Administrative judiciary in Hungary Abstract The purpose of this thesis is to give a comprehensive picture of the institute of administrative judiciary in Hungary mainly by using the comparative method. Its aim is therefore to show the similarities and the differences between the Czech and Hungarian administrative judiciary, while also comparing the two legislations to the European standards of the Rule of Law principle. The Rule of Law principle is then used as defined by the European Commission for Democracy through Law, better known as the Venice Commission. Chapter one dives directly into an analysis of the Rule of law principle and its importance in the context of administrative judiciary. Furthermore, this chapter will also provide a short description of the traditional models of administrative judiciary. The purpose of chapter two is to give its reader a brief introduction of the evolution of administrative judiciary in Hungary from the late 19th century to today's legislation, while also mentioning the upcoming changes and their foreseeable impacts. Chapter three then provides a full description of the organisation of Hungarian administrative courts, while also mentioning the upcoming changes brought by the judicial reform in the country. The reason for my research is to provide an analysis of German administrative jurisdiction. The thesis is composed of seven chapters, each of them dealing with different aspects of analysed matter. Chapter one is introductory and defines basic elements of the thesis, which are the public system of judiciary and administrative jurisdiction. The chapter is subdivided into three parts. Part one describes horizontal model of public judiciary organisation. Part two deals with vertical model of public judiciary organisation and part three with diagonal model, as mixture of elements of the previous two models. Chapter two examines historical background and relevant constitutional legislation. The chapter consists of two corresponding parts. Chapter three is subdivided into two parts and provides an outline of institutional organisation of administrative courts. Part one illustrates the court organisation. Part two looks closer at the personal component of - in part one - described courts. Chapter four concentrates on access to the administrative courts. Part one describes the condition of access to administrative courts. Part two analyses the legal actions in particular and part three the scale of judicial review. It argues that the legal and constitutional mechanisms to control the legality and effectiveness of such policies are unable to identify and evaluate the role that the media and use media of government actions - aimed at improving approval rates and electoral performance of governments - have the definition in the implementation of such policies, due to the low interdisciplinary permeability of the current juspublicist paradigm to the language of communication science and policies, regarding in particular the current 'culture of the spectacle' which we live and, consequently, the policies culture of the spectacle based on the perspective of the influence that the mass media and networked media have on public opinion, being an important variable considered in the actions and decisions of managers and public administrators. It starts with the criticism of the current theoretical frameworks of Public Law, Constitutional Theory and Theory of Fundamental Rights, as well as reflective and interdisciplinary analysis on the current role of media in political and social life, to explicit, as a central outcome of the investigation, the contradictions and gaps in the current legal and constitutional control instruments of public policy, in ensuring of link them to what's supposed to be the legitimizing goal of all of them: the promotion of human-fundamental rights. / Essa dissertação tem por objeto a análise das insuficiências dos meios jurídicos em controlar o processo de tomada de decisão no que se refere às políticas públicas de promoção e implementação de direitos humano-fundamentais, abordando, especificamente, os problemas trazidos pelo fenômeno da “espetacularização da política” na efetivação constitucionalmente adequada de tais políticas públicas. Defende que os mecanismos jurídico-constitucionais de controle da legalidade e efetividade de tais políticas são incapazes de identificar e avaliar o papel que a mídia e a utilização midiática das ações governamentais – voltadas à melhoria dos índices de aprovação e de desempenho eleitoral dos governantes – possuem na definição e na implementação de tais políticas, em razão da baixa permeabilidade interdisciplinar do atual paradigma juspublicista à linguagem das Ciências da Comunicação e das Ciências Políticas, no que tange, em especial, a atual ‘cultura do espetáculo’ em que vivemos e, consequentemente, a cultura política do espetáculo, baseada na perspectiva da influência que os meios de comunicação de massa e a mídia em rede possuem na opinião pública, sendo uma variável determinante a ser considerada nas ações e decisões dos gestores e administradores públicos. Parte-se da crítica aos atuais referenciais teóricos do Direito Público, da Teoria da Constituição e da Teoria dos Direitos Fundamentais, bem como da análise reflexiva e interdisciplinar no atual papel das mídias na vida político-social, para explicitar, como resultado central da investigação, as contradições e falhas nos atuais instrumentos de controle jurídico-constitucional das políticas públicas, na garantia da vinculação das mesmas àquilo de deveria ser a meta legitimante de todas elas: a promoção dos direitos humano-fundamentais.

