Lato sensu corresponde ao que chamamos de instituto jurídico compreendendo além do ato propriamente dito, o poder que a corte tem para reprimir este, os procedimentos necessários para sua apuração e as sanções aplicáveis. O contempt power é o poder que as cortes possuem para reprimir atos que constituem contempt of court por intermédio da aplicação de sanções. A premissa básica é que não existe judiciário sem um poder que lhe assegure autoridade e garanta o cumprimento de suas decisões. A origem deste poder se confunde com a própria origem do judiciário nos países de common law, o que acaba por torná-lo inerente a este. É certo que não se trata de um poder ilimitado, utilizado indiscriminadamente, existem procedimentos próprios para a apuração deste. No Brasil o instituto não é utilizado em sua plenitude, entretanto a vasta pesquisa jurisprudencial efetuada permitiu concluir que os Tribunais pátrios reconhecem o contempt of court tanto no sentido estrito, relacionado ao ato atentatório propriamente dito, como no amplo, como o instituto adequado para punir atos de desobediência a ordens judiciais.

By the Grace of Joyce, the Brute is Freed: Brutish Bodies, Munificent Minds, and Liberating Language Within Dubliners

My thesis examines Dubliners through the lens of Rene Descartes’s mind-body dualism to explain the relationship between contrasting themes in the text and demonstrate how they are connected. In an explication of the three words introduced by Joyce in the introductory paragraph of the first story in his collection, namely paralysis, gnomon, and simony, linking them with their more subtle but equally significant antonymic themes, which I propose are progression, epiphany, and grace, I show that Joyce was as compassionate as he was contemptuous of his countrymen. I propose that recognizing this balance helps us better understand what Joyce may have meant by making no apology for the brute-like spectacle he projects in his nicely polished looking-glass. Moreover, I argue that Dubliners serves as a fictional canvas upon which Joyce projects his dream of an Ireland that can transcend the tedium-inducing confines of its past.

Thesis advisor: James A. Russell / Theories in moral psychology propose a link between emotions and moral judgments. This dissertation presents a series of studies examining whether different discrete emotions are each linked to a different discrete moral content. Some of the studies tested a proposal called CAD: an acronym for the theory that contempt is linked to violations in the community domain (C), anger is linked to violations in the autonomy domain (A), and disgust is linked to violations in the divinity domain (D). Other studies further focused on the emotion disgust: Whether acts or issues that remind humans of their animal nature elicit disgust and whether the English concept of disgust refers to a single emotional experience pan-culturally. In most of the studies we recruited participants both from America and from India (N = 3893). The findings challenged any clean mappings between different discrete emotions and different contents of moral violations. Instead, moral violations were associated with a range of negative emotions rather than with a specific one. There was no support for the hypothesis that acts or issues that remind us of our animal nature elicit disgust, and the English concept disgust, as referring to unclean substances and moral violations, is equivalent to similar concepts in two Indian languages. / Thesis (PhD) — Boston College, 2017. / Submitted to: Boston College. Humiliated and offended people: A study about scorn and discrimination in Peru / Humillados y ofendidos : un estudio acerca del desprecio y la discriminación en el Perú

Seven hundred eighty nine Peruvian students (362 men and 427 women, in ages between 16 and 27 years) answered a 6 - items Scale of Perception of Contempt in Peru. Although there is no significative statistical differences between the total scores in men and women, item- analysis showed these difference in three items. The subjects wich saw themselves as of white race had a stronger perception of contempt in the Peruvian society than the other people. The validation and other psychometric qualities of the Scale of Perception of Contempt in Peru are commented in this communication. / Setecientos ochenta y nueve universitarios peruanos (362 varones y 427 mujeres, en edades entre 16 y 27 años) respondieron una escala de 6 ítems que evaluaba la percepción de desprecio en el Perú. Aunque no se dieran  diferencias estadísticamente significativas entre los puntajes totales de hombres y mujeres, el análisis de ítems puso en evidencia esas diferencias en tres de ellos. Los sujetos que se vieron a sí mismos como de raza blanca tuvieron una percepción más fuerte de desprecio en la sociedad peruana que otras personas. La validación y otras cualidades psicométricas de la Escala de Percepción de Desprecio  en el Perú son comentadas en esta comunicación.

Competent or Warm? Applying the Stereotype Content Model to Investigating the Relationship Between Job Performance and Workplace Aggression

This dissertation aims to advance our understanding of workplace aggression by developing and testing two models based on the stereotype content model (SCM) and adopting the social network analysis approach. Specifically, two studies of the dissertation focus on (a) unfavorable social evaluations stemming from competence stereotypes, (b) stereotype-driven negative emotions as a mechanism to explain the relationship between competence and workplace aggression, and (c) the role of informal workplace relationships in predicting workplace aggression. Study one investigates the nonlinear relationship between job performance and exposure to workplace aggression and two distinct mediating mechanisms at high and low levels of job performance. High performers provoke jealousy, and low performers provoke contempt from coworkers, both of which are positively associated with exposure to workplace psychological aggression. The study tested these relations using data from a sample of 187 teachers from educational institutions in India and found support for the curvilinear relationship between performance and workplace psychological aggression and the mediating mechanisms of jealousy and contempt for high and low performers, respectively. Study two examines the role of workplace social ties (advice and friendship ties) in predicting workplace aggression. Results from data collected at 2-time points from 248 individuals in 21 workgroups largely supported the proposition that highly competent employees become victims of covert aggression and low competence employees become victims of overt aggression. Interestingly, the findings suggest that advice-giving and friendship ties mitigate the experience of aggression by reducing coworkers’ envy. Många människor har efter avslutad psykoterapi tankar om densamma. Kanske fanns det ämnen som inte kom att benämnas, eller om de överhuvudtaget benämndes kom att göra det i begränsad utsträckning. Uppsatsen bygger dels på en empiriskt genomförd undersökning och dels på litteraturstudier. Det är en kvalitativ studie med halvstrukturerade frågor och meningskoncentrering. Fem personer har intervjuats, minst sex månader har gått sedan psykoterapin avslutades. Syftet med studien är att undersöka de processer som utifrån ett patientperspektiv ligger bakom att visst material inte aktualiserats i psykoterapin. För att göra intervjumaterialet överskådligt delades det upp i två dimensioner. Den första dimensionen beskriver de faktorer som förorsakat den förändrade upplevelsen av terapin. Den andra dimensionen beskriver de processer som hindrar att viktigt material aktualiseras. Dessa hinder handlar dels om specifika hinder som har med den psykoterapeutiska relationen att göra och dels handlar det om hinder som har att göra med olika försvarsstrategier som patienten använt sig av under sin psykoterapi. Flera av personerna uttryckte efter avslutad terapi en besvikelse över att man i psykoterapin upplevde en brist på djup och att det var ämnen som man ibland undvikit att prata om. Det framkom att problem i samband med överföringen innebar svåra motstånd mot fördjupningen av psykoterapin. En viktig slutsats i studien var att man antingen tenderade att skuldbelägga sig själv för de svårigheter som uppstod i psykoterapin alternativt att man lade över huvudansvaret för svårigheterna på terapeuten. Skam var ett återkommande ämne i flera av intervjuerna. Hur arbetsalliansen fungerade visade sig vara helt avgörande för hur psykoterapin utvecklades.
