julgada e sobre sua eficácia preclusiva de forma crítica. Vive-se um momento de desconforto com relação ao instituto da coisa julgada material, na medida em que a estreiteza de seus limites objetivos permite o surgimento de decisões incompatíveis do ponto de vista lógico, e a eternização de determinado conflito de interesses, por meio do fracionamento da lide em diversos processos. O ordenamento jurídico brasileiro define os limites objetivos da coisa julgada com referência ao objeto da sentença e, indiretamente, ao objeto litigioso do processo. Essa opção denota que o sistema, em última análise, atribui às partes o poder de definir os contornos da coisa julgada, a despeito do forte interesse público que norteia o instituto. Com base nessas razões, alguns países europeus, cujos sistemas processuais foram construídos sob a tradição romano-germânica, têm, recentemente, procurado revisitar e redimensionar os limites objetivos da coisa julgada. Assim, este trabalho se debruça sobre possíveis alterações do sistema brasileiro, tanto para que a coisa julgada estenda-se aos fundamentos necessários da decisão, bem como para que a eficácia preclusiva da coisa julgada seja ampliada para abranger as causas de pedir que poderiam ter sido deduzidas na petição inicial e, no entanto, foram omitidas pelo autor. Tais mudanças são analisadas em prestígio à segurança jurídica e à economia processual, mas sem olvidar das discussões pretéritas, travadas desde o século XIX a respeito do tema. Algumas propostas de mudança dos limites objetivos e da eficácia preclusiva da coisa julgada, apesar de visarem a aumentar a segurança jurídica, paradoxalmente, podem ter efeito oposto, gerando ainda mais insegurança. Considera-se também a possibilidade de eventual mudança incrementar demasiadamente a complexidade dos litígios em que se discuta a existência de coisa julgada em seu sentido positivo e negativo. Esses inconvenientes de ordem teórica e prática são considerados nesta dissertação, bem como os impactos de eventual mudança sobre institutos correlatos à coisa julgada, especialmente o objeto do processo. / The purpose of this paper is to critically discuss the objective limits of res judicata and its preclusive efficacy. We are living a time of discomfort in relation to the legal procedure of res judicata, to the extent that the narrowness of its objective limits enables the appearance of judgments that are incompatible from the logical viewpoint and the perpetuation of a certain conflict of interests, by means of the fractioning of the case in several proceedings. The Brazilian legal system defines the objective limits of the matter adjudged in relation to the judgment purpose and, indirectly to the litigation purpose of the proceeding. This option means that the system ultimately attributes to the parties the power to define the outlines of res judicata, despite the strong public interest that guides the legal procedure. Based on those reasons, some European countries the procedural system of which was built under the Roman-Germanic tradition have recently sought to revisit and reshape the objective limits of the matter adjudged. Accordingly, this work looks at some possible changes to the Brazilian system so that the matter adjudged is extended to the necessary grounds of the judgment, as well as to enable the preclusive efficacy of the matter adjudged to be expanded in order to reach the causes of action that could have been stated in the complaint but were omitted by the plaintiff. Such changes are analyzed with consideration for the legal certainty and procedural enhancement but without forgetting the past discussions conducted in the 19th century about the matter. Some proposals for change of the objective limits and of the preclusive efficacy of res judicata, although aiming at increasing legal certainty, paradoxically may have the opposed effect, generating even more uncertainty. It is also considered that an occasional change may excessively increase the complexity of those litigations where the existence of the res judicata is discussed in its positive and negative meanings. Those theoretical and practice inconveniences are taken into account in this paper, as well as the impacts of any change to the legal procedures related to the res judicata, especially the purpose of the proceeding.

L’étude fait un bilan de l’étendue de la protection de l’objet du brevet et de la sécurité juridique. Elle s’appuie sur la législation et les décisions brésiliennes et européennes. L’étude aborde dans un premier temps la détermination de l’objet du brevet lors de sa rédaction: la description est analysée du point de vue de la forme, puis de celui du fond. Ensuite, la revendication est analysée du point de vue de ses structures et de ses conditions de fond.La notion de moyen est définie. Le rôle de la description et de la revendication dans la détermination de l’objet du brevet étant défini, la deuxième partie de l’étude est consacré aux règles d’interprétation. L’analyse constitutionnelle brésilienne est faite en prenant en compte les cadres données par le protocole interprétatif de l’article 69 de la Convention Européen de Brevets. Ensuite, nous proposons des paramètres internes et externes pour guider l’interprétation des revendications et déterminer l’objet du brevet. La démarche vise à assurer au titulaire du brevet le plein droit et aux tiers la sécurité juridique. / The thesis makes a balance between the protection scope of the patent and legal certainty. It is based on the legislation and decisions raised in Brazil andEurope. In this course, it first attacks the determination of the patent object during its drafting: firstly the description is subject of a formal and substantive analysis. Then the claims are analyzed in terms of its structures, as well as of its substantive conditions. The “means” notion is defined. The role of the description and the claims in determining the patent object being defined, the second part of the study is devoted to the rules of the interpretation. A Brazilian constitutional analysis is made taking into account the limits established by the Protocol on the Interpretation of Article 69 of the European Patent Convention. Then, we offer internal and external parameters to guide the interpretation of the claims, and determine the scope ofthe patent. The approach aims to ensure to the patentee the good right, as well as legal certainty to third parties.

This thesis questions the relation between political program and architectural production via a close examination of the modern myth: democratization through design. This idea is rooted in the 19th century arts and crafts movement, which indirectly caused the foundation of a very influential design school, the Bauhaus, where the idea of democratization of design has been invented. Years later, the slogan reappeared and became more visible than ever. This time it was IKEA, a furniture company that also promotes the idea of &lsquo / democratization through design&rsquo / with references to Bauhaus announcing the democratic design utopia is back. The survey of the study is based on four main principles that are developed at Bauhaus and later reinvented by IKEA. These principles, namely, mass production, standardization, modularization, and claim of universality characterize the modernist project of instrumentalizing mass production for social benefits.