Veřejný ochránce práv / The public advocate

Nowadays the office of the ombudsman is considered as one of the main institutions, which should not lack in any democratic country. The actual ombudsman of Czech republic Mgr. Anna Šabatová Ph.D. solves many causes, of which some are mentioned in this thesis. Public advocate is expected to be independent and available for people to advise them in case of negotiation with institutions, that are in his or her competence. By constitution of law no. 349/1999 Sb. the institution of ombudsman was anchored in Czech republic. The objective of my thesis is to explain the evolution of ombudsman from the moment of the constitution of the law, till present, to analyze the law itself and to focus on the office of the public advocate. Further, I compare the institution of ombudsman with other countries and define recommendations for adjustment of law about the public advocate in Czech republic. First of all I recommend to install specialized ombudsman for different areas, set up requirements of education of public advocate and a possibility to appeal him or her in case of long-term disease, which hinders him or her to perform.

As novas tecnologias moldaram a sociedade atual e são fatores chave no aprimoramento do controle da Administração Pública. Com base em uma linha jurídico-sociológica, a análise da evolução do próprio Estado demonstra a elevação da função do controle. Assim, o estudo considera o conceito e possibilidades de abrangência do termo dentro desse cenário, bem como suas classificações mais relevantes para os objetivos propostos. Com o panorama do sistema de controle no país são identificados os dilemas atuais que obstam o controle no nível que dele se espera. Como elo com as novas tecnologias, a obra de Manuel Castells é referencial por apresentar os impactos que conduziram à sociedade em rede. A morfologia das redes já foi identificada na prática como forma de organização social, e não há óbice para sua implementação no controle da Administração Pública, com o emprego de ferramentas tecnológicas. As deduções são aplicadas à Plataforma de Acompanhamento de Licitações Públicas (PALP), iniciativa que simboliza o potencial transformador das novas tecnologias no controle da Administração Pública. / The new technologies have shaped the current society and are key factors in order to improve the control of Public Administration. Based on a juridical-sociological study, the analysis of the evolution of the State itself demonstrates the growth of the control function. Thus, this study considers the concept and scope of the term control, as well as its most relevant classifications, considering the proposed objectives. Taking into account the situation of control system in the country, the current dilemmas that obstruct the control at the optimum level are identified. As a link with the new technologies, the work of Manuel Castells is referential for presenting the impacts that led to the network society. The morphology of the networks has already been identified as a form of social organization, and there is no obstacle to its implementation in the control of the Public Administration, with the use of technological tools. The results are applied to the Plataforma de Acompanhamento de Licitações Públicas (PALP), an initiative that symbolizes the transformative potential of new technologies in the control of Public Administration.

Institut ombudsmana v severní Evropě a jeho srovnání s institucí veřejného ochránce práv v České republice / A Comparison of the Ombudsman Institute in Northern Europe and the Public Defender of Rights in the Czech Republic

This diploma thesis creates a general model of the Ombudsman Institution in Northern Europe and draws a comparison to the Public Defender of Rights in the Czech Republic. This thesis introduces a theoretical framework of this topic including definitions for control of public administration, ombudsman, classification of ombudsmen and historical evolution of this institution in selected countries. Based on the analysis of legislation in Sweden, Finland and Denmark, the general model of the ombudsman institution in Northern Europe is created. The comparison between this general model and the Public Defender of Rights Institution brings recommendations for Czech modifications. These recommendations include anchoring ombudsman institution in the Constitution of the Czech Republic, specifying education requirements of the ombudsman in the Public Defender of Rights Act, or increasing the number of ombudsmen, thereby dividing responsibility among several people specialized in certain areas.

The aim of the thesis is to characterize the institution of the Ombudsman, his place in the distribution of powers and, above all, to analyze its relationship to the judicial power. The thesis is divided into five parts, with the first three parts focused on the theoretical description of the institution of the Ombudsman and its role in the control system of public administration. The fourth part characterizes the institution of the Ombudsman, his place in the distribution of power and its relationship to the judicial power. The fifth part is focused specifically on the relationship of the Ombudsman and the courts. The institution of the Ombudsman has the duty to protect citizens against acts of authorities, which may be in conflict with the law, against their inactivity and against the behavior that does not conform to the principles of good governance and the principles of the rule of a democratic State. Unlike an Ombudsman, the courts only protect citizens against unlawful acts. The courts have the availability to render decisions which are enforceable by the State power. The relationship between the Ombudsman and judicial power is characterized by a high degree of independence.
