Tal análise vem mostrando que tanto o advogado, profissional que normalmente redige e assina a PI, quanto o autor da ação, pessoa que é representada pelo advogado, adotam, nas Petições Iniciais, estratégias discursivas que refletem suas identidades, a fim de alcançarem êxito em seu projeto discursivo: fazer com que o juiz seja favorável aos seus pedidos. Diante disso, tendo como escopo a teoria Semiolinguística de Análise do Discurso, os pressupostos dos estudos de gênero discursivo e textual, focalizando em particular a construção do ethos e as identidades dos sujeitos comunicantes desse ato linguageiro, propomos pensar a construção da PI a partir do seu caráter linguístico, o que poderá ser útil tanto para os profissionais da área jurídica, já que, ao compreenderem melhor o gênero em estudo, terão a possibilidade de aperfeiçoar as estratégias discursivas utilizadas; quanto para qualquer pessoa interessada no assunto, visto que as PIs, normalmente, ficam restritas ao meio jurídico / This study is based on the analysis of four Claim Applications (CA), a discourse genre of the legal domain that inaugurates a procedural action. This analysis shows that both the attorney, who normally writes and signs the Claim Applications, and the plaintiff, who is represented by the lawyer, adopts, in the claim, discursive strategies that reflect their identities in order to achieve success in the discursive project: to make the judge favor his/her requests. Therefore, having as a scope the Semiolinguistic Discourse Analysis Theory, the presuppositions of discursive and textual genres studies, focusing in particular on the construction of the communicative subjects’ ethos and identities of this language act, we propose to think of the construction of the CA from their linguistic perspective, which may be useful both for professionals in the legal area, once when they understand the genre under study better, they will have the possibility to improve the discursive strategies used; as well as for anyone interested in the subject, since CAs are usually restricted to the legal environment

Para além da costura: trabalho imigrante e organização coletiva na metrópole / Beyond the sewing: immigrant work and collective organization in the metropolis

Esta pesquisa tem como objetivo central apresentar e analisar diferentes aspectos da busca por melhores condições de vida por parte dos imigrantes bolivianos que se dedicam à costura na Região Metropolitana de São Paulo. Desse modo, o cerne da discussão desenvolvida ao longo dos três capítulos que compõe esta dissertação foi que, após migrarem para o Brasil, o trabalho em confecção precário e mal remunerado tem se mostrado incapaz de, isoladamente, proporcionar uma situação de vida satisfatória a grande parte desses imigrantes e, como resposta, recentemente, imigrantes bolivianos tem assumindo uma postura mais atuante e se organizaram em cooperativas e associações, firmaram parcerias e conseguiram apoio de ONGs, sindicatos e outras entidades para reivindicar direitos e garantias. Nesse sentido, nossa hipótese é que as manifestações promovidas pelos imigrantes que tomaram as ruas de São Paulo simbolizam avanço da participação social da comunidade boliviana na cidade. Essas questões foram trabalhadas a partir de uma divisão heurística tripartite formada pela imigração, o trabalho e as reivindicações em prol de direitos, garantias e melhorias nos âmbitos social, político, legal e simbólico que corresponderia à base da busca por melhores condições de vida no interior desse grupo. / This research has as main objective present and analyze the pursuit for better conditions of life by the Bolivian immigrants who work at apparel industries in the Metropolitan Region of São Paulo. Thus, the central point of the discussion developed over the three chapters that compose this dissertation was that after migrating to Brazil, the work in apparel workshop precarious and poorly paid has been alone unable to provide a satisfactory life situation for the great majority of these immigrants. Recently, in response Bolivian immigrants have taken a more active stance and organized themselves into cooperatives, associations, partnerships have been signed, and support achieved from several NGOs, trade unions and others to claim rights and guarantees. In this sense, our hypothesis is that the protests promoted by immigrants that took place into São Paulos streets symbolize an advancement of social participation of the Bolivian community in the city. We addressed these questions from a heuristic tripartite division formed by immigration, work and claims in favor of rights, safeguards and improvements in, political, legal, social and symbolic spheres that correspond to the base of the pursuit for better conditions of life within that group.

