Overlaps of intellectual property rights are a phenomenon that is not yet fully understood and analyzed; yet it is an increasingly important issue due to development of new hybrid technologies that defy the established structure of the system. Despite the potential adverse effects this phenomenon can have on the integrity of the system, the problem of overlaps has been neglected in judicial and scholarly analyses. This research presents the thesis that all uses of intellectual property rights should be viewed in light of their purposes. In other words, the phenomenon of overlapping intellectual property rights is not a problem per se; instead, it is the use of the rights for incompatible purposes that may be considered objectionable. The analyses use the concept of balance of rights as the measuring rod for assessment of the consequences resulting from use of the overlapping rights. Thus, the dissertation investigates how use of intellectual property rights associated with one segment of the system can affect carefully crafted balance of rights of various stakeholders in an overlapping segment and whether effectiveness of this segment to advance its purposes will be impeded by such use. The analyses are also done with the aim to formulate a uniform answer to identified and potentially objectionable uses of overlapping rights in an attempt to provide the judiciary and law practitioners with analytical framework for resolving disputes involving overlaps in the intellectual property system. An adequate response to the challenge posed by improper use of overlapping intellectual property rights can be found in a properly construed doctrine of misuse of intellectual property rights. Because overlaps in the intellectual property system are a phenomenon that probably cannot be legislated in practical terms, this dissertation advocates adoption of a judicially created doctrine of misuse based on purposive analysis of intellectual property rights.

A pesquisa não envolveu profunda análise de casos, nem foi feita pesquisa quantitativa. Por meio de levantamento bibliográfico são apresentados argumentos que demonstram a inadequação das restrições de acesso à cultura e à participação econômica promovidas pelo tradicional sistema de direitos autorais perante comportamentos e exigências sociais inerentes à cultura digital e as práticas com base na rede mundial de computadores. O objetivo da tese é propor uma reformulação dos direitos autorais sem a presença de seus aspectos patrimoniais para assim alcançarem suas funções socioeconômicas, apresentando para tal o argumento dos direitos humanos. Estes últimos são apresentados como motivo pelo qual tais direitos do autor devem ser abolidos, ao mesmo tempo que são apresentados como parâmetro de sua reconstrução. Resultados numéricos não são alcançados, considerando a natureza da pesquisa. Mas, conclusões são alcançadas no sentido de ver adequação da proposta, principalmente pela sua natureza democrática e pelas inevitáveis transformações econômicas que surgirão com próximas transformações na internet e demais tecnologias da informação, a exemplo dos impactos a serem produzidos pela internet das coisas e pela impressão em 3D. A extinção dos direitos patrimoniais de autor poderá trazer benefícios coletivos, sejam de natureza econômica, pela criatividade, sejam de natureza pessoal, pelo enriquecimento cultural. / The main thesis of this work is extingishing exclusive copyrights considering human rights in ciberculture and technological changes impacts, in order to promote economic inclusion by creativity freedom. The research does not involve deep analysis of cases or practical real situations, and also does not involve quantitative tools. By bibliographic readings arguments are made aiming to demonstrate inadequacy of the restrictions on culture access and economic participation promoted by traditional copyright system, considering some behaviors and social requirements typical of digital culture and practices based on the World Wide Web logics. The thesis purpose is abolishing copyrights patrimonialist aspects pleading for a new author law protection, without property aspects, helping it to achieve their social-economic functions, influenced by human rights arguments. These fundamental rights are presented as a parameter useful for abolishing copyrights, as it is settled down, and, at the same time, useful for reconstructing authors law protection, under the ciberculture circumstances. Numerical results are not achieved, considering research nature. But some conclusions are reached seeing purpose adequacy, mainly because its democratic arguments and also because inevitable forecoming economic changes on Internet and other information technologies, like the internet of things and the impression 3D social-economics impacts. Copyrights exclusive and patrimonialistics issues extinction can bring collective benefits, whether at economy, at creativity, or even at personal aspects, as cultural enrichment.

The digital technologies advances are growing day per day, many of them are here to give us a new perspective and help us to do many things productively and efficiently. In the last years, there is considerable debate throughout how we can implement the new technologies and how they will transform the use of intellectual property rights. In this paper, we aboard this issue from the perspective of the copyrights. Many years ago, when platforms like Spotify or Apple Music came to this world, many artists and consumers were excited. Many people that were involved in the music industry saw this as a new way to reach a global market, fight piracy, and receive many economic benefits. For the consumers, the implementation of digital platforms was a new way to discover new artists and a new way to enjoy music. In the case of consumers, many of them are still thinking the same, but what about the rightsholders? For example, there is a lot of trendy artists that it is not possible to find in Spotify due to the skepticism about how beneficial it can be this kind of technology. This work looks at how beneficial it can be to the use of blockchain technology due to make a better industry that can be profitable again for the artist.

La titularité initiale des droits patrimoniaux de l'auteur sur les oeuvres de l'esprit : étude comparative des droits positifs français et égyptien / The titularity of economic rights of author of literary and artistic works : comparative study of French and Egyptian positive rights

Le but des législateurs français et égyptien, étant , avant tout, de protéger les auteurs. La législation comporte de nombreuses dispositions spéciales et éparpillées qui dérogent au droit commun, en particulier à celui des contrats, pour mieux défendre les intérêts matériels et moraux des auteurs. Cela a nécessairement une incidence sur l’attribution initiale de la titularité des droit s patrimoniaux sur les oeuvres de l’esprit. Conséquence logique de ce but, le véritable créateur de l’oeuvre de l’esprit bénéficie ab initio de tous les droits sur son oeuvre, et ce, quelles que soient les conditions matérielles et juridiques dans lesquelles il exerce son activité créatrice. Toutefois, il convient de mettre à part de nombreuses hypothèses au sein desquelles l’attribution de la propriété des droit s patrimoniaux sur les oeuvres de l’esprit peut soulever , même sous la loi actuelle de la propriété intellectuelle en France et l’Egypte, des difficultés particulières. Il s’agit, par exemple, de l’hypothèse d’une oeuvre publiée de façon anonyme ou sous pseudonyme. Aussi, du cas des oeuvres créées en collaboration, ou en collectivité sous la direction d’une autre personne. De même, il est fréquent que l’oeuvre soit le fait d’auteurs ou d’équipes d’auteurs dans le cadre d’un contrat de travail, voire le fait d’agents de l’Etat. Même si l’auteur est un indépendant, force est de constater qu’un grand nombre d’oeuvres est créé sur commande ou conçue par une personne et réalisé par une autre personne. Il convient aussi de s’interroger sur l’incidence que peut avoir le mariage de l’auteur sous un régime de communauté quant à la titularité des droits patrimoniaux. Ces hypothèses ont-elles une véritable incidence sur l’attribution de la titularité initiale des droits patrimoniaux à l’auteur ? / The destination of French and Egyptian lawmakers, is above all, protect the authors. However, it is appropriate to share many assumptions in which the allocation of ownership rights over the works of the mind can raise, even under the current law of intellectual property in France and Egypt, difficulties. These include, for example, the hypothesis of a work published anonymously or pseudonymously. Also, the case of works created in collaboration or in the community under the direction of another person. Similarly, it is often the work is done the authors or teams of writers within the framework of an employment contract or the fact of state officials. Even if the author is an independent, it is clear that a large number of works created on commission or by a person designed and directed by another person. It should also consider the potential impact of the marriage of the author under a community as to the ownership of rights. These assumptions do they have a real impact on the allocation of initial ownership of rights to the author ?