Accounts Receivable Management Strategies to Ensure Timely Payments in Rural Clinics

Healthcare business leaders in a rural clinic setting can enhance profitability by implementing strategies to ensure timely payments. The purpose of this multiple case study was to examine strategies applied by healthcare leaders in rural clinics to improve profitability. The population included 10 rural clinic managers and billing staff from 5 rural clinics in the southwestern region of the United States. The conceptual framework for this study was Wernerfelt's resource-based value theory. Implementing Yin's multiple-step data analysis process, data from semistructured interviews were transcribed, coded, and analyzed to identify strategies used by rural clinic managers and billing staff to enhance profitability. Four primary themes emerged regarding revenue cycle management that could increase profitability, including developing effective communication between medical providers and billing staff, implementing payment plan strategies, ensuring accuracy of billing claims, and consistently reviewing open receivable accounts. The implications of this study for positive social change include insights for clinic managers in the development of strategies to increase cash from accounts receivables, which may contribute to the financial stability of the clinic and improve the provision of healthcare for citizens of the southwestern region of the United States.

交通事故每日無時無刻在世界各地發生,每次之交通事故均產生一連串椱雜之處理程序,該程序常涉及多方之關係人,包括消費者、保險公司、車禍處理人員、理賠人員、汽車修理廠與汽車製造商等。交通事故所致之汽車損壞,其處理程序,其實是相當值得觀察的,包括賠案登錄、損失金額之認定、賠款之處理與賠案之稽核等,均須耗費龐大之人力。   於台灣,汽車損失金額之認定,傳統上均由汽車修理廠師傅依其主觀判斷加以衡量,因為缺乏客觀標準與不夠精確,因此常導致消費者、汽車修理廠與保險人間之糾紛。由於估價不夠精確,因此影響汽車保險之經營甚劇。歐美先進國家產險業者,為達到汽車製造商要求之水準,保障被保險人行車安全,常以共同危險團體管理人自居,力求汽車修理成本之控制,保障被保險人之權益;而為了消弭理賠糾紛、提升保險公司服務品質與商譽,更致力於保險理賠的電腦化、標準化、數位化,以期提供公正、客觀、高效率之理賠。有鑑於此德國Audatex公司早在六○年代便極力發展此種電腦估價系統,運用電腦之資料處理簡化車輛估價之理念。   台灣地區汽車保險業務十年來平均占產物保險業總業務之59%,汽車保險理賠問題嚴重且持續,一套正確、客觀、有效率之估價系統,可以真實反映損失狀況,對於公平合理之費率釐定有重大之意義。   本文乃從實務角度探討Audatex電腦估價系統在台灣產險市場運用之可行性及其效益分析,比較英國、日本等先進國家之經驗,並發現該系統之運作不但對保險公司經營汽車保險有極大之助益,對消費者權益之維護亦有相當大之幫助。於後並建議於引進Audatex電腦估價系統之前,應先成立汽車修理研究中心,使兩者之能夠相輔相成,期能為業界提供決策與方針,加強管理技術,提供消費者更完善之服務。 / Road traffic accidents occur every day and spark a sequence of complex claim settlement procedure to consumers, motor insurers, accidents managers, loss assessors, repairers, motor manufacturers and many other related parties. In each claim of motor damages, a few linked stages need to be observed, i.e. claim registration, estimating and approving the repair cost, completing the repair work, auditing and invoicing claim settlement.   In Taiwan, it is conventional that car repairers estimate motor damages by their individual discretion and opinions case by case. Given lack of objectiveness and accuracy, it often causes a lot of arguments and conflicts among consumers, motor insurers and car repairers. Under such a circumstance, it calls for a need for an end-to-end and comprehensive system to manage the above procedure.   The Audatex system, a computerized estimating and integrated claims management system, is adopted in many developed countries to assist motor insurers in claim handling and cost estimating more efficiently. It could not only reduce duplication and errors, but also improve authorization turnaround time. All estimates are calculated and validated through the system, with the rate and terms of business agreed between individual repairers and work providers. Based on the most up-to-date parts and labor information, a fully cost assessment, is automatically sent to the work provider in the approved format.   This paper is to examine the feasibility of introducing the Audatex to the motor insurance market in Taiwan. The main theme of this paper is to examine the feasibility of the Audatex in Taiwan motor insurance market. It analyzes the cost of establishing such a system and compares the experiences in certain countries, such as Japan and U.K. It observes that a computerized estimating system would be invaluable both for repairers and work providers. It is suggested that Taiwan shall firstly have a motor vehicle repair research center in place and then a computerized estimating system such as the Audatex.

Mineral Rights : Legal Systems Governing Exploration and Exploitation

The objective of this thesis is to examine the legal procedures and systems concerning granting or possessing mineral rights, and how such rights may be exercised, particularly given the diametric interests of land use, ownership and land tenure. The study, comparative in its nature, aims at highlighting the similarities and differences between the countries and states of comparison, and thereby identify interesting solutions of issues relating to the granting and exercising of mineral rights. The study examines mineral rights and different legal systems regulating mineral exploration and exploitation. The focus is on mining and mineral legislation and its application, including the exercise of mineral rights. The systems chosen are those of Sweden, Finland and the states of Ontario and Western Australia. The main result is generated by the comparison dealing with the application, granting and possession of mineral rights related to the development of a mine. Several processes are thereby identified. In addition, the content and extent of the different rights and obligations related to exploration and exploitation activities are examined, as well as land areas open or closed for the exercise of these rights. The legal processes concerning granting mineral rights are in fact complex as evidenced by this work, particularly when land-use and environmental legislation is taken into account. The perception of a good balance in legislation between diametric interests of land use, ownership and land tenure is heavily linked to the view of sustainable development. The difficulties of achieving this are confirmed by the countries and states compared. The continuous change of mineral legislation during the course of this study is an indication of the complexity of the topic. / QC20100723

Cox and Shaun Wang Major Academic Unit: Department of Risk Management and Insurance This is a multi-essay dissertation designed to explore the contingent claim pricing theory with non-tradable underlying assets, with emphasis on its applications to insurance and risk management. In the first essay, I apply the real option pricing theory and dynamic programming methods to address problems in the area of operational risk management. Particularly, I develop a two-stage model to help firms determine optimal switching triggers in the event of an influenza epidemic. In the second essay, I examine mortality securitization in an incomplete market framework. I build a jump-diffusion process into the original Lee-Carter model and explore alternative model with transitory versus permanent jump effects. I discuss pricing difficulties of the Swiss Re mortality bond (2003) and use the Wang transform to account for correlations of the mortality index over time. In the third essay, I study the valuation of the non-recourse provision in reverse mortgages. I model the various risks embedded in the HECM program and apply the conditional Esscher transform to price the non-recourse provision. I further examine the premium structure of HECM loans and investigate whether insurance premiums are adequate to cover expected claims.

Multiagent systems (MAS) are systems consisting of several autonomous entities, called agents, which interact with each other to either further their own interests (competition) or in pursuit of a joint goal (cooperation). In systems composed of multiple autonomous agents, negotiation is a key form of interaction that enables groups of agents to arrive at a mutual agreement regarding some belief, goal or plan. The aim of this thesis is to develop a multiagent system that simulates the negotiation process between parties about sharing of cost overrun in international construction projects. The developed tool can be used to understand how the risks and associated costs are shared between parties under different scenarios related with the risk allocation clauses in the contract, objectives of parties and level of knowledge about actual sources of cost overrun. MAS can be utilized by decision-makers to predict potential outcomes of a negotiation process.

Parameter estimation error: a cautionary tale in computational finance

We quantify the effects on contingent claim valuation of using an estimator for the volatility of a geometric Brownian motion (GBM) process. That is, we show what difficulties can arise when failing to account for estimation risk. Our working problem uses a direct estimator of volatility based on the sample standard deviation of increments from the underlying Brownian motion. After substituting into the GBM the direct volatility estimator for the true, but unknown, value of the parameter sigma, we derive the resulting marginal distribution of the approximated GBM. This allows us to derive post-estimation distributions and valuation formulae for an assortment of European contingent claims that are in accord with the basic properties of the underlying risk-neutral process. Next we extend our work to the contingent claim sensitivities associated with an assortment of European option portfolios that are based on the direct estimator of the volatility of the GBM process. Our approach to the option sensitivities - the Greeks - uses the likelihood function technique. This allows us to obtain computable results for the technically more-complicated formulae associated with our post-estimation process. We discuss an assortment of difficulties that can ensue when failing to account for estimation risk in valuation and hedging formulae.
